AN ORDINANCE AMENDING ORDINANCE NO. 53A, PASSED BY THE CITY COUNCIL
ON AUGUST 8, 1977, BY REQUIRING EITHER PUMPING OF EVERY INDIVIDUAL
PRIVY VAULT, SEPTIC TANK AND CESSPOOL OR THE OFFICIAL INSPECTION
THEREOF EVERY FOUR (4) YEARS, SETTING A FEE FOR THE PERMITS HEREIN
REQUIRED AND AMENDING SUBDIVISION 11 HEREOF.
The City Council of the City of Lino Lakes, Anoka County,
Minnesota, ordains:
I.
Ordinance No. 53A, passed by the City Council on August 8,
1977, is hereby amended as follows:
A. By adding thereto Section 8A., which shall be as follows:
Every individual privy vault, septic tank and cesspool
in the City of Lino Lakes shall be pumped, and the
contents thereof removed in accordance with the pro-
visions hereof, at least once during every four (4)
year interval, commencing with the date of the effective-
ness of this Ordinance; in lieu of such pumping during
such four year interval each such individual unit shall
be inspected by the city plumbing inspector, or other
person designated to do so by the City Council. If such
inspector or other designated person reports to the City
Clerk -Treasurer that such individual unit is functioning
properly and meets applicable City and State codes, then
pumping thereof shall not be required; however, if such
inspector or other designated person reports to the City
Clerk -Treasurer that such individual unit is not
functioning properly and in accordance with City and
State codes, then the City Clerk -Treasurer shall, in
writing, notify the owner of such fact and the owner
shall correct the nonconforming problem existing in such
individual unit within 30 days from the date of mailing
of such notice, all to the satisfaction of such inspector
or designated person to comply with City and State codes.
B. By adding thereto Subd. 12, which shall be as follows:
A fee, in the sum of $2.00, or other price as established
from time to time by the City Council by resolution,
a copy of which shall be kept on file in the office of the
City Clerk -Treasurer and open for inspection during
business hours, shall be paid for each such pumping
and a permit therefor shall be issued by the City
Clerk -Treasurer. A fee of such sum as so established
by resolution for each such inspection of non -pumped
units shall be charged.
C. By amending Subd. 11 thereof so that same shall read
as follows:
Any person, firm or corporation which shall have been
served with the recommendations stated in Subd. 9,
shall perform the necessary remedial work to correct
same within a maximum period of 30 days after service
of such recommendations.
II.
Save as herein amended, said Ordinance No. 53A shall stand
and be in full force and effect as previously so passed.
III.
This Ordinance shall be in full force and effect from and
after its passage and publication according to law.
