ORDINANCE NO.-87
AN ORDINANCE REGULATING THE OPERATION OF MOTOR VEHICLES
WITHIN THE CITY OF LINO LAKES, MINNESOTA.
The City Council of the City of Lino Lakes, County of Anoka,
State of Minnesota, does ordain:
Section 1. Definitions.
Subdivision 1. Motor Vehicle. "Motor Vehicle" means every
device in, upon, or which any person or property is or may
be transported which is self-propelled, except devices moved
by human power or used exclusively upon stationary rails or
tracks, including, but not limited to, snowmobiles and
motorcycles.
Subdivision 2. Public Property. "Public Property" is lands
which include, without limitation, parks and school grounds,
recreational areas, 'streets, sidewalks, public easements,
golf courses, trailways, cemeteries, and other similar
areas.
Section 2.
No motor vehicles shall be driven across or upon any private
property without permission of the owner or occupant thereof,
express or implied.
Section 3.
It shall be unlawful for any person to operate any motor
vehicle upon public property other than a paved surface
designated for vehicular use or upon a path or area designated
by appropriate signs permitting such use.
Section 4.
Any person who operates any motor vehicle within the City in
such a manner as to indicate either a willful or wanton
disregard for the safety of others or property is guilty of
reckless driving.
Section 5.
Any person who operates any motor vehicle in such a manner
as to carelessly or heedlessly be in disregard of the rights
or the safety of others is guilty of careless driving.
Section 6.
No person shall at any place operate a motor vehicle while
under the influence of intoxicating liquor or narcotics or
habit-forming drugs.
Section 7.
No person shall operate a motor vehicle at a rate of speed
greater than reasonable and proper under all surrounding
circumstances.
Section 8.
No person shall operate a motor vehicle in a manner so as to
create a loud, unnecessary and unusual noise which disturbs,
annoys or interferes with the peace and quiet of other
persons.
Section 9.
The several provisions of this ordinance shall be deemed
severable, and a finding of invalidity Of any section hereof
shall not have the effect of invalidating any other section.
Section 10.
Any person violating any provision of this ordinance shall
be guilty of a misdemeanor as defined by state law.
Section 11.
This ordinance shall be effective 30 days following its
passage and publication as provided by Lino Lakes City
Charter.
