AN ORDINANCE AMENDING ORDINANCE NO. 6 OF THE CITY OF LINO LAKES BY
REZONING CERTAIN REAL ESTATE TO DUPLEX FAMILY (R-2).
The City Council of the City of City of Lino Lakes, Anoka County,
Minnesota, does ordain:
I.
Ordinance No. 6, of the City of Lino Lakes, Anoka County, Minnesota, passed
by the then Village Council on July 18, 1955, is hereby amended by re-
zoning from Residential Single Family (R-1) to Duplex Family (R-2), pursuant
to the provisions of Ordinance No. 56, of the City of Lino Lakes, the
following described real estate:
Lot 2, Block 1; and Lots 1 through 5, Block 4,
Wollans' Estates, as now platted and recorded.
II.
Save as above amended, said Ordinance No. 6 shall stand as initially
passed and as previously amended.
III.
This Ordinance shall be in full force and effect from and after its
passage and publication according to law.
Passed by the City Council this 22nd day of December, 1980.

Mayor Gourley called a recess at this point. Meeting to reconvene at 8:55 P.M.
The meeting was reconvened. Mayor Gourley noted that there are three requests
under the Planning and Zoning report - Mr. Smeed and Mr. Turene for keeping of
horses and Mr. Suchy for keeping animals - he suggested these requests be
tabled until the suggested ordinance is completed. He put this suggestion
to the persons affected and they agreed to the postponment.
Mr. McLean moved to approve the tabling of these three items Seconded by Mr.
Jaworski. Motion carried unanimously.
The Public Hearing on Wollan's Estates was called to order. Mayor Gourley asked
Mr. Schumacher to present the information on this request. Mr. Schumacher
read the notice of publication.
The application was for the rezoning from Commercial/Residential to Light Ind-
ustrail. This is for the four lots facing Lake Drive. This should have been
for a zoning of General Business.
This is for the rezoning of the entire lots 24,25,26, and 27 of Wollan's Estates
from Comm/Res to General Business. The park requirements for this land has been
taken care of for this property,
Mayor Gourley asked for comments from the audience, there was none. Mr. McLean
moved to approve this rezoning. Seconded by Mr. Kulaszewicz.
Mr. Locher said the meets and bounds description will have to be used for the
legal since this is not a filed plat. Legal descriptions that are not filed
cannot be used, so in order to rezone this , the meets and bounds description
of these lots must be used.
Mayor Gourley amended the motion to have the developer provide this description
for the Attorney. This was accepted. Motion carried unanimously.
Mr. Kulaszewicz moved to close the Public Hearing. Seconded by Mr. McLean.
Motion carried unanimously. 9:20 P.M.
On considering the Restrictive Ordinance, Mr. Locher reported t at e a had
problems in locating the exact State Statute. The Ordinance is not ready for
consideration at this meeting but is to be on the June 9, 1980 agenda.
The next item was the ponding areas in Sunset Oaks and there are some dis-
crepancies. There are some ponding areas thg7 are not included. This matter
was discussed with Mr. Stanley. Mr. Locher disagreed with the term "Ponding
area". He felt that the situation may change and there would be another use
of this land that would serve a different purpose.
Mr. McLean moved to table consideration of these ponding areas until the June
9, 1980 meeting. Seconded by Mr. Kulaszewicz. Motion carried unanimously.
The Public Hearing. for the rezoning for Rite -Way Waterproofing was called to
order at 9: 30 P.M. There was no representative present. Mr. Schumacher felt
this rezoning is necessary for the financing of their project. There was no
testimony from the audience. Mr. Schumacher read the legal notice of publicatio
Mr. Jaworski moved to continue this hearing to June 9, 1980 at 9:00 P.M.
Seconded by Mr. McLean. Motion carried unanimously.

Mr. Stanley was asked if he had contacted the property owner whose lands had
been suggested for an exchange in this matter.
Mr. Stanley said he had contacted Mr. Hendricksen and he seemed to have no
objections. Mr. Heath felt the lands designated as Light Inustrial should
remain or be replaced with the like amount.
Mr. Johnson moved to deny this request and leave at LI, Seconded by Mr. Doocy.
Motion carried with Mrs. Schwankl voting, No.
Mr. Prokop moved to recommend to the Council that the lands to the North and
West of Lilac & 4th Avenue be considered as LI. Seconded by Mr. Doocy.
Motion carried.
The special use permit for Teresa Krysinski of 7830 Lake Drive for the operation
of a used vehicle lot. Teresa Krysinski appeared before the Planning and
Zoning Board and briefly explained the operation. The Planning and Zoning
requested some drawings and information concerned with the adjoining property
owners, streets, Comprehensive Plan conformance. The Planning and Zoning had
tabled this matter until the information is available.
Mr. Robert Turenne of 1282 W. 81st Street had applied for a variance to keep
a horse on 2.53 acres. A letter signed by seven of the adjacent property
owners that says they have no objections. The Planning and Zoning Board had
recommended to the Council approval of this request.
A special use permit request from Robert Sulander of 7384 Lake Drive for
temporary storage - exterior. Five adjacent property owners had signed his
petition - needs four more. The parcel of approximately 3 acres is zoned
commercial/ residential. The Comprehensive Land Plan calls for Multi -family.
The zoning ordinance calls for this type of operation be in a LI area. The
Planning and Zoning Board had recommended approval of this special use permit,
This exterior storage included used construction materials. This permit to be
reviewed on an annual basis.
The special use permit of Mr. Henry Suchy of 6620 -20th Ave. for the keeping
of 2 hogs, 150 fryer, 30 geese, 20 ducks, 75 laying hens, 6 head of cattle,
50/100 rabbits. There is three signatures of surrounding property owners. Mr.
Locher had said that what ever had existed at the time of transfer could
continue. There is only 265 front footage and a farm requires 300. Mr.
Nadeau said he only had dogs, cats and horses at the time of the sale. If this
is under a residential zone, Ord. #56 said that you cannot keep animals in a
residential zone or if it is considered under an agricultural zone, then the
Ord. states there must be a 300' frontage. After a lenghly discussion, the
Planning and Zoning Board recommended denial of this special use permit. Mr.
Nadeau had presented a new petition and there are conflicting signatures - some
of the signatures appeared on both petitions.
,-The application of James R. Schilling to rezone of Lot 24,25, 26, & 27 in
Wollans' Estates from Crom Res to LI, this is in error - should read from
Comm. to General Business. The first 300' of these lots are currently zoned i
Commercial - this application is to rezone any portion of these lots beyond
the 300'. The Comprehensive Plan shows this as commercial and the lots sizesi
are in conformance. The Planning and Zoning Board had recommended approval of
this rezoning request.

Mr. Schumacher summarized the action that had occured at the previous Council
meeting. This layout has been redesigned to give 18+ acres to the City ror
Park purposes and also providing access to this park land. This had been
` the major contention at the last meeting.
Another concern was the access to Highway 8 in a second location - this had
been provided so that; if and when, the land is developed there is an
additional access to the Highway'to assist in the traffic flow.
It was noted this park land dedication is to include the lands being platted
as the Lino Industrial Park.
Mayor Gourley asked about the rezoning of the back portion of the lots that
face Highway #8 - he suggested this hearing be set at this meeting in order
to facilitate this hearing.
Mr. McLean moved to approve this plat, Woolan Estates, as presented and
amended, including the approval of the 18+ acres to be deeded to the City
f01`/ gifX/00x413010# to include the park requirements from the Lino Industrial
park, require a letter of Credit to be issued before building permits are
issued, lot elevations to be set by the City Engineer, and Rice Creek Water-
shed requirements he met. Seconded by Mr. Kulaszewicz. Motion carried
unanimoulsly.
Mr. Jaworski moved to set the Public Hearing for the rezoning of the Lots
along Highway #8 for May 27, 1980 at 8:30 P.M. Seconded by Mr. McLean.
Motion carried unanimously.
Mayor Gourley indicated to the Engineer what this Council is requiring in
reference to the lot elevations.
Mr. Jaworcki moved to close the hearing at 9:25 P.M. Seconded by Mr. McLean.
Motion carried unanimously.
The next agneda item was the Attorney's report and the first matter to be
discussed was tho matter of 77th street. Mr, Locher presented the deeds for
the Soutl: 28'-f feet - this is measured from the Section line.
Mr. Locher pointed out that the State Law, the Cartway easement, it is the
provisions of this lay that, if a cartway has been maintained for a period
of six years continuously or longer, then the cartway easement exists from
then on., 33 feet on either side of the traveled portion of the roadway.
Mr. Locher noted .hat the traveled portion of this roadway is basically
north of the censor line. The Engineer had prepared a map showing the
existing roadway. The traveled surface is approximately 22 to 23 feet wide.
3 to 4 feet lies South of the section line - 19 to 20 feet of the surface
is to the :forth o-- the center line.
Mayor Gourley asked Mr. Marier to present his arguments on this matter.
Mr. Marier said when the road was upgraded in 1971, Mr. Gotwald was to have
centered the traveled surface and he pointed out that the major portion of
the street was on his property to the North. He suggested this would cause
L: setback problem with the development now being done on the- South - side of
the street. Mr. Marier disputed the Certificate of Survey that was to have
been done in 1966 - he said this was not a survey, just a sketch.
