RESOLUTION NO. 19-41
RESOLUTION APPROVING DECLARATION OF RESTRICTIVE COVENANT FOR
MAIN STREET SHOPPES 2ND ADDITION
WHEREAS, City Resolution No. 19-09 approving the Final Plat for Main Street Shoppes 2"
Addition required an amendment to the existing Declaration of Driveway Easement; and
WHEREAS, the proposed Declaration of Restrictive Covenant places a restrictive covenant on
Main Street Shoppes 2" Addition prohibiting the conveyance of the property to a third party
until either an amendment to the Driveway Easement or a separate suitable reciprocal easement
is recorded against the property, providing reciprocal access and utility rights for the respective
owner(s) of the property.
NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes
hereby approves the Declaration of Restrictive Covenant as executed by CM Properties 14, LLC.
Adopted by the Council of the City of Lino Lakes this 25th day ofMarch , 2019.
The motion for the adoption of the foregoing resolution was introduced by Council Member
Maher and was duly seconded by Council Member Stoesz and upon
vote being taken thereon, the following voted in favor thereof:
