I. CALL TO ORDER AND ROLL CALL: Mr. Sullivan called the Lino Lakes Environmental Board meeting to order at 6:30 p.m. on April 29, 2020 II. PLEDGE OF ALLEGIANCE III. APPROVAL OF AGENDA Ms. Andrzejewski made a MOTION to approve the agenda as presented. Motion was supported by Ms. Holmes. Motion carried 4 - 0 IV. ACTION ITEMS – A. I-35E Alternative Urban Areawide Review (AUAR) 5 Year Update Mr. Grochala, Community Development Director, presented the AUAR report and Andi Moffat of WSB and Associates was available for comments The City of Lino Lakes adopted the I-35E Corridor AUAR in conformance with Minnesota Rules 4410 in 2005. The City has subsequently updated the AUAR every five years. The AUAR study area is approximately 4,500 acres and is located in the northeastern portion of the City. The original I-35E AUAR was a very comprehensive document covering the City’s 35E corridor from Birch Street to our northern city limits. The most significant developments over the past five years are the 372 acre Watermark residential development and the 402,000 square foot Distribution Alternatives fulfillment center on 21st Avenue. Each of these projects were subject to the mitigation requirements of the AUAR including but not limited to transportation and water management improvements. As long as a development project is consistent with the assumptions of the analyses in the AUAR, no additional environmental review is required. A key component of the AUAR is the mitigation plan that addresses cumulative impacts of development as the corridor develops. In order to remain valid, the AUAR must be revised under certain criteria. Development in the study area will require infrastructure improvements. The analysis for the storm water, water, wastewater, and traffic have been updated as part of this AUAR Update. So far the infrastructure improvements include 35E interchange, extending 21st Ave and 20th /73rd turn Board Comments Mr. Sullivan asked if there was any discussion of light pollution especially in the industrial area. Ms. Moffat stated in the state environmental review process guidance is provided but light pollution is not required in this type of study. Mr. Grochala mentioned that this has always been a high propriety issue. We do include down cast lighting in our development plans. Mr. Sullivan stated in the in the initial 2005 AUAR study it states that conservation testing methods were used. Why it is stated that conservation methods were used. Enivonmental Board Minutes April 29, 2020 Page 3 DRAFT MINUTES Ms. Moffat replied that in the area of wastewater section we will be using less because the actual data is calculated to more realistic predication instead of general guidance from Met Council. Mr. Flower mentioned that looking at this report in the air section there is some reference to vehicle emissions and mentions updated traffic study. Why isn’t stationary source and vehicle emissions stated as not applicable to an AUAR. Ms. Moffat replied that guidance from the state an AUAR cannot be use if you have heavy industrial use area. This is not heavy industrial so there were certain studies that were not needed to be done. The headings that are in this report come right from the form that the state provides to the city. Mr. Sullivan is impressed by the document and the 70% reduction is run off with the improvements in the area. Ms. Andrzejewski made a MOTION to recommend the approval of the 2020 AUAR update – Motion was supported by Mr. Sullivan. Motion carried 4-0. This approved report will go before City Council and act on it and then submitted back to the agencies to let them know that it has been adopted. VII. DISCUSSION ITEMS A. Status of Annual Recycling Day Mr. Nelson announced that the Annual Recycling Day which was to be held on May 16, has been canceled. Hopefully in June, the monthly recycling day will begin again and maybe a Fall Annual recycling day will be held. It is still uncertained at this time. For appliances, All Disposal, of East Bethel will take your item and if you mentioned you are a Lino Lakes resident – he will honors the prices on city literature. B. Boulevard Tree Plans Mr. Nelson 80 trees have been planted and with 30 more to be planted. VIII. Respectfully submitted, Mary Fogarty 1 ENVIRONMENTAL BOARD AGENDA ITEM 6A STAFF ORIGINATOR: Andy Nelson, Environmental Coordinator MEETING DATE: May 27th, 2020 REQUEST: Conditional Use Permit for Laborer’s Training Center Campus Expansion (2350 Main Street) APPLICANT: Laborer’s Training Center Attn: Dean Mills 2350 Main Street Lino Lakes, MN 55038 OWNER: Same PROPOSED ADDITION BACKGROUND Laborer’s Training Center (LTC) is located at 2350 Main Street. The applicant is proposing to construct a 37,284 sf training facility to the east of the existing facility. The Land Use Application is for the following: • Conditional Use Permit o Two (2) or more buildings on the same lot • Site and Building Plan Review This staff report is based on a review of the following documents: • Laborer’s Training Center Campus Expansion Plan Set, prepared by Barr Engineering Co. dated 5/11/20 • Stormwater Management Plan prepared by Barr Engineering Co. dated May 2020 • Geotechnical Exploration Report prepared by Haugo Geotechnical Services dated February 2020 • Wetland Delineation Report prepared by Barr Engineering Co. dated August 2019 2 ANALYSIS Background Per the applicant’s narrative, Laborer’s Training Center offers construction industry vocational training. They have been at this location since 1993 and have outgrown their current working/training bays, classrooms, and storage space. The proposed project will include a new building with working/training bays, classrooms, offices, and an auditorium. The expansion will also include additional parking, an access road, utilities, and stormwater ponds. General Site Characteristics The existing site is approximately 18 acres. The current training facility is approximately 40,000 square feet with an outdoor training facility to the east and a parking lot with 163 spaces to the west. The southern half of the site is generally composed of wetlands and wooded open space that will not be impacted by the site expansion. The proposed addition will include a building covering 37,284 square feet and an additional 167 parking spots. Soils Per the Geotechnical Exploration Report, four soil borings encountered 0.5-1.0 foot of topsoil comprised of sandy lean clay. Beneath the topsoil was sandy lean clay glacial till that extended to the termination of the borings at 14.5 feet. Infiltration was not deemed possible for this site due to the low permeability of the soils and the high water table indicated by the surface elevation of the wetlands. Stormwater Management, Erosion and Sediment Control Stormwater management plan has been submitted and is being reviewed by the City Engineer. The following general review is adapted from the May, 2020 Stormwater Management Plan prepared by Barr Engineering Co. All impervious surfaces for the site will be routed through two proposed stormwater ponds, which will be constructed south of the existing and proposed buildings and north of existing wetlands. The outlet structure for both ponds will connect to existing 12” storm sewer pipes, which outlet into wetlands to the south. Ultimately, water discharges through wetlands to the south, then to Clearwater Creek, and finally to Peltier Lake. 3 Stormwater Pollution Prevention Plan (SWPPP) SWPPP has been submitted and will be reviewed with final construction plans. This site will drain to impaired waters, Clearwater Creek and Peltier Lake, so stabilization of exposed soil areas must occur within 7 days after the construction activity in that area permanently ceases. Redundant perimeter controls will be required near wetlands on the site wherever a 50 foot natural buffer cannot be maintained. This is noted in the SWPPP. Flood Plain Site does not fall within the flood management zone. Wetlands Per the wetland delineation report prepared by Barr Engineering Co., three wetlands were delineated within the site totaling 7.52 acres that are protected by the Wetland Conservation Act. This prohibits draining, filling, and excavating in wetlands unless the activity is exempt or the wetland impacts are mitigated. The overall goal of the WCA is no net loss of wetlands. No impact to these 7.52 acres of wetlands is proposed. Other areas evaluated on the site include three stormwater ponds and a created ditch totaling 0.9 acres. These excavated ponds, impoundments, and drainage ditches do have wetland characteristics, but they were created for the purpose of water retention or detention and drainage. These areas were created in upland, and would not be regulated by WCA. This is going to be reviewed by Rice Creek Watershed District. The wetlands are within the Wetland Management Corridor and conservation easement and wetland buffers are required. The applicant proposes a 25 foot buffer. This will be reviewed by RCWD. As part of the 1999 building expansion project, a Declaration of Restrictions and Covenants (DORC) was recorded over the wetlands. This is being modified as part of the Rice Creek Watershed District wetland permit review. The DORC will be modified to reflect the current delineations. A separate public drainage and utility easement covering the delineated wetland, conservation easement and WMC buffer shall be drafted and recorded against the property. 4 Alternative Urban Areawide Review (AUAR) Considerations The site is within the 2005 I-35E Corridor AUAR environmental review boundary. The AUAR was updated in May 2020. The AUAR identified this site as industrial in all 3 land use scenarios. The LTC campus expansion project is consistent with industrial development. No further environmental assessment is required. Drinking Water Protection The site is within the Drinking Water Supply Management Area (DWSMA) and is moderately vulnerable with a highly vulnerable section in the south. No stormwater infiltration is proposed on the site and the site is connected to City water and sewer. Landscape Plan Tree Preservation and Mitigation Standards The purpose of these standards is to protect valuable trees and stands of vegetation while not interfering with landowners’ reasonable use and development of property. The goal is to minimize unnecessary loss of habitat, biodiversity, and forest resources and to replace removed trees in areas where tree cover is most critical. There are 124 trees slated for removal. 112 new trees are proposed. Clarification will have to be provided on numbers of trees in basic use areas, which will not require mitigation, and trees that will have to be mitigated for. See staff recommendations. Open Areas Landscape Standards The purpose of these standards is to provide general site beautification and high aesthetic quality with a mix of plant materials in open areas. Open area landscape standards call for 1 large tree and 3 large shrubs per 2000 sq.ft. The following substitutions are allowable: 1 large tree = 1.5 medium or 2 small trees 1 large shrub = 1.5 medium or 3 small shrubs 70,293 sq. ft. of open space calls for 36 large trees and 106 large shrubs. 102 large trees, 11 medium trees, 61 large shrubs, and 68 medium shrubs have been provided. Open areas landscape standards have been met. Buffer and Screen Standards The purpose of this requirement is to separate and buffer different land use types, screen roads and parking, and screen utility and loading areas. 5 Continuous, year-round planting screens require at the minimum a double row of plants with triangulated spacing. Buffer and screen standards are not currently met, as the double row of triangulated plants is not continuous. See staff recommendations. Canopy Cover Canopy cover standards call for a minimum of 40% canopy coverage. Canopy coverage values are calculated per tree based on the anticipated size 15 years after planting, and the distance to hardscape edge from the planting location. 33,322 sq. ft. required 38,650 sq. ft. provided Canopy cover requirements have been met. Foundation Landscaping The purpose of these standards is to soften and enhance building architecture, define access points, add color and seasonal interest, and to blend buildings in with the natural environment. 2 large trees and 6 large shrubs are required per 100 linear feet of building. These plants should be within 30 feet of the building. The following substitutions are allowable: 1 large tree = 1.5 medium or 2 small trees 1 large shrub = 1.5 medium or 3 small shrubs For 440 linear feet of foundation, 9 large trees and 27 large shrubs are required for the north and east building faces. 9 large trees, 3 large shrubs, and 50 medium shrubs have been provided. The Foundation Landscape requirements have been met. Sod and Ground Cover Standards All areas not otherwise improved in accordance with the approved site plans shall have a minimum depth of 4 inches of topsoil and be sodded including boulevard areas. Seed may be provided in lieu of sod in certain cases, including when the area is adjacent to natural areas or wetlands. The applicant is proposing to provide 6 inches of topsoil and MnDOT seed mix 25-131 in place of sod over 53,973 sq. ft. This mix is low maintenance turf grass which is salt, shade, and drought tolerant and requires less frequent mowing and less fertilization than conventional turf grass. See staff recommendations. 6 Areas around stormwater ponds totaling 16,320 sq. ft. will be seeded with MnDOT 33- 261, Stormwater South and West, which is a native mix of grasses, forbs, sedges, and rushes for stormwater pond edges. Lighting The purpose of the lighting requirements in the Zoning Code is to reduce light pollution, promote energy conservation, and increase night time safety, utility, security, and productivity. Lighting is reviewed by the City Planner, but some highlights of the lighting requirements follow. • Maximum height of the fixture and pole must not exceed 30 feet. • The luminaire shall contain a cutoff which directs and cuts off the light at an angle of 90 degrees or less. • Light cast on a public street shall not exceed one foot candle as measured from the right of way. Light cast on adjacent residential property must not exceed 0.4 foot candles as measured from the property line. • Lights serving industrial businesses shall be turned off one hour after closing, except for approved security lighting. • Any illuminated signs for advertising purposes shall be turned off between 12:00AM and sunrise except that said signs may be illuminated while the business facility on the premise is open for service. Recycling Applicant is planning to construct an enclosure for trash and recycling. This enclosure will be reviewed by the City Planner. RECOMMENDATIONS Staff recommends approval of the conditional use permit and site plan review for Laborer’s Training Center Campus Expansion subject to the following comments: 1. Trees in the proposed west pond will have to be surveyed and accounted for in the Tree Preservation and Mitigation Standards. Surface water detention ponds are not considered part of the basic use area, and thus are not exempt from surveys or mitigation standards. Clarification is needed on numbers of trees not in basic use area that are to be removed and thus potentially requiring mitigation. 2. Buffer and screen standards can be met on the eastern perimeter by planting a triangulated double row of coniferous trees that curves west to meet with the northeast edge of the east pond. It is recommended that two or three species suitable for the site conditions are alternated to make this screen more resistant to pests and pathogens than it would be if it were comprised of a single species. 7 3. Tree protection zones should extend 5ft. farther from the trunk than the dripline. Tree protection fence should be installed prior to any construction activities taking place on the site. 4. Install tree protection fence at the construction limits east of the East Pond to limit tree removals in that area. 5. Foundation plantings should be irrigated. 6. Allow substitution of MnDot 25-131 and 6 inches of topsoil for 4 inches of topsoil with sod. 7. Wetland buffers need to be a minimum of 25 feet wide and an average of 50 feet wide. ATTACHMENTS 1.
