City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Occasionally, the Board may continue a hearing to another meeting before taking action. Meeting Etiquette The Planning & Zoning Board must preserve order and decorum while the meeting is in session. A resident shall not, by conversation or otherwise, delay or interrupt the proceedings or the business of the Board, nor disturb any resident or Board Member while speaking or refuse to obey the orders of the Board. CALL TO ORDER AND ROLL CALL: Chair Tralle called the Lino Lakes Planning and Zoning Board meeting to order at 6:30 P.M. on April 10, 2019. II. APPROVAL OF AGENDA Staff added a discussion item regarding Lakewood Apartments. The Agenda was approved. III. APPROVAL OF MINUTES Mr. Ruhland made a MOTION to approve to the February 13, 2019 meeting minutes. Motion was supported by Mr. Evenson. Motion carried 5-0. Chair Tralle and Ms. Peacock abstained. Mr. Root made a correction to the March 13, 2019 meeting minutes. The minutes should note that Chair Tralle declared Open Mike. Mr. Root made a MOTION to approve the March 13, 2019 meeting minutes. Motion was supported by Mr. Evenson. Motion carried 4-0. Mr. Stimpson and Mr. Laden abstained. IV. OPEN MIKE Chair Tralle declared Open Mike at 6:32 P.M. There was no one present for Open Mike. Mr. Stimpson made a MOTION to close Open Mike at 6:32 P.M. Motion was supported by Mr. Laden. Motion carried 6 - 0. DRAFT MINUTES Planning & Zoning Board April 10, 2019 Page 2 V. ACTION ITEMS A. PUBLIC HEARING: Draft 2040 Comprehensive Plan Kendra Lindahl, Landform, presented the staff report. As an addition to the staff report, staff would support a change to the Planning District 3 text to add a new bullet "As the City continues to work with MnDOT, Anoka County and Ramsey County on proposed County Road J improvements and an upgrade to a full interchange at I-35E, the city will evaluate a possible plan land use changes in the area". Mr. Ruhland asked about tapping into Shoreview regarding the Lundgren and Noren properties. Mr. Grochala explained the sanitary sewer currently serving the properties to the south was not designed to accommodate the flows. It is a considerable extension to bring water and sanitary sewer to the Lundgren and Noren properties. Mr. Root noted the implementation of the PUD and making the tradeoffs clear. Chair Tralle opened the public hearing at 6:58 P.M. Andrew Chirhart, TaTonka Real Estate Advisors at 150 South 5t' Street, Minneapolis, spoke on behalf of the Lundgren family. Mr. Chirhart has had several conversations with developers and builders and a consistent issue is the timing of the utility connection. The Lundgren family is requesting the property to be incorporated into utility staging I to allow for near term development. Mark Riverblood spoke on behalf of the Hawkins family. The Hawkins agrees as long as land use planning is included when looking at transportation planning. Jeff Joyer, 8174 Lake Drive, spoke on behalf of two properties: Vicky Lane and Lake Drive — The property is currently planned to be up to 15 units per acre; it is proposed to be 6 units per acre. Mr. Joyer is requesting 10 units per acre. The property is currently for sale and utilities are available. The City is requesting owners/developers to reroute Vicky Lane to match with Kelly Lane. Mr. Joyer explained that this would result in a loss of an acre and significant development cost. Recommending the property to be put in as high density. 8174 Lake Drive (Waldoch Farms) — Requesting to provide stage 1 sewer and water to garden center area. Mr. Joyer stated they would be willing to swap the south 10 acres of the medium density parcel on Main Street currently in stage 1. DRAFT MINUTES Planning & Zoning Board April 10, 2019 Page 3 Ron Mikolai, 764 Fox Road, agreed with Mr. Joyer's property on Vicky Lane and Lake Drive regarding 10 units per acre. Mr. Grochala explained between 732 and 744 Vicky Lane is right-of-way platted for a street between 732 and 744 Vicky Lane. There has been trouble with reaching 8 units per acre. Mr. Root acknowledged that buffering is not taken into consideration. Mr. Peacock asked what the reason is behind the request for more units per acre. Mr. Mikolai stated they have had an issue with selling the land. Mr. Grochala stated that developers are having difficulties getting 8 units per acre. Mr. Stimpson asked if the increased density will allow for other traffic calming parameters. Mr. Grochala stated it would not warrant signals. Staff explained the back access through Vicky Lane. Mr. Ruhland asked what will be gained if the density was increased. Mr. Mikolai explained the additional road and development costs. Chair Tralle asked staff why the applicant would take on the expense of Vicky Lane. Mr. Grochala explained the road construction requirements. Mr. Stimpson asked if signage is located at Vicky Lane. Mr. Grochala stated there is not signage posted. John Dahl, 1101 Holly Court, thanked the Board and city staff for the opportunity to develop their property. Mr. Ruhland made a MOTION to close the Public Hearing. Motion was supposed by Laden. Motion carried 6-0. Board addressed public comments: • Lundgren and Noren properties — Recommend no changes. Adding statement in planning district text to provide direction to future Comp Plan amendments. • Holly Court — Recommend parcels staging moving to IA, will get water main utilities moving south. • Hawkins — Several moving parts in that area that need to be decided before warranting a change • Waldoch Farms — More research needs to be completed Mr. Laden made a MOTION to approve the draft 2040 Comprehensive Plan. Motion was supported by Mr. Root. Motion carried 6-0. B. Eastside Villas PUD Final Plan/Final Plat DRAFT MINUTES Planning & Zoning Board April 10, 2019 Page 4 Katie Larsen, City Planner, presented the staff report. Mr. Evenson asked for clarification regarding the fence along 35E. Staff is recommending color treated wood. Mr. Evenson asked if both sides of the discussed solar fence are solar panels. Ms. Larsen stated the A frame would be on top of the berm with panels on both sides. Mr. Stimpson asked for clarification on the proposed noise barrier wall verses the noise barrier going up along 35W. Ms. Larsen stated a noise study was completed and a recommendation was made. Ms. Peacock asked what the timeframe is for staff conversations regarding the solar panel wall. Ms. Larsen stated a review will take place if the applicant submits an application. Chair Tralle asked why staff is recommending color treated fence because color fades. Ms. Larsen stated for aesthetic reasons. Roger Hokanson stated he would like to keep the solar panels in conversation; the State was in favor and would like to use it as a test. Ms. Peacock asked about debris coming off the highway and the solar panels. Mr. Hokanson stated the panels are warrantied. Mr. Hokanson stated the house currently on the property will come down and will be vacant by the end of April. Mr. Hokanson is in conversation with the Fire Chief regarding burning the house down. Mr. Ruhland made a MOTION to approve Eastside Villas PUD Final/Final Plat. Motion supported by Mr. Evenson. Motion carried 5-0. Mr. Laden abstained. C. Lakewood Apartments (705 Town Center Parkway) Exterior Materials Ms. Larsen presented the staff report. Mr. Laden stated he sees this part of the development having an urban feel and the horizontal siding gives a residential feel. He suggested using horizontal siding as an accent. Mr. Stimpson agrees with Mr. Laden. Mr. Stimpson suggested using some characteristics of the townhomes and brick. Mr. Ruhland asked if the City can require material to go vertical and horizontal. Mr. Root stated reducing the current architecture features would be a mistake. DRAFT MINUTES Planning & Zoning Board April 10, 2019 Page 5 Dan O'Mara, 2905 Northwest Blvd, Plymouth, is with Dominium. Mr. O'Mara explained the current issues. Mr. O'Mara stated that they feel this building is a mixed use building. The proposed plan shows a residential feel on the upper part of the building and a commercial feel on the lower part. Chair and Board Members suggested bringing back new ideas, proposing all sides to be classy, adding a sense of height, not to solely focus on entrances, and the previous 2 inch reveals made the building look sharp. Mr. Laden reminded the board and staff about a previous architectural subcommittee that existed. Mr. Stimpson and Mr. Laden are interested in being a part of the committee. VI. DISCUSSION ITEMS A. Project updates Mr. Grochala thanked the board for their time and effort on the 2040 Comprehensive Plan. Lyngblomsten preliminary design was approved by City Council. There are ongoing conversations regarding tax increment financing. Discussions regarding County Road J and Centerville Road. A bill was submitted to receive $1.5M from the State to complete the project. A house is under construction in Watermark. Chair Tralle asked the status of advisory board appointments. VII. The proposed residential development is an 8 lot single family conservation subdivision located north of Foxborough and west of Saddle Club. It contains 1 parcel totaling approximately 5.25 gross acres. Rud & Sons, Inc. dated 2-26-19 Previous Council Actions: • June 11, 2018: Council adopted Ordinance No. 06-18 approving the rezoning of property from R-1, Single Family Residential to PUD, Planned Unit Development • June 11, 2018: Council passed Resolution No. 18-72 approving PUD Development Stage Plan/Preliminary Plat • October 8, 2019: Council passed Resolution No. 18-129 approving a Grading and Trunk Utility Agreement ANALYSIS Subdivision Ordinance Conformity with the Comprehensive Plan and Zoning Code The Saddle Club Fourth PUD Final Plan/Final Plat has been reviewed for compliance with the comprehensive plan, zoning and subdivision ordinance. The proposed development is not considered premature and meets the performance standards of the subdivision and zoning ordinance. The PUD Final Plan/Final Plat is consistent with the PUD Development Stage Plan/Preliminary Plat. Phases Saddle Club Fourth Addition is being developed in one phase. Blocks and Lots The preliminary plat and final plat have 8 single family lots and 3 outlots. The outlots are for stormwater management facilities and delineated wetland areas. The outlots will be deeded to the City. As noted during the preliminary plat process, Saddle Club Fourth Addition incorporates Outlot B, Saddle Club Third Addition. This outlot was originally preliminary platted as 2 single family lots. The Fourth Addition is now utilizing 1 of the lots as a stormwater management pond. The other lot will remain for a single family house. W Lot 2, Block 2 is an irregular shaped lot but meets the required lot dimensions in regards to size, width and depth. Similar to some lots in Foxborough and Saddle Club, this lot has limited rear yard area for accessory structures. The developer has submitted an example house plan that demonstrates a house and 2 possible decks options for this lot. Streets and Alleys As approved with the preliminary plat, Fox Road road right-of-way is 50 feet wide and the paved roadway will be 32 feet wide. This is consistent with Foxborough and Saddle Club. The temporary cul de sacs at the north and south end of Fox Road will be removed and restored to standard road widths. Easements Standard drainage and utility easements at least 10 feet wide are provided along all lot lines. A 15 foot wide easement is dedicated along the east lot line of Lot 1, Block 2 to cover a storm sewer pipe. Drainage and utility easements are shown to be dedicated 10 feet above the high water level over stormwater drainage ponds and 10 feet outward from the delineated wetland boundary. Rear lot lines also have a minimum 10 foot wide easement. A Right -of -Way, Drainage and Utility Easement was recorded in March 2017 granting the City a perpetual easement over the entire property for purposes of constructing street and utilities. A vacation exhibit has been submitted with the final plat application and the easement will be vacated upon Council approval of the PUD Final Plan/Final Plat for Saddle Club Fourth Addition. Staff Comment: 1. Drainage and utility easements shall be dedicated on the final plat over all outlots. Storm Water Management and Erosion and Sediment Control Per Sheet C1.1, Grading, Drainage and ESC Plan prepared by Plowe Engineering and dated April 30, 2018, one (1) stormwater pond is located in Outlot A and one (1) stormwater pond is located in Outlot C. Per the Stormwater Drainage Report dated April 9, 2018, the water table elevation is too high to achieve the necessary 3 foot separation for infiltration so NURP ponding is proposed. Lot frontages and public street drainage is collected via catch basins and stormwater pipes that drain north on Fox Road into Pond 1 on Outlot A and then to Pond 2 on Outlot C. Rear lot run-off is routed onto pervious disconnected surfaces. The site will be mass graded and developed in one (1) phase. Utilities Public water, sanitary and storm sewer utilities will be installed within the development. Sanitary Sewer An 8" sanitary sewer pipe will connect from Foxborough to Saddle Club along Fox Road and serve the site. Watermain An 8" watermain will connect from Foxborough to Saddle Club along Fox Road and serve the site. Public Land Dedication The City will require cash in lieu of land dedication. Per the City's Park, Greenway & Trail System Plan, a neighborhood park is not programmed for this area. An existing trail system extends from Foxborough to Saddle Club and provides connection to Birch Park. No further trail construction is required. Saddle Club Fourth Addition 1! 8 lots x $3,000 $24,0001 Zoning Zoning Requirements The property was rezoned from R-1, Single Family Residential to PUD, Planned Unit Development in June 2018 with Ordinance No. 06-18 to allow for the following flexibilities: • Reduced front and rear yard setback from 30 feet to 25 feet • Reduced road right of way from 60 feet to 50 feet This is consistent with Foxborough and Saddle Club developments. Minimum lot widths are 80 feet, minimum lot depth is 135 feet and the average lot size is 14,478 sf. The regulations and performance standards of the R-1, Single Family Residential zoning district will be in effect unless otherwise stated in Council resolution or Development Agreement. The PUD Final Plan/Final Plat is compliant with these requirements. 2 Wetlands Four (4) wetlands were identified and delineated on site totaling 1.62 acres. The project area is located within the Lino Lakes Comprehensive Wetland Protection and Management Plan (CWPMP). RCWD issued a WCA Notice of Decision on April 23, 2018. Per the May 9, 2018 CAPROC and as noted during the PUD Development Stage Plan/Preliminary Plat process, the project proposes 0.50 acres of wetland fill requiring 1.23 acres of replacement. Permanent wetland impacts are proposed to be replaced through the purchase of wetland bank credits. Title Commitment The City Attorney is reviewing the title commitment and final plat and will provide comments. Stormwater Maintenance Agreement Under the City's and RCWD Programmatic Stormwater Management Facility Maintenance Agreement, the City will be responsible for maintenance of the stormwater maintenance facilities. Rice Creek Watershed District (RCWD) RCWD issued Permit #17-034 on January 2, 2019. 5 RECOMMENDATION Staff recommends approval of the Saddle Club Fourth Addition PUD Final Plan/Final Plat subject to the following conditions: 1. A Development Agreement shall be drafted by the City, executed and recorded by the developer. 2. Outlots A, B and C shall be deeded to the City of Lino Lakes. 3. The Right -of -Way, Drainage and Utility Easement covering the parcel shall be vacated upon filing of the final plat. The following items shall also be addressed: 1. All comments from City Engineer letter dated May 1, 2019 shall be addressed. 2. The applicant shall prepare the deeds for Outlot A, Outlot B and Outlot C for City review and approval. 3. Final Plat: a. Drainage and Utility Easements shall be dedicated over the outlots. 4. Sheet C3.1, Details a. The Wetland Buffer Sign detail shall be revised to include the correct detail. Permit #17-034 was for the original Saddle Club 41h Addition for surface water management. The RCWD permit is currently under review. (4-1-2019) Wetland permitting has been approved by RCWD and TEP agencies. • Drainage and Utility Easements The Saddle Club 4lh Addition development includes standard drainage and utility easements rear yard drainage easement areas. Block 2, Lot 1 has a 19' Drainage and Utility Easement for storm sewer. Construction easements are being reviewed by the City's Environmental Coordinator. Updated preliminary plan and draft final plat included with resubmittal. • Development Agreement The Saddle Club 4lh Addition will require a Development Agreement. Developer shall coordinate development agreement directly with City.
