HomeMy WebLinkAbout1980-056P Council OrdinancesORDINANCE NO. 56P CITY OF LINO LAKES COUNTY OF ANOKA STATE OF MINNESOTA AN ORDINANCE AMENDING ORDINANCE NO. 6 OF THE CITY OF LINO LAKES BY REZONING CERTAIN REAL ESTATE TO DUPLEX FAMILY (R-2). The City Council of the City of Lino Lakes, Anoka County, Minnesota, does ordain: I. Ordinance No. 6, of the City of Lino Lakes, Anoka County, Minnesota, passed by the then Village Council on July 18, 1955, is hereby amended by rezoning from Residential Single Family (R-1) to Duplex Family (R-2), pursuant to the provisions of Ordinance No. 56, of the City of Lino Lakes, the following described real estate: Lots 2 and 3, Block 2; Lots 2, 12 and 13, Block 3; and Lots 2 and 3, Block 4, all in Mar Don Acres, according to the map or plat thereof on file and of record in the office of the County Recorder, Anoka County, Minnesota. II. Save as above amended, said Ordinance No. 6 shall stand as initially passed and as previously amended. III. This Ordinance shall be in full force and effect from and after its passage and publication according to law. Passed by the City Council this 14th day of July, 1980. F. Mr. Jaworski moved to continue these permits for another year. Seconded by Mr. Kulaszewicz. Mein carried unanimously. Mrs. Elsenpeter moved to continue this hearing to the July 28, 1980 meeting. Seconded by Mr. Kulaszewicz. Motion carried unanimously. This hearing will be at 8:30 P.M. 14(ayor Gourley called the public hearing on the rezoning request of Marlin Tramm or the R2 zoning in MarDon Acres. I't was suggested that these lots should be dispersed throughout the plat rather t an in a row. The Council has suggested that perhaps the lots adjacent to the p wer line easement would be more suitable for this type of construction. L t 2 & 3, Block 4; Lots 12 & 13, & 2; Block 3; Lots 2 & 3, Block 2; - this is a total of seven lots. Mr. Tramm was agreeable to these lots. He was told that; Rfl is allowed on these lots, however, if he wishes to put R2 on another lot, it 11 need to be rezoned.: There was no comment from the audience. Jaworski moved to rezone the above listed lots from R1 to R2. Seconded by lulaszewicz. Motion carried unanimously. 10r. Jaworski moved to close the hearing. Seconded by Mr. Kulaszewicz. Motion carried unanimously. 9:35 P.M. The status of the publication of Ord. 56M was discussed. The Clerk explained thar,..,this had been left out of the paper due to a mixup in instructions. This wil ave to be continued until the July 28, 1980 meeting. Mr. Jaworski moved to continue this until July 28, 1980 at 9:00 P.M. Seconded by Mr. Kulaszewicz. Motion carried unanimously. A recess was called at this point in time. The meeting was continued and Mr. Suchy's special use permit application was considered. Mr. Schumacher read the application setting for the number of animals to be kept on this land. Mr. Suchy had presented a petition from neighbors agreeing to this use and a second petition had been presented objecting to the keeping of these animals. Several persons from the audience testified as to the area being well kept. Mr. Pete Nadeau listed his objections to the keeping of animals at this location. Mr. Suchy presented his reasons for the keeping of these animals, and also noted his facilities for the animals. Yrs. Elsenpeter moved to approve subject to the inspection of the adjacent wet lands and that the animals be limited to 150 fryers, 20 geese,10 ducks, 5 laying hens, 4 head of cattle , 50 to 100 rabbits, with all swine to be re - Dyed. Mr. ScThhy to be required to dispose of the waste and adequate fencing • contain the animals on his property. Seconded by Mr. Jaworski. /"N deua asked what disposal of the waste consists of - either tilling under >r hauling away. Mr. Nadeau asked that the Health Department be called in. !rs. Elsenpeter asked if the rabbits were in pens and Mr. Suchy said, Yes. Waste to be removed weekly. Mrs. Elsenpeter amended the motion to ask for a -ecommendation from the Anoka County!ealth Department. Someone suggested the CA. Mrs. Elsenpeter agreed. The general feeling of this Board was that they would prefer to hold this number of lots to 15% of the overall plat. Mr. Tr.amm presented a design of the proposed duplexes which are two floor but side by side duplexes. Mr..Bathke moved that Block 2, Lots 5 through 11 be recommneded for rezoning to R2. Mr. Prokop added that one copy of the developer's (1—___ sketch be included in this proposal for Council consideration. Seconded by Mr. Johnson. Motion delcared passed. The lot split for Mrs. McClean was considered. The representative said he had called a surveyor and it had been suggested, that in order to save money, they felt that an indication of whether this lot split would be allowed would be advisable before the actual work is done. This lot is a corner lot facing Sunrise Avenuewith the side street being Fairmont. This lot contains approximately one acre and has one house on the lot at this time. This type of split has been allowed in this area in the past. The general consensus of the Board was that this would be allowed. The representative was advised to proceed with the variances for this split. The next item to be considered was a request from Mr. & Mrs. Illg for the placement of a trailer on private property located along Pine Street. Mr. Illg owns 5 acres of land at that location. Mr. Schumacher presented the Council's request that this be submitted as a special use permit. The fee has been paid, pictures of the trailer are attached. Mr. Schumacher reminded the Board that Ordinance 6Q allows Moh%le homes in a mobile home park only. The legality of this was discussed.. It was felt that if this is allowed it would almostimpossible to disallow the next request for the same thing. Mr. Johnson felt this was creating an ongoing problem. Mrs. Illg was asking for permission to keep the mobile home on that pproperty for at least five years. Mr. Johnson felt this would open the door for many more requests of this same nature and this Board would find it hard to deny these requests. Mr. Barthke felt this Board was being asked to make a concession due to the economy and he flet this is something all persons are facing the same problem/ This City's Ordinance states that mobile homes must:be placed in a mobile home park. He felt this family was not being placed in a position any different than many other mobile home owners. Mr. Johnson felt this could lead to a city of temporary homes. Mr. Bathke moved to recommeded to the Council that this special use permit•application be denied. Seconded by Mr, Johnson. The motion declared passed. Planning and Zoning Board April 16, 1980 Page Four There was discussion on the transferring of a parcel of 'land with a 60' wide frontage leading into a parcel containing 2+ acres. Mr. Scherer brought the Board up to date as to the history of this land. The State Higway department condemned this property and used the soil for the construction of 135E. A bank has been left on the South side of the property. Mr. LeRoux is asking for a special use permit to remove this bank in order to make this land usable. Even with the removal of this soil, the land will be still at a higher elevation than 64th Street. There was general discussion on the finished grade level and how this was esbilished. Mr. Johnson asked to have Mr. Gotwald's comments on this matter in writ- ing. There was also discussion on the need for a topog map. It was generally felt that one had been prepared, but Mr. LeRoux said they would have another prepared, if necessary. The letter of credit should be in the amount of $11,887.00 for the restoration of 64th Street. It will also be neccasry to prepare plans for the finished grade as compared to the existing grade in order to compute the amount of dirt being taken from that area. Mr. LeRoux is planning on only two 2 acres at a time, thus the topog map willb prepared for each area,making sure the area being worked on is com- pleted before the next one is started. Mr. Prokop moved to table. Motion declared passed. Special Use Permit - Marvin Emly - for a general repari shop on his property on 62nd Street off Ware Road. Mr. Emly explained the lots in the area are all very large. This is for working on cars. Mr. Bathke moved to recommend this special use permit. Seconded by Mr. Johnson.' Motion declared passed. A special Use Permit for the extension of the use of the land being used for auto salvage, remodeling of existing building to include use parts sales and additional fence. The front of the building will be remodeled in order to made the build- ing on the North conform to the existing buildings. Mrs. Schwankl moved to recommend approval of this special use permit. Seconded by Mr. Johnson. To include a drawing. Motion declared passed. The application of Mar Don Acres for the rezoning of lots in that plat, / 11 through 4, Block 2, to be rezoned to duplexes. The percentage of lots this represents was discussed. Mr. Schumacher said they had not considered the percentage, just that it was generally felt the lots for duplexes should be in one portion of the plat. Mr. Heath suggested lots 6 through 11, Block 2, be considered for this rezoning. April 28, 1980 Council Meeting Page Ten The amendments were accepted and seconded. Motion carried unanmously. Mayor Gourley reminded Mr. Olson there will be a review on this permit one year from July. ;The nest item on the agenda was the application of MarDon Homes for rezoning. There was no one present to represt the company. Mrs. Elsenpeter moved to table until a representative was present. Mayor Gourleyasked to amend to table this until a Letter of Credit was revceived. Seconded by Mr. McLean. Motion carried unanimosuly. A special Use permit for the placing of a mobile home on private property had been submitted by Mrs. I11g. Mr. Schumacher reported this special use permit had been requested by the Council to be processed through the normal channels. The Ordinance governing the placement of mobile homes within this City was reviewed. This proposal was to place this mobile home on five acres abutting Pine Street, for a period of five years The Planning and Zoning Board had recommended this request be denied. Mr. McLean moved to deny this request. Seconded by Mr. Jaworski. Motion carried unanimously. Anoka County Historical Society had requested funds. Mr. McLean moved tc table this until budget hearings. Seconded by Mr. Kulaszewicz. Motion carried with Mayor Gourley voting, No. Consideration of the Hand Bill Ordinance as presented by Mrs. Elsenpeter. 1rs. Elsenpeter moved to table. Seconded by Mr. Jaworski. Motion carried nanimously. Considertion of Susan Sears to the vacancy on the Park Board. Mrs. Elsenpeter moved to approve this appointment. SEconded by Mr. Kulaszewicz. Motion carried unanimously. ons ted s d- :h Consideration of the March financial report. Mr. Schumacher explained brief%y. Mayor Gourley said he had gone through this report and found no problems. 7e Mr. Schumacher pointed out that over $40,000.00 in interest has been earned the first quarter of this year. There was discussion op the different aspectsr of this report, with Mr. Schumacher explaining the discrepancies. Under new business, the subject of a mining permit fee was discussed. Th re had been a mining permit fee schedule set up by Resolution - $100.00 plus 15C per yard; (5/29/73 - 8/28/72). The next request was from the Fire Chief in Lexington who had suggested an open house to view the fire fighting equipment. The request is for this Council to select a date for this function. This was set for May 18, 198' from 1:00 P.M. Mr. Schumacher will set this up. The Boy Scouts, Girl Scouts and Cub Scouts spent the week end cleaning up the road sides. Mayor Gourley will find who the letter should be addressed ani inform the Clerk. Dear Council Members: Mardon Homes Inc. is trying to get Mardon Acres approval for FHA and VA financing. Mr. Thomas T. Feeney from the FHA has told us we could get approval if we could deed the ponding area in Block 3 to the municipality, and they ( the municipality) would maintain it. I have talked to Mr. Gotwald about this matter and he seemed to think something could be worked out. This would be very benificial to us if this (FHA and.
