HomeMy WebLinkAbout2019-151 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 19-151 RESOLUTION DECLARING A CITY COUNCIL VACANCY AND CALLING FOR A SPECIAL ELECTION TO BE HELD ON FEBRUARY 11, 2020 WHEREAS, Councilmember Rob Rafferty received the most votes for the Mayor position following the November 5, 2019 municipal election; and WHEREAS, effective December 31, 2019, a vacancy will occur on the City Council following Rob Rafferty's written resignation as Councilmember with two years remaining on his term; and WHEREAS, Section 4.05 of the Lino Lakes City Charter provides that there shall be a special election to elect a successor to serve the remainder of the unexpired term when a Council vacancy occurs within 365 days or more remaining in the term of the vacated office; and WHEREAS, the City Council has determined that holding the special election to fill the unexpired term of Councilmember Rafferty on February 11, 2020, in conjunction with the County Board election, is in conformity with applicable state law and is in the best interest of the citizens of Lino Lakes; and WHEREAS, once the vacancy is declared and the special election is called, the first legal requirement is posting the notice of candidate filing two weeks prior to the start of the candidate filing period in accordance with Minnesota Statute 205.13. NOW, THEREFORE, BE IT RESOLVED by the Lino Lakes City Council that the Council hereby declares a vacancy in the position of Councilmember, effective December 31, 2019, and orders a special election for the City of Lino Lakes to be held on the second Tuesday of February, that being February 11, 2020, for the purpose of electing a City Councilmember to serve the unexpired term of Rob Rafferty. Adopted by the Council of the City of Lino Lakes this 12th day of November 2019. BACKGROUND Following the results of the November 2019 municipal election, in which Councilmember Rafferty received the most votes for the office of mayor, Mr. Rafferty is expected to submit a letter of resignation as councilmember on Friday, November 8, which would be effective December 31, 2019. Minnesota Statute 351.055 provides that if a future vacancy is certain to occur, the City Council may begin procedures for a special election so that a successor may be elected at the earliest possible time. Preparations for the special election may begin immediately after the written resignation is received by the official. Staff received confirmation from the Anoka County Elections Manager that the City would meet the timelines for a special election on February 11, 2020, if the Council approves a resolution at its November 12 meeting. Following is the projected time ine for the special election: Resignation received Expected November 8 Public notice of candidate filing two weeks in advance In official paper 14 days prior to start of filing Tuesday, November 19, 2019 Candidate filing begins 70 days prior to election Tuesday, December 3, 2019 Candidate filing ends 56 days prior to election Tuesday, December 17, 2019 Withdrawal ends 2 days after close of filing Thursday, December 19, 2019 Absentee balloting begins 46 days prior to election Friday, December 27, 2019 Election Day Tuesday, February 11, 2020 RECOMMENDATION Staff recommends approval of Resolution No. 19-151, declaring a Council vacancy and calling for a special election.
