City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. Motion was supported by Mr. Laden. Motion carried 3-0. VI. ACTION ITEMS A. PUBLIC HEARING: Nadeau Acres Rezoning and Preliminary Plat Ms. Larsen, City Planner, presented the staff report. DRAFT MINUTES Planning & Zoning Board January 8, 2020 Page 2 The applicant, BL Holdings, LLC, submitted a rezoning and preliminary plat land use application for Nadeau Acres. The proposed residential development is a 69 single family lot subdivision located north of CSAH 34 (Birch Street) and west of CSAH 54 (20th Avenue) across from NorthPointe. It contains two (2) parcels totaling approximately 33 gross acres. The applicant is proposing an R-1, Single Family Residential development on standard 80 foot wide lots. Board Comments Mr. Laden asked about park access and transportation level of service. Ms. Larsen stated a future park to the west is programmed for the area. The closest existing park is NorthPointe Park. Staff would consult with Anoka County regarding a possible cross walk across 201h Avenue. Level of service information was detailed in the staff report. Ms. Peacock also asked about park access. Mr. Root asked about park dedication fees and park access. He also asked about south driveway relocation for 6709 201h Avenue. Ms. Larsen noted the relocation is required due the extension of Red Oak Lane and the applicant would work with the property owner to relocate the existing driveway to the west. The Public Hearing was opened at 7:00 P.M. q Public Comments Christa Weber, 6709 201h Avenue, expressed concerns about having to relocate the driveway behind house to avoid the median on Red Oak Lane. She also inquired about future turn lanes on 20th Avenue and where that land would come from. Jim Nelson, 6747 20t" Avenue, is not happy about the proposed development and read a letter expressing the following concerns: 1. NorthPointe development has caused flooding of property. 2. Will existing houses be required to hook up to municipal services? 3. Why are some of the retaining walls being removed? 4. Where will run-off from stormwater pond go? 5. There should be access to Birch Street. 6. Filling in wetlands does not support goal of protecting natural environment. 7. How is stubbing in road 6 feet higher than his property compatible with adjacent properties? 8. Pond 400 drains into an existing channel that is already full. 9. Headlights will shine into his bedroom windows. 10. He spoke with RCWD and they are only concerned about on -site drainage within the development boundaries, not what is already happening down stream. David Vickers, 6756 Centerville Road, asked who will be responsible for maintaining the stormwater run-off across his property to the private ditch. DRAFT MINUTES Planning & Zoning Board January 8, 2020 Page 3 Julie McNeely, 6687 20 h Avenue, asked if Outlot C provided access to her property and inquired about drainage, wetland fill and high ground water. Larry Olson, BL Holdings, LLC, 7567 162" d Avenue NE, Columbus, MN 55025, stated they will certainly work with residents and staff to address concerns. Mr. Laden encouraged applicants to have pre -development neighborhood meetings. Mr. Vickers noted concern with pre -development neighborhood meetings is that residents do not know City requirements and they are only hearing from developer. Kristine Swanson, 6737 201h Avenue, asked what recourse there is if stormwater plans do not work. Mr. Laden made a MOTION to close the Public Hearing at 7:19 P.M. Motion was supported by Ms. Peacock. Motion carried 3-0. Staff Comments 1. No median is proposed on Red Oak Lane so driveway relocation shouldn't be an issue. 2. Turn lanes will be constructed within the existing road right-of-way obtained with the minor subdivision of 6709 201h Avenue. 3. Existing houses are not required to hook up to municipal services. 4. Staff is recommending removal of retaining walls with more gradual grade changes where possible. 5. Access to Birch Street is not consistent with the Birch Street Corridor Study or Anoka County access management requirements. 6. The existing wetlands are not high quality wetlands or an integral part of the City's wetland management corridor. The wetlands are being mitigated in compliance with Minnesota Wetland Conservation Act. 7. Staff will review evaluate existing drainage issues in the area. 8. Staff will evaluate the possibility of planting coniferous trees at the north end of Heritage Avenue. 9. Outlot C does provide direct access to 6687 201h Avenue. 10. Site grading, drainage ways and storm sewer pipes direct stormwater to pond areas and not on to adjacent sites. 11. Stormwater maintenance agreements are required detailing responsibility of maintenance of facilities. Mr. Laden made a MOTION to approve the Nadeau Acres rezoning and preliminary plat with conditions noted in the staff report. Motion was supported by Mr. Root. Yeas: Laden and Root; Nays: Peacock. PUBLIC HEARING: Conditional Use Permit For Building Within Floodplain, 7020 West Shadow Lake Drive Ms. Kelsey Gelhar, WSB City Engineer, presented the staff report. The applicant, Leslie Schuhbauer, is proposing to build a home at 7020 West Shadow Lake Drive. A conditional use permit is required for building within the floodplain using alternative elevation methods. The parcel is approximately 0.31 acres. Board Comments Mr. Laden asked if the crawl space is intended to flood, if the vents open automatically and if storage is allowed. Ms. Peacock asked if construction on stilts or fill is more aesthetic. Mr. Root asked what the crawl space floor elevation was and if plantings are allowed near vents. The Public Hearing was opened at 8:17 P.M. Public Comments Leslie Schuhbauer, 1558 Simpson Street, St. Paul, MN 55108, introduce herself to the Board. She had no other comments. Mr. Laden made a MOTION to close the Public Hearing at 8:18 P.M. Motion was supported by Ms. Peacock. Motion carried 3-0. Staff Comments 1. Ms. Gelhar noted the crawl space is intended to flood, the vents open automatically and storage is allowed. Habitable space is not allowed. 2. The low floor elevation is 885 and the vents are at approximately 887. Pumps would be used to pump out water if necessary. 3. Landscape plantings should not be located near vents. Ms. Peacock made a MOTION to approve the 7020 West Shadow Lake Drive conditional use permit. Motion was supported by Mr. Laden. Motion carried 3-0. C. Concept Plan Review for 87 Lilac Street Ms. Larsen presented the staff report. The applicant, Bonfe Builders, submitted a land use application for Concept Plan Review. The proposed development is a 4 lot residential subdivision of a 1.62 acre parcel located at 87 Lilac Street. The property owners are Lyndal and Sally Nelson. DRAFT MINUTES Planning & Zoning Board January 8, 2020 Page 5 Board Comments The Board unanimously agreed the road and public utilities should be extended to the west property line at this time. Lot 1 and Lot 2 would then front the new road. Mr. Laden suggested a 30 foot street setback for Lot 3 may be acceptable since older lots along Lilac Street are at 30 feet. Mr. Root supported a possible amendment to City ordinance regarding road right-of-way and setbacks for certain collector and arterial roads. Public Comments Mr. Joe Bonfe, applicant, requested the road and public utilities not be required due to cost. He suggested possibly dedicating an outlot to City for future road right-of-way. He stated his son was possibly going to move into the existing house at 87 Lilac Street and didn't see any issue with relocating the driveway to Mustang Lane. No motion needed for concept plan review. VII. DISCUSSION ITEMS A. Project Updates Staff gave verbal updates to the Board on current City projects. VIII. PUBLIC HEARING: Ordinance Amendment for Site Plan and Building Modifications for 617 Apollo Drive Ms. Larsen, City Planner, presented the staff report. The applicant, Sergei Nazarenko, submitted a Land Use Application for an Ordinance Amendment for site plan and building modifications at 617 Apollo Drive. The applicant is proposing to construct a restaurant with rooftop dining in the existing building. Eagle Liquors currently occupies the north portion of the retail building. The 1.02 acre site is legally described as Lot 3, Block 1, Lino Lakes Market Place. Per the Marketplace Planned Development Overlay (PDO) Design Guidelines Ordinance No. 03-05, substantial departures from the approved plans require an amendment to the ordinance. The proposed amendment relates to an increase in building height, exterior staircase structure and both ground and rooftop mechanical equipment screening. Board Comments Mr. Root commented on the type of material use to screen the ground mechanical equipment. He suggested a block wall be installed rather than the proposed 6ft stained cedar fencing. Mr. Root commented on the color of exterior staircase. He suggested a more neutral color for the staircase as opposed to the proposed red. Mr. Root questioned if there would be enough parking spaces in the lot. Mr. Evenson suggested the proposed 6ft cedar fencing be raised to 9ft so that it would be high enough to screen any exhaust. Mr. Evenson concurred with Mr. Root's proposal for a more neutral color for the staircase. Mr. Tralle liked the idea of a block wall to screen the ground mechanical equipment. He wondered if the screen, whether a fence or block wall is used, would prohibit the airflow to the cooling condenser. In addition, he proposed that the fence along the trash enclosure drive be continuous. Mr. Tralle thought the red color of the rooftop safety railings and the staircase was fine. Mr. Tralle stated if there is concern over the number of parking spaces in the lot it would be addressed by the business. Mr. Tralle, Mr. Evenson, and Mr. Root thought the proposed additional screening south of the hood exhaust was not necessary. Staff recommends approval of the Ordinance Amendment subject to conditions listed in the staff report. Chair Tralle declared the Public Hearing open at 7:02 P.M. DRAFT MINUTES Planning & Zoning Board March 11, 2020 Page 3 Public Comments Jerry Anderson, JAMB Architects representing Muddy Cow and the owner of the building, was open to the idea of installing either a fence or block wall to screen the ground mechanical equipment. He was not opposed to raising the height of the screen to 9ft. He maintained a neutral stance regarding the color of the railings and exterior staircase. However, he stated that the owner would prefer the staircase remain red. He also emphasized that the concern over the parking spaces was a non -issue. Andrew Schmitz, partner of 617 Apollo Drive Muddy Cow, was present. Mr. Root made a MOTION to close the Public Hearing at 7:17 P.M. Motion was supported by Mr. Evenson. Motion carried 3-0. Mr. Root made a MOTION to recommend approval of the Ordinance Amendment for Site Plan and Building Modifications with the conditions that the screening of the ground mounted mechanical equipment be a block wall and that the exhaust section be raised to 9 feet. In addition, the materials and colors used should match the rest of the building. Motion was supported by Mr. Evenson. Motion carried 3-0. B. Watermark 3rd Addition PUD Final Plan/Final Plat Ms. Larsen, City Planner, presented the staff report. Watermark is a 372 acre master planned residential community consisting of 692 single family lots and 172 townhome units totaling 864 housing units. Lennar submitted a Land Use Application for Watermark 3rd Addition PUD Final Plan/Final Plat. The plat proposes 96 single family lots, 79 townhome lots and 1 outlot. Staff recommends approval of the Watermark 3rd Addition PUD final plan/final plat subject to conditions listed in the staff report. Mr. Evenson made a MOTION to recommend approval of the Watermark 3rd Addition PUD final plan/final plat. Motion was supported by Mr. Root. Motion carried 3-0. VII. DISCUSSION ITEMS A. The original PUD Development Stage Plan/Preliminary Plat was approved by City Council on April 8, 2019 by Resolution No. 19-42. The original plans included a centrally located stand-alone clubhouse. The clubhouse is now being omitted in order to enlarge the stormwater pond. This staff report is based on the following submittal documents: • PUD Amendment Narrative prepared by Lyngblomstem dated March 9, 2020 • Revised Site Plan and Grading Plan prepared by AJA Associates, Inc. dated December 31, 2019 • Stormwater Management Report prepared by AJA Associates, Inc. revised February 28, 2020 ANALYSIS The April 8, 2019 Council Staff Report, Ordinance No. 07-19 and Resolution No. 19-42 detail the project's compliance with the Comprehensive Plan, Master Planning Study - Hodgson Road & CR J and Subdivision Ordinance. Ordinance No. 07-19 rezoned the property to PUD, Planned Unit Development in order to implement the goals of the Master Planning Study. The Ordinance details permitted, accessory and conditional uses allowed within the development. Resolution No. 19-42 approved the PUD Development Stage Plan/Preliminary Plat that includes the preliminary plat, site plan, grading & drainage plans, utility plans, landscaping plans, architectural building elevations etc. The resolution also establishes the development's framework in regards to lot and yard requirement, height regulations, impervious surface coverage and design guidelines. The amendment is to the site plan and grading & drainage plan of the PUD Development Stage Plan. If approved, all plans sheets of the PUD Development Stage Plan and Preliminary Plat will be revised to reflect the amendment and other comments listed in Resolution No. 19-42. The applicant will then submit PUD Final Plan/Final Plat for Council approval. Original Site Plan and Grading & Drainage Plan Overview Site Plan Resolution No. 19-42 approving the PUD Development Stage Plan/Preliminary Plat included an overall general site plan and grading & drainage plan of the 20 acre development. Per the original site plan, Lyngblomsten is proposing a 3 phased approach to redevelopment of 6 parcels totaling 20 acres located in the northwest quadrant of CSAH49 (Hodgson Road) and CR J (Ash Street). • Phase 1 is the senior living community consisting of the following housing options: Cottage Homes = 20 units Senior Living Campus o Independent Living = 100 units o Assisted -living = 50 units W o Skilled NursingFacility acility = 48 units o TOTAL UNITS = 218 total units The market rate cottage homes are 1,400 sf single level cottages with 2 bedrooms and an attached 2 1 ' x 2 1 ' garage. The senior living community independent and assisted -living units are market -rate and mid -range in price with a variety of 1- and 2-bedroom units and heated underground parking. The community also includes complementary campus amenities such as a Life Enrichment Center (2°d Half Lyngblomsten), main floor town center with bistro style or fine dining, a pub, cinema, chapel, fitness center and gift shop. The development also includes a 4,600 sf club house with game room, kitchen and lounge. Phase 2 is a stand-alone 6,000 sf restaurant with outdoor patio Phase 3 is future commercial development The senior living community and restaurant are located on one existing 17 acre parcel. The future commercial development will be a redevelopment of the remaining 5 parcels (3 acres) which is currently occupied by an insurance business, vacant liquor store and recently demolished 49 Club. Grading & Drainage Plan Per the original Storm Water Management Report prepared by Anderson -Johnson Associates dated March 11, 2019, rate control is being accomplished using a combination of a dry pond and a storm water treatment pond. The proposed rate is less than 80% of the existing rate of runoff. Water quality treatment is accomplished at the single stormwater treatment pond. True infiltration was considered during the design phase, but several factors contributed to not pursuing infiltration practices. First, shallow groundwater exists on site. Secondly, the site has been maximized and there is not adequate space for effective infiltration practices. Instead, a stormwater pond was to be constructed. The stormwater pond, in addition to providing rate control, has been sized to provide adequate dead storage to meet water quality requirements. Finally, an irrigation pumping station will be constructed at the stormwater pond to draw water from the pond to irrigate the surrounding areas. The clubhouse was strategically located adjacent to the landscaped stormwater pond as a site amenity. Proposed PUD Amendment #1 to Site Plan and Grading & Drainage Plan The amendment proposes to omit the stand-alone clubhouse and associated parking lot and expand the size of the stormwater pond. Per the applicant's March 9, 2020 PUD Amendment Narrative: "The following changes have been made to the original PUD Application: • Rice Creek Watershed District's (RCWD) sent comments to the design team on 4/12/2019, regarding the proposed pond. The normal water level (NWL) of the pond was questioned by both RCWD and the city of Lino Lakes due to high groundwater table. Lyngblomsten hired Braun Intertec in April of 2019 to monitor the site's groundwater. We discussed these findings with the city, and as the result, had to propose addition site storage to satisfy RCWD's comments. There are two options to accommodate the additional stormwater storage: o A second pond would be required. However, the location of the second pond would have to be in the commercial parcel, limiting the developable land and restricting how much development could occur on the commercial parcel. The city has long seen this intersection as the gateway to Lino Lakes and the neighborhood oriented commercial amenities have been consistently identified by the neighborhood and city leadership as one of the major benefits of this project. o Therefore, in lieu of the second pond, we are proposing adding the capacity to the current central pond to accommodate additional impervious surface, including the 3+ acre corner lot, purchased after the original PUD application. In doing so, the pond's size increased significantly and would need to consume the area previously allotted for the Clubhouse and its associated parking lot. The development and design team have successfully included all of the amenities from the Clubhouse into the Town Center of the main senior living building. o In the proposal presented to the neighborhood group in August of 2018, the amenity and administrative spaces within the Clubhouse was approximately 4,450 square feet. The Town Center at the time was approximately 10,200 square feet. o In the final construction documents, our Town Center is 18,185 square feet. This additional 8,000 square feet of common and amenity space more than makes up in both size and function for the loss of the Clubhouse space. The Town Center is designed to welcome the neighborhood beyond our immediate live-in residents. Some of the additional amenities include: ■ A vendor space for outside vendors like service dog or banking organizations 2 ■ Additional space to accommodate a community based Adult Day program ■ Larger multi -purpose room, available for larger events like concerts and community meeting space ■ Larger lap pool for water exercise classes ■ A larger Wellness Center ■ A larger Salon with capacity for nail care ■ Designated spaces for a 50-seat formal dining, 25-seat informal dining (caf6), 57-seat indoor/outdoor pub, and a 16-seat party room." The District Engineer finds the revised grading and stormwater management plans compliant with RCWD rules. In general, the rest of the overall site plan and building layout remains the same. The number of housing units is still 218. Some notable changes include: • The northeast cul de sac in the private road in the cottage home neighborhood was flipped to the south allowing the cottage homes pads to be slightly adjusted but the number remains 20 units. • The northwest parking stalls have been moved to the end of the cul de sac. • The applicant purchased 275 Ash Street and the main public road will now align with St. Albans Street to the south as supported by Resolution No. 19-42. • Joint parking facilities and shared driveways were incorporated into the commercial area as required. A final detailed site plan review will be completed upon submission of the PUD Final Plan/Final Plat. The intent of PUD Amendment is to obtain Council approval of omitting the clubhouse and enlarging the stormwater pond before the applicant moves forward on final plans. RECOMMENDATION Staff recommends approval of the Lyngblomsten PUD Amendment #1 to omit the clubhouse and revise the site plan and grading & drainage plan subject to the following conditions. 5 1. There are four main stormwater management systems proposed with the project: • Storm sewer system for surface water to drain into the proposed BMPs • Groundwater lift station to address high groundwater on the site • Stormwater lift station to address surface flow into the underground parking garage area • Draintile gravity system to alleviate groundwater around the proposed main building Storm Sewer System The storm sewer system will drain surface water from storm events and drains into two BMPs, a dry basin (4P) and a stormwater pond (3P). The project proposes approximately 12.5 acres of impervious surface, and the proposed stormwater pond dead pool volume exceeds the required treatment volume for the site. Additionally, the hydroCAD models submitted show the runoff rates for the site meet existing rates, which meets the City requirements. Groundwater Lift Station The proposed lift station plans will be developed by Braun for the final plat plans and report. The flow values from the proposed lift station will not be regulated by the City's stormwater management rate control regulations. However, the final plat must show there are no adverse impacts to the proposed site as a result of the proposed groundwater levels and discharge rate from the pumped system into the stormwater system. Stormwater Lift Station and Holding Tank There are approximately 0.6 acres of area proposed to be drained into the underground parking garage. The drainage will be captured by a trench drain at a low point in the garage entrance, and then the water will be stored in a holding tank and pumped into the proposed storm sewer system and ultimately into the proposed stormwater pond. The HydroCAD model submitted by Andesron Engineering shows the 5 proposed holding tanks that have a capacity of 2,000 gallons each. Total they provide the volume capacity to hold the 100-year storm event in the case of pump failure. Draintile Gravity System The draintile gravity system is proposed to encompass the entire building perimeter as shown on C1.42. This system is proposed to outlet into the existing ditch system,and will not be routed through the storm sewer. Our understanding is that this discharge location is to prevent water levels in the pond from backing up into the draintile system. Per WSB Engineering letter dated September 24, 2019, new impervious area from the site is routed to the west towards West Shadow Lake Drive, the north into an existing wetland area, and the east to Reshanau Lake. The new impervious surface is less than 10,000 square feet, and all runoff from new impervious will run over a pervious surface prior to leaving the site, therefore no water quality treatment will be required as a result of the additional impervious surface from the single-family residential development. A side yard drainage way has been between the existing and proposed home. A minimum 20 foot wide vegetated shoreline buffer has been provided as a stormwater management best management practice (BMP) to minimize runoff pollutants from entering the lake. Utilities Sanitary Sewer A 3" sanitary sewer force main is being installed along West Shadow Lake Drive. The existing house shall hook up upon availability. The new house shall hook-up upon construction. The existing septic drain field shall be removed. Watermain al An 8" DIP watermain is being installed along West Shadow Lake Drive. The existing house shall hook up upon availability. The new house shall hook-up upon construction. The existing well may be used for irrigation only or shall be properly capped and abandoned. Public Land Dedication The City will require cash in lieu of land dedication for the new lot. The lot with the existing house will not be charged a park dedication fee. Park Dedication Fees Total # of Lots = 1 x 2020 Park Dedication Fee $3,150 = Total Due $3,150 Tree Preservation The goal of tree preservation is to minimize unnecessary loss of habitat, biodiversity and forest resource and to replace removed trees in areas where tree cover is most critical. Sheet 4, Tree Inventory/Removals identifies 46 significant trees on the entire site and 8 of these trees will be removed. Of those 8 trees, 7 of the trees are within the basic use area of the house pad and driveway and mitigation is not required. The other 1 tree is being removed in order to construct the FEMA floodplain mitigation basin. The remaining 38 trees provide open space mitigation requirements, prevent erosion control and provide shoreland aesthetics. No further tree mitigation is required. Landscaping Canopy cover, foundation landscaping, and buffer and screens are not required for the 2 lot residential subdivision. Open Area Landscaping The proposed FEMA floodplain mitigation basin is approximately 600 sf. This would require 1 large tree and 3 large shrubs. The remaining 38 trees and existing shrubs on site satisfy the open area landscape requirements. No further landscaping is required. Boulevard Trees Boulevard trees are required at the rate of 1 tree per lot frontage for singly family lots. This would require 2 boulevard trees. Both Lot 1 and Lot 2 contain existing trees in the front yard that serve as boulevard trees. No additional boulevard trees are required. 5 Sod and Ground Cover All disturbed areas shall have appropriate ground cover in accordance with Section 1007.043(17)(h). This includes the existing driveway turn around being removed. Shoreline Buffer Zone Reshanau Lake is an impaired, recreational development lake and efforts to protect and improve the natural resource should be implemented with any development. A native vegetated shoreline buffer will be required as a stormwater management best management practice (BMP) to minimize runoff pollutants from entering the lake. The buffer will also help stabilize the shoreline, reduce erosion and support aquatic plants and wildlife. An average 20 foot wide but no less than 10 foot minimum wide native vegetated buffer zone extending from the shoreline shall be installed and maintained on both Lot 1 and Lot 2. As recommended by the Planning & Zoning Board, a 20 foot wide access opening to the lake is allowed. A landscape plan with buffer plantings has been submitted. A maintenance plan shall be submitted. Wetlands A Wetland Delineation Report was completed by Jacobson Environmental, PLLC on August 2, 2019. A WCA Notice of Decision approving the wetland delineation was issued by RCWD on September 16, 2019. Three (3) basins were delineated. Basin 1 is 0.016 acres and Basin 2 is 0.024 acres. Both are located within the rear yard of Lot 1. Basin 3 is 0.008 acres and is adjacent to the Reshanau Lake shoreline on both Lot 1 and Lot 2. No wetland impacts are proposed. Per RCWD, Rule F is not triggered; therefore, no WMC wetland buffers are required. A drainage and utility easement 10 feet above the delineated wetland is provided. Floodplain The 2015 DFIRM indicates Zone AE floodplain on both Lot 1 and Lot 2. The FEMA base flood elevation (BFE) is 887. Per Sheet 6, CLOMR-F Exhibit, the applicant is proposing 38 cy of floodplain fill and 39 cy of compensatory storage. The applicant has submitted a CLOMR-F application to the City for review to revise the floodplain map. This application shall be submitted to FEMA for approval. A LOMR-F shall be approved by FEMA as well. It should be noted that any future proposed structures such as accessory structures shall meet the floodplain ordinance requirements. Shoreland Management Overlay The general purpose and intent of the Shoreland Management Overlay ordinance is to protect public waters. Per the ordinance Policy statement, the uncontrolled use of shorelands of the city affects the public health, safety and general welfare not only by contributing to pollution of public waters, but also by impairing the local tax base. Con Therefore, it is in the best interests of the public health, safety and welfare to provide for the wise subdivision, use and development of shorelands of public waters. As discussed, the site is located in a Shoreland Management Overlay district of Reshanau Lake. This lake is a classified as a Recreational Development Lake and has an 883.5 OHWL elevation. The required OHWL setback for both Lot 1 and Lot 2 is 75 feet for sewered lots. The proposed setback on Lot 1 is 87.6 feet and is compliant. The current setback from the existing house on Lot 2 is 73.5 feet. The house is considered legal non- conforming. Per Section 1102.87(1)(c)4, impervious surface coverage on each lot must not exceed 30%. Sheet 2, Preliminary Plat notes impervious surface coverage for Lot 1 = 18.0% and Lot 2 = 19.8%. Both meet the allowed 30% impervious surface coverage of the shoreland ordinance. A native vegetated shoreline buffer is provided as a stormwater management best management practice (BMP) to minimize runoff pollutants from entering the lake. An average 20 foot wide drainage and utility easement is dedicated on the plat along the shoreline to create and protect the buffer. Impervious Surface Coverage Per the Site Drainage Narrative prepared by Plow Engineering, Inc. dated September 13, 2019, the overall total site impervious surface coverage is as follows: Impervious Surface Coverage Total Parcel Size 0.98 acres Existing Impervious 0.16 acres (16%) Proposed Impervious 0.20 acres (21 %) Comprehensive Plan Stern Addition is consistent with the goals and policies of the comprehensive plan in regards to resource management, land use, housing, transportation and utilities as detailed with approval of the preliminary plat. The proposed net density of 2.20 units per acre is consistent with the Comprehensive Plan. Development Agreement A Development Agreement has been drafted by the City and shall be executed and recorded by the developer. Title Commitment The City Attorney shall review and comment on the title commitment and final plat. The title commitment shall be updated. Stormwater Maintenance Agreement The stormwater maintenance of this subdivision will be covered under the City's Programmatic Maintenance Agreement. FINDINGS OF FACT -FINAL PLAT The Planning and Zoning Board shall consider the final plat and the Community Development Department shall forward the Planning and Zoning Board N. recommendations to the City Council. The following requirements shall be met before consideration of the final plat by the Planning and Zoning Board: 1. The final plat shall substantially conform to the approved preliminary plat and phasing plan. The final plat substantially conforms with the preliminary plat. 2. For plats that consist solely of individual single family residential lots, final plat applications for subsequent phases shall not be approved until building permits have been issued for 40% of lots in the preceding phase. This division applies only when the preceding phase consists of 40 or more lots; and This is a two (2) lot single family residential subdivision and will he platted in one (1) phase. 3. Conditions attached to approval of the preliminary plat shall be substantially fulfilled or secured by the development agreement, as appropriate. The conditions of the preliminary plat have been substantially fulfilled. Securities will be required with a Development Agreement. RECOMMENDATION Staff recommends approval of the final plat for Stern Addition subject to the following conditions: 1. The existing septic system and private well on Lot 2 shall be properly removed, sealed and approved by the City prior to the issuance of a single family home building permit on Lot 1. 2. The existing house on Lot 2 shall hook up to municipal utility services upon availability. 3. The new house on Lot 1 shall hook-up to municipal utility services upon construction. The following comments shall be addressed: 1. Any comments from the City Engineer letter dated March 31, 2020 shall be addressed. 2. Any comments from the Environmental Coordinator letter dated March 31, 2020 shall be addressed. 3. The title commitment shall be updated within 3 months prior to Council approval of final plat. 4. Recommend low maintenance fescue (such as Mn/DOT 25-131) between the two restoration shoreland buffer areas. 3. The DNR standards for shoreland should be applied, including minimizing vegetation loss, and a buffer from the lake that must average 20 feet. Landscaping in this area would exclude sod -type grasses that are mowed. The property owner should submit a planting plan for alternative ground cover in this area. This could consist of native forbs and grasses, or where there are existing trees, a shade tolerant woodland seed mix, or alternative no -mow lawn. The fence may have to be relocated from what is shown on the plan to allow for work related to the Basin/FEMA mitigation area. 0 Page 2 PLANNING & ZONING BOARD AGENDA ITEM 6C STAFF ORIGINATOR: Michael Grochala, Community Development Director P & Z MEETING DATE: April 8, 2020 REQUEST: Recommendation Supporting Federal Funding Application for Main Street (CSAH 14) Multi -Purpose Trail APPLICANTS: City of Lino Lakes BACKGROUND The Transportation and Park components of both the City's 2030 Comprehensive Plan and the draft 2040 plan include a proposed extension of the Central Anoka County Regional Trail along Main Street (CSAH 14). The trail is proposed to ultimately extend from our eastern border with the City of Hugo to the City of Ramsey on Anoka County's western border. Over 16 miles of the planned 26 miles have been constructed county wide. Portions of the trail, within Lino Lakes, have been constructed over the past 15 years as part of County Highway projects. The latest segment, completed in 2013, extended the trail over 35W from the Chain of Lakes Regional Park. Providing access to the Regional Park and expanding multi -use trail access to the City's north side continues to be a priority goal for the City. In 2016, the City partnered with Anoka County to seek federal funding for the segment of trail between Lino Lakes Elementary and the 35W overpass. While unsuccessful, the application was an important first step in programing the future extension of the trail system. Every two years, the Regional Solicitation distributes federal transportation funds to locally initiated projects that meet regional transportation needs. The 2020 Solicitation process is now open and accepting applications through May 15, 2020. The City is again partnering with Anoka County to submit an application for consideration under the Multiuse Trails and Bicycle Facilities category. Staff is still in the process of updating cost estimates. The 2016 application estimated a total cost of $1,100,000. If successful, federal funding would cover 80% of the project cost. The City and County would split the remaining share. RECOMMENDATION Staff is requesting a motion from the board recommending support of the federal funding application. ATTACHMENTS 1.
