When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. Motion was supported by Mr. Laden. Motion carried 3-0. VI. ACTION ITEMS A. PUBLIC HEARING: Nadeau Acres Rezoning and Preliminary Plat Ms. Larsen, City Planner, presented the staff report. DRAFT MINUTES Planning & Zoning Board January 8, 2020 Page 2 The applicant, BL Holdings, LLC, submitted a rezoning and preliminary plat land use application for Nadeau Acres. The proposed residential development is a 69 single family lot subdivision located north of CSAH 34 (Birch Street) and west of CSAH 54 (20th Avenue) across from NorthPointe. It contains two (2) parcels totaling approximately 33 gross acres. The applicant is proposing an R-1, Single Family Residential development on standard 80 foot wide lots. Board Comments Mr. Laden asked about park access and transportation level of service. Ms. Larsen stated a future park to the west is programmed for the area. The closest existing park is NorthPointe Park. Staff would consult with Anoka County regarding a possible cross walk across 201h Avenue. Level of service information was detailed in the staff report. Ms. Peacock also asked about park access. Mr. Root asked about park dedication fees and park access. He also asked about south driveway relocation for 6709 201h Avenue. Ms. Larsen noted the relocation is required due the extension of Red Oak Lane and the applicant would work with the property owner to relocate the existing driveway to the west. The Public Hearing was opened at 7:00 P.M. q Public Comments Christa Weber, 6709 201h Avenue, expressed concerns about having to relocate the driveway behind house to avoid the median on Red Oak Lane. She also inquired about future turn lanes on 20th Avenue and where that land would come from. Jim Nelson, 6747 20t" Avenue, is not happy about the proposed development and read a letter expressing the following concerns: 1. NorthPointe development has caused flooding of property. 2. Will existing houses be required to hook up to municipal services? 3. Why are some of the retaining walls being removed? 4. Where will run-off from stormwater pond go? 5. There should be access to Birch Street. 6. Filling in wetlands does not support goal of protecting natural environment. 7. How is stubbing in road 6 feet higher than his property compatible with adjacent properties? 8. Pond 400 drains into an existing channel that is already full. 9. Headlights will shine into his bedroom windows. 10. He spoke with RCWD and they are only concerned about on -site drainage within the development boundaries, not what is already happening down stream. David Vickers, 6756 Centerville Road, asked who will be responsible for maintaining the stormwater run-off across his property to the private ditch. DRAFT MINUTES Planning & Zoning Board January 8, 2020 Page 3 Julie McNeely, 6687 20 h Avenue, asked if Outlot C provided access to her property and inquired about drainage, wetland fill and high ground water. Larry Olson, BL Holdings, LLC, 7567 162" d Avenue NE, Columbus, MN 55025, stated they will certainly work with residents and staff to address concerns. Mr. Laden encouraged applicants to have pre -development neighborhood meetings. Mr. Vickers noted concern with pre -development neighborhood meetings is that residents do not know City requirements and they are only hearing from developer. Kristine Swanson, 6737 201h Avenue, asked what recourse there is if stormwater plans do not work. Mr. Laden made a MOTION to close the Public Hearing at 7:19 P.M. Motion was supported by Ms. Peacock. Motion carried 3-0. Staff Comments 1. No median is proposed on Red Oak Lane so driveway relocation shouldn't be an issue. 2. Turn lanes will be constructed within the existing road right-of-way obtained with the minor subdivision of 6709 201h Avenue. 3. Existing houses are not required to hook up to municipal services. 4. Staff is recommending removal of retaining walls with more gradual grade changes where possible. 5. Access to Birch Street is not consistent with the Birch Street Corridor Study or Anoka County access management requirements. 6. The existing wetlands are not high quality wetlands or an integral part of the City's wetland management corridor. The wetlands are being mitigated in compliance with Minnesota Wetland Conservation Act. 7. Staff will review evaluate existing drainage issues in the area. 8. Staff will evaluate the possibility of planting coniferous trees at the north end of Heritage Avenue. 9. Outlot C does provide direct access to 6687 201h Avenue. 10. Site grading, drainage ways and storm sewer pipes direct stormwater to pond areas and not on to adjacent sites. 11. Stormwater maintenance agreements are required detailing responsibility of maintenance of facilities. Mr. Laden made a MOTION to approve the Nadeau Acres rezoning and preliminary plat with conditions noted in the staff report. Motion was supported by Mr. Root. Yeas: Laden and Root; Nays: Peacock. PUBLIC HEARING: Conditional Use Permit For Building Within Floodplain, 7020 West Shadow Lake Drive Ms. Kelsey Gelhar, WSB City Engineer, presented the staff report. The applicant, Leslie Schuhbauer, is proposing to build a home at 7020 West Shadow Lake Drive. A conditional use permit is required for building within the floodplain using alternative elevation methods. The parcel is approximately 0.31 acres. Board Comments Mr. Laden asked if the crawl space is intended to flood, if the vents open automatically and if storage is allowed. Ms. Peacock asked if construction on stilts or fill is more aesthetic. Mr. Root asked what the crawl space floor elevation was and if plantings are allowed near vents. The Public Hearing was opened at 8:17 P.M. Public Comments Leslie Schuhbauer, 1558 Simpson Street, St. Paul, MN 55108, introduce herself to the Board. She had no other comments. Mr. Laden made a MOTION to close the Public Hearing at 8:18 P.M. Motion was supported by Ms. Peacock. Motion carried 3-0. Staff Comments 1. Ms. Gelhar noted the crawl space is intended to flood, the vents open automatically and storage is allowed. Habitable space is not allowed. 2. The low floor elevation is 885 and the vents are at approximately 887. Pumps would be used to pump out water if necessary. 3. Landscape plantings should not be located near vents. Ms. Peacock made a MOTION to approve the 7020 West Shadow Lake Drive conditional use permit. Motion was supported by Mr. Laden. Motion carried 3-0. C. Concept Plan Review for 87 Lilac Street Ms. Larsen presented the staff report. The applicant, Bonfe Builders, submitted a land use application for Concept Plan Review. The proposed development is a 4 lot residential subdivision of a 1.62 acre parcel located at 87 Lilac Street. The property owners are Lyndal and Sally Nelson. DRAFT MINUTES Planning & Zoning Board January 8, 2020 Page 5 Board Comments The Board unanimously agreed the road and public utilities should be extended to the west property line at this time. Lot 1 and Lot 2 would then front the new road. Mr. Laden suggested a 30 foot street setback for Lot 3 may be acceptable since older lots along Lilac Street are at 30 feet. Mr. Root supported a possible amendment to City ordinance regarding road right-of-way and setbacks for certain collector and arterial roads. Public Comments Mr. Joe Bonfe, applicant, requested the road and public utilities not be required due to cost. He suggested possibly dedicating an outlot to City for future road right-of-way. He stated his son was possibly going to move into the existing house at 87 Lilac Street and didn't see any issue with relocating the driveway to Mustang Lane. No motion needed for concept plan review. VII. DISCUSSION ITEMS A. Project Updates Staff gave verbal updates to the Board on current City projects. VIII. The applicant is proposing to construct a restaurant with rooftop dining in the existing building. Eagle Liquors currently occupies the north portion of the retail building. The 1.02 acre site is legally described as Lot 3, Block 1, Lino Lakes Market Place. Per the Marketplace Planned Development Overlay (PDO) Design Guidelines Ordinance No. 03-05, substantial departures from the approved plans require an amendment to the ordinance. The Land Use Application is for the following: • Ordinance Amendment to Ordinance No. 03-05 • Site and Building Plan Review This staff report is based on the followings plan sets: • Architectural Plan Set prepared by Jamb Architects dated December 12, 2020 • Color Rendering Elevations prepared by Jamb Architects dated December 12, 2020 • Applicant Narrative prepared by Jamb Architects dated February 3, 2020 ANALYSIS History Lino Lakes Marketplace is a master planned shopping/retail center approved in 2001. The development includes Target and Kohl's, the four Apollo Drive retail buildings as well as those commercial buildings along Lake Drive. Ordinance No. 16-01 and amended by Ordinance No. 03-05 regulates site plan and design guidelines for the development. The design guidelines detail requirements for building composition, materials, lighting, signage, landscaping and building elevations. Per the Marketplace Site Plan, the subject site is the Retail B building. The existing building located at 617 Apollo Drive received administrative site and building plan approval in 2016 and was constructed in 2017. The multi -tenant building is 6,058 sf. Eagle Liquors currently occupies the north portion of the building. Per the Marketplace Planned Development Overlay (PDO) Design Guidelines Ordinance No. 03-05, substantial departures from the approved plans require an amendment to the ordinance. Zoning and Land Use The subject site is zoned GB, General Business with a PDO, Planned Development Overlay as established by Ordinance No. 16-01 and amended by Ordinance No. 03-05 and Ordinance No. 04-05. The building complies with site plan, stormwater management, public utilities and landscaping requirements. The proposed amendment relates to an increase in building height, exterior staircase structure and both ground and rooftop mechanical equipment screening. Site Plan The existing site plan meets the performance standards of the zoning ordinance and the Lino Lakes Marketplace PDO Design Guidelines. StaffComments: Sheet Al.1, Site Plan a. The sidewalk and striped pedestrian crossing across Marketplace Drive as required with construction of the original building shall be completed. b. Landing pad for middle door shall be marked. c. The middle rear door may need to be wider for emergency exit requirements. d. Concrete sidewalk shall be extended from the landing of the exterior staircase to the existing sidewalk. e. Should a fence be installed south of the hood exhaust to provide additional screening? f. Should the fence along the trash enclosure drive be continuous? Grading Plan and Stormwater Management No stormwater management changes are required for the building modifications. The existing site BMPs consist of an infiltration area to the west and an existing infiltration pond to the north for treatment, volume control and rate control. Public Utilities No changes to the public utilities are required. The site is served by an 8" watermain and 8" sanitary sewer line located along Market Place Drive. A 6" watermain line serves the building. These utilities can accommodate the demands of the retail building and proposed restaurant. Landscaping and Tree Preservation Twenty-two (22) deciduous trees and thirty-five (35) shrubs are planted on site which is consistent with the Marketplace Master Landscape Plan. Additional shrubs are proposed along the screen fencing. Architectural Plans and Exterior Building Materials The existing exterior materials consist of CMU, brick, EFIS, glass, metal flashing and an awning. The building fagade has recognizable elements of a base, middle and top, with various building materials and complementary colors. Materials and colors are compliant with the Lino Lakes Marketplace PDO Design Guidelines. The existing building height is 16'0-16'8" to the rooftop, 18'8" to the parapet and 22'4" to the cornice. The proposed restaurant includes ground mounted mechanical equipment with 6 ft cedar, stained fence screening and exterior stair structure. The rooftop includes dining/bar areas, restrooms, stone fire pits, elevator shaft, metal guardrails and mechanical equipment with 6 ft cedar, stained fence screening. Exterior materials include glass, stucco and metal parapet cap flashing to match existing. These materials are compliant with the Lino Lakes Marketplace PDO Design Guidelines. The proposed building height is 17'6" to the rooftop, 29'6" to bar and restroom parapet and 33'2" to elevator shaft parapet. These improvements increase the height of the building in some areas by 11 feet. West (Rear) Elevation Ground mounted mechanical equipment is proposed along the west (rear) elevation of the building. Equipment consists of cooler freezer condensers, makeup air, dishwasher exhaust and hood exhaust. The equipment is shown on the plan sheets as dashed lines behind the screen fences. Per Sheet Al.1, Site Plan, the applicant proposes to install four (4) sections of a 6 ft high stained cedar screen fence adjacent to the rear sidewalk and trash enclosure driveway to screen the equipment. Shrubs are also proposed along the fence. The plan sheet notes that gaps between the fence boards may occur when not using tongue and groove system. The 6 ft tall fence does not completely screen the 9 ft tall exhaust unit. Staff Comments 1. Screen fencing may not block egress paths. 2. Sheet A6.1 under Exterior Elevation Keynote the last #23 shall be revised to #25. 3. Is the proposed 6 ft high stained cedar fence (non -tongue and groove) acceptable? 4. The screen fence shall be high enough to screen the exhaust unit. 5. Should fencing be installed south of the hood exhaust to provide additional screening? 6. Restroom exhaust location and details shall be shown. 7. Dishwasher exhaust location shall be clearly shown. Is it above or into the trash enclosure? 8. Details are required for proposed rooftop fence screening. 9. Is red an acceptable color for the rooftop safety railings? East (Front) Elevation There are no proposed changes to the east (front) elevation of the building. North (Side) Elevation A metal exterior stair structure is proposed to provide to emergency exit from the rooftop. The staircase will egress onto a concrete sidewalk. Per the color rendering, the staircase will be painted red. It is assumed the red matches the existing exterior light fixtures on the building. Staff Comments 1. Is red an acceptable color for the stair structure? 2. Stairway lights and details are required. South (Side) Elevation There are no proposed changes to the south (side) elevation of the building. Staff Comments Sheet A6.0, Existing Exterior Elevations does not accurately show the existing metal overhead door that replaced the glass windows. Are the overhead doors being replaced with glass windows? Parking During the 2016 site plan review and approval, the applicant expressed an interest regarding a restaurant as a possible second tenant. Per the Marketplace Master Site Plan, the subject site was designed for retail only. Thirty (30) parking stalls were required and constructed for this retail parcel. A restaurant would require additional parking spaces. Per the approved 2001 Marketplace Site Plan, parking requirements are as follows: 5 • Retail = (Floor Area/1,000) * 5 spaces • Restaurant = ((Dining Area/1,000) * 10 spaces) + 1 spaces per employee Per City Ordinance No. 09-18, parking requirements for outdoor dining are as follows: • Outdoor Dining = For seating area > 500 sf. 1 parking space per 100 sf outdoor dining area The following chart shows parking calculations based on 10 restaurant employees: 617 Apollo Drive Floor Area (sf) # Stalls Required # Stalls Provided1 Eagle Liquors Retail 2,165 11 Restaurant Restaurant 2,172 32 Rooftop Dining Restaurant 3,298 28 Subtota 4.337 71 75 130 parking stalls currently exist on site. 45 parking stalls are provided through a Commercial Lease Agreement with Discount Tires. As noted, the applicant obtained a Commercial Lease Agreement with Discount Tires to lease 45 parking stalls through March 2058. Per City Zoning Ordinance Section 1007.044(9), Control of Off -Site Parking Facilities is allowed with a recorded long term lease agreement. (9) Control of Off -Site Parking Facilities. When required, accessory off-street parking facilities are provided elsewhere than on the lot in which the principal use served is located, they shall be in the same ownership or control either by deed or long term lease, as the property occupied by such principal use, and the owner of the principal use shall file a recordable document with the City requiring the owner and his or her heirs and assigns to maintain the required number of off- street spaces during the existence of said principal use. Parking requirements are met. It should be noted that City approval of these parking requirements does not supersede any private agreements related to the overall Marketplace development. Signage All signage shall comply with by the Lino Lakes Marketplace PDO Design Guidelines. A separate Sign Permit Application is required for all permanent and temporary signs. IN Comprehensive Plan Resource Management System The Resource Management System Plan goal of preserving surface water quality is supported by the implementation of stormwater management BMP infiltration basins. Land Use Plan The Comprehensive Plan guides the subject site for commercial use. The existing retail business and proposed restaurant is consistent with the designated land use. Housing Plan The goals and policies of Housing Plan are not negatively impacted by existing retail business and proposed restaurant. Economic Development A goal of the Economic Development Plan is to promote Lino Lakes' location within the metropolitan region as an advantage in doing business. The existing retail business and proposed restaurant support this goal. Transportation Plan Goals of the Transportation Plan are to ensure that street and roads are as safe as possible and to reduce unnecessary traffic. The existing retail business and proposed restaurant are accessed via two main driveways off of Market Place Drive and there are no required improvements to these driveways. Market Place Drive is directly accessed either from Apollo Drive or CSAH 23/Lake Drive, an "A" minor reliever road that has capacity for the commercial building. Sanitary Sewer and Water Supply Plan The subject site is served by an 8" sanitary sewer line and an 8" watermain located along Market Place Drive. The public utilities can accommodate the demands of the existing retail business and proposed restaurant. Community Facilities Plan The goals and policies of Community Facilities Plan are not negatively impacted by existing retail business and proposed restaurant. 7 Findings of Fact -Ordinance Amendment Per City Zoning Ordinance Section 1007.015(5), the Planning and Zoning Board shall consider possible adverse effects of the proposed amendment. Its judgement shall be based upon, but not limited to, the following factors: (a) The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The existing retail business and proposed restaurant are consistent with the City's Comprehensive Plan in regards to resource management, land use, housing, economic development, transportation, sanitary sewer and water supply plan and community facilities. (b) The proposed use is or will be compatible with present and future land uses of the area. The existing retail business and proposed restaurant are compatible with present and future land uses. (c) The proposed use conforms with all performance standards contained herein. The existing retail business and proposed restaurant conforms with all performance standards with minor revisions required as noted. (d) The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. The existing retail business and proposed restaurant can be accommodated with existing public services and will not overburden the City's service capacity. (e) Traffic generation by the proposed use is within capabilities of streets serving the property. The traffic generated by the existing retail business and proposed restaurant are within the capabilities of the streets serving the property. Wetlands There are no wetlands located on site. Floodplain The site is not within a floodplain. Stormwater Maintenance Agreement A Declaration for Maintenance of Stormwater Facilities was recorded on January 6, 2017 and includes both the existing retail business and proposed restaurant. Site Improvement Performance Agreement A Site Improvement Performance Agreement is required. RECOMMENDATION Staff requests the following input from the Planning & Zoning Board: 1. Should a fence be installed south of the hood exhaust to provide additional screening? 2. Should the fence along the trash enclosure drive be continuous? 3. Is the proposed 6 ft high stained cedar fence (non -tongue and groove) acceptable? a. For both ground mounted and rooftop screening? 4. Is red an acceptable color for the rooftop metal safety guardrails? 5. Is red an acceptable color for the stair structure? Staff recommends approval of the ordinance amendment and site and building plan review for 617 Apollo Drive with the following conditions and items being addressed: 1. Screen fencing may not block egress paths. 2. Details are required for proposed rooftop fence screening. 3. Details are required for the rooftop metal safety guardrails. 4. Details for stairway lights are required. 5. Sheet T1.1, Title Page: a. Revise title from Eagle Liquors to 617 Apollo Drive. b. Revise parking calculations. 6. Sheet Al.1, Site Plan: a. The sidewalk and striped pedestrian crossing across Marketplace Drive as required with construction of the original building shall be completed. b. The landing pad for middle door shall be marked. c. The middle door may need to be wider for emergency exit requirements. d. A concrete sidewalk shall be extended from the landing of the exterior staircase to the existing sidewalk. 7. Sheet A6.0, Existing Exterior Elevations: a. The plan sheet does not accurately show the existing metal overhead door that replaced the glass windows. i. The booklet and matrix detail compliance of the housing products with the resolutions in regards to exterior materials and styles, house elevations and garage and porch requirements. There are 20 different single family house plans with multiple facade and elevation options for a combination of over 100 different housing styles proposed for the 3rd Addition. The townhome products also meet the architectural design standards. Color packages and anti -monotony plans will be included with each building permit application to ensure that the homes elevations are varied with a minimum of five different styles and those homes in proximity to each other not look alike in terms of the combination of color of siding, accent and roofing materials. Coventry by Alside vinyl siding with .042" panel thickness is proposed on all the housing units. All houses have minimum 4" window trim on the side and 3 rear elevations to meet resolution requirements to incorporate an architectural feature into those elevations that are visible from 20" Avenue (CSAH 54), 215t Avenue N. and the public park. In summary, the Watermark 3rd Addition single family housing types and products and townhomes meet the architectural design standards requirements of Resolution No. 17-133 and Resolution No. 19-131. Landscaping The Watermark 3rd Addition Site Landscape Plan has been reviewed by staff and is consistent with the PUD Development Stage Landscaping Plan. The Environmental Coordinator Memo dated February 27, 2020 notes some minor comments such as seed mix types, clear vision areas and planting details. The Watermark Open Space Maintenance Plan has been revised to reflect correct seed mixes and management plan. Staff will be meeting with Lennar and Prairie Restorations, Inc. to determine the best practices for implementing this plan. Subdivision Ordinance Conformity with the Comprehensive Plan and Zoning Code The Watermark 3rd Addition final plat has been reviewed for compliance with the comprehensive plan, zoning and subdivision ordinance. The proposed final plat meets the performance standards of the subdivision and zoning ordinance and is consistent with the PUD Development Stage Plan/Preliminary Plat and Final Plan. Sidewalk is being installed along Crane Drive and Watermark Way as required. Public Land Dedication and Fees As approved with Resolution No. 16-51, the City will require the following combination of land dedication and cash is lieu of land dedications: Land dedication for the public and private parks will be credited from the total payment in lieu. 5 2. Costs for public park improvements and trail construction will be credited from the total payment in lieu. 3. Improvements to the private parks and recreational center will not be credited from the total payment in lieu. In the 3rd Addition, an 8.5 ft wide bituminous trail will be constructed 1,2001f along the eastern berm. A Permanent Trail Easement was recorded in March 2019 that includes this trail section. A 10 ft wide bituminous trail will be constructed 1,000 if along CSAH 54 (20d' Avenue) within Outlot A. A Permanent Trail Easement with Description Sketch has been drafted; however, there is a trail section from the townhome neighborhood to the south property line that needs to be included in the easement and Trail Construction Plan Sheet 27. Park dedication fees will also be credited for the private park land platted as Watermark, Outlot K and Outlot I. These are the private parks in the Discovery neighborhood near Crane Drive and the tot lot in the townhome neighborhood. Per the Master Developer Agreement (MDA), the park dedication fees are based on an appraisal of fair market value. An appraisal was prepared in December 2018 by Insight Realty Advisors, Inc. and forwarded to Lennar for their review. The final values will be reflected in the Council staff report and 3rd Addition Development Agreement. Lennar stated the tot lot and play equipment in the townhome neighborhood will be developed in 2020. Per Resolution No. 16-51, credit will not be given for theses private park improvements. The 3rd Addition Landscape Plans shall include details from the Overall Landscape Plan detailing the tot lot site plan, landscaping and equipment. The delineation identified 28 wetlands totaling approximately 20 acres in size. The original approved WCA Sequencing 2 Application proposed wetland impacts, wetland creation, wetland restoration and upland buffer establishment. In April 2018, the developer revised the application to purchase 3.3671 acres of wetland banking credits as the proposed compensatory mitigation action. The wetland fill, impacts and mitigation (wetland bank credits) occurred within the Phase I grading limits and are complete. The establishment of the greenway corridor including wetlands, trails and open space on the north end of the Watermark development is a critical component of the project and will be developed in future phases. The Master Development Agreement details the timing, establishment and management of that corridor. An Open Space Easement has been dedicated over outlots containing wetlands, open space, stormwater ponds, berms etc. The Watermark 3rd Addition Final Landscape Plan details the location of required "Protected Open Space Area" signs. A Conservation Easement and Declaration establishing wetland buffer (both favor of RCWD) have been recorded over Wetland 17 (Outlot G, Preliminary Plat) as required by RCWD. When the lots abutting this buffer are graded in the future, these signs will be located along the rear lots lines. Development Agreement Master Development Agreement A Master Development Agreement was recorded in March 2019. The Agreement covers the entire 372 acre site and details the terms and conditions of City approvals, the Development Plans, the required public and private improvements as part of the first and subsequent phase, the standards for the timing and financing of the improvements, required HOA documents and the terms of payment. Development Agreement and Planned Unit Development Agreement The City will also require our standard Development Agreement specific to each phase of development. This agreement further details required improvements and securities. The City Engineer will draft this Agreement and it shall be approved by the City Council. Homeowner's Association (HOA) Prior to release of the final plat mylars, Lennar shall submit to the City the applicable HOA documents and annexation amendments. The City Attorney shall review and comment prior to recording. Title Commitment The City Attorney is reviewing the title commitment and final plat. Any comments shall be addressed prior to release of the mylars. 7 Stormwater Maintenance Agreement A recorded Declaration for Maintenance of Stormwater Facilities between RCWD and Lennar covers Ponds 100, 200, 300 and 20. These stormwater facilities and Pond 400 will be eventually covered under the City's Programmatic Stormwater Management Agreement after they have been installed and accepted by the City A recorded stormwater declaration is required for the private facilities in the townhome area. The current declarations include additional facilities that in the future will be covered by the City's Programmatic agreement in the future. RECOMMENDATION Staff recommends approval of the Watermark 3rd Addition PUD Final Plan/Final Plat subject to the following conditions: 1. The 3rd Addition Development Agreement shall be approved by the City Council, executed and recorded against the property. a. The Development Agreement will include park dedication credit for the platted private parks, Outlot K and Outlot I, Watermark. 2. The title commitment shall be reviewed by the City Attorney prior to the release of the final plat mylars. 3. The City Attorney shall review and approve the applicable Watermark Homeowner's Association (HOA) documents prior to release of the final plat mylars. a. All applicable HOA documents shall be amended to include the revised Open Space Maintenance Plan. 4. A copy of the recorded deed for Outlot A shall be submitted to the City. 5. A copy of the recorded Permanent Trail Easement with Description Sketch for the trail on Outlot A and Townhome Neighborhood shall be submitted to the City. 6. A separate fence permit is required for the fencing along CSAH 54 (201h Avenue). The following comments shall also be addressed: 1. Comments: 1. Rear yards with less than 2% grade between Johanna Circle and Itasca Circle have not been updated in the latest grading plans revised December 13, 2019.
