CITY OF LINO LAKES
COUNTY OF ANOKA
STATE OF MINNESOTA
AN INTERIM ORDINANCE DECLARING A MORATORIUM ON SUBDIVISION AND BUILDING IN
A PART OF THE CITY OF LINO LAKES .
WHEREAS, the City Council of the City of Lino Lakes, Anoka County, Minnesota ,
is conducting studies and has , held a scheduled hearing for the purpose of
considering amendment of its Comprehensive Plan : and
WHEREAS, the City Council hereby determines that further residential
development within an area of the City of Lino Lakes , bounded on the West
by County State Aid Highway No . 14, on the North by Interstate Highway No.
35W, and by the North line of the City of Lino Lakes , on the East by the
East line of the City of Lino Lakes , and on the South by the North lines of
Sections 13, 14 and 15 , without benefit of said amended Comprehensive Plan
is deemed to be detrimental to the lives and property of the owners thereof
and others , as said area is essentially agricultural in usage and contains
many low lying areas; and
WHEREAS, The City Council deems it necessary that a moratorium be declared
on said land for the immediate preservation of health and safety .
NOW THEREFORE, the City Council of the City of Lino Lakes , Anoka County,
Minnesota , ordains :
I.
A moratorium is hereby declared on any subdivision or building upon the
following lands within the City of Lino Lakes :
That part of Lino Lakes bounded on the West by County State Aid
Highway No. 14, on the North by Interstate Highway No 35W, and by
the North line of the City of Lino L4-rkes , on the West by the East
line of, the City of Lino Lakes , and on the South by the North lines
of -Sections 13,14, and 15 .
II,
This moratorium shall remain in effect until the Comprehensive Plan
Amendment is approved by the Metropolitan Cojncil and the passage of 90
days thereafter, or one year from the date hereof, whichever is less .
III.
No building permits shall be granted for any construction on said lands
during said moratorium, except upon prior hearing thereon and the granting
of a written variance by the City Council . This interim ordinance shall
not affect building permits issued prior to the date hereof.
IV.
This Ordinance shall be effective from and after its passage and publication
according to law.
