HomeMy WebLinkAbout1979-027A Council OrdinancesORDINANCE NO. 27A CITY OF LINO LAKES COUNTY OF ANOKA STATE OF MINNESOTA AN ORDINANCE AMENDING THE CITY ORDINANCE REGULATING THE DISCHARGE OF FIREARMS WITHIN THE CITY. The City Council of the City of Lino Lakes, Anoka County, Minnesota, ordains: SECTION I Section 1 of Ordinance No. 27, passed by the City Council on August 8, 1960, which states as follows: SECTION 1. It shall be unlawful to shoot, fire off, discharge or explode any gun, pistol, revolver or other firearm or device which ejects a projectile, upon or onto: (a) Any road, street, avenue, sidewalk or other public place in this Village. (b) Lands lying Southerly of the center line of Lilac Street which are Westerly of the center line of Lake Drive (U.S. Highway No. 8) as the same are now laid out and travelled. is hereby amended by adding the following: (c) Any City or County park or other City owned lands or waters. (d) All lands and waters, in the City of Lino Lakes, lying Westerly of Hodgson Road and North of County Road J, and any other areas which may be, from time to time, designated by the City Council, by resolu- tion, a copy of which shall be kept on file in the Clerk -Treasurer's office of the City and open to public inspection at regular office hours. (e) Any lands and waters within the City now owned by the person so shooting, firing off, discharging or exploding any gun, pistol, revolvers, or other firearm or device which ejects a projectile, unless the person doing so has on his person the written consent of the owner of such lands. SECTION II Section 2 of Ordinance No. 27, of the City of Lino Lakes, so passed by the City Council on August 8, 1960, is hereby amended to read as follows: It shall be unlawful, and a misdemeanor, to hunt for any animal or animals, bird or birds, to shoot, fire off, discharge or explode any single ball ammunition in the City, except upon ranges permitted by the City Council. The Chief of Police may issue spe- cial permits for the slaughtering of domestic animals with single shot ammunition. SECTION III Ordinance No. 27, of the City of Lino Lakes, so passed by the City Council on August 8, 1960, is hereby further amended by adding the following: Section 2A. For the purposes of this Ordinance, evidence of any of the following, or a combination thereof, is prima facie evidence that the person doing so was hunting with or shooting or discharging single ball ammunition in violation of this Ordinance: 1. The carrying of a loaded or unloaded gun, pistol, revolver, rifle or other firearm or device which ejects a projectile openly or uncased, in which single ball ammunition is generally used or discharged. 2. The carrying of single ball ammunition on the person while carrying any firearm, openly or uncased, loaded or unloaded, and which firearm is capable of discharging such ammunition so being carried. SECTION IV Save as herein amended, said Ordinance No. 27 shall stand and be of full force and effect as passed. SECTION V This Ordinance shall be of full force and effect from and after its passage and publication according to law. Passed by the City Council this 24th day of September, 1979. ATTEST: Edna L.
