PLANNING & ZONING BOARD MEETING
I. CALL TO ORDER AND ROLL CALL:
Vice Chair Root called the Lino Lakes Planning and Zoning Board meeting to order at
6:30 P.M. on February 12, 2020.

The Agenda was approved as presented.
IV. APPROVAL OF MINUTES
Ms. Peacock made a MOTION to approve the January 8, 2020 meeting minutes. Motion
was supported by Mr. Laden. Motion carried 3-0.
V. OPEN MIKE
Vice Chair Root declared Open Mike at 6:32 P.M.
There was no one present for Open Mike
Ms. Peacock made a MOTION to close Open Mike at 6:33 P.M. Motion was supported
by Mr. Laden. Motion carried 3-0.
VI. ACTION ITEMS
A. PUBLIC HEARING: Nadeau Acres Rezoning and Preliminary Plat
Ms. Larsen, City Planner, presented the staff report.

The applicant, BL Holdings, LLC, submitted a rezoning and preliminary plat land use
application for Nadeau Acres. The proposed residential development is a 69 single family
lot subdivision located north of CSAH 34 (Birch Street) and west of CSAH 54 (20th
Avenue) across from NorthPointe. It contains two (2) parcels totaling approximately 33
gross acres. The applicant is proposing an R-1, Single Family Residential development
on standard 80 foot wide lots.
Board Comments
Mr. Laden asked about park access and transportation level of service. Ms. Larsen stated
a future park to the west is programmed for the area. The closest existing park is
NorthPointe Park. Staff would consult with Anoka County regarding a possible cross
walk across 20th Avenue. Level of service information was detailed in the staff report.
Ms. Peacock also asked about park access.
Mr. Root asked about park dedication fees and park access. He also asked about south
driveway relocation for 6709 20th Avenue. Ms. Larsen noted the relocation is required
due the extension of Red Oak Lane and the applicant would work with the property
owner to relocate the existing driveway to the west.
The Public Hearing was opened at 7:00 P.M.
Public Comments
Christa Weber, 6709 20th Avenue, expressed concerns about having to relocate the
driveway behind house to avoid the median on Red Oak Lane. She also inquired about
future turn lanes on 20th Avenue and where that land would come from.
Jim Nelson, 6747 20th Avenue, is not happy about the proposed development and read a
letter expressing the following concerns:
1. NorthPointe development has caused flooding of property.
2. Will existing houses be required to hook up to municipal services?
3. Why are some of the retaining walls being removed?
4. Where will run-off from stormwater pond go?
5. There should be access to Birch Street.
6. Filling in wetlands does not support goal of protecting natural environment.
7. How is stubbing in road 6 feet higher than his property compatible with adjacent
properties?
8. Pond 400 drains into an existing channel that is already full.
9. Headlights will shine into his bedroom windows.
10. He spoke with RCWD and they are only concerned about on-site drainage within the
development boundaries, not what is already happening down stream.
David Vickers, 6756 Centerville Road, asked who will be responsible for maintaining the
stormwater run-off across his property to the private ditch.

Julie McNeely, 6687 20th Avenue, asked if Outlot C provided access to her property and
inquired about drainage, wetland fill and high ground water.
Larry Olson, BL Holdings, LLC, 7567 162nd Avenue NE, Columbus, MN 55025, stated
they will certainly work with residents and staff to address concerns.
Mr. Laden encouraged applicants to have pre-development neighborhood meetings.
Mr. Vickers noted concern with pre-development neighborhood meetings is that residents
do not know City requirements and they are only hearing from developer.
Kristine Swanson, 6737 20th Avenue, asked what recourse there is if stormwater plans do
not work.
Mr. Laden made a MOTION to close the Public Hearing at 7:19 P.M. Motion was
supported by Ms. Peacock. Motion carried 3-0.
Staff Comments
1. No median is proposed on Red Oak Lane so driveway relocation shouldn’t be an
issue.
2. Turn lanes will be constructed within the existing road right-of-way obtained with the
minor subdivision of 6709 20th Avenue.
3. Existing houses are not required to hook up to municipal services.
4. Staff is recommending removal of retaining walls with more gradual grade changes
where possible.
5. Access to Birch Street is not consistent with the Birch Street Corridor Study or Anoka
County access management requirements.
6. The existing wetlands are not high quality wetlands or an integral part of the City’s
wetland management corridor. The wetlands are being mitigated in compliance with
Minnesota Wetland Conservation Act.
7. Staff will review evaluate existing drainage issues in the area.
8. Staff will evaluate the possibility of planting coniferous trees at the north end of
Heritage Avenue.
9. Outlot C does provide direct access to 6687 20th Avenue.
10. Site grading, drainage ways and storm sewer pipes direct stormwater to pond areas
and not on to adjacent sites.
11. Stormwater maintenance agreements are required detailing responsibility of
maintenance of facilities.
Mr. Laden made a MOTION to approve the Nadeau Acres rezoning and preliminary plat
with conditions noted in the staff report. Motion was supported by Mr. Root. Yeas: Laden
and Root; Nays : Peacock. Motion carried 2-1.
B. PUBLIC HEARING: Conditional Use Permit For Building Within Floodplain,
7020 West Shadow Lake Drive

Ms. Kelsey Gelhar, WSB City Engineer, presented the staff report.
The applicant, Leslie Schuhbauer, is proposing to build a home at 7020 West Shadow
Lake Drive. A conditional use permit is required for building within the floodplain using
alternative elevation methods. The parcel is approximately 0.31 acres.
Board Comments
Mr. Laden asked if the crawl space is intended to flood, if the vents open automatically
and if storage is allowed.
Ms. Peacock asked if construction on stilts or fill is more aesthetic.
Mr. Root asked what the crawl space floor elevation was and if plantings are allowed
near vents.
The Public Hearing was opened at 8:17 P.M.
Public Comments
Leslie Schuhbauer, 1558 Simpson Street, St. Paul, MN 55108, introduce herself to the
Board. She had no other comments.
Mr. Laden made a MOTION to close the Public Hearing at 8:18 P.M. Motion was
supported by Ms. Peacock. Motion carried 3-0.
Staff Comments
1. Ms. Gelhar noted the crawl space is intended to flood, the vents open automatically
and storage is allowed. Habitable space is not allowed.
2. The low floor elevation is 885 and the vents are at approximately 887. Pumps would
be used to pump out water if necessary.
3. Landscape plantings should not be located near vents.
Ms. Peacock made a MOTION to approve the 7020 West Shadow Lake Drive conditional
use permit. Motion was supported by Mr. Laden. Motion carried 3-0.
C. Concept Plan Review for 87 Lilac Street
Ms. Larsen presented the staff report.
The applicant, Bonfe Builders, submitted a land use application for Concept Plan
Review. The proposed development is a 4 lot residential subdivision of a 1.62 acre parcel
located at 87 Lilac Street. The property owners are Lyndal and Sally Nelson.

Board Comments
The Board unanimously agreed the road and public utilities should be extended to the
west property line at this time. Lot 1 and Lot 2 would then front the new road.
Mr. Laden suggested a 30 foot street setback for Lot 3 may be acceptable since older lots
along Lilac Street are at 30 feet.
Mr. Root supported a possible amendment to City ordinance regarding road right-of-way
and setbacks for certain collector and arterial roads.
Public Comments
Mr. Joe Bonfe, applicant, requested the road and public utilities not be required due to
cost. He suggested possibly dedicating an outlot to City for future road right-of-way. He
stated his son was possibly going to move into the existing house at 87 Lilac Street and
didn’t see any issue with relocating the driveway to Mustang Lane.
No motion needed for concept plan review.
VII. DISCUSSION ITEMS
A. Project Updates
Staff gave verbal updates to the Board on current City projects.
VIII. ADJOURNMENT
Ms. Peacock made a MOTION to adjourn the meeting at 8:53 P.M. Motion was
supported by Mr. Laden. Motion carried 3-0.
