CALL TO ORDER AND ROLL CALL: Mr. Sullivan called the Lino Lakes Environmental Board meeting to order at 6:30 p.m. on July 29, 2020. II. PLEDGE OF ALLEGIANCE III. APROVAL OF AGENDA The agenda was approved as presented. Mr. Sullivan introduced Ella McNulty, our new board member. Ms. McNulty told the board a little about herself and her interests. IV. APPROVAL OF MINUTES: May 27, 2020 Ms. Holmes made a MOTION to approve the May 27, 2020 Meeting Minutes. Mr. Schwartz seconded the motion. Motion carried 6 - 0. V. ACTION ITEMS A. Otter Crossing Otter Crossing is a proposed multi-tenant retail building to be located at the northwest quadrant of the intersection of Otter Lake Road and Main Street. In addition to the 7800 sq ft building, the plan also includes an access road connecting to Otter Lake Road, a turn lane and a storm water basin. Currently, the site is predominantly agricultural fields in corn production and two wetland areas that total 4.29 acres. The applicant is proposing to subdivide the property. Lot 1 is 1.4275 acres proposed to be a new retail building with parking lot and drive through lane. Street A will be constructed to provide access from Otter Lake Road. A turn lane will be added for right turns from Otter onto Main. A storm water pond with filtration basin will handle storm water generated on the site. Stormwater management plan has been submitted and is being reviewed by the City Engineer. The plan for this development is to route storm water from the site to a basin with connected filtration cell that will outlet to Wetland A. This project as proposed will involve impacts to Wetland A, the owner will be mitgating these impacts with the purchase of wetland credits. The wetlands do not appear to be within the Wetland Management Corridor, so a buffer of 10 feet would meet City standards. The site will be connected to City water and sewer. A few of the disscussion items were; • It would be better to understand and vote on a Preliminary Plat and Site Plans if more of the various standards were meet • Will the board see this plan once or doe it come back to the Environmental Board again after the plans are more complete In addition to the staff recommendations • Add more native plants and less maples • Have a smart irrigation plan • Seeding is a better choice instead of sod • Enclosure for recycling and trash containers Enivornmental Board July 29, 2020 Page 3 DRAFT MINUTES Mr. Sullivan made a MOTION to forward Otter Crossing /Preliminary Plat and Site Plan Review with the Environmental Board’s concerns and staff recommendations. Ms. Andrzejewski seconded the motion. Motion carried 6 - 0. VII DISCUSSION ITEMS A. Mini Storage Update New trees have replaced and seeded has been done. Ms. Holmes wanted to know if there was irrigation for the newly planted trees. Mr. Nelson was unsure but believed that hoses were being used until irrigation was to be installed. B. Recycling Update Mr. Kvendru mentioned that Recycling Saturday was busy – the workers wear gloves and masks while unloading the vevhicles and have the residents stay in their car This past Saturday 3800 lbs of paper was shredded There will be no Annual Recycling Day this year. It is too hard to social distance at such an event. Lino Park will be getting an Organics sign installed to better indentified the organics cans. The first half of the SCORE Report was turned in. Had 934 lbs of recycling and our total goal for the year is 2265 lbs, a little under half. Mr. Kvendru last day is August 31. VIII. Respectfully submitted, Mary Fogarty Office Specialist Memorandum To: Environmental Board Members From: Andy Nelson, Environmental Coordinator Date: August 20, 2020 Re: Meeting Attendance and Quorum City Code section 217.02 (1) states that the board shall operate in accordance with Chapter 210. City Code section 210.04 states that 51% of any commission shall constitute a quorum for conducting business. Generally, the Environmental Board has 7 members so a quorum would be 4. However, quorum consists of appointed positions, so if only 5 are currently appointed then a quorum would be 3. In practice, given that the board is advisory, we continued to hold the meeting, even if a quorum is not present. Approval of board minutes are postponed, but any discussion items are typically reviewed. Land use decisions, developments and subdivisions in the City of Lino Lakes require submittal of a Land Use Application. Examples include comprehensive plan amendments, rezoning, conditional use permits, site plan review and subdivisions. State Statute 15.99 requires governmental entities to approve or deny requests within 60 days (aka the 60-day Rule). State statute allows 120 days for preliminary plat review. Attached is a copy of the City’s Land Use Application which includes a fee schedule, calendar of submittal deadlines and meeting dates for the City’s Advisory Boards (Environmental, Parks, EDAC and Planning & Zoning). When planning staff receives a Land Use Application, we review it to make sure the required information has been submitted in order to deem the application complete. A complete application; however, does not necessarily mean the plans meet all City ordinance requirements. It is now the role of staff and the Advisory Boards to determine compliance with the City’s Comprehensive Plan and ordinances. Planning staff reviews the plans and presents their staff reports to their respective Advisory Board. Staff and Board comments are summarized and presented to the Planning & Zoning Board for final recommendation to the City Council. The Planning & Zoning Board is the advisory board statutorily authorized to review land use applications and typically hold public hearings. Projects are not allowed to start construction until final revised plans have been submitted. Planned Unit Developments provide for the grouping of lots or buildings for development as an integrated, coordinated unit as opposed to traditional parcel by parcel, piecemeal, or sporadic approach to development. This is intended to introduce flexibility of site design and architecture for the conservation of land and open space through clustering of lots, buildings and activities, which promote the goals outlined in the Comprehensive Plan or serve another public purpose. This plan is for the proposed development of four parcels into 102 single family homes and a 50 unit senior housing building that would be located directly south of the Northpointe subdivision. These parcels have 23.01 acres of developable land, 34.61 acres of wetlands and buffers, and 6.29 acres of street ROW. This project would involve rezoning parcels from rural to residential. This staff report is based on a review of the following documents: • Concept Layout prepared by Sambatek Inc., dated 7/20/20 • Context Layout prepared by Sambatek Inc., dated 7/20/20 2 SITE CHARACTERISTICS General Site Characteristics The site is currently composed of four adjacent parcels, three of which are zoned Rural, one zoned for PUD. There is one home on the site, a large wetland area, mowed fields, several small ponds, and a private ditch. The site is bounded by the Northpointe residential subdivision to the north, rural single- family homes to the south, highway 35E on the east, and agricultural land to the west. Soils SSURGO (Soil Survey Geographic Database from Natural Resource Conservation Service) soils data indicates the presence of the following soil types: The wetland area soil is Rifle mucky peat that is hydrologic soil type A/D, very poorly drained, with a water table varying between a foot below to a foot above ground level. For dual class soil types, the first letter applies to the drained condition, the second to the undrained condition. In this case, these soils have a low runoff potential when drained, and a high runoff potential when poorly drained. The rest of the site is comprised of Hayden fine sandy loam, Nessel fine sandy loam, Kingsley fine sandy loam, and Braham loamy fine sand which are moderately well drained to well drained soils that are in hydrologic soil type B. These soil types have a moderately low runoff potential and unimpeded water transmission through soil. Land Cover Pre-settlement land cover (Marschner) was oak openings and barrens, aspen-oak land, and wet prairie. Current land cover is: wet meadow, cropland, oak woodland, spruce/fir trees, floodplain forest, ponds, seasonally flooded altered/non-native dominated emergent vegetation, medium-tall grass altered/non-native dominated grassland, and altered/non-native deciduous forest. Rare, Unique or Significant Resources No rare, unique, or significant resources have been identified at this time, but if any wetland impacts are proposed, a survey for these resources should be performed. Most of the site appears to have been used for agriculture, so disturbance would be expected to have altered any native plant communities on the site. There are opportunities for wetland restoration associated with this project. 3 Storm Water Management, Erosion and Sediment Control Storm water on the site heads south to Amelia Lake through private ditches. Storm water management plan will have to be submitted. Given the soil types and location in a highly vulnerable section of the Drinking Water Supply Management Area (DWSMA), infiltration will probably not be feasible. Stormwater Pollution Prevention Plan (SWPPP) The project will require an NPDES permit and SWPPP. Flood Plain Site falls within the flood management zone. Flood zone should not encroach into lots if feasible. Wetlands Per the Sambatek concept layout, there are 34.61 acres of wetlands on site. A wetland delineation will be required. Vadnais Lake Area Water Management Organization (VLAWMO) is the Local Government Unit (LGU) responsible for administering the Wetland Conservation Act (WCA). VLAWMO will provide decisions regarding any wetland impacts that are proposed to occur during the course of the development. The wetlands are considered high priority in the Resource Management Plan. This project should include wetland buffers of 50 feet on average with a 25 foot minimum. There may be opportunities to restore hydrology on the site by minimizing runoff to the private ditch. Restoration of native plant communities could be conducted in conjunction with restoration of hydrology. Alternative Urban Areawide Review (AUAR) Considerations The northeast portion of the site containing the senior housing building falls within the AUAR boundary. This area was planned for residential in all three land use scenarios described in the 2020 AUAR update. Drinking Water Protection The site is within the Drinking Water Supply Management Area (DWSMA) and is highly vulnerable. This will impact how storm water is managed on the site, particularly through limiting infiltration. Also, any existing private wells should be sealed and abandoned per Department of Health requirements. 4 Greenway The site includes an area shown as part of the City’s Greenway System in the 2040 Comprehensive Plan. The greenway corridor is intended to provide areas for storm water management, wetland buffer areas, conservation of natural areas, open space, and trails for people. The recreational trail system within a greenway corridor is intended to provide a continuous, natural experience for trail users and should connect natural landscapes, parks, and open space areas with limited interruption by roads and other development features. As previously noted, this wetland area should be preserved to the extent practicable, and should also incorporate buffers and any proposed trails along the periphery. Storm ponding should be located along the greenway corridor to both protect and enhance the corridor. Tree Preservation Plan A detailed tree inventory and preservation plan will have to be submitted. Landscape Plan A detailed landscape plan will need to be submitted. RECOMMENDATIONS Staff recommends that the Burque Property concept plan review be forwarded on to the Planning and Zoning Board and City Council with the following comments: 1. Greenway corridor should be established through the site. 2. Consider restoring wetland hydrology and vegetation on the site. 3. Wetland buffers should have a minimum width of 25 feet and be 50 feet wide on average. 4. Storm water pond(s) should be located in close proximity to wetland areas. 5. Storm water pond design should take into account the site’s location in a highly vulnerable area of the Drinking Water Supply Management Area. This may limit infiltration possibilities on the site. 6. If any wetland impacts are proposed with this project, a survey for rare, unique, and significant resources should be performed.
