AN ORDINANCE AMENDING ORDINANCE NO. 56 ENTITLED ZONING REGULATIONS
ADOPTED JUNE 12, 1972.
THE CITY COUNCIL OF THE CITY OF LINO LAKES HEREBY ORDAINS:
Ordinance No. 56 is hereby amended to read as follows:
SECTION 1. The purpose of this ordinance is to maintain property values
and otherwise promote the health, safety, order and convenience, and
general welfare by defining manufactured homes, by regulating the location
and the use of such manufactured homes and establishing minimum standards
for design and construction in conformance with the recently adopted
legislation by the State of Minnesota, Minnesota Laws 182, Chapter 490.
Such law takes effect on August 1, 1982 and it is necessary to pass this
ordinance as an emergency ordinance under the provisions of the Lino Lakes
City Charter in order to preserve the integrity of the existing residential
structures within the City.
SECTION 2. Section 3.02 DEFINITIONS is amended to read as follows:
Dwelling, One Family, Two Family: A detached
building designed for or occupied by, not more
than one or two families respectively and shall
include manufactured homes as defined herein.
SECTION 3. Section 3.02 DEFINITIONS is amended to add the following
definition:
Manufactured Home: A manufactured home means a structure,
transportable in one or more sections, which in the traveling
mode, is eight body feet or more in width, or forty body feet
or more in length, or, when erected on site, is 320 or more
square feet, and which is built on a permanent chassis and
designed to be used as a dwelling with or without permanent
foundation when connected to the required utilities, and includes
the plumbing, heating, air conditioning, and electrical systems
contained therein; except that the term includes any structure
which meets all the requirements and with respect to which the
manufacturer voluntarily files a certificate required by the
Secretary of the United States Department of Housing and Urban
Development and complies with the standards established under
Minnesota Statute 327 including the Manufactured Home Building
Code adopted therein.
Wherever the term mobile home.is used within this
ordinance it shall be amended and defined as
manufactured home.
SECTION 4. Section 4.11 DWELLING UNITS PROHIBITED shall be
amended to read as follows:
4.11 DWELLING UNITS PROHIBITED
No cellar, garage, tent, travel trailer,
basement with unfinished structure above, or
accessory building shall at any time be used
as a dwelling unit. Manufactured homes shall
be located in a manufactured home park approved
by the City and the State of Minnesota, and
in accordance with Section 6.11 (R-6) of this
ordinance, unless such manufactured home
meets the design criteria for the zoning
district within which it is to be located.
No manufactured home which does not comply
with the definition contained herein shall be
allowed within the City of Lino Lakes unless
same was located herein at the time of the
adoption of this ordinance.
SECTION 5. Section 6.11 MULTI -FAMILY (R-6) DISTRICT is
amended to read as follows:
6.11 MULTI -FAMILY (R-6) DISTRICT'
All manufactured homes and trailer parks or
similar units having one or more units are
designated as R-6 Multiple Units, and are
required to conform to the provisions of
Sections 5.03, 6.06 as applicable, and 6.11
of this code. Minimum land area for any R-6
manufactured home park shall have at least
three acres of land and a minimum lot width
at the main entrance street shall have no
less than 300 feet.
Wherever the term trailer is used in Section
6.11, it shall be amended to read manufactured
home.
SECTION 6. Section 6 is amended by adding the following
section:
6.2V RESIDENTIAL BUILDING STANDARDS
All permitted residential structures in R-1,
R-2, R-3, R-4, and R-5 zoning districts shall
meet the following design criteria:
(1) All structures shall have permanent
concrete or treated wood foundations
which will anchor the structure, which
comply with the Uniform Building Code as
adopted in the State of Minnesota and
which are solid for the complete circumference
of the house.
(2) No residential 'structure shall have a
width of less than 24 feet at its narrowest
point. Width measurement shall not take
into account overhangs or other projections.
Such width requirement shall be in
addition to the minimum area per dwelling
requirements established within this
ordinance.
(3) Single family dwellings other than approved
earth sheltered homes shall have at
least a 4/12 roof pitch and shall be
covered with shingles or tiles.
(4) All single family dwellings shall have
roof overhangs which extend a minimum of
one foot from all the walls of the
structure.
(5) All single family structures must be
built in conformance with Minnesota
Statute 327.31 to 327.35 or the Uniform
Building Code as adopted in the State of
Minnesota.
(6) Any metal siding upon single family
residence structures shall have horizontal
edges and overlapping sections no wider
than 12 inches. Sheet metal siding shall
not be permitted in such districts.
This ordinance shall be in full force and effect from and
after its passage and publication according to the City
Charter.
Adopted by the City Council of the City of Lino Lakes this
