Mr. McLean noted that in the previous study order, a condition was made that v"`.v persons petitioning would be asked to share the costs. He requested at this be added to this motion. Mr. Bohjanen asked the location of this - will this be on both sides of County IY14? The petition stops at the South line of County Road #14. Mayor Gourley said he will prepare the same Resolution as was prepared for the previous petition. Mr. Kulaszewicz seconded the amendment. The vote was on both the Motion and the amendment. Both carried unanimously. DESIGNATION OF A FINANCIAL CONSULTANT OSM is requesting a financial consultant be designation for the trunk sewer now being considered. Mayor Gourley said Juran $ Moody had been used for the last bond issue and Mr. Schumacher said the service had been excellent.= - Mayor Gourley moved that Juran F, Moody be designated as financial consultants on this project. Seconded by Mr. McLean_ Motion carried unanimously. SETTING OF A SPECIAL MEETING FOR CIP AND FIRE SERVICE REPORT Mr. McLean suggested this meeting be held on April 6, 1981 at 8:00 P.M. Council members agreed. RESIGNATION OF MR. GARY FOSTER Mr. McLean moved to accept this resingnation and the usual letter of thanks be forwarded to Mr. Foster. Seconded by Mr. Jaworski. Motion carried unanimously. INTERNSHIP This is just for Council consideration for perhaps employing an intern again this year as was done last year. He asked the Council to think about this. RECESS 'P IC HEARING - REZONE REQUEST - GLENN REHBEIN Mayor Gourley noted that the format will be the same as previously - consultants will give testimony first, the developer may make comments, comments from the audience - either pro or con and the developer may answer - it will then be turned to the Council for a decision. A letter from Mr. Arden Lind, of Palico Instruments, was read. This indicates there is no objections to LI but did object to he HI designation. Clerk read the notice of publication and noted that certified letters had been mailed to all persons within 350' of the property and all but one - Mrs. Edith Morse - had been returned as received. March' 23, 1981 Pa.ge Three - Mr. Schumacher presented the petition as it had been presented to the Planning and Zoning Board. The Planning and Zoning Board had recommended a Public Hearing be set for the consideration of the property designated as LI but had e"le no recommendations in reference to the proposed area for HI. Mr. Schumacher reported on the letter received from Mr. Short bascially noting that this is a proper use for this parcel of land. Mr. Short also suggested that the entire parcel be zoned LI until such time as Mr. Rehbein has a specific proposal for HI. This use is consistent with the Comprehensive Plan. Mr. Schumacher presented some of the LI uses that are allowed per Ordinance #56. The Engineer's letter was read noting there would be limitations on the street construction and the septic system installation due to high water table. However, it was noted this area is scheduled for sewers sometime between 1981/1990. The street specifications were noted in this letter also. There is an additional letter from Mr. Short but this deals with the re- quirements for the platting and Mr. Schumacher that is not appropriate at this hearing since this hearing deals with the rezoning of the lands. Mrs. Paul Reinhold had written a letter setting forth some points she felt should be considered before this rezoning is approved. She indicated she felt that this matter had received preliminary approval. Mayor Gourley -said there has not been any action with the exception of recommending that a"public hearing be set. There has not been any preliminary approval of any sort. The purpose of this hearing is to approve or disapprove the rezoning of the lands - then the plat will need to go through the Planning and Zoning Board aommk the Council. Mrs. Reinhold's concerns with screeing, etc. will be con- s ered at that time. Mr. Harvey Karth, representing Mr. Glenn Rehbein, stated that they are not concerned with the HI area - this can either be rezoned to LI or left as- is. Mr. Karth pointed out that at the present time, they do not plan to develop the lands North of the ditch, nor do they plan to install a street on the South of the Skelly Station. There are several other items that will be discussed in more detail when the plat is presented. Mr. Bill Bohjanen asked how big an area is being considered? Mayor Gourley noted the area and that it contains 55 acres. Tyr:. Bouvier , 7841 Lake Drive, School property to the West? Yes. Wondered what kind of problems would this plat present if a school is developed- at that location. Mayor Gourley said those kinds of concerns would be addressed at the time of platting. Mr. Karth said he had a list of concerns that had been presented by some of the property owners along Lake Drive and these concerns will be taken into consideration at the time of platting. A resident asked if there had been any consideration of what this would do to property values - wouldn't this devalue thepropertyexisting? N �r Gourley said no such study had been done but he felt with the coming of the sewer the property values would increase. This person said that from what he had heard at this meeting, he would object to this rezoning. Mayor Gourley asked if he had any specifics and March 23, 1981 Page Four - he said he didnot - the things he wanted to discuss were the items that would be concerned with the platting of the property. Y"'N. Tom Ennis, 7395 Lake Drive, lives next door to Palico and he said there 1 only 25 to 30 feet from his house to the property being considered and he -asked the Council not to rezone this land. Mayor Gourley asked Mr. Ennis if he knew he was in a commercial zone at the present time and Mr. Ennis said, Yes. Mr. Wally 0stlie, 7420 Lake Drive, concerned with the private homes being affected by the change and he wanted to know if there was something they could say to sway the Council or has this already been decided? Mayor Gourley said the purpose of the hearing is to take testimony and find facts. Mr. Ostlie felt that there is other areas of the City that could be use for Industrial purposes - the Acton property on the East side of the City. The Council noted that sewer is not available for that area and Mr. Acton's property is not for sale - he wants to develop this. Mrs. Elsenpeter said this has not been an immediate step - this matter is tied into the Comprehensive Plan. There has been over a year's work of planning into that plan in order to have a orderly development within the City to insure that this is not justa 'bedroom' community. She also point- ed out that the accessability to the freeway makes this an ideal site for i-4\ - nobody would want an Industrial Park in the middle of a residential ea. Mr. Ostlie asked if anyone had determined what the tax advantage to the City would be from this industrial property? Mr. Karth said he had called the County Assessor and asked how the Industrial tax is computed and was told they use the figure of $46.35 per thousand of assessed value - on a single family homesteaded property, they use the figure of $15.70 per thousand - these are 1980 figures. Multi -family residences are about midway between. Mrs. Reinhold, Lake Drive said her property had been devalued because of the Industrial property on the North of her by 25%. Mayor Gourley asked her to submit her documents to this effect to the City. Mr. Glenn Rehbein, the Developer, pointed out that this property is ideally located for industrial property - that his new home is across the street and did not feel that this development would devalue property. Mr. Jeff Johnson, 7421 Lake Drive, he is opposed to sewer because he has a lot of frontage and it follows that he would also be opposed to the rezoning. Mr. Ostlie felt it would be good to know what impact the reported tax increase would have on the residents of the City before a decision is made on this rezoning. . Karth said the dollar value would be approximately 3 times as much from an industrial zone as from a residential area. Mayor Gourley asked if there was any questions from the Council. Mr. Jaworski asked Mr. Karth if the area was zoned industrial, is there a time schedule _ Marcn Ls, i• I ,.Page Five for the development of the property - Mr. Karth said there is approximately a three months process of platting - the next phase would be to start of the construction - this would probably be in the early fall. This would depend pumNhow soon the preparation of the plat could be accomplished and presented the Planning and Zoning Board for their review. The area being considered is the entire area with the exception of 12,13, & 14. These are the Southern most lots that had been proposed for HI. Mrs. Elsenpeter pointed out that this Council must consider what is best for the entire City and regreted that in that process, some individuals may be hurt. Mr. Jaworski moved to approve the rezoning Zone A to Light Industrial. Seconded by Mr. McLean. Motion on roll call vote: Mr. Kulaszewicz, Aye; Mr Jaworski - Aye; Mr. McLean - Aye; Mrs. Elsenpeter - Aye; Mayor Gourley - Aye.' Motion carried unanimously. --------------------- A recess was called at this point in the meeting. The meeting reconvened and Mayor Gourley asked if there was a representative of Northwestern Bell Telephone present. Mr. Dokken was in the audience. Mr. Dokken presented the Council with contour maps of the area and informed the Council that there is no problem with the setbacks as required by the City. The building will be put at the 40' setback line. The site has been reduced in size to accomadate just the building with the minimum setbacks. Aiis would create a substandard lot that cannot be used for any other purpose. is lot will be fenced and will also be landscaped. This will be presented in detail at the time the application for construction is submitted. Mr. McLean moved to approve this variance as amended, the area to be land- scaped and fenced. Seconded by Mr. Kulaszewicz. Mayor Gourley pointed out this is a variance to Ord. #56 $ Ord. #78. Mr. Schumacher questioned the Park Land dedication. MT. McLean amended his motion, that since this is a public utility, the park land dedication be waived. The amendment was second- ed by Mr. Kulaszewicz. Motion carried unanimously. The Planning and Zoning Board actions were next on the agenda. SCHILLING - LIGHT INDUSTRIAL ZONING Mr. Schumacher pointed out the portion of this area that will be considered in this rezoning. A portion of the land abutting Lilac has LI zoning at the present time. This would include the remainder of the lands. Minneapolis, Minnesota 55454 (612)332-0421 February 17, 1981 Mr. Gary Bathke, Chairman Planning and Zoning Board City of Lino Lakes 1189 Main Street Lino Lakes, MN 55014 Re: Glenn Rehbein; Request for Rezoning Dear Mr. Bathke: I have reviewed the "Sketch Plan" (dated February 3, 1981) for the proposed industrial park and have discussed it briefly with the developer's representative Harvey Karth. The following comments are intended to address only the more general aspects of the Sketch Plan as plan refinement (required in Section 5.03) should provide us with the level of detail necessary to more thoroughly review the industrial park plan. 1. Zoning Classification: The developer is proposing to rezone the entire 55 acres from Commercial and Residential to Light Industrial (21 lots) and Heavy Industrial (3 lots). As mentioned in previous reviews (December 11, 1980 and November 25, 1980), this area appears to be generally suited for Light Industrial or Commercial use. Therefore, I would recommend a rezoning to Light Industrial when the industrial park site plan meets the city's approval and other assurances are met. And further, I would recommend that the city not rezone to Heavy Industrial at this time unless the developer has specific proposals for lots 12, 13 and 14. Rezoning the property to Light Industrial will provide the city with more control over proposed uses. 2. Layout: The conceptual lot and street layout illustrated on the Sketch Plan appears to be generally workable; as it allows opportunities for small business (on 1 to Di acre lots) and/or large business (on larger lots or assemblages of smaller lots). The minimum lot size for a sewered area is 22,500 square feet and has been met. The minimum lot size for an industrial use in an unsewered area must be established in a Special Use Permit. With the exception of the following four comments, I would recommend that the developer be encouraged to refine his industrial park layout plan in pursuit of the Light Industrial rezoning. a. How will lot 5 (north of County Ditch 10) be provided access and how might it be developed. b. The industrial park access road (between Fourth Avenue and Lake Drive) has an unnecessary jog in it which could be eliminated by realigning the intersection with Fourth Avenue. c. The intersection of Fourth Avenue and the industrial Bark roadway could be redesigned as a continuous curve rather than a 90 intersection (thereby allowing an opportunity to straighten out the jog mentioned above). This would require minor changes in the Fourth Avenue right- of-way. d. Since the primary purpose of Fourth Avenue will be to serve this property and the property to the west of Fourth Avenue, it appears feasible that its alignment could be revised to better suit the shape and character of the property. The attached sketch illustrates one potential realignment of Fourth which might more efficiently serve the industrial park. The developer should be encouraged to consider alternative layouts plans to assure that the one selected best suits the project area. 3. Utilities: Is sanitary sewer service an important factor in developing this industrial park? If it is, then the developer should be prepared to discuss the issue with the Planning Commission and City Council while continuing the planning process. A central water system may also be desirable in this area. Central water could better handle wet industries and would provide better fire protection. Feasibility for sewer and water should be discussed with the City Engineer. 4. Soils: The Anoka County Soil Survey indicates that approximately 20% of the site consists of soils with very severe wetness limitations (Iw-Isanty fine sandy loam) and that approximately 30% of the site consists of soils with marginal limitations due to wetness (Ln-Lino loamy fine sand). These soils limitations will most likely influence the lot and roadway layout of the industrial park. I would suggest that the developer perform a soils inventory of the site and record the extent, location and character of the problem soils and address what measures he will utilize to overcome them. 5. Access and Traffic: The developer should review the access and roadway plans with the Anoka County Highway Engineer and MnDOT. Their comments, in writing, should be submitted with any refined plans. Also, cul-de-sacs should be avoided in industrial areas where possible due to the more difficult turning movements of heavy trucks. If cul-de-sacs must be built (such as in area just south of ditch) then the diameter should be at least 130 feet. 6. Screening: The Sketch Plan illustrates areas for berm and landscape screening and screen planting along their east property line just south of the ditch. This positive design feature should also be utilized in the following areas: a. east property line north of County Ditch 10 b. property adjacent to I-35W (required 20 foot buffer strip per Section 6. (7) (bb) of Ordinance 21) c. property adjacent Reinholt residence Also, the developer should provide "typical" details of the proposed berm and landscape buffers for city approval. 7. Retention Pond: The Sketch Plan illustrates a Proposed Retention Pond along I-35W. This important feature may be more accurately located when site topographical and soils data are provided during plan refinement. A better location may be proposed in a less buildable (wet) area. 8. County Ditch 10: The proposed 50 foot wide natural green area located along County Ditch 10 is another positive design feature which may be more accurately dimensioned when the existing natural vegetation is located on the refined plan. There may be some locations where the natural green protection area should be wider than 50 feet. 9. Site and Building Plans: As previously mentioned, Section 5.03 requires, that prior to rezoning in any other category than Agriculture (A), Single -Family (R-1) and Duplex Residences (R-2), certified site plans (and building plans, as appropriate) be furnished to the city. The existing and proposed site data required in this section will be very important to the Planning Commission in completing your review of this proposal. In summary, the proposed Light Industrial rezoning appears to be generally suited to the area. The proposed industrial park layout is also generally acceptable but needs considerable site inventory input and refinement. The efforts already made by the developer are significant and helpful in reviewing the proposal. I would recommend that he be encouraged to continue his efforts towards acquiring the rezoning by refining his plan and submitting it to the city for more thorough development review. The above comments summarize my second review of this proposal and I will be available for more thorough review when the city receives the refined industrial park plan. St. Germain St. St. Cloud, Minnesota 56301 251-7751 RE: Review Sketch Plan of Rehbein Industrial Area Dear Commissioners: 314 Oak Street Sauk Centre, Minnesota 56378 352-3664 Feb. 17, 1981 I have reviewed the sketch plan for the Rehbein Industrial Area and offer the following comments. This is a brief review, a more thorough review will be required at the preliminary plat stage. 1. The Anoka County Soils Survey classifies the soils in this area as Lino (LnA), Isanti (Iw), and Zimmerman (ZmB). The majority of the soil is Lino and Isanti with severe limitations for on -site sewer systems and moderate to severe limitations for road construction due to the high water table. Due to the severe limitations of the soil, on -site sewer systems will limit the type of industry that can utilize this area. 2 This area is included in Urban Service District No. 2 and scheduled for sanitary sewer between the years 198i and 1990. This would eliminate the need for on -site sewer systems. At this time, sanitary sewer is not available. 3 The water supply will come from individual wells and will limit the type of industry unless a water system is installed to meet the demands required for consumption and fire flows. At this time, City water is not available in this area. Planning & Zoning Board Page 2 Feb. 17, 1981 4. The streets in the industrial area should have a 9 ton design and have a minimum width of 36 feet. Fourth Ave. will also have to be upgraded to a 9 ton design. Anoka County should be contacted concerning the possible need to upgrade County State Aid No. 12 (Elm St.) due to the possibility of increased truck traffic. The cul-de-sacs shown in the industrial area are not recommended because they cause problems with parking, driveways, and snow removal. At the December, 1980 meeting of the Zoning Board, Mr. Karth was instructed to contact each of the five homeowners residing within the area planned for rezoning, and work out a suitable agreement for their protection. He was asked to return with a report at the February, 1981 meeting. The Board stated that they would act on the rezoning at that time. Just before the February meeting I called Mr. Schumacher because none of the residents had been contacted. He assured me that there would be no action at the February meeting. There was action on a part of the area, but the Zoning Board did not feel comfortable about the part be- ing considered for heavy industrial. When Mr. Schumacher was questioned abobt the instructions the Zoning Board had issued in December, he stated it was not in the minutes. Mr. Bathke was not at the December meeting so I have contacted him and discussed the matter with him, requesting an investigation. Subsequently, Counsil gave preliminary approval of the entire area, even though the Zoning Board had expressed a desire to study the plan more thoroughly. We are sincerely hoping the City Counsil will be very cautious in passing the rezoning without holding a tight reign on what is proposed at a later date for the protection of the homeowners, and that new busi- nesses being developed will be compatable with adjoining' property use. On listening to discussion by Counsil at the preliminary approval, it is felt that if sewer were brought in, such controlls might not be exercised. Also the 75 ft. proposed buffer zone for residences might be inadequate for some types of activity. The ordinance allows 200 ft. for light in- dustrial and 300 ft. for heavy. Since there is now letigation pending against the already exsisting heavy industry, approval without careful consideration could very well lead to further legal action. Please study the plan carefully and make some provisions to protect homeowners. Counsil can prevent later head- aches by looking to this need before passing a rezone. Sincerely, Mrs. Paul E. Mr. Locher and Mr. Schumacher were also present. Mr. McLean moved to approve the minutes of February 9, 1981 as presented. Seconded by Mr. Jaworski. Motion carried unanimously. Mr. Jaworski moved to approve the disbursements as presented. Seconded by Mr. Kulaszewicz. Motion carried unanimously. There was no one present who wanted to speak under the open mike portion of the agenda. The animal control contract was the next agenda item. Motion carried unanimously. /Glenn Rehbein - Rezonirig zlu-3 Rcet. /This request is for the rezoning of a part of the lands bounded on the North, by I35W, on the East by Highway 8, on the West by 4th Avenue, and on the South by Elm Street. Mr. Schumacher pointed out this is just a sketch plan for Lots 1 through 10 and Lots 1 thorugh 11 proposed as LI and Lots 12,13, & 14 as HI. The Planning and Zoning had a lot of quesitons on this dealing with cul-de-sacs, screening, berms, etc., this plan will be coming back and this is just a request for the rezoning. The Planning and Zoning had \recommended a Public Hearing be set for the rezoning of Lots 1 through 10 and Lots 1 through 11 to LI and did not take any action on the HI lots. The Council questioned this action and Mr. Schumacher said he was not sure what they wanted in conjunction with the lots proposed for HI. Mrs. lElsenpeter pointed out that one of the lots is currently being used as HI. It was pointed out that even thought this land could be rezoned to LI, it would still be necessary for the builder to come before the Council for a ISpecial Use Permit in that this area is not served by sewer. 1 There was discussion as to the usages that could be applied in a HI zoning 'with the Council being concerned with this aspect of the zoning request. Mr. McLean asked if this would be fenced and Mr. Dokken said the adjoining land owner would be using a portion of the property for a turn around and would probably use it for grazing cattle. Mr. Dokken said this will be a radio facility for the storage of anumber of cables that will increase the telephone capacity for this area. There was discussion of the landscaping of the area - the driveway - the possibility of conforming with the set back regulations. Mr. Dokken said that when they have a survey done, they will also have contour maps done. /'\ McLean moved to table this request until these maps are done and the Council has more information. Seconded by Mr. Kulaszewicz. Motion carried unanimously. Mr. Dokken will call the office when he has the information and will be put on the agenda. Ostrom Variance Request. This request is for permission to allow a garage to remain nearer the street than the principle building. The garage had been constructed without a permit. Mr. Ostrom said he did not know he needed a permit - he thought this was included in the permit for construction of the home. Mr. Short had reviewed this matter and had recommended that this provision in the Ordinance be revoked and that garage be allowed nearer the street than the home. The Planning and Zoning Board had recommended on a 4 to 1 vote that the Council amend the Ordinance to allow this. Mr. McLean felt that amending the Ordinance is not the answer to this - this is piecemealing the Ordinance. Mr. Jaworski questioned the owners as to why the building is where it is and Mrs. Ostrom said that when they bought the lot they were told that a street would be put in on the North line of the lot - so they built their home to face North and used Sunset - which is the West line - for an " dress. They built the garage on the West side of the house also facing firth. At the time they built, Leonard was not in. Members present; Klaus, Johnsen, Doocy, Prokop. Absent; Johnson. Mr. Bathke noted that there is a quorum present but not a 2/3's majority. The minutes of Jan. 7, 1981 special meeting were considered. Mr. Doocy moved to approve. Seconded by Mr. Prokop. Motion carried. Mr. Prokop moved to approve the minutes of January 21, 1981 as presented. Seconded by Mrs. Klaus. Motion carried. Mr. Schumacher reported on the actions of the Council actions on Jan. 26, 198I noting that a Resolution had been forwarded to the Metropolitan Council in conjunction with the submission of the Comprehensive Plan for review. Mr. Prokop asked the status of the court action in conjunction with the proposed quads and Mr. Schumacher said at the present time he has not heard of any further action at this point in time. The first item on the agenda was a request for a rezone as submitted by Mr. Glenn Rehbein. Mr. Harvey Karth represented Mr. Rehbein. Mr. Rehbein had also submitted a variance request and since there is not a 2/3's majority to vote on a rezone, Mr. Bathke suggested considering the variance first. This variance is for the splitting of the land that had been vacated as park lands in Shenandoah I. This would split that parcel of land into two lots each with more than the required square footage. Mr. Prokop moved to recommend approval of this variance for the lots splits per the survey of December 30, 1980.Seconded by Mr. Doocy. Motion carried. Mr. Johnson arrived. li considering the rezone request, the Board took some time to read the comments from Mr. Meister and Mr. Short they had just received this evening. - Mr. Bathke asked Mr. Karth what the company's reaction was to Mr. Short's letter, particularly in the area of crossing the creek. Mr, Karth said they had pulled the cul-de-sac back to the South of the Creek. Mr. Johnson questioned the use of the land of as HI at the present time - has there been a special use permit issued? Mr. Schumacher said that this use had been approve administratively- there had not been a special use permit issued. Mr. Johnson asked if this property is currently under litagation and Mr. Karth said, yes, a civil action. The points set forth in both Mr. Short's and Mr. Meister's letters of reviewed were discussed. Mr. Doocy moved to recommend approval of the rezone of the Glenn Rehbein proposal for LI, to include Lots 1 through 11, according to the sketch 1 and Zoning Board February 18, 2981 Page Two /"'N plan dated Feb, 3, 1981 and that consider Lots 12,13,E 14 at a later 1 date. Seconded by Mr. Prokop. Correction on the lot numbers would b 1 through 10, Block 1, and 1 through 11, Block 2 for the LI. Seconde by Mr. Prokop. Motion carried. The next item on the agenda was a variance request for Nor rn-� Bell Telephone for the purchase of a small parcel of land for the construction of a building for the housing of cables. Mr. Dokken repre- sented Northwestern Bell and explained this will be a building 17'x18' and will used for equipment storage only. The land is located on Birch Street, approximately 300' West of Centerville Road. There were questions on the use of the building, will there be fencing, etc. with Mr, Dokken supplying the answers. Mr. Johnson moved to recommend approval of this variance request. Seconded by Mr. Prokop. Motion carried. The next item on the agenda was a variance request by Mr Edward Ostrom. Thiss request is for the placement of a garage nearer the street than the home and is an after the fact request in that the garage has already been constructed. Mrs. Ostrom explained why the building is where it is. A letter from Mr. Short had been received this evening and the members took time to read Mr. Short's comments. Mr. Johnson moved to table this request to give the City Council time to change the language in Ord. #i56, Section 4.05 (I). Seconded by Mr. Prokop. Mr. Schumacher said the first question the Council will ask is does the Planning Commission agree with this amendment. Mr. Johnson said this is part of his motion. After some discussion of this matter, Mr. Bathke said he would prefer to leave the Ordinance as is and deal with this problem on an individual basis. The motion carried with Mr.Bathke voting, No. The next item on the agenda was a variance presented by the VFW for the transfer of a triangular parcel of land from the parcel to the North of the building. The existing fence is located on the North line of the proposed parcel the variance is being considered. There was discussion on the location of the fence, the septic system and the side lot line in conjunction with the existing home on the North parcel. Mr. Prokop moved to recommend approval of this variance with the provision that the proposed new lot line with be at least 10' from the existing home. Seconded by Mr. Doocy. Motion carried. That was my major concern about that particular item being set up special." The first item on the agenda was a special use permit application by Gary Taylor for the construction of a pole building on his property along Lake Drive North of Main STreet to be used for the purpose of old car restoration and aused car sales lot. The land is currently zoned commercial and the special use permit is for the construction of a building for commercial use in an unsewered area. Several of the residents had questions that were discussed. MRs. Schwankl asked about the absence of the signatures of the surrounding property pwners. There was discussion on the possibility of noise pollution. Mr. Reinert asked Mr. Doocy to read Mr. Short's letter on this request. Mrs. Schwankl moved to deny this request. Seconded by MR. Doocy. Mr. Johnson asked to amend the motion to 'deny because this is not consistent with the Comprehensive Plan' - Mrs, Schwankl refused the amendment. Mr. Reinert asked for a second - Mr. Prokop seconded the amendment. The amend- ment passed with Mr. Reinert casting the tie breaking vote. The original motion carried. There was a five minutes recess called at this point in time. Th iext item on the agenda was a rezoning request by Mr. Glenn and Mr. Ray Rehbein to create an Industrial Park on lands located South of I35W, West of Lake Drive, North of Elm Street and East of 4th Avenue with the exception of 'the several residential parcels existing. There was a definite concern of some sort of scredjing or a buffer zone for the existing residential lands. Mrs. Reinhold pointed out there is current litagation with some of this land and she didn't feel this rezoning request should be rail roaded through. The Board asked that Mr. Karth present a more specific and detailed plan at a subseque#tp P&Z meejfting. Mr. Johnson moved to table this rezoning request; pending a more detailed layout being presented to the Board for consideration, surrounding property owners to be notified by staff, per Mr. Reinert. Second- ed by Mr. Prokop. Motion _carried. Mr. James Livingston requested a variance for the split of a lot on the corner of Sunrise and Fairmont. It was noted this is the only areas in the City where lots of less that 1 acre and:150' frontage is allowed. Mr. Doocy moved to recommend approve of this lot split. Seconded by Mr. Prokop.
