The City of Lino Lakes conducted an election for municipal offices on November 5th, 2019. The results of the election are attached. The steps to canvass the results are: • the clerk prepares a canvassing report (abstract) to accumulate results from multiple precincts; • the canvass board publicly canvasses the election returns by reviewing the abstract and write-in reports; • the board may ask to examine summary statements before it declares the results; • when satisfied that the abstract reports are correct, the board signs the abstracts and they become the official results; RECOMMENDATION That the city council act as Canvassing Board and accept the results as presented. He noted two changes from the last discussion: Verizon requested several 18 revisions and after attorney review, staff is concurring with two changes; other changes 19 were felt to be covered already. (502 and 36 510 Lilac Street) – City Planner Larsen reviewed the rezoning request. The applicant requested a land use decision extension until November 29, 2019 to allow time for the City to work with MNDNR on some issues. ANALYSIS History The subject site was originally platted in 1982 as Lot, Block 1 Reshanau Shores. The residential subdivision was not served by municipal water or sanitary sewer. In June of 2017 the City Council approved the 2017-2021 Street Reconstruction plan which included authorization to reconstruct West Shadow Lake Drive, Sandpiper, and Shadow Court. With approval of the street project City staff began working with property owners to consider extension of municipal sanitary sewer and water services as part of the project. The extension of sanitary sewer service was pursued to eliminate use of 61 existing individual sewage treatment systems, most of which are non-conforming systems. To aid in this project the City was successful in receiving a water quality grant from the Rice Creek Watershed District. In 2018, the City commenced the West Shadow Lake Drive Street and Utility Improvement Project to reconstruct the street and install municipal water main and sanitary sewer. With the extension of public utilities, larger lots may be able to subdivide. In anticipation of such subdivision requests, in 2018, the City also rezoned several parcels, including the subject parcel, from R, Rural to R-1X, Single Family Executive Residential. 3 Existing Site Conditions The residential lot contains the existing house and garage that were built in 1984, trees, grass, a shed, septic system, well, fire pit and wetland. The fire pit will be removed. The Certificate of Survey indicates Zimmerman Fine Sand and Lake Beaches soil. Groundwater was encountered at approximately 5 feet (EL 884.0). The parcel abuts Reshanau Lake and is subject to the requirements of the Shoreland Overlay Management District as detailed later in this staff report. Zoning The subject site was rezoned from R, Rural to R-1X, Single Family Executive in 2018 with Ordinance No. 19-18 in conjunction with the West Shadow Lake Drive Street and Utility Improvement Project. Of the 100 platted riparian lots, approximately 10 existing lots on the west side of Reshanau Lake along West Shadow Lake Drive may have the potential to subdivide based on lot size. One of these lots is the proposed Poehling Addition. The remaining 90 lots do not appear to be further sub-dividable based on lot size or extensive on-site wetlands. OHWL Setback The required setback from the OHWL is 75 feet; however, Section 1102.07(2)(a) of the Overlay District provisions states “Where structures exist on the adjoining lots on both sides of a proposed building site, structure setbacks may be altered without a variance to conform to the adjoining setbacks from the ordinary high water level, provided the proposed building site is not located in a shore impact zone.” The OHWL setback from the existing house on the proposed Lot 1 is 54.8 feet and the OHWL setback on the adjoining parcel to the south, 6770 West Shadow Lake Drive, is approximately 67 feet. The average OHWL setback for Lot 2 is then 60.9 feet. The preliminary plat shows a OHWL building setback line on Lot 2 extending from the house structures on Lot 1 and 6770 West Shadow Lake Drive that is a minimum of 65 feet from the OHWL. The proposed house on Lot 2 is setback 78 feet from the OHWL. This is compliant with both the required and average setback. Variances Variances are required for lot size and street setback. Lot Size The required minimum lot size for riparian shoreland parcels is 20,000 sf. The larger lots promote less intense development along lakes and provide additional surface area to minimize the amount of stormwater runoff impacts into the public waters. Per Section 1102.07(1)(c)1 of the Overlay District provisions: Only land above the ordinary high water level (OHWL) of public waters and outside existing watercourses can be used to meet the lot area standards. 6 Under the Shoreland Management Overlay Ordinance, watercourses refer to tributary rivers and streams. Rice Creek and Hardwood Creek are the only watercourses listed in Lino Lakes and are not applicable to the Poehling Addition. Therefore, lot area will be measured above the OHWL of Reshanau Lake. The applicant is requesting a 25 foot street setback along West Shadow Lake Road for Lot 2. Reducing the front setback allows more separation from the building pad to the existing wetland and OHWL. There will also be less floodplain impact and impervious surface. The existing street setback for Lot 1 is 22.2 feet. Staff is not sure why there is a deviation on Lot 1 other than the fact that the house was constructed in 1984 and surveys were not required and setbacks may not have been verified. Building Requirements At the time of building permit, the single family dwelling unit will be reviewed for compliance regarding floor area, garage and design and construction standards. Subdivision Ordinance The legal description of the subject site is Lot 1, Block 1, Reshanau Shores. It was platted in 1982. Per Section 1001.076(2) of the Subdivision Regulation, any subdivision that results in the creation of one or more sewered residential lots shall be platted in full compliance with preliminary plat and final plat requirements and therefore, it is not a minor subdivision. Conformity with the Comprehensive Plan and Zoning Code The preliminary plat is consistent with the comprehensive plan for low density residential development and zoning code requirements for R-1X, Single Family Executive as discussed above. Blocks and Lots The preliminary plat contains Lot 1 and Lot 2, Block 1, Poehling Addition. As noted above, Lot 1 contains the existing house and Lot 2 proposes a single family home. Variances are required for lot size and street setback. 7 Streets and Alleys Both lots are served by West Shadow Lake Road which is being reconstructed and municipal water and sanitary sewer is being installed. The existing road has 60 feet of right-of-way and the paved road surface is 26 feet wide with ribbon curb. Easements Standard drainage and utility easements at least 5 and 10 feet wide are provided along all lot lines. The wetland and stormwater basin shall be covered by an easement that includes a 10 foot buffer. Storm Water Management and Erosion and Sediment Control Per the Site Drainage Narrative prepared by Plow Engineering, Inc. dated July 1, 2019, there are 3 areas of discharge from the site (one to the north and 2 to the east). The existing fire pit will be removed and a small basin will be constructed in the area adjacent to the fire pit. Per WSB Engineering letter dated September 24, 2019, new impervious area from the site is all routed to the east towards Reshanau Lake. The new impervious surface is less than 10,000 square feet, and all runoff from new impervious will run over a pervious surface prior to leaving the site, therefore no water quality treatment will be required as a result of the additional impervious surface from the single-family residential development. Side yard drainage ways are required. Utilities Sanitary Sewer A 3” sanitary sewer force main is being installed along West Shadow Lake Drive. The existing house shall hook up upon availability. The new house shall hook-up upon construction. The existing septic drain field shall be removed. Watermain An 8” DIP watermain is being installed along West Shadow Lake Drive. The existing house shall hook up upon availability. The new house shall hook-up upon construction. The existing well may be used for irrigation only or shall be properly capped and abandoned. Of those 13 trees, 8 of the trees are within the basic use area of the house pad and driveway and mitigation is not required. The other 5 trees are being removed in order to construct the basin. The remaining 83 trees provide open space mitigation requirements, prevent erosion control and provide shoreland aesthetics. Further tree mitigation is not required. Landscaping Canopy cover, foundation landscaping, and buffer and screens are not required for the 2 lot residential subdivision. Open Area Landscaping The proposed stormwater basin is approximately 2,000 sf. This would require 1 large tree and 3 large shrubs. The remaining 83 trees and existing shrubs on site satisfy the open area landscape requirements. No further landscaping is required. Boulevard Trees Boulevard trees are required at the rate of 1 tree per lot frontage for singly family lots. This would require 2 boulevard trees. The 6 existing trees on Lot 1 and 1 existing tree on Lot 2 along West Shadow Lake Drive provide boulevard tree coverage. No additional boulevard trees are required. Shoreline Buffer Zone Reshanau Lake is an impaired, recreational development lake and efforts to protect and improve the natural resource should be implemented with any development. A native vegetated shoreline buffer will be required as a stormwater management best management practice (BMP) to minimize runoff pollutants from entering the lake. The buffer will also help stabilize the shoreline, reduce erosion and support aquatic plants and wildlife. An average 20 foot wide but no less than 10 foot minimum wide native vegetated buffer zone extending from the shoreline shall be installed and maintained on both Lot 1 and Lot 2. As recommended by the Planning & Zoning Board, a 20 foot wide access opening to the lake is allowed. A landscape plan detailing the buffer plantings and maintenance shall be submitted. Environmental Assessment Worksheet (EAW) An Environmental Assessment Worksheet is not mandated. The two (2) unattached residential units are under the 250 unattached unit thresholds required for a mandatory EAW. Wetlands 9 A Wetland Delineation Report was completed by Jacobson Environmental, PLLC on November 27, 2018. A WCA Notice of Decision approving the wetland delineation was issued by RCWD on January 1, 2019. Two basins were delineated. Basin 1 is approximately 0.046 acres (2,003 sf) and is located within the rear yard of Lot 2. Basin 2 is Reshanau Lake and portions of its shoreline. No wetland impacts are proposed. Per RCWD, Rule F is not triggered; therefore, no WMC wetland buffers are required. A drainage and utility easement 10 feet above the delineated wetland is required. Floodplain The 2015 DFIRM indicates Zone AE floodplain on both Lot 1 and Lot 2. The FEMA base flood elevation (BFE) is 887. The applicant is proposing 110 cy of floodplain fill and 110 cy of compensatory storage. The applicant has drafted a CLOMR-F application to revise the floodplain map. It should be noted that any future proposed structures such as accessory structures shall meet the floodplain ordinance requirements. The City Engineer also notes the low floor elevation shall be 2 feet above the BFE and the plans shall be revised. Shoreland Management Overlay The general purpose and intent of the Shoreland Management Overlay ordinance is to protect public waters. Per the ordinance Policy statement, the uncontrolled use of shorelands of the city affects the public health, safety and general welfare not only by contributing to pollution of public waters, but also by impairing the local tax base. Therefore, it is in the best interests of the public health, safety and welfare to provide for the wise subdivision, use and development of shorelands of public waters. As discussed, the site is located in a Shoreland Management Overlay district of Reshanau Lake. This lake is a classified as a Recreational Development Lake and has an 883.5 OHWL elevation. The required setback from the OHWL is 75 feet; however, Section 1102.07(2)(a) states “Where structures exist on the adjoining lots on both sides of a proposed building site, structure setbacks may be altered without a variance to conform to the adjoining setbacks from the ordinary high water level, provided the proposed building site is not located in a shore impact zone.” The OHWL setback on the proposed Lot 1 is 54.8 feet and the OHWL setback on the adjoining parcel to the south, 6770 West Shadow Lake Drive, is approximately 67 feet. The average OHWL setback for Lot 2 is 60.9 feet. The preliminary plat shows a OHWL building setback line on Lot 2 extending from the house structures on Lot 1 and 6770 West Shadow Lake Drive that is a minimum of 65 feet from the OHWL. The proposed house on Lot 2 is setback 78 feet from the OHWL. This is compliant with both the required and average setback. Also noted was the need for a lot size variance from the required 20,000 sf. This is further explained below under Variances. Sheet 2, Preliminary Plat notes impervious surface coverage for Lot 1 = 20.9% and Lot 2 = 14.6%. Both meet the allowed 30% impervious surface coverage of the shoreland ordinance. 10 A native vegetated shoreline buffer will be required as a stormwater management best management practice (BMP) to minimize runoff pollutants from entering the lake. Comprehensive Plan Poehling Addition is consistent with the goals and policies of the comprehensive plan in regards to resource management, land use, housing, transportation and utilities. Resource Management System Plan Goals of the Resource Management System Plan include: • Natural Resources and Amenities o Goal #1: Identify, protect and preserve the desirable natural areas and ecological and aquatic resources of the community. • Land Use Policies o Goal #1: Ensure that well-planned, quality residential, commercial, industrial and institutional development to accommodate the city’s projected growth needs occurs in a manner that also conserves and enhances the city’s natural resources and amenities. Municipal sanitary sewer is being installed along West Shadow Lake Drive. The extension of this utility to serve lots eliminates on-site septic systems and promotes the goal of protecting the natural resource, Reshanau Lake, by preventing sewage pollution of public waters. The Poehling Addition also protects the natural resource by providing storm water and floodplain management and installing vegetative shoreline buffers. Land Use Plan Goal 2: Ensure that zoning and subdivision ordinances and official maps are consistent with the intent and specific direction provided within the Comprehensive Plan. Policies: 1. Ensure developers meet the standards specified within the land-use plan and official controls, including zoning and subdivision ordinances and official maps. 2. Ensure compatibility of adjacent land uses. Poehling Addition is compliant with the zoning, subdivision and shoreland management ordinances with approved variances. The two (2) lot subdivision is consistent with low density residential development as guided by the Comprehensive Plan. The development is also compatible with adjacent smaller lot single family residential land uses. Housing Plan Goal 1: Ensure housing development is compatible with existing and adjacent land uses and provides accessibility to key community features and natural resources. 11 Poehling Addition meets the goals of the housing plan. The development is compatible with the existing and adjacent residential homes and provides access to the natural resource. Transportation Plan Goal 1: Plan for and achieve required street improvements and connectivity throughout the City of Lino Lakes. West Shadow Lake Drive is a reconstructed local street and has capacity to accommodate one (1) new single family home. Sanitary Sewer Plan Goals of the sanitary sewer plan are to ensure well-planned, quality residential development that conserves and enhances the city’s natural resources and to provide an affordable and safe sanitary sewer system. Municipal sanitary sewer is being installed along West Shadow Lake Drive. The extension of this utility to serve lots eliminates on-site septic systems and promotes the goal of preventing pollution of public waters. The sanitary system has capacity to handle two (2) single family homes. Funding of the sanitary sewer extension contemplated a higher allowable density of homes as is reflected in the rezoning of the properties to R-1X Water Supply Plan A goal of the water supply plan is to provide residents affordable potable water that is safe and of high quality for daily consumption and fire demand. Municipal watermain is being installed along West Shadow Lake Drive. The water supply system has capacity to handle two (2) single family homes. Planning Districts The site is located in Planning District 1 and is guided for low density residential development. There are no specific planning recommendations for this site. The site is located within Reshanau Resource Management Unit (RMU). Environmental Board Comments The Environmental Board reviewed the proposed variances and preliminary plat on July 31, 2019. They recommended approval of the project with conditions listed in the attached August 6, 2019 Memo from the Environmental Coordinator. MNDNR Comments 12 The DNR reviewed the Poehling Addition preliminary plat and variance request. They recommend denial of the lot size variance request. See attached MNDNR letter dated October 2, 2019. Staff has drafted the following Findings of Fact supporting the variance request for consideration of the Board and Council. Final Plat A land use application for final plat and Development Agreement shall be required. Planning & Zoning Board The Planning & Zoning Board held a public hearing on October 9, 2019. They recommended approval with a 6-0 vote with the following additions (underlined) and/or deletions (strikeout) from the October 9, 2019 Planning & Zoning staff report: 1. A basin and side yard drainage way are required to minimize stormwater and pollutants from entering the public water. 2. A vegetated buffer zone extending upland from the shoreline averaging at least 20 feet in width but no less than 10 feet in width shall be installed and maintained on both Lot 1 and Lot 2. a. One access opening to the shoreline no greater than 5 20 feet wide is allowed on Lot 1 and Lot 2. 3. The existing house on Lot 1 and new house on Lot 2 are required to connect to municipal water and sanitary service upon availability. 4. Lot 1 and Lot 2 will have limited ability to construct accessory structures, decks or additions due to the required OHWL setback and floodplain requirements. 5. The applicant shall obtain a FEMA LOMR-F to revise the floodplain map. Findings of Fact The Findings of Fact for the variances and preliminary plat are detailed in the attached resolutions. Shadow Lake Drive in Lino Lakes, MN. Variances to shoreland ordinance standards are an important tool for balancing property rights with the public’s right to clean water and healthy habitats. However, variances to shoreland standards should be rare and only for exceptional situations. The variance criteria in Minnesota Statutes must be used for determining these exceptional situations. Note that ALL five variance criteria must be satisfied to approve a variance. These five criteria are: • Is the variance consistent with the comprehensive plan? • Are there unique circumstances to the property not created by the landowner? • Is the variance in harmony with the purposes and intent of the ordinance? • Will the variance, if granted, alter the essential character of the locality? • Does the proposal put property to use in a reasonable manner? I reviewed the application against the five criteria above and below is a summary of how the application compares to three of them that the City may want to review the variance request against. Are there unique circumstances to the property not created by the landowner? Unique circumstances relate to physical characteristics of the land - such as lot dimensions (not area), steep slopes, poor soils, wetlands, and trees. These do not include physical limitations or personal circumstances created by the property owner that prevent compliance with the minimum lot size. 2 Owning an approximately 30,000 sq ft. lot in a zoning district that has a 20,000 sq ft. minimum lot size is not a unique circumstance. The need for a variance is created by the landowner’s desire to subdivide a conforming lot that is not large enough to create two lots. Is the variance in harmony with the purposes and intent of the ordinance? The purpose and intent of restricting minimum lot size is to limit the density of development occurring in shoreland areas. Increasing density can have wide ranging impacts. For example, impervious surface increases, resulting in an increased rate and amount of runoff and pollutants entering public waters. The variance requested does not seek minimal relief of the minimum lot size but is a substantial deviation that is not in harmony with the purposes and intent of the City’s Shoreland Ordinance. The proposed variance to allow a conforming lot to be subdivided into two non-conforming lots sets a precedent for all zoning districts of the City. Does the proposal put property to use in a reasonable manner? The purpose and intent of having a mimimum lot size is to control the density of development in shoreland areas .The property currently is being used in a reasonable manner. That is, a single family home that is located on a lot that is between the minimum lot size and a lot that is large enough to subdivide. When evaluated against the purpose and intent of the City’s Shoreland Ordinance the proposed subdivision does not use the property in a reasonable manner. Recommendation After reviewing the application, it appears that the variance request is being driven by the economic interests of the landowner. Legal standards require that variances may only be granted when the applicant establishes that there are “practical difficulties” in complying with the official control. The DNR recommends denial of the variance request to subdivide a lot that currently conforms to lot size requirements into two non-conforming lots. State rule requires that final decisions regarding variances be sent to the DNR within 10 days of the decision. The DNR monitors the circumstances and frequency under which local governments approve variances to shoreland ordinances and may take legal action in situations where variances that don’t meet the statutory criteria, and result in negative impacts to shoreland areas and adjacent public waters, are approved. Conditions may be imposed in the granting of a variance to protect adjacent properties and the public interest. A basin, side yard drainage way and vegetative buffer are required to minimize stormwater and pollutants from entering the public water. The existing house and new house are required to connect to municipal water and sanitary service upon availability. 2. The variance shall be consistent with the comprehensive plan. The variance request is consistent with the comprehensive plan. The subject site is guided for low density residential development and the proposed two (2) lot residential development is consistent in regards to land use and density. 3. There shall be practical difficulties in complying with the ordinance. “Practical difficulties,” as used in connection with the granting of a variance, means that the property owner proposes to use the property in a reasonable manner not permitted by the ordinance. Economic considerations alone do not constitute practical difficulties. Practical difficulties include, but are not limited to, inadequate access to direct sunlight for solar energy systems. There are practical difficulties in meeting the 20,000 sf lot area requirements. The parcel was originally platted in 1982 before the adoption of the 1995 Shoreland Management Overlay ordinance. The minimum lot area requirement at the time of platting was 1 acre; however, the lot area was not measured above the ordinary high water level (OHWL). The existing parcel is 34,023 sf as measured above the OHWL; therefore, creating two 20,000 sf lots is not possible. When the house was constructed in 1984, there was a conscientious effort to locate it so the lot could be subdivided in the future with the extension of municipal sanitary sewer. The property owner proposes to use the property in a reasonable manner. The subject site is guided for low density residential development and the proposed 2 lot residential subdivision is consistent in regards to land use and density. 3 4. The plight of the landowner shall be due to circumstances unique to the property not created by the landowner. The plight of the landowner is due to circumstances unique to the property and was not created by the landowner. The applicant is proposing to subdivide an existing lot of record platted in 1982 prior to the City’s 1995 adoption of the shoreland management ordinance. 5. The variance shall not alter the essential character of the locality and is consistent with development of adjacent properties. The variance will not alter the essential character of the locality. Riparian development adjacent to Reshanau Lake includes low density single family lots. Many of these smaller lots were platted between 1969 and 1991. 6. NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes hereby makes the following: FINDINGS OF FACT Per Subdivision Ordinance Section 1001.013, Premature Subdivision: (1) General. Any concept plan, preliminary plat or final plat deemed premature pursuant to the following criteria shall be denied by the City Council. (2) Conditions for establishing a premature subdivision. A subdivision may be deemed premature should any of the following conditions not be met. 2 (a) Consistency with the Comprehensive Plan. Including any of the following: 1. Land use plan; 2. Transportation plan; 3. Utility (sewer and water) plans; 4. Local water management plan; 5. Capital improvement plan; and 6. Growth management policies, including MUSA allocation criteria. Poehling Addition is consistent with the goals and policies of the comprehensive plan in regards to resource management, land use, housing, transportation and utilities as detailed in the November 12, 2019 Council staff report. The development is also consistent with the local water management plan, capital improvement plans and growth management policies. (b) Consistency with infill policies. A proposed urban subdivision shall meet the city's infill policies: 1. The urban subdivision must be located within the Metropolitan Urban Service Area (MUSA) or the staged growth area as established by the city's Comprehensive Plan; 2. The cost of utilities and street extensions must be covered by one or more of the following: a. An immediate assessment to the proposed subdivision; b. One hundred percent of the street and utility costs are privately financed by the developer; c. The cost of regional and/or oversized trunk utility lines can be financed with available city trunk funds; and d. The cost and timing of the expenditure of city funds are consistent with the city's capital improvement plan. 3. The cost, operation and maintenance of the utility system are consistent with the normal costs as projected by the water and sewer rate study; and 4. The developer payments will offset additional costs of utility installation or future operation and maintenance. Poehling Addition is consistent with infill policies. The development is within the current Utility Staging Area 1A=2008-2015. In 2018, the City commenced the West Shadow Lake Drive Street and Utility Improvement Project to reconstruct the street and install municipal water and sanitary sewer. The cost, operation and maintenance of the utility system is consistent with the normal costs projected by the water and sanitary system plans. No future utility costs are proposed. (c) Roads or highways to serve the subdivision. A proposed subdivision shall meet the following requirements for level of service (LOS), as defined by the Highway Capacity Manual: 1. If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade; 2. If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C; 3. If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D; 3 4. The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better; 5. Existing roads and intersections providing access to the subdivision must have the structural capacity to accommodate projected traffic from the proposed subdivision or the developer will pay to correct any structural deficiencies; 6. The traffic generated from a proposed subdivision shall not require city street improvements that are inconsistent with the Lino Lakes capital improvement plan. However, the city may, at its discretion, consider developer-financed improvements to correct any street deficiencies; 7. The LOS requirements in divisions (2)(c)1. to 4. above do not apply to the I-35W/Lake Drive or I-35E/Main St. interchanges. At city discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Department of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the subdivision project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties that contribute to traffic at the interchange; and 8. The city does not relinquish any rights of local determination. Poehling Addition meets the requirements for level of service (LOS). West Shadow Lake Drive is a local street and has capacity to accommodate one (1) new single family home. West Shadow Lake Drive is being reconstructed in 2019. The city does not relinquish any rights of local determination. (d) Water supply. A proposed subdivision shall be deemed to have an adequate water supply when: 1. The city water system has adequate wells, storage or pipe capacity to serve the subdivision; 2. The water utility extension is consistent with the Lino Lakes water plan and offers the opportunity for water main looping to serve the urban subdivision; 3. The extension of water mains will provide adequate water pressure for personal use and fire protection; and 4. The rural subdivision can demonstrate that each of the proposed lots can be provided with a potable water supply. Poehling Addition will have an adequate water supply. In 2018, the City commenced the West Shadow Lake Drive Street and Utility Improvement Project to reconstruct the street and install municipal water and sanitary sewer. The subject site is served by a 8” DIP watermain. The water supply system has capacity to handle one (1) single family home. (e) Waste disposal systems. A proposed subdivision shall be served with adequate waste disposal systems when: 1. The urban sewered subdivision is located inside the city's MUSA or is consistent with the MUSA allocation criteria; 2. The city has sufficient MUSA and pipe capacity to serve the subdivision if developed to its maximum density; 4 3. The subdivision will result in a sewer extension consistent with Lino Lakes sewer plan and capital improvement plan; 4. A rural subdivision can demonstrate that each lot can be served by an adequate sanitary sewer disposal system; and 5. A rural subdivision with a proposed communal sanitary sewer or water system has an effective long range management and maintenance program with proper financing. Poehling Addition will be served with an adequate waste disposal system. In 2018, the City commenced the West Shadow Lake Drive Street and Utility Improvement Project to reconstruct the street and install municipal water and sanitary sewer. The subject site is served by a 3” sanitary sewer force main and has capacity to handle one (1) single family home. The residential subdivision was not served by municipal water or sanitary sewer. In 2018, the City commenced the West Shadow Lake Drive Street and Utility Improvement Project to reconstruct the street and install municipal water main and sanitary sewer. With the extension of public utilities, larger lots may be able to subdivide. In anticipation of such subdivision requests, in 2018, the City also rezoned several parcels, including the subject site, from R, Rural to R-1X, Single Family Executive Residential. Existing Site Conditions The residential lot contains the existing house and garage that were built in 1978, trees, grass, a shed, septic system, well, fire pit and wetland. Overhead wires exist along the street. The existing driveway turn around will be removed. The fire pit and shed will be removed or relocated. The Certificate of Survey indicates Zimmerman Fine Sand and Lake Beaches soil. Groundwater was encountered at approximately 2.8 feet (EL 883.7). The parcel abuts Reshanau Lake and is subject to the requirements of the Shoreland Overlay Management District as detailed later in this staff report. OHWL Setback The current required setback from the OHWL on unsewered lots on recreational development lakes is 100 feet. The existing house setback from the OHWL is 73.5 feet. The house is 5 considered legal non-conforming because it was constructed in 1978 prior to the City’s adoption of the Shoreland Management Ordinance in 1995. With the installation of municipal sanitary sewer along West Shadow Lake Drive, the required setback from the OHWL on sewered lots on Recreational Development lakes is 75 feet. This is applicable to both Lot 1 and Lot 2. Although Section 1102.07(2)(a) states “Where structures exist on the adjoining lots on both sides of a proposed building site, structure setbacks may be altered without a variance to conform to the adjoining setbacks from the ordinary high water level, provided the proposed building site is not located in a shore impact zone”, this standard does not apply to Lot 1 since the required 75 foot setback can be met. The 75 foot OHWL setback is also applicable to Lot 2. As discussed, the house is considered legal non-conforming. The house becomes more compliant with the OHWL setback requirement from the current 100 foot setback for unsewered lots to the 75 foot setback for sewered lots. The plans shall be revised to show a 75 foot “BLDSB” setback line from the OHWL on both Lot 1 and Lot 2. Building Requirements At the time of building permit, the single family house proposed on Lot 1 will be reviewed for compliance regarding floor area, garage and design and construction standards. Subdivision Ordinance The legal description of the subject site is Lot 1, Block 1, Lakes Addition No.5. It was platted in 1978. Per Section 1001.076(2) of the Subdivision Regulations, any subdivision that results in the creation of one or more sewered residential lots shall be platted in full compliance with preliminary plat and final plat requirements and therefore, it is not a minor subdivision. Conformity with the Comprehensive Plan and Zoning Code The preliminary plat is consistent with the comprehensive plan for low density residential development and zoning code requirements for R-1X, Single Family Executive as discussed above. Blocks and Lots The preliminary plat contains Lot 1 and Lot 2, Block 1, Stern Addition. As noted above, Lot 1 proposes a single family home and Lot 2 contains the existing house. Streets and Alleys 6 Both lots are served by West Shadow Lake Road which is being reconstructed and municipal water and sanitary sewer is being installed. The existing road has 60 feet of right-of-way and the paved road surface is 26 feet wide with ribbon curb. Easements Standard drainage and utility easements at least 5 and 10 feet wide are provided along all lot lines. The wetland and stormwater basin shall be covered by an easement that includes a 10 foot buffer. Storm Water Management and Erosion and Sediment Control Per Section 1011.011, stormwater management is required for all proposed land development activity if the site is within the 100-year floodplain or within 1,000 feet of a public water. Stern Addition is within the floodplain and shoreland district. Per the Site Drainage Narrative prepared by Plow Engineering, Inc. dated September 13, 2019, there are 3 existing areas of discharge from the site (one to the West to W. Shadow Drive, one to the inland wetland area, and one to the East to Reshanau Lake). Per WSB Engineering letter dated September 24, 2019, new impervious area from the site is routed to the west towards West Shadow Lake Drive, the north into an existing wetland area, and the east to Reshanau Lake. The new impervious surface is less than 10,000 square feet, and all runoff from new impervious will run over a pervious surface prior to leaving the site, therefore no water quality treatment will be required as a result of the additional impervious surface from the single- family residential development. A side yard drainage way is required between the existing and proposed home. As detailed below under Landscaping, a minimum 20 foot wide vegetated shoreline buffer shall be required as a stormwater management best management practice (BMP) to minimize runoff pollutants from entering the lake. Utilities Sanitary Sewer A 3” sanitary sewer force main is being installed along West Shadow Lake Drive. The existing house shall hook up upon availability. The new house shall hook-up upon construction. The existing septic drain field shall be removed. Watermain An 8” DIP watermain is being installed along West Shadow Lake Drive. The existing house shall hook up upon availability. The new house shall hook-up upon construction. The existing well may be used for irrigation only or shall be properly capped and abandoned. Public Land Dedication 7 The City will require cash in lieu of land dedication for the new lot. The lot with the existing house will not be charged a park dedication fee. Park Dedication Fees Total # of Lots = 1 x 2019 Park Dedication Fee $3,000 = Total Due $3,000 Tree Preservation The goal of tree preservation is to minimize unnecessary loss of habitat, biodiversity and forest resource and to replace removed trees in areas where tree cover is most critical. Sheet 4, Tree Inventory/Removals identifies 46 significant trees on the entire site and 8 of these trees will be removed. Of those 8 trees, 7 of the trees are within the basic use area of the house pad and driveway and mitigation is not required. The other 1 tree are being removed in order to construct the FEMA floodplain mitigation basin. The remaining 38 trees provide open space mitigation requirements, prevent erosion control and provide shoreland aesthetics. No further tree mitigation is required. Landscaping Canopy cover, foundation landscaping, and buffer and screens are not required for the 2 lot residential subdivision. Open Area Landscaping The proposed FEMA floodplain mitigation basin is approximately 600 sf. This would require 1 large tree and 3 large shrubs. The remaining 38 trees and existing shrubs on site satisfy the open area landscape requirements. No further landscaping is required. Boulevard Trees Boulevard trees are required at the rate of 1 tree per lot frontage for singly family lots. This would require 2 boulevard trees. Both Lot 1 and Lot 2 contain existing trees in the front yard that serve as boulevard trees. No additional boulevard trees are required. Sod and Ground Cover All disturbed areas shall have appropriate ground cover in accordance with Section 1007.043(17)(h). This includes the existing driveway turn around being removed. Shoreline Buffer Zone 8 Reshanau Lake is an impaired, recreational development lake and efforts to protect and improve the natural resource should be implemented with any development. A native vegetated shoreline buffer will be required as a stormwater management best management practice (BMP) to minimize runoff pollutants from entering the lake. The buffer will also help stabilize the shoreline, reduce erosion and support aquatic plants and wildlife. An average 20 foot wide but no less than 10 foot minimum wide native vegetated buffer zone extending from the shoreline shall be installed and maintained on both Lot 1 and Lot 2. As recommended by the Planning & Zoning Board, a 20 foot wide access opening to the lake is allowed. A landscape plan detailing the buffer plantings and maintenance shall be submitted. Environmental Assessment Worksheet (EAW) An Environmental Assessment Worksheet is not mandated. The two (2) unattached residential units are under the 250 unattached unit threshold required for a mandatory EAW. Wetlands A Wetland Delineation Report was completed by Jacobson Environmental, PLLC on August 2, 2019. A WCA Notice of Decision approving the wetland delineation was issued by RCWD on September 16, 2019. Three (3) basins were delineated. Basin 1 is 0.016 acres and Basin 2 is 0.024 acres. Both are located within the rear yard of Lot 1. Basin 3 is 0.008 acres and is adjacent to the Reshanau Lake shoreline on both Lot 1 and Lot 2. No wetland impacts are proposed. Per RCWD, Rule F is not triggered; therefore, no WMC wetland buffers are required. A drainage and utility easement 10 feet above the delineated wetland is provided. Floodplain The 2015 DFIRM indicates Zone AE floodplain on both Lot 1 and Lot 2. The FEMA base flood elevation (BFE) is 887. Per Sheet 6, CLOMR-F Exhibit, the applicant is proposing 38 cy of floodplain fill and 39 cy of compensatory storage. The applicant shall obtain a CLOMR-F from FEMA to revise the floodplain map. It should be noted that any future proposed structures such as accessory structures shall meet the floodplain ordinance requirements. Shoreland Management Overlay The general purpose and intent of the Shoreland Management Overlay ordinance is to protect public waters. Per the ordinance Policy statement, the uncontrolled use of shorelands of the city affects the public health, safety and general welfare not only by contributing to pollution of public waters, but also by impairing the local tax base. Therefore, it is in the best interests of the public health, safety and welfare to provide for the wise subdivision, use and development of shorelands of public waters. As discussed, the site is located in a Shoreland Management Overlay district of Reshanau Lake. This lake is a classified as a Recreational Development Lake and has an 883.5 OHWL elevation. The required OHWL setback for both Lot 1 and Lot 2 is 75 feet for sewered lots. The proposed setback on Lot 1 is 87.6 feet and is compliant. The current setback from the existing house on Lot 2 is 73.5 feet. The house is considered legal non-conforming. 9 Per Section 1102.87(1)(c)4, impervious surface coverage on each lot must not exceed 30%. Sheet 2, Preliminary Plat notes impervious surface coverage for Lot 1 = 18.0% and Lot 2 = 19.8%. Both meet the allowed 30% impervious surface coverage of the shoreland ordinance. A native vegetated shoreline buffer will be required as a stormwater management best management practice (BMP) to minimize runoff pollutants from entering the lake. Resource Management System Plan Goals of the Resource Management System Plan include: • Natural Resources and Amenities o Goal #1: Identify, protect and preserve the desirable natural areas and ecological and aquatic resources of the community. • Land Use Policies o Goal #1: Ensure that well-planned, quality residential, commercial, industrial and institutional development to accommodate the city’s projected growth needs occurs in a manner that also conserves and enhances the city’s natural resources and amenities. The Stern Addition protects the natural resource, Reshanau Lake, by providing storm water management and vegetative buffers. Land Use Plan Goal 2: Ensure that zoning and subdivision ordinances and official maps are consistent with the intent and specific direction provided within the Comprehensive Plan. Policies: 1. Ensure developers meet the standards specified within the land-use plan and official controls, including zoning and subdivision ordinances and official maps. 10 2. Ensure compatibility of adjacent land uses. Stern Addition is compliant with the zoning and subdivision ordinances. It is also compatible with adjacent residential land uses. Housing Plan Goal 1: Ensure housing development is compatible with existing and adjacent land uses and provides accessibility to key community features and natural resources. Stern Addition meets the goals of the housing plan. The development is compatible with the existing and adjacent residential homes and the natural resource. Transportation Plan Goal 1: Plan for and achieve required street improvements and connectivity throughout the City of Lino Lakes. West Shadow Lake Drive is a reconstructed local street and has capacity to accommodate one (1) new single family home. Sanitary Sewer Plan Goals of the sanitary sewer plan are to ensure well-planned, quality residential development that conserves and enhances the city’s natural resources and to provide an affordable and safe sanitary sewer system. Municipal sanitary sewer is being installed along West Shadow Lake Drive. The sanitary system has capacity to handle 2 single family homes. Water Supply Plan A goal of the water supply plan is to provide residents affordable potable water that is safe and of high quality for daily consumption and fire demand. Municipal watermain is being installed along West Shadow Lake Drive. The water supply system has capacity to handle 2 single family homes. Planning Districts The site is located in Planning District 1 and is guided for low density residential development. There are no specific planning recommendations for this site. The site is located within Reshanau Resource Management Unit (RMU). 11 Environmental Board Comments The Environmental Board reviewed the proposed preliminary plat on September 25, 2019. They recommended approval of the project with conditions listed in the October 3, 2019 Memo from the Environmental Coordinator. MNDNR Comments The preliminary plat was emailed to the MNDNR on September 13, 2019 but no comments have been received. Final Plat A land use application for final plat and Development Agreement shall be required. Planning & Zoning Board The Planning & Zoning Board held a public hearing on October 9, 2019. They recommended approval with a 6-0 vote with the following additions (underlined) and/or deletions (strikeout) from the October 9, 2019 Planning & Zoning staff report: 1. A basin and side yard drainage way are required to minimize stormwater and pollutants from entering the public water. 2. A vegetated buffer zone extending upland from the shoreline averaging at least 20 feet in width but no less than 10 feet in width shall be installed and maintained on both Lot 1 and Lot 2. a. One access opening to the shoreline no greater than 5 twenty (20) feet wide is allowed on Lot 1 and Lot 2. 3. The existing house on Lot 2 and new house on Lot 1 are required to connect to municipal water and sanitary service upon availability. 4. Any concept plan, preliminary plat or final plat deemed premature pursuant to the following criteria shall be denied by the City Council. (2) Conditions for establishing a premature subdivision. One hundred percent of the street and utility costs are privately financed by the developer; c. The cost of regional and/or oversized trunk utility lines can be financed with available city trunk funds; and d. The cost and timing of the expenditure of city funds are consistent with the city's capital improvement plan. 3. The cost, operation and maintenance of the utility system are consistent with the normal costs as projected by the water and sewer rate study; and 4. The developer payments will offset additional costs of utility installation or future operation and maintenance. Stern Addition is consistent with infill policies. The development is within the current Utility Staging Area 1A=2008-2015. In 2018, the City commenced the West Shadow Lake Drive Street and Utility Improvement Project to reconstruct the street and install municipal water and sanitary sewer. The cost, operation and maintenance of the utility system is consistent with the normal costs projected by the water and sanitary system plans. No future utility costs are proposed. (c) Roads or highways to serve the subdivision. A proposed subdivision shall meet the following requirements for level of service (LOS), as defined by the Highway Capacity Manual: 1. If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade; 2. If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C; 3. If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D; 4. The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must 3 provide, as part of the proposed project, improvements needed to ensure a level of service D or better; 5. Existing roads and intersections providing access to the subdivision must have the structural capacity to accommodate projected traffic from the proposed subdivision or the developer will pay to correct any structural deficiencies; 6. The traffic generated from a proposed subdivision shall not require city street improvements that are inconsistent with the Lino Lakes capital improvement plan. However, the city may, at its discretion, consider developer-financed improvements to correct any street deficiencies; 7. The LOS requirements in divisions (2)(c)1. to 4. above do not apply to the I-35W/Lake Drive or I-35E/Main St. interchanges. At city discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Department of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the subdivision project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties that contribute to traffic at the interchange; and 8. (d) Water supply. A proposed subdivision shall be deemed to have an adequate water supply when: 1. The city water system has adequate wells, storage or pipe capacity to serve the subdivision; 2. The water utility extension is consistent with the Lino Lakes water plan and offers the opportunity for water main looping to serve the urban subdivision; 3. The extension of water mains will provide adequate water pressure for personal use and fire protection; and 4. The rural subdivision can demonstrate that each of the proposed lots can be provided with a potable water supply. Stern Addition will have an adequate water supply. In 2018, the City commenced the West Shadow Lake Drive Street and Utility Improvement Project to reconstruct the street and install municipal water and sanitary sewer. The subject site is served by an 8” DIP watermain. The water supply system has capacity to handle one (1) single family home. (e) Waste disposal systems. The urban sewered subdivision is located inside the city's MUSA or is consistent with the MUSA allocation criteria; 2. BACKGROUND The I-35E Corridor Alternative Urban Areawide Review (AUAR) is an environmental review document that analyzed potential impacts of development within a study area of 4,660 acres. The final document was originally adopted by the Lino Lakes City Council on October 24, 2005. The AUAR serves as a substitute environmental review. As long as a development project is consistent with the assumptions of the analyses in the AUAR, no additional environmental review is required. In order to remain valid as a substitute form of environmental review, the AUAR must be revised under certain criteria. One of the criteria is the passing of five years. The AUAR serves as both an important economic development tool as well as a comprehensive framework for mitigating possible environmental impacts of development. The AUAR was last updated in October of 2015. Since that time the City has amended the Comprehensive Plan for the corridor as well as prepared the 2040 Comprehensive Plan update. New development has also begun to take place within the corridor including Main Street Shoppes, Northpointe and Watermark. Additionally, the update will allow for the City to accommodate any considerations to further facilitate the Minnesota Technology Corridor along 35E. WSB and Associates have prepared a proposal to complete the update in the amount of $33,272. Funding for this project is included in the Professional Services line item of the Economic Development, Planning and Zoning and Engineering budgets as well as the Water, Sanitary, and Surface Water Management funds. The City does collect an AUAR fee of $269 per acre for all new development within the corridor to offset the administrative costs associated with the document. To remain valid as the environmental review document for the area, the AUAR needs to be updated every five years until development has received approval. The AUAR was originally completed in 2005. Updates have been completed in 2010 and 2015. Approach In 2015, the update included a simple review and update of any changes and mitigation measures for the study area. Since it has been nearly 15 years since the original AUAR was completed and based on comments we received from review agencies on recent, similar AUAR Updates, we will use the EAW/AUAR questionnaire form to update the AUAR rather than having a standalone report. This will allow information to be more formally brought forward in the document as part of the AUAR Update process. Scope of Work for AUAR Update Task 1 – Project Management and Meetings This task includes the project management and meetings to be completed throughout the development of the AUAR Update. This includes three meetings with city staff; one meeting with the planning commission, and one meeting with the City Council. Task 2 – Review Development Scenarios The development scenarios will be reviewed based on the current, adopted Comprehensive Plan and any anticipated development in the study area. It is anticipated that Scenario 1 will be removed from the Update; Scenario 2 will be reviewed and adjusted to reflect actual conditions as well as a review of the residential land use plans; and the new Comp Plan will become a new scenario. These scenarios will be reviewed with City Staff before proceeding with further tasks. Task 3 – Prepare List of Permits/Approvals This item will be developed per the AUAR requirements and list the local, state, and federal permits and approvals that may be needed for development. Task 4 – Evaluate Geology, Soils, and Topography This task includes describing the geology, soils, and topography of the study area. Available public information sources and GIS will be used to develop this section. If additional information is available based on past studies of the project area, that will be included. If these features would create unique environmental impacts, that will be discussed in this section. Recent past studies that WSB has completed will be used to inform this section. Information about wetlands will be obtained through the existing wetland delineation information and readily available desktop data, such as the National Wetland Inventory. For the stormwater analysis, WSB will prepare a planning level stormwater analysis for the scenarios. This will include general analysis of before and after conditions as well as requirements for stormwater management based on MPCA, City, and Watershed District requirements. For groundwater, existing soils mapping and groundwater information from the USGS will be used to analyze impacts to susceptible groundwater features in relation to proposed land use. WSB will analyze the proposed water use and wastewater generation based on the three development scenarios and the recent studies that WSB has completed. This will be reviewed in relation to the municipal system’s ability to serve the area. Task 6 – Review of Contamination / Hazardous Wastes Available studies and information will be used to complete this section of the Update. If the scenarios include the potential for hazardous wastes to be stored or generated within the project area, that will be included in this section as well. Task 7 – Review of Fish and Wildlife Information from past site visits and the DNR Natural Heritage Database will be used to describe and evaluate wildlife impacts to the area. From the existing information and the field review, the impact of the development scenarios on these resources will be summarized in the Update. Task 8 – Review of Historic Properties, Visual Impacts, and Parks Information from the City, State Historical Preservation Office, and the readily available public data will be used to determine if there are impacts to historic properties or parks or if there will be visual impacts. Based on our understanding of the site and proposed development, we do not expect there will be visual impacts per the AUAR guidelines. This information will be used to complete the AUAR Update. Task 9 – Traffic Analysis The traffic mitigation measures will be reviewed and updated if needed, based on changes in land use from the 2040 Comprehensive Plan, other studies completed in the area, and the implementation of roadway improvements. The updated traffic study will include: Data Collection: Updated traffic data will be collected from MnDOT, Washington County and the City of Lino Lakes. It is assumed that no additional traffic counts will be collected. Traffic Generation: Area traffic generation will be updated and compared to the traffic generation from the previous AUAR updates. Task 11 – Prepare and Submit AUAR Update This task includes compiling the information prepared in the previous tasks into the AUAR Update using the EAW form. This task assumes one round of review and revision with City. Once distribution of the AUAR Update has been authorized by the City, the Update will be submitted to the required agencies for a 10-day review. Task 12 – Respond to Comments and Adopt AUAR Update If no objections are filed, the City can adopt the AUAR Update. This task includes responding to comments and preparing the Council Packet items for AUAR Update adoption. This task assumes a typical level of agency comments. If comments are received that require additional analysis, this will be discussed with the city. The final Update with responses to comments will be submitted to the agencies after Council adoption. BACKGROUND On October 28, 2019, the City Council approved Resolution No. 19-141, adopting the 2019 Individual Assessment Roll. Since this time, an additional individual assessment has been processed. The property owners have submitted a signed waiver, which waives their rights to a hearing and waives their rights to appeal under the Lino Lakes City Charter and/or Minnesota Statute 429 provided that the assessment associated with the improvement is levied against their property. We have amended the assessment roll for the following individual property, which has requested connection to city utilities: - 6996 West Shadow Lake Drive The amended total amount to be assessed is $75,929.38. Attached is the amended assessment roll. RECOMMENDATION Staff is recommending approval of Resolution No. 19-154, Amending Adopted Assessments, 2019 Individual Properties. ATTACHMENTS 1. Amended Assessment Roll CITY OF LINO LAKES RESOLUTION NO. 19-154 RESOLUTION AMENDING ADOPTED ASSESSMENTS 2019 INDIVIDUAL PROPERTIES WHEREAS, pursuant to an executed Petition and Waiver Agreement, associated property owners waive all rights to a hearing on conducting of local improvements which will benefit the following properties which requested connection to City utilities: - 7932 Lake Drive - 6881 Rustic Lane - 7002 West Shadow Lake Drive - 7006 West Shadow Lake Drive - 6994 West Shadow Lake Drive - 6996 West Shadow Lake Drive - 1427 Pond View Circle NOW, THEREFORE, BE IT RESOLVED by the City Council of Lino Lakes: 1. Such proposed assessment, a copy of which is attached hereto and made a part thereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of fifteen years, the first installment to be payable on or before the first Monday in January, 2020, and shall bear interest at the rate of five percent (5%) per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 2019. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. The owner of any property so assessed may, at any time prior to certification of the assessment to the County Auditor, pay the whole of the assessment on such property, with interest accrued to the date of payment, to the City, except that no interest shall be charged if the entire assessment is paid within 30 days from the adoption of this resolution; and the owner may, at any time thereafter, pay to the City the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which such payment is made. Such payment must be made before November 15 or interest will be charged through December 31 of the next succeeding year. 4. The clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County. Such assessments shall be collected and paid over in the same manner as other municipal taxes. Adopted by the City Council of Lino Lakes, Minnesota this 12th day of November, 2019.
