I. CALL TO ORDER AND ROLL CALL: Mr. Sullivan called the Lino Lakes Environmental Board meeting to order at 6:30 p.m. on May 27, 2020. II. PLEDGE OF ALLEGIANCE III. APPROVAL OF AGENDA The agenda was approved as presented. IV. APPROVAL OF MINUTES: With a few changes Ms. Holmes made a MOTION to approve the April 29, 2020 Meeting Minutes. ACTION ITEMS – A. Laborer’s Training Center Campus Expansion Conditional Use Permit Mr. Nelson presented the Conditional Use Permit for the Laborer’s Training Center which is located at 2350 Main Street. The applicant is proposing to construct a 37,284 sf training facility to the east of the existing facility. The site is connected to city water and sewer. The Land Use Application is for the following: • Conditional Use Permit • Two or more building on the same lot • Site and Building Plan Review The proposed project will include a new building with working/training bays, classrooms, offices and an auditorium. The expansion will also include additional parking, an access road, utilities and stormwater ponds. The site is approximately 18 acres. The site expansion will not impacted the wetlands and the wooded open space which is on the southern half of the site. Mr. Nelson mentioned that the lighting is reviewed by the City Planner, and some of the lighting requirements in the Zoning Code are to promote energy conservation, increase night time safety and to reduce light pollution to name a few. Board Comments Ms. Andrzejewski was wondering about the impact to Hugo with eliminating the stormwater ditch and replacing it with a stormwater pipe. Ms. Michelle Kimball, civil engineer from Barr Engineering, mentioned there will be a catch basin over the pipe to catch the small amount of drainage, the drainage will be the same and so there will be no impact. Mr. Sullivan wanted to know if the seed mix is tilled-in or is the seed broadcast. Ms. Andrea, landscape architect from Barr Engineering, stated that the seed mix is broadcast spread, disc into the soil and then mulched with a cover crop as well. Mr. Flower questioned the statement on page 4 which pertained to drinking water being moderately vulnerable with a highly vulnerable section in the south. Mr. Nelson stated that if there was going to be infiltration on site this would be a concern. But this site will have city water and sewer. The section that is vulnerable is on southern Enivonmental Board Minutes May 27, 2020 Page 3 DRAFT MINUTES edge in the wetland area. There is no impact to the wetland. There would be more of a concern if there was a well or storage tanks in the area. Ms. Holmes was wondering about the soil infiltration with the extra land being paved for parking. Ms. Kimball, Barr civil engineer, the ponds have to be sized to handle the 2, 10, 100 year water events. The Rice Creek Watershed will not allow a higher flow rate or more volume of water to increase into the wetlands. Mr. Sullivan mentioned that there are 5 areas in the proposal the board doesn’t have results from certain studies. Areas being reviewed are Stormwater Management, Erosion, Sediment Control, Recycling and a report from Rice Creek Watershed. Mr. Sullivan made a MOTION to recommend the approval of the Conditional Use Permit for the Laborer‘s Training Center Campus Expansion siting positive reviews on the five studies that are pending and also with the staff’s listed recommendation #1-7 and including #8 which is seeding the phase two area during construction of phase one. Ms. Nelson seconded the Motion. Motion carried 5-0. VII. DISCUSSION ITEMS A. Status of Annual Recycling Day Mr. Nelson announced that hopefully in June, the monthly recycling day will begin again and maybe a fall annual recycling day will be held. It is still uncertained at this time. B. Water Conservation and Magnesium Mr. Flower was curious if there was any more information about the magnesium in the water. Wondering about educating the public about best practices in water usage as the warm weather is approaching. Mr. Grochala stated that this issue will be brought forth to the council at the next council meeting. Also on a side note smart irrigation has been installed in the city parks and water usage should decrease by 50%. Ms. Holmes would like updates on a site that we have approved. As example the storage unit on Lake Dr. it doesn’t look like the plan is being followed. The trees were put in too late in the year and the dead trees should be removed. Respectfully submitted, Mary Fogarty 1 ENVIRONMENTAL BOARD AGENDA ITEM 6A STAFF ORIGINATOR: Andy Nelson, Environmental Coordinator MEETING DATE: July 29th, 2020 REQUEST: Otter Crossing Preliminary Plat and Site Plan Review APPLICANT: Paul Schreier Tyme Properties 3435 Labore Road Suite 150 Vadnais Heights, MN 55110 OWNER: Tyme Properties BACKGROUND Otter Crossing is a proposed multi-tenant retail building to be located at the northwest quadrant of the intersection of Otter Lake Road and Main Street. In addition to the 7,800 sq ft building, the plan also includes an access road connecting to Otter Lake Road, a turn lane, and a storm water basin. This staff report is based on a review of the following documents: • Otter Crossing Plan Set prepared by Pioneer Engineering, dated 7-06-20. • Preliminary Storm Water Management Plan prepared by Pioneer Engineering, dated 7-06-20. • Geotechnical Exploration Report prepared by Haugo Geotechnical Services, dated 2-07-20. • Wetland Permit Application prepared by Midwest Natural Resources, dated 7-13- 20. • Wetland Delineation Report prepared by Midwest Natural Resources, dated 9-04- 19. 2 ANALYSIS General Site Characteristics Tyme Properties owns the entire 28.12 acre parcel of undeveloped land located just northeast of the intersection of 35E and County Road 14. Currently, the site is predominantly agricultural fields in corn production and two wetland areas that are 4.29 acres total. Historically, the site was mostly oak openings and barrens with a smaller portion of big woods in the southeast corner. The applicant is proposing to subdivide the property. Lot 1 is 1.4275 acres proposed to be a new retail building with parking lot and drive through lane. Street A will be constructed to provide access from Otter Lake Road. A turn lane will be added for right turns from Otter onto Main. A storm water pond with filtration basin will handle storm water generated on the site. The project does have wetland impacts which will be mitigated for through the purchase of wetland credits. Soils Per the Geotechnical Exploration Report, ten soil borings encountered 1.0-1.5 feet of topsoil over native glacial till soils consisting of lean clay, sandy lean clay, clayey sand, silty sand, and poorly graded sand with silt. Groundwater was encountered in six of the ten borings at depths of 3-9 feet below the surface. Haugo Geotechnical is recommending removal of topsoil and compaction or replacement of softer consistency glacial till soils in order to provide more support for building foundations. Soils in Lot 1 are mostly Webster loam or Hayden fine sandy loam, which are B/D and B type soils respectively. B type soils have a moderate infiltration rate (moderate runoff potential) when saturated, D type soils have a very slow infiltration rate (high runoff potential) when saturated. This information is used to design the storm water features (the storm water and filtration basin) to ensure that the site will be able to manage water from 2, 10, and 100 year storms. The site as proposed has lower runoff rates than the existing site for all three categories of storm. 3 Stormwater Management, Erosion, and Sediment Control Stormwater management plan has been submitted and is being reviewed by the City Engineer. The following general review is adapted from the Preliminary Storm Water Management Plan prepared by Pioneer Engineering. The north portion of the property currently drains to the northeast to Wetland B, and then flowing north. The south portion of the site drains to Wetland A and south from there through a culvert under County Road 14. There is also a small section of the property that drains to the existing storm sewer on Otter Lake Road. Ultimately, the site drains to Clearwater Creek and Peltier Lake, both of which are impaired waters. The plan for this development is to route storm water from the site to a basin with connected filtration cell that will outlet to Wetland A. Stormwater Pollution Prevention The Grading, Drainage, and Erosion Control Plan calls for inlet protections, a rock construction exit, and silt fence for perimeter control. Redundant perimeter controls near the wetlands are noted, as is secondary perimeter control around the high water level of the storm water basin. Being that this site will drain to impaired waters, Clearwater Creek and Peltier Lake, stabilization of exposed soil areas must occur within 7 days after the construction activity in that area permanently ceases. Flood Plain Site does not fall within the flood management zone. Wetlands Per the wetland delineation report, two wetlands were delineated within the site totaling 4.29 acres. Wetland A is a 2.59 acre partially farmed seasonally flooded basin/fresh wet meadow/shallow marsh. Plant species in this wetland include reed canary grass (Phalaris arundinacea), yellow nutsedge (Cyperus esculentus), and corn (Zea mays). Wetland B is a 1.7 acre partially farmed seasonally flooded basin/fresh wet meadow/shallow marsh. Plant species in this wetland include reed canary grass (Phalaris arundinacea) and corn (Zea mays). 4 The Wetland Conservation Act prohibits draining, filling, and excavating in wetlands unless the activity is exempt or the wetland impacts are mitigated. The overall goal of the WCA is no net loss of wetlands. This project as proposed will involve impacts to Wetland A, which include 3,600 sq ft (0.0826 acre) of fill to allow for grading and construction of Street A, and 1,670 sq ft (0.0383 acre) of excavation that will allow for construction of an outlet pipe to discharge water from the storm water pond to the southwestern portion of Wetland A. The owner will be mitigating these impacts with the purchase of wetland credits. The wetlands do not appear to be within the Wetland Management Corridor, so a buffer of 10 feet would meet City standards. Alternative Urban Areawide Review (AUAR) Considerations The site is within the 2005 I-35E Corridor AUAR environmental review boundary. The AUAR was updated in May 2020. The AUAR identified this site as commercial in all 3 land use scenarios. No further environmental assessment is required. Drinking Water Protection The site is within the Drinking Water Supply Management Area (DWSMA) and is moderately vulnerable. The site will be connected to City water and sewer. LANDSCAPE PLAN Tree Preservation and Mitigation Standards The purpose of these standards is to protect valuable trees and stands of vegetation while not interfering with landowners’ reasonable use and development of property. The goal is to minimize unnecessary loss of habitat, biodiversity, and forest resources and to replace removed trees in areas where tree cover is most critical. A tree survey will not be required for this site, because there are no trees over 6 inch DBH to survey. Preservation and mitigation standards do not apply to this site. Open Areas Landscape Standards The purpose of these standards is to provide general site beautification and high aesthetic quality with a mix of plant materials in open areas. Open area landscape standards call for 1 large tree and 3 large shrubs per 2000 sq.ft. If the storm water pond area is going to be permanent, open space plantings will be required. 5 Buffer and Screen Standards The purpose of this requirement is to separate and buffer different land use types, screen roads and parking, and screen utility and loading areas. Continuous, year-round planting screens require, at the minimum, a double row of plants with triangulated spacing. This project calls for a 30 inch high planting screen. Continuous screen is not present on the north perimeter. Buffer and screen standards have not been met. Canopy Cover Canopy cover standards call for a minimum of 40% canopy coverage. Canopy coverage values are calculated per tree based on the anticipated size 15 years after planting, and the distance to hardscape edge from the planting location. Vehicular hardscape planned: 34,276 sq ft Canopy cover requirement: 13,710 sq ft Canopy cover provided: 8,675 sq ft Canopy cover requirements have not been met. Foundation Landscaping The purpose of these standards is to soften and enhance building architecture, define access points, add color and seasonal interest, and to blend buildings in with the natural environment. These standards apply to building fronts and sides facing public or private streets. 2 large trees and 6 large shrubs are required per 100 linear feet of building. These plants should be within 30 feet of the building. The following substitutions are allowable: 1 large tree = 1.5 medium or 2 small trees 1 large shrub = 1.5 medium or 3 small shrubs For 320 linear feet of applicable foundation, 7 large trees and 20 large shrubs (or acceptable substitutes) are required for the north, east, and south building faces. The plans indicate: 3 medium trees 14 medium shrubs 25 small shrubs These substitutions are equivalent to: 1 large tree 17 large shrubs 6 The foundation landscape requirements have not been met in terms of numbers or with respect to placement. Sod and Ground Cover Standards All areas not otherwise improved in accordance with the approved site plans shall have a minimum depth of 4 inches of topsoil and be sodded including boulevard areas. Seed may be provided in lieu of sod in certain cases, including when the area is adjacent to natural areas or wetlands. Area around the storm water pond from normal water level to high water level will be seeded with MnDOT 33-261, Stormwater South and West, which is a native mix of grasses, forbs, sedges, and rushes for stormwater pond edges. Above high water level in the storm water pond area calls for 35-621 Dry Prairie Southeast. The area north of Lot 1 will also have MnDot 35-621 to create a buffer strip for Wetland A near the impacted portion of the wetland. The remainder of the site will be seeded with MnDot 25-141 Mesic Roadside General or sodded. The Seeding Plan indicates this mix covering areas of the site that call for sod on the Landscape Plan. These two plan sheets should match. Lighting The purpose of the lighting requirements in the Zoning Code is to reduce light pollution, promote energy conservation, and increase night time safety, utility, security, and productivity. Lighting for this site is downcast, has the correct cutoffs, light poles are the right height, and foot candles at perimeters meet City specifications. Lighting requirements are met. Recycling Applicant is planning to construct an enclosure for trash and recycling. 7 RECOMMENDATIONS Staff recommends approval of the preliminary plat and site plan review for Otter Crossing subject to the following comments: 1. Canopy cover standards have not been met. More trees will be required. 2. Foundation landscape standards have not been met in terms of numbers or with respect to placement. More plants will be required. 3. Open space plantings will be required in the storm water pond area if this is intended to be a permanent feature. 4. Buffer screen will need to be added for the north perimeter. 5. Clarify areas to be seeded with MnDOT 25-141 or sodded. The Landscape Plan and Seeding Plan do not currently match. 6.
