BY REZONING CERTAIN REAL ESTATE TO GENERAL BUSINESS (GB) AND
LIGHT INDUSTRIAL (LI)
The City Council of the City of Lino Lakes, Anoka County,
Minnesota, does ordain:
I.
Ordinance No. 6, of the City of Lino Lakes, Anoka County,
Minnesota, passed by the then Village Council on July 18, 1955,
is hereby amended by rezoning from Agriculture (A) to General
Business (GB), pursuant to the provisions of Ordinance No. 56,
of the City of Lino Lakes, the following described real estate:
The North 468.6 feet of the West Half of the Southeast
Quarter of the Northeast Quarter of Section 24, Town-
ship 31, Range 22, Anoka County, Minnesota;
and by further rezoning from Agricultural (A) to Light Industrial
(LI),pursuant to the provisions of Ordinance No. 56, of the City
of Lino Lakes, the following described real estate:
The West Half of the Southeast Quarter of the Northeast
Quarter of Section 24, Township 31, Range 22, Anoka
County, Minnesota, except the North 468.6 feet thereof.
II.
Save as above amended, said Ordinance No. 6 shall stand as
initially passed and as previously amended.
III.
This Ordinance shall be in full force and effect from and
after its passage and publication according to law.
Passed by the City Council this loth day of December, 1979.

Mr. Kulaszewicz moved to authorize Mr. Schumacher to contact members of th
Personnel Commission informing them of the disbanding of that Commission
thanking them for their contributions to the City. Seconded by Mr. McLean.
Motion declared passed.
Mr. Schneider reported briefly on the financial report. Mr. Schneider, Mr.
Schumacer and Mrs. Anderson will go over the financial status and report
back at the next Council meeting. Also, the Council should appove a formal
budget at the same meeting.
Mayor Karth announced, that due to the Holidays, the next regular scheduled
Council meeting will be held on December 26, 1979.
The Public Hearing of Peltier Veiw Plat was called to order at 8:45 P.M. Mr.
Locher noted this was a continued hearing first published on May 14, 1979.
Mr. Locher read the notice of legal publication. Mayor Karth read the permit
approval from Rice Creek Watershed Board.
Mr. McLean asked about soils limitation and Mr. Gotwald's comments stated the
soils was moderate to sever.
Mr. Donald Marier, who owns lands to the North of this plat presented his
objections to the platting of this land - high water table, possibility of
pollution of Peltier Lake, no on -site inspection by RCWB, excessive ground
water run-off.
Mayor Karth noted that these problems were the reason why this plat was seTh
to Rice Creek Watershed Board before this hearing. Mr. McLean felt the pei_"lt
addressed the matter of soils and septic systems and not ground water run-off.
Mayor Karth felt this was handled in the statement 'this plat conformed with
the guidelines of the district'.
There was general discussion on the drainage and ponding - the size of the
lots - the planned density for: the area (Mr. Short's letter indicates this
conforms to the existing Comprehensive Land Use Plan) - the ponding area is
designed for the 100 year storm - The need for each individual lot to have
a perc test and soil borings before a permit is issued - a complete road
design and drainage plan must be submitted before final approval.
Mr. McLean moved this hearing be continued with consideration of this plat
tabled with Mr. Gotwald to look at the ground water of the area and advise
the C ouncil on what a complete study would entail to be available for Council
consideration in 30 days. Seconded by Mr. Schneider. Motion declared passed.

Locher read the notice of legal publication and noted there is notarized
mailing list. There was discussion of the status of Elmcrest (24th Avenue)
and the fact this street will not carry industrial traffic. Mr. McLean aske.
Mr. Tschida if he would participate in the upgrading of that street and Mr.
Tschida dai•d they would be interested but it would have to have more owner's
of the land involved to include the City of Hugo.
The was discussion on the requirement of a plat design being presented befc
rezoning and the inclusion of General Business lots along County Road #14.
. Gourley said the Planning and Zoning had felt that rezoning could be

without the plat design. The developer must return for a special use permit
before a building permit may be obtained in a commercial area without sewer
All Building plans and site plans must be approved before any developing cG
be done.
Mr. Tschida was asked the plans for the area and he said they are looing for
owners - they sell lots - they sometime consturct building and lease. He
also has the land across 24th Avenue in Hugo for sale and they are not asking
for any to participate in the upgrading of 24th.
The matter of a portion being rezoned to general business and a portion to
light Industrial was questioned and Mr. Tschida said it was done in order
to attract different types of businesses. There was discussion of moving
the area designated as general business from the East side of the area to
the West but Mr. Locher said the area designated as general business could
not be considered for light industrial at this hearing - it is permissable
to zone down but not up.
Mr. McLean moved to deny this rezoning. Mr. Tschida objected in that he
felt that he must wait a year before reapplying - Mr. McLean said, not if
he returned with a different layout. Mr. Zelinka suggested the entire North
portion be rezoned to General Business with a rezoning application for the
East half at a later date.
Mr. McLean's motion died for lack of a second. Mr. Zelinka moved to rezone
the North 468.6 feet of the W# of the SE' of the NE3 of Section 24 to
General Business and the Wof the SEA of the NE -I except the North 468.E
feet thereof to Light Industrial. Seconded by MR. McLean. Motion declared
passed.
Mr. Zelinka moved to deny the zoning on Block 3 of the plat. Seconded by
Mr. Schneider. Motion declared passed.
Mr. McLean moved to close the hearing at 10:15 P.M. Seconded by MR. Zelinka.

Mr. Locher reported that the matter of Mr. Donald Holzmer's home had been
completed. A11 that is necessary is the variance to the ceiling height in
the basement area. This can be done by variance.
Mr. McLean moved to grant a variance for the difference in height requirement
for the basement area, this variance to be filed with the County Recorder
to become a part of the abstract. Seconded by MR. Zelinka. Motion declared
passed.
The Forest Tagg matter is scheduled for trial Wednesday, December 12, 1979
at 10:30 A.M.
Mr. Locher reproted that he had delived the transcripts of the minutes to
the bond Attorney. There are a few minor details to be completed, but these
must wait for a delvier date.
Mr. Locher had checked the Letter of Agreement from the Metropolitan Waste
Control Commission and had found only one area that he questioned. This wa.
the area of repairs being done by the City on the MWCC equipment. The City
would be reimbursed on a 50/50 basis. There was some discussion on this.
Mr. Zelinka moved to approve this contract and to authorize the Mayor and

Rehbein indicated he had not contacted them yet. Mr. Gourley noted that Mr. Rehbein
had had this problem once before this year, and Mr. Rehbein indicated there had been
no argument on his part with that, and the problem had been resolved; however, in this
case, as far as safety factors, the adjoining house was 33 feet from the lot line and
the house in question was 8'6" in from the line, so there should be no problem. Mr.
Shearen felt the Board was more concerned with precedents --if they granted this one,
where would they stop? Mr. Heath added that the neighbor was entitled to build up to
10 ft. from the lot line, and it wasn't feasible to tell him he couldn't do so. Mr.
Rehbein asked about the situation where the neighbor is not willing to sell a foot and
a half of property, the Borad indicated that was the case with Mr. Nelson's house, and
hte 00 currently in suit, and was workinv with his title company and his lender and
oper.
Tim Rehbein had another matter for discussion concerning one of the two lots recently
d R-2, on which he proposed to build a duplex (side -by -side), one side to be
privately and the other to be used by himself, the upper level for model home
es ail the lower as an office. He intended to park vehicles outside, and the
would be used as shop space. Partof the lot, about 70 feet, was within the 300-ft.
r'cial"4one along Lake Drive. This was. just north of 77th street and just east of
Lino Auto Body; the duplex right across the street was used in a similar manner some years
ago and didn't create a problem. There was some concern as to the property reverting
to.a simple duplex after Mr. Rehbein moved out, and he indicated this was his intention.
%t,.*s felt this could be made a condition, so that somebody buying it for the same
purposes would have to go through the same process of applying for a permit. Mr. McLean
fe there. should be some screening provision for the neighborhood; however, it was felt
that'probably would not be necessary in view of the fact that the body shop was op one
side and Swan Frozen Food across the street. 'M McLean asked what specifically Mr.
Rehbein meant by the "shop" in°the garage. He indicated this was an attached garage
in which they would be storing various lumber, light, items like nails, and would be doing
light mechanic work for vehicles, no different than an individual would. There would
be four trucks parked outside, the heaviest a one -ton truck. It would not technically
be a shop, as they would have the model home upstairs. Mr. Gourley noted he might check
with the building inspector as to parking requirements, as he thought it would require
a larger driveway than normal, to accomodate people stopping by,so they wouldn't park
in the street. Mr. Rehbein was told he would need the signatures of the adjoining
property owners as well as the application.
The next item on the agenda was Golden's Rice Lake lot; however, Mr. Berget was not
present.
T next item on the agenda was a rezone for Land and Oaks, Inc., which had been on the`
genda at the last meeting, but nothing had been done. The representative present indi
ated he hadn't realized they were'on that agenda,. They were requesting a rezoning on
the property to light industrial, although they would also consider a general business
category. He asked if industrial zoning included commercial zones as well, and was told
they were different classifications. The developer indicated they were basically sellers
of land, and although they did build some buildings, and also bought from other contract-
ers to sell along with the land. He indicated they basically wanted to use the frontage
of the County Road and Main Street, and split the land up into a 16-acre piece and two
10-acre pieces so everything would have over 330-ft. frontages. Also, they had thought
about coming through the center with a road and putting lots off that. They had hired.
Midnight Drilling to perk the property and had gone over the results with Mr. Mobley.
He indicated that they were flexible at this point, and had more than one type of ten-
ant or owner in mind; they basically wanted to know what the Board's position was. Mr.
Mclean asked if they planned on splitting the property up into an industrial park, or
did they want blanket zoning in the hopes that something might happen? He indicated

that the Acton property, an industrial park, was just south of this area, and Mr. Heath
noted a lot of the area had been zoned industrial and commercial, but not this particu-
lar piece. Mr. Gourley pointed out a number of items; first, the property fit the Compre-
hensive Plan, guidelines for the area; secondly, that the P & Z would want to see a com-
plete layout as to how the developer intended to divide it before it was rezoned; and
thirdly, there was a provision in the ordinance that stipulated that construction would
have to begin within one year or the zoning would revert back to its prior use. The
developer asked if all the parcels would have to be built by then, and was told not if
if was zoned as a complete parcel, and so long as there was some substantial progress
within one year. The developer indicated a Baptist Curch was considering the property,
although this didn't qualify as a commercial or industrial use. Mr. McLean said this
would be a public use, but it was indicated they would like to see an industrial or
commercial use there, and there would be no major problem with the rezoning. The deve-
loper asked if he went to 5 and 10 acre parcels, would he have to go through a subdivi-
sion process; Mr. McLean explained the procedures used by Acton in their industrial
park. The developer indicated they had considered 4 lots with two double driveways,
and he had spoken to the County Highway Department about this; they had also considered
6 lots, but felt this was too small. He discussed some prospective tenants, and also
the sewer situation at Bald Eagle Industrial Park. He did not feel the lack of sewer
would cause a problem, and realized there was no possibility of its coming in. Mr.
Gourley indicated the Board was in favor of the rezoning, but would like to see a pack -
a .type plan: He indicated they should requst a specific zoning, and that the attorney
coud give them some guidance on whether they wanted to go with a general business or
'.light industrial use. Mr. McLean personally felt commercial would be more appropriate,
and Mr. Heath asked if it would be possible to zone partly industrial and partly corn-
mercial within one zoning; it was indicated this would be possible. The developer'
felt they could convert the request to general business and plat 4 lots of varying
s#res. Mr. Reinert expressed the opinion that at this time the Board really didn't know
what the developer wanted, and wouldn't be able to act on it until they brought in a
proposal. The developer indicated that if they stayed with the industrial zoning, the
plan would. be 3 lots (two 10-acre and one 16-acre) on the County Road, and it was his
understanding they would not need a plat along with that, and asked for a recommendation
to the Council on that proposal. Mr. Reinert felt there was nothing to work with at
this point, until the Board saw a complete plan. He indicated that industrial parks
generally set a standard lot size throughout, and set the roads up, and then if an indus-
try or business came in and needed more space,`they.combined lots, whatever was necessar
He foresaw a problem with the 10- and 16-acre lots,-4ecause they would probably be comin
in to divide that later on. For the benefit of the developer, Mr. McLean reviewed in
detail the procedure they should follow in making his submission to the Board. The
developer indicated he would like to submit his plan to the consultants before the next
meeting, and was told this should be done two weeks in advance; also, he should submit
the plan to Hugo as the property was on the county line. The city would notify all prop
erty owners within 350 feet. Mr. Shearen moved to table the matter. Mr. Heath seconded
the motion. All were in favor. Motion declared passed. It was noted the Board was in)
favor of a development of this kind.
Next on the agenda was a request by Mr. and Mrs. Blain for a variance to transfer less
than 22 acres to provide frontage for tract B. Mr. Ellison, the buyer, and owner of
tract B, was present. The land in question was 80 feet on the culdesac. Mr. Blain owned
the house on tract A. Mr. Gotwald had put together this plan, which would still main-
tain frontage for the Blains, and give Mr. Ellison enough frontage for his lot as well.
Mr. McLean indicated the.culdesac ha•d been reinstated at the last Council meeting in order
to maintain the frontage. Mr. Gourley indicated a long driveway variance would be needed
as well; however, P1r. Ellison said Mr. Gotwald had measured it, and found it was not
necessary. Mr. Heath moved to recommend that this variance application be passed, con-
tingent upon the sale. Mr. Shearen seconded the motion. All were in favor. Motion de-
clared passed.

zoning and was only to clear up transfer of title on the land. There was some dis-
cussion, and it was noted the house should have been indicated on the drawing. Mr.
Doocey moved to approve the variance for 7720 Lake Drive. Vi Schwankl seconded the
motion.. All were in favor. Motion declared passed.
The next item on the agenda was a preliminary discussion of Twilight III, El Rehbein
aed,Son, with Mr. Blackbird present. He indicated they would like to plat the area
into four one -acre pieces fronting on Lake Drive, the exception being the area deeded
to Tim Rehbein. The lots'would be 560 feet weep, and Mr. Blackbird's question was
whether the entire area could.be platted commercial with a variance on the back 160
feet, which would be landlocked. It was noted that t[ie lots had 100-ft frontages,
and in an unsewered area, the requirement was 150 feet. Mr. Doocey consulted the
ordinances on this. Mr. Blackbird asked if it was feasible with the right kind of
sketch, whether a variance would be granted on the back 160 feet. This would be a
rezone, and it was also adjacent to a residential area, which could be a problem with
homeowners. An alternative suggested by Mr. McLean was to plat two lots with 150-ft
frontages as commercial or duplex, put a road in, and have the back lots as residential.
Mr. Blackbird also had a matter involving the extension of 79th Street for a projected
lot split. The problem lay with lining up the road extension with the existing
79th Street, which angled in from the south. Mr. Gourley read Marilyn Anderson's
letter to the engineer stating the problem and asking for his comments, and also read
the engineer's letter reviewing it. Lot B did not have a full 22 acres considering
road easements; also the total net acreage did not add up to 5 acres. Mr. Blackbird
explained that 79th Street angled.about 15 degrees north, then turned right at the
line and went into Moorhouses' property, stopping there. He indicated North -Northeast
Realty would absorb the cost of the road, but had a question as to how the 33-ft
easement would be obtained from Mr. Moorhouse, and how to handle the road at the end
of the property line. Mr. McLean felt this could be handled with some type of cul-de-
sac, and Mr. Blackbird felt Mr. Moorhouse would probably give up the easement if they
paid for the road. Mr. Gourley asked how the City handled getting the easements, and
Mr. McLean indicated Mr. Blackbird would do that. Vi Schwankl brought up a similar
situation of about a year and a half ago. Mr. Gourley asked about the other road
easements, and Mr. Blackbird said they were vacated. The straightening of 79th Street
was further discussed, and it was felt the details should be handled by the City
engineer and the developer. Mr. Gourley noted that the existing road was entirely
on the south easements and this would not match up at all if 33-ft easements were
taken on both sides of the section line. Mr. Shearen moved to authorize the City
Engineer to work with North -Northeast Realty on the extension of 79th Street for the
projected lot split. Vi Schwankl seconded the motion. All were in favor. Motion
declared passed. It was noted that the developer would be absorbing the cost of the

Next on the agenda was a plat for Forest Glen, with Mr. Menkveld present. The plat
was first proposed in October of 1977, and the minutes of the April 10, 1978 public
hearing' were available. The plat had been approved at that time; however, it was
never signed, and the one-year period was up in April of 1979. Mr. Menkveld was told
that a apvlication and platting fee would be required. Mr. Menkveld had not
realized this would be necessary, and had hoped to be able to go ahead with the plat
at this meeting. Mr. Reinert moved to authorize the Clerk to forward all necessary

Mr. Gourley asked about the problem Mr. Rehbine was having on Knoll Drive regarding the
side setback of a house. Mr. Rehbine said he is going to get the surveyor and Mr. Mobley
out to the lot to see what can be done.

Mr. Gourley read the letter from Barton - Aschman regarding this property.
Elmcrest Avenue was discussed. The point being the road would not support any industrial
traffic.
Mr. Heath questioned Bloct #2 zoning. Mr. Tschida said whatever the Board prefers, either
heavy or Tight industrial. One proposed use is a green house.
Mr. Tschida said now they have a time problem and did not realize there would be a problem
with Elmcrest.
Mr. Gourley read the letter from the Anoka County Highway Department. In regard to the
paragraph regarding the additional 27' for street right-of-way the City policy is not to
require the additional dedication but to require additional set backs. Mr. McLean said
this gets away from the idea that the County will get this land free. Also the County
does not have any ordinances or legislation to back up this requirement.
Mr. McLean asked for topogs. There were none.
Mr. Gourley referred to the planners letter regarding frontage road. Mr. Tschida said
the County has no plans for one.
Mr. McLean said there remains the problem of Elmcrest Avenue, need for topogs and soil
Iborings. Mr. Tschida said the soil borings are needed for the platting but not required
for rezoning. Mr. Gourley said there is a request for rezoning not platting in the file.
Mr. McLean read the requirement for Tight industrial and what operations were allowed in
a light industrial area. It was noted that Acton is light industrial.
Mr. Gourley said this could be sent on to the Planner and Engineer for more detail study
or a recommendation. for rezoning as presented on the map tonight with the understanding
,that a Special Use Permit Is needed just•for the land use.

Mr. Heath moved to recommend that Block #1 be rezoned General Business and Block #2 and
#3 be rezoned light industrial. .Mr. Gourley asked for withdrawal of the motion until
after.further discussion. Mr. Heath agreed.
Mr. Gourley said the Palnner had addressed himself to setback requirements. Lot #1 was
only 100' wide.
, Mr. McLean said that the industrial park was rezoned only after they had shown complete
plans and prepared a package. Mr. Gourley said they had to put in some streets. Mr.
,Gourley said as stated before they can go two ways.

Mr. Heath moved to recommend to Council that Block #1 be•rezoned to General Business and
Block #2 and #3 be rezoned to light industrial with the stipulation that in Block #I
the lines be moved so that they 132' frontage lot be Lot #1 and the 100' frontage lots
be #2 and #3 with the access to County Road #14 be limited to two access and the County
requirement of an additional 27'vwi,llinot be necessary but an additional set back re-
quirement will be necessary and the Council set a public hearing. Mr. Shearen seconded
the notion, Motion carried. Mr. Gourley told Mr. Tschida that this will be on the Council
agenda November 26, 1979 about 8:30 p.m. Mr. Gourley noted that Mr. Tschida will have to
come back to the Planning and Zoning Board for a.Saecial Use Permit before any construction
can be started.

'Mr. Richard Berget did not appear tonight or last regular Planning and Zoning meeting
and the Clerk was asked to contact Mr. Berget and ask him what his intentions are in
respect to Lot #II of Goldens Rice Lake Terrace.
Plat - Royal Oaks Estates - Shoreview
Mr. Gourley read the letter submitted with this plat. The plat is located in Shoreview
adjoining Lino Lakes sourthern boundary just south of Baldwin Lake Road. The City of
•Shoreview has asked if this City has any comments or questions on the proposed development.
Mr. Gourley'said his only concern is that the County has input on the capacity of County
Road "J". The entire access is County. Road "J". It was noted that the area contains
193 acreas and 498 housing units plus two 150 unit apartments.
/"1 Mr. Gourley suggested the only action this Board could take was to forward it to the•
Council listing the Boards concern for County Road "J".
Mr. Shearen moved to pass this plat on to the Council with the recommendation that the
Council express its concern for additional traffice on County Road "J". Mrs. Schwankl
seconded the motion. Motion carried.
Mr. Gourley noted in Ordinance #56 on page 13 the section dealing with unsewered areas
in non-residential areas need a Special Use Permit. The City has not been enforcing
this part of the ordinance.
Mr. Shearen said he understood that a Special Use Permit could not be made non -transferable
and wondered if this would cause a -problem. Mr. Gourley noted the Ordinance stated the
Council could put any conditions they want on Special Use Permits.

iThe Industrial plat of Land and Oaks was considered. This is located alon
County Road 14 East of 135E and a portion borders 24th Avenue. There was
discussion on the condition of 24th and the ability to handle commercial
usage. The County's recommendation for only two driveway exits had been
received - Mr. Short, the Planner,had felt this rezoning is consistent with
the Comprehensive Land Use Plan - Mr. Gotwald was questioned on this and he
will submit his remarks in writing. Planning and Zoning had recommneded
approval of this rezone. MR. McLean moved to set a public hearing on thi
,plat for December 10, 1979, at 9:00 P.M. Seconded by MR. Kulaszewicz. otion
laced passed.
Shoreview had submitted a preliminary plat -of Royal Oaks which borders County
Road J and and asked for this City's comments' Mr. McLean moved that this
development'be delayed until Anoka County and Ra►sey County has made a com-
.plete study on the ability of the adjoining street to handle the increase in
traffice that would be generated by this planned development. It was also
suggested that the Metropolitan Council be involved in this study. Seconded
by Mr. Zelinka. Motion declared passed.
Mr. Schneider presented the prepared list of investments and the due date on
the CD's. There is to be some reinvesting of these monies. Mr. Schneider
and Mr. Schumacher will do this.
Mr. Kulaszewicz presented the bids for the new Police car. The low bid was
from Main Motiors in Anoka in the amount of $8969.47. After some discussion,
Mr. Schneider moved to approve this bid. Seconded by MR. Zelinka. Motion
declared passed.
There was no report on the Park Board..
Mr. Locher noted that MR. Babcock had done the title search on the Bloom's
addition. There was to be some change in the legal description. He will
check with MR. Anderason, the County Surveyor, on this matter.
Mr. Zelinka reminded the Council that his term on the Circle Pines Utility
Commission expires at the end of this year and this Council should make
their wishes known, to the Circle Pines Council as soon as possible as to who
they would recommend to serve on that Commission.

Mr. Zelinka asked Mr. Locher if there is any way this City can assist in
collecting cverdue bills or unpaid bills on the gas system in Lino Lakes. In
Circle Pines this is handled by the lein process but since Circle Pines has
no jurisdiction in Lino Lakes, it cannot be handled in that manner. Mr.
Locher said he did not know, but would research and get back to Mr. Zelinka
with an answer..
Mr. Gotwald reported that he had be revieweing all projects in relationship
to Letters of Credit with Mr. Schumacher. Some of the Letters of Credit should
be renewed in an amount sufficient to complete the project.
Mr. Gotwald said he had contacted NSP several times on the street lights in
the Shenandoah area. He felt the construction on Birch Street and the sewers

Re: Sketch Plan. Commercial/Industrial Subdivision (Land and Oaks Inc.)
Dear Mr. Gourley:
I have reviewed the proposed subdivison and discussed it with Ken Tschida, the
developer. The following comments summarize may brief initial review.
1. The proposed commercial and industrial land use is generally consistent with
the City's draft Land Use Plan. According to the developer, the precise
location of the three commercial lots is felxible as long as the frontage along
CSAH 14 remains about the same. Before finally tying down the commercial
lots the City may wish to review any proposed uses to the east and west of
the property in an effort to align the commercial lots with a consistent
adjacent land use.
2. The mixed commercial and industrial land uses and the odd shape of the
property dictate that special care be taken in reviewing this proposal. The
two large industrially zoned pieces (15.5 acres and 20.3 acres) will have
limited frontage relative to their size. An ultimate development plan should
be prepared for this property to illustrate how these large parcels will be used
and how access will be provided.
3. Control of driveway cuts along CSAH 14 is important in minimizing traffic
disruptions. The City's draft Thoroughfare Plan policies reinforce the need
for such control. Mr. Tschida mentioned that he has already met with the
Anoka County Highway Department to discuss the access issue. The City
should require a sign -off from Anoka County documenting their recommended
access arrangements. The City should also consider the possibility of a future
frontage road for the proposed commercial areas on both sides of Main
Street. Although it may not be practical to develop a frontage road now, the
City should consider some provision for one in the future. This could be done
by simply requiring a deeper front yard setback, deep enough for a proper
setback if a frontage road is ever built.

4. Ordinance No. 56 (Zoning Code) Section 6:23 requires a minimum 100 foot lot
width for General Business (GB) and Limited Business (LB). This requirement
has been met in the sketch plan.
5. Section 4.15 requires that where a commercial district is adjacent to a
residential district, that the minimum building setback from the lot line be 35
feet. The setback for an industrial district adjacent to a residential district
is 75 feet.
6. Section 4.23 states that non-residential land uses may be permitted in areas
without sanitary sewer only if a special use permit is issued. See Section 5.04
Special (Conditional) uses.
7. The City may want to ask the engineer for an opinion as to whether or not
Elmcrest Avenue would have to be upgraded in order to support industrial
traffic.
The above comments represent only a "quick" review of the proposal. Should the
developer continue to refine the plat a more thorough review during the
Preliminary Plat phase will be undertaken.

together with an on -site inspection and offer the following
comments:
1. The present use is Agriculture (corn field).
2. Soils are as follows:
HdB - Fine Sandy Loam, water below 6 feet
Ge - Glencoe Loam & Silt Loam - water 0 to 3 feet
NEA - Hessel - Fine Sandy Loam - water 3 to 5 feet
NO - Fine Sandy Loam - water 2 to 4 feet

General soils information from the Soil Survey of Anoka Co.
3 The existing Elmcrest Avenue is nothing more than a dirt
and gravel road and, therefore, could not withstand commerical
or industrial traffic. Any non-residential land use plan that
would outlet traffic onto Elmcrest Avenue must i-nclude a
plan to upgrade Elmcrest to a 36 foot wide, 9 ton road. This
may not be feasible because the east side belongs to Hugo and
the north_1/4 mile on the west side is not a part of this
proposal.
The City could limit the access to County Road 14 by the way of
a 60 foot right-of-way and not permit any access to Elmcrest
until such time that it is upgraded. The proposed G. B. lots
could front onto the above mentioned street.

The only soil limitations for on -site sewer systems and roads
appear to be the water table. The water table limitations can be
corrected by excavation and filling. Detailed engineering plans
shall be a part of the actual preliminary and final plat phase.
The above review is limited to items that could present future
problems for the owners.

additional 27 feet of right-of-way be dedicated for the portion fronting on

BY ORDINANCE AMENDING ORDINANCE No. 6 OF THE CITY OF LINO LAKES
BY REZONING CERTAIN REAL ESTATE TO GENERAL BUSINESS (GB) AND
LIGHT INDUSTRIAL (LI)
The City Council of the City of Lino Lakes, Anoka County,
Minnesota, does ordain:
I.
Ordinance No. 6, of the City of Lino Lakes, Anoka County,
Minnesota, passed by the then Village Council on July 18, 1955,
is hereby amended by rezoning from Agriculture (A) to General
Business (GB), pursuant to the provisions of Ordinance No. 56,
of the City of Lino Lakes, the following described real estate:
The North 468.6 feet of the West Half of the Southeast
Quarter of the Northeast Quarter of Section 24, Town-
ship 31, Range 22, Anoka County, Minnesota;
and by further rezoning from Agricultural (A) to Light Industrial
(LI),pursuant to the provisions of Ordinance No. 56, of the City
of Lino Lakes, the following described real estate:
The West Half of the Southeast Quarter of the Northeast
Quarter of Section 24, Township 31, Range 22, Anoka
County, Minnesota, except the North 468.6 feet thereof.
II.
Save as above amended, said Ordinance No. 6 shall stand as
initially passed and as previously amended.
III.
This Ordinance shall be in full force and effect from and
after its passage and publication according to law.
