City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: • Please address the meeting chair. • State your name and address for the record. • Please observe a 4-minute limit. • The topic must relate to city business. • Open Mike is for items not on the agenda. • A spokesperson must represent a group of five or more — groups will have 8 minutes. • The Presiding Officer may limit duplicative presentations. • Remember, the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: • The Presiding Officer (Chair or Vice -Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. • Staff will present their report on the proposal. • Board members will then ask City Staff questions about the proposal. • The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. • After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. • The Board will then discuss the proposal. No further public comments are allowed. • The Board will then make a recommendation(s) and/or a decision. When you are called upon for your comments, please step to the microphone at the podium and state your name and address for the record. PUBLIC HEARING: Otter Crossing Preliminary Plat and Site Plan Review Ms. Larsen, City Planner, presented the staff report. The applicant, Tyme Properties, LLC, is creating a 1.43 acre parcel for the purpose of constructing a 7,800 sf commercial retail building. The name of the preliminary plat is Otter Crossing. Staff recommended approval of the preliminary plat and site plan review for Otter Crossing subject to conditions listed in the staff report. Ms. Larsen asked the board for input regarding the building's location. Board Comments Mr. Reinert asked if we have data on how the positioning of the building will impact the success of the businesses. Tom Schuette, from Tyme Properties, said the tenants want to face the traffic on Main Street. He told the board he understands the concept of creating a village with the businesses facing the back street. However, he mentioned the back street will not likely have a main street feel since the street will eventually be right -in, right -out and the area to the north of the site is a wetland. Mr. Reinert stated an argument can be made for either design. He remarked if a decision is made for the positioning of one building, all of the buildings that will be developed on the road need to be positioned the same for consistency. He commented if the backside of the businesses face Main Street and if proper signage is displayed to ensure the businesses are noticed, then maybe there would be no loss of opportunity. He asked Mr. Evenson what his opinion was on the matter. Mr. Evenson said, from a retailer's perspective, you would want the front of your business to face the busiest road. He liked how the developer positioned the building. Mr. Root remarked the new businesses will be a good addition to Lino Lakes. Regarding the position of the building, he explained he would prefer to have the front facing Main Street, but he acknowledged the alternative design could be done if the building was designed accordingly and the signage was prominent. Ms. Peacock suggested a sidewalk area be built around the shops to allow customers to be able to walk from business to business and to give the occupying businesses the opportunity to place additional seating outside. She questioned if the new trail would be a bike trail or a walking trail. DRAFT MINUTES Planning & Zoning Board August 12, 2020 Page 3 Ms. Larsen clarified the new trail would be a standard 8 ft. wide bituminous bike trail. Mr. Laden preferred to have the building pulled forward and have the front face Main Street. He recommended the back side of the building be addressed since the drive thru traffic will be driving through the back parking lot in view of the garbage, back doors, etc. He suggested incorporating shrubs and alternative screening options on the side of the building. Mr. Root questioned, with the future development of Outlots E and F, if a path would be installed between adjacent buildings to provide access for pedestrians. Mr. Vojtech speculated if there will be congestion issues when considering the traffic from the drive thru, the parking lot traffic, and the foot traffic of pedestrians. He wondered, if the building is moved to the south and there is no parking on the south, if the drive thm could be rerouted north of the parking lots thereby eliminating the possible issue of pedestrians walking across the drive thru lane and decreasing the amount of congestion between the drive thru and the parking lot. Mr. Reinert reiterated his desire to examine any existing data that would assist the board in making a decision on the placement of the building. He explained analyzing that data would then help the board determine what is better for the businesses that are occupying the space so the board could make a more informed decision. IL '0 Chair Tralle explained the building should face Main Street so the occupying businesses are exposed to passersby. He also stated to position the back of the building facing Main Street would be a mistake as those passing by would be viewing the businesses' dumpsters and heating and cooling units. He recommended the drive thru configuration be reviewed. Ed Farr, from Edward Farr Architects, appreciated the board's observations about the project and agreed with Chair Tralle's statement concerning the building's orientation. He further expounded if the building was moved south towards Main Street, they would still want the building rear -loaded for delivery vehicles and have the driveway around the southernmost part of the building. The drive-thru would be placed in the southeast corner and congestion would likely occur with drive-thru vehicles and delivery trucks. He commented the current preliminary plat and site plan will look much better with the storefront facing Main Street. He stated this design is a superior solution and feedback received from tenants and leasing agents supports it. Mr. Farr explained it is their project's intention to comply with all of the staff recommendations for the conditions of approval listed in the staff report. They will be addressing the roadway configuration items and pedestrian safety issues. They will also upgrade the landscape plan to comply with zoning regulations and to address comments made regarding landscape buffers and screening. He shared they will be providing another 5 ft. of property to the west in order to comply with the 10 DRAFT MINUTES Planning & Zoning Board August 12, 2020 Page 4 ft. side yard setback. The lighting plan will also be upgraded. He further commented the two ground signs in the public way will be accepted. Lastly, he appreciated the board's support of the building being placed further to the north for best tenant visibility. Mr. Root asked if Mr. Farr to comment on his suggestion to incorporate a pedestrian access between buildings and between sites. Mr. Farr stated they are proponents of a strong pedestrian access as they believe it is good for business and the community. He explained, as the project develops, there will be a pedestrian connectivity plan and they look forward to developing it with the board. Mr. Root questioned Mr. Farr, if a space was reserved now for the future connection, how would he envision the development of the future connection. Mr. Farr remarked they have the space for it in their setback between the property line, which is the future street right-of-way for Street A and the parking curb. He clarified there is sufficient land for the pedestrian connectivity plan on either the public side of the right-of-way or the private side of the right-of-way. He informed the board, a trail will be provided from the single building to Main Street and a pedestrian crossing across Main Street. Chair Tralle declared the Public Hearing open at 7:11 p.m. There were no public comments. Mr. Evenson made a MOTION to close the Public Hearing at 7:12 p.m. Motion was supported by Mr. Reinert. Motion carried 6 - 0. Chair Tralle abstained. B. Lyngblomsten at Lino Lakes Addition PUD Final Plan/Final Plat Ms. Larsen, City Planner, presented the staff report. The applicant, Lyngblomsten at Lino Lakes, LLC has submitted a land use application for PUD Final Plan/Final Plat for development of Phase 1, the senior living community. Future PUD Final Plans/Final Plats will be required for development of the future commercial phases. Staff recommended approval of the PUD Final Plan/Final Plat for Lyngblomsten at Lino Lakes Addition subject to conditions listed in the staff report. DRAFT MINUTES Planning & Zoning Board August 12, 2020 Page 5 Brian Prunty, from Wold Architects and Engineers, presented the revised architectural plans. Board Comments Ms. Peacock inquired if the Lyngblomsten signage, on the exterior of the building, would stay illuminated throughout the night. She also questioned if the light will impact the residents in the units closest to the signage. Mr. Prunty remarked, since the signage is on a flat elevation to the windows, there should not be a lot of light infiltration for the nearby units. He acknowledged the timing about how long the lights will be on was not discussed with the owner. Mr. Root stated he is not completely satisfied with the HVAC chases and would have preferred to see them incorporated into the building. He expressed support for the land use and acknowledged his objections to the design are subordinate to the overall approval of the use; therefore, Mr. Root stated he would vote to approve the final plan/final plat, but reluctantly. Ms. Peacock agreed with Mr. Root. She communicated her dissatisfaction with the windows and expressed concern that the white siding on the building's exterior may discolor over time. She said she would also vote to approve the final plan/final plat, but acknowledged the final plan is not exactly what she would love to see. Mr. Laden commented even though the board was not able to get everything they desired architecturally, the project as a whole is a good project. He asked when the future commercial development on the corner begins, if the restaurant will be sure to have the trash enclosures incorporated into the building. Ms. Larsen assured Mr. Laden the trash enclosures will be incorporated into the building unless there is a formal approval and change by the City Council. Mr. Reinert made a MOTION to recommend approval of the PUD Final Plan/Final Plat for Lyngblomsten at Lino Lakes Addition subject to conditions listed in the staff report. Motion was supported by Mr. Evenson. Motion carried 6 - 0. Chair Tralle abstained. C. 6508 West Shadow Lake Drive Variance Ms. Larsen, City Planner, presented the staff report. Anoka County Highway Department, on behalf of Patrick and Patricia Barry, submitted a Land Use Application for building setback and fence height variances. This is related to the 2021 reconstruction project of Birch Street from Hokah Drive to Old Birch Street and necessary acquisition of road right-of-way. The proposed development is a PUD residential community located south of NorthPointe and east of CSAH 54 (20t' Avenue) and west of I-35E. It contains 4 parcels totaling approximately 63 gross acres. Future land use applications may include: • Comprehensive Plan Amendment o Land Use ■ Re -guide 1 parcel from Urban Reserve to Low Density Residential o Utility Staging Area ■ Move 1 parcel from Stage 3 (Post 2040) to Stage IA (2018-2025) • Rezone property from R, Rural to PUD, Planned Unit Development • PUD Development Stage Plan/Preliminary Plat 1 • PUD Final Plan/Final Plat This staff report is based on the following submittals: • Context and Concept Plan Layout prepared by Sambatek dated July 20, 2020 • Photos of Housing Products submitted by the applicant on July 10, 2020 ANALYSIS Proposal The applicant is proposing the following residential unit types: Single Family Lots (60 ft lot width) = 91 units Single Family Lots (40 ft lot width) = 11 units Senior Housing Building = 50 units TOTAL = A& 152 units The 40 ft wide lots would have 5 ft side yard setbacks, two car garages and 2 story, split entry walkouts and villas. The 60 ft wide lots would have 5 ft side yard setbacks, 3 car garages and 2 story, split entry walkout. Proposed front and rear yard setback and garage size information was not provided. Comprehensive Plan and Housing Density At the time of this staff report, the City's draft 2040 Comprehensive Plan was under review by Met Council with tentative City Council approval in November 2020. This PUD Concept Plan is being reviewed against the draft 2040 Comprehensive Plan. The development proposes to incorporate Outlot A, NorthPointe 5t' Addition. Per Resolution No. 14-21 approving the NorthPointe PUD Development Stage Plan/Preliminary, "...Outlot C shall be developed in a future phase as an age -restricted (55+ years of age) multiple family dwelling consistent with the regulations of the R-4, High Density Residential District with underground parking for 50% of the required stalls and at a density of 20 to 25 dwelling units per acre" It should be noted that Outlot C of the preliminary plat is now final platted as NorthPointe 5t' Addition Outlot A and will be referenced as such throughout this report. The outlot was proposed as an 88 unit senior housing complex in the NorthPointe development. The Burque proposal shows this outlot with a 50 unit senior housing complex. Two of the 3 Burque parcels are guided low density residential per the 2040 Comprehensive Plan. One Burque parcel is guided Urban Reserve. NorthPointe 5 h W Addition, Outlot A is guided medium density. The applicant is proposing to "transfer" some of the density from NorthPointe 5th Outlot A over the entire Burque property development. The entire development's net acreage is 29.30. The required density range would be 3.97 to 5.83 units per acre which equates to 116 to 171 housing units. The applicant is proposing 152 housing units at 5.19 units per acre. This is consistent with the density range. Staff Comments: 1. Additional wetland buffers and arterial road right-of-way dedication will affect the net density. 2. A Comprehensive Plan Amendment is required to re -guide the one (1) Burque parcel from Urban Reserve to Low Density Residential. Rezoning The property is currently zoned R, Rural and is guided for low density residential land use. Per the zoning ordinance, land that is guided low density residential can be zoned R- 1, Single Family Residential, R-IX, Single Family Executive Residential or R-2, Two Family Residential. The property would need to be rezoned to PUD, Planned Unit Development in order to allow for 40 ft wide lots with 50 ft of road right-of-way and allow for the "density transfer" between NorthPointe and Burque property. Staff Comment: 1. The applicant would need to provide additional public benefit in order to be considered for PUD zoning. More detailed information is required to analyze each lot in regards to lot sizes, lot widths and depths and setbacks. The R-2, Two Family Residential zoning district is being used as a baseline zoning district for comparison. The R-2 zoning district allows for 60 ft wide lots and minimum 7,500 sf lot sizes. The following chart shows a comparison of the R-2 District standards to the proposed Burque property single family detached homes. Staff Comments: 1. Several lots include the wetland, wetland buffer and/or floodplain. Lots shall not include either of these. 2. Lot widths shall be measured at the setback line. 3. The lots abutting CSAH 54 and I-35E shall have greater depth. 4. Staff would not recommend side yard setbacks less than 7.5 ft for both principal and arterial structures. Building Design Standards More information is required regarding the proposed building design standards for both the senior building and single family. Photos of the proposed single family homes were provided. It does not appear the homes meet the minimum standards of the R-2, Two Family District in regards to protruding garages and front porch widths. No building elevations or photos of the senior building were provided. Staff Comment: 1. The senior building and single family homes shall exceed minimum City ordinance standards if PUD is considered. 5 Surrounding Zoning and Land Use Direction Zoning Current Land Use Future Land Use North PUD Single Family Medium Density Residential South R, Rural Rural Residential Urban Reserve East R, Rural Rural Residential Low Density R-1, Single Family Single Family Urban Reserve West R, Rural Agricultural Urban Reserve Subdivision Ordinance Blocks and Lots The proposed development provides 102 single family lots, and one 50 unit senior housing building. Outlots would contain wetlands, buffers, stormwater ponds etc. The lots vary in width, depth and lot size as may be allowed per the PUD flexibility. Staff Comment: • The block of 40 ft wide lots at the northwest corner of do not appear feasible due to the need for additional CSAH 54 and local road right-of-way dedication, lot depth, buffers, cul de sac design etc. Streets and Alleys CSAH 54 (20th Avenue) is A -Minor Arterial Reliever. I-35E is a Principal Arterial. CSAH 34 (Birch Street) is a major collector road. Cypress Street and Chestnut Street are local roads intended to serve the site from the north. Per the City's Transportation Plan, Birch Street is to extend west and connect with Cypress Street. The majority of the proposed interior local roads have 60 foot wide right of way as required. One section of right of way is 50 ft wide with a "half cul de sac". Road width information was not provided, but they should be a minimum 32 foot wide back to back. The south access point into the development from CSAH 54 (20th Avenue) is approximately 1,300 ft south of Birch Street and appears to meet access spacing guidelines. Staff is aware of current traffic concerns at I-35E/CR J/20th Avenue and Centerville Road. The interchange is currently under evaluation by government agencies including MnDOT, Anoka County and Ramsey. MnDOT has installed temporary signals at the on/off ramps of I-35E/CR J. Anoka County is considering a transportation funding application for improvement of the Centerville Road/CR J intersection. Ramsey County no is working on a federal transportation funding application to reconstruct bridge and ramp terminals and CR J/Centerville Road intersection. Staff Comments: • The applicant shall work with the property owner of 6620 20th Avenue to obtain necessary road right-of-way to connect Birch Street and Cypress Street. • Local road right-of-way shall be a minimum of 60 ft wide. • Cul de sacs shall not exceed 500 ft in length and bulbs shall meet City standards. • Additional road right of way along CSAH 54 shall be required. • Access shall be provided to the parcels south of the proposed development. • A traffic study shall be required. • Anoka County Highway Department is in receipt of the concept plan and will provide additional comments on the development. • Sidewalks and trails shall be incorporated throughout the development. • The south connection to CSAH 54 (201h Avenue) shall occur in the first phase of development. • Sidewalks shall be incorporated though out the development. • A noise study for the entire development is required. Staff anticipates a noise wall will be required along I-35E. Easements Staff Comments: • Standard drainage and utility easements at least 10 feet wide shall be provided along all lot lines. • Drainage and utility easements shall also be dedicated over stormwater management facilities. • Conservation easements shall be required over wetlands and greenway corridors. Stormwater Management and Erosion and Sediment Control The concept plan does not show stormwater management facilities. Staff Comment: • A stormwater management plan and erosion and sediment control plan in accordance with Chapter 1011 shall be required. Utilities Public water, sanitary and storm sewer utilities will be installed within the development. The site is located in Sanitary Sewer District 3 (Sub -district 3C). Flow is collected along East Cedar Street and conveyed east to MCES Meter M220. 7 Outlot A, NorthPointe 5th Addition is located in Utility Staging Area 1 A (2018-2025). Two of the 3 Burque parcels are in Utility Staging Area 1B (2025-2030). The 3rd Burque parcel is in Utility Staging Area 3 (Post 2040). Municipal water and sanitary sewer utilities to serve the Burque development exist along Cypress Street and Chestnut Street in NorthPointe. Staff Comments: • Per the City Engineer, sanitary sewer to serve this development shall come from Cypress Street. The sewer line in Chestnut Street does not have enough depth to serve the proposed development. • A comprehensive plan amendment to move from Utility Staging Area 3 to IA is required. Parks, Greenways and Trail Plan Per the draft 2040 Parks, Greenways and Trails Plan, this development is within the NorthPointe Park service area. No future land dedication or park development is required. A greenway corridor exists along the wetland and ditch. A proposed trail is shown on the plan extending from the existing trail on Chestnut Street to Birch Street. A proposed on -street bike route is shown along CSAH 54 (20th Avenue). The City will require cash in lieu of land dedication. Any required trail construction costs will be credited from the total payment in lieu. Staff Comment: • Additional trails along the wetland corridor shall be evaluated. The threshold computation of unattached units (102) and attached units (50) is less than one. The majority of the site is outside the I-35E AUAR Corridor. Outlot A in NorthPointe is within the AUAR and was evaluated as part of that development. N. Wetlands The PUD concept plan indicates 34.61 acres of wetlands and buffers on site. The buffers are shown as 20 ft wide. Both RCWD and VLAWMO are the local governing units (LGU) for administering the Wetland Conservation Act (WCA). NorthPointe 5tn Addition Outlot A is in RCWD. The balance of the site is in VLAWMO. Staff Comments: • A wetland delineation report and VLAWMO and RCWD approval shall be required with a PUD Development Stage Plan/Preliminary Plat submittal. • Wetland buffers consistent with RCWD regulations (50 ft wide average, monument signs etc.) may be required as part of the PUD. • Wetland restoration may be required as part of the PUD. Floodplain The FEMA Floodplain Map indicates Zone A flood plain on the subject property. Staff Comments: • A Base Flood Elevation is required to be determined, using detailed methods acceptable by the Federal Emergency Management Agency (FEMA). • A FEMA CLOMR and LOMR are required for this site. • The CLOMR shall be submitted with a PUD Development Stage Plan application. Shoreland District The subject property is not located within the Shoreland Management Overlay District. Additional Comments The PUD Concept Plan has been sent to Anoka County Highway Department and Lino Lakes Public Safety for review and comment. At the time of this staff report, comments have not yet been received. Any comments received will be shared with the Board and Council. Environmental Board Comments The Environmental Board reviewed the PUD concept plan on August 26, 2020. General comments included the need for wetland restoration, buffers, stormwater management and noise study. I PUD Development Stage Plan/Preliminary Plat The City's review and comments on the concept plan's relation to the Comprehensive Plan and development regulations does not grant any rights to the applicant to develop the property as depicted by the concept plan. Engineering • Erosion Control & Grading The proposed Burque Property project would require mass site grading, appurtenant erosion control and SWPPP. • Stormwater Management The Burque owned area of the site, 58.24 acres, overland flows to onsite private ditches that then flow through a culvert under 20th Ave and eventually outlets to Lake Amelia within VLAWMO. The Emmerich (Outlot A Northpointe 5th Addition) owned parcel, 4.48 areas, drains through the Northpointe Development which outlets through a culvert under 135E to JD3 within RCWD. There is a culvert under 135E at the Burque Property that brings water from the east side of 135E to the site. The concept plan does not identify proposed surfacewater management. The applicant will be required to meet the City of Lino Lakes and RCWD rules for surfacewater management. We anticipate a reduction in the amount of proposed lots to accommodate drainage. This could lead to a change in the proposed densities. • Water Supply There is an existing 16-inch diameter trunk watermain within Cypress St that will need to be looped to the existing 16-inch diameter trunk watermain at Birch St. A 12-inch diameter watermain will need to be extended south through the property or along 20th Avenue. It should then loop back to the existing 8-inch diameter watermain within Chestnut St. • Sanitary Sewer There is existing 8-inch polyvinyl chloride (PVC) sanitary sewer within Cypress St that will need to be extended south to serve the south portion site. The sanitary sewer at Chestnut St is not deep enough to serve the south portion site. We recommend that the City consider project phasing such that the utilities are extended to the south with the first phase. • Transportation The Burque property is adjacent to 1-35E which is a Principal Arterial, 20th Avenue (CSAH 54) which is A -Minor Arterial Reliever, Birch Street (CSAH 34) is a Major Collector road, Cypress Street and Chestnut Street are local roads. Cypress Street is planned to be connected to Birch Street as outlined in the City's Comprehensive Plan. A traffic study will be required for the site. Based on ITE Traffic Generation rates, the proposed development is anticipated to generate a total of 1,148 daily trips, 86 AM peak hour trips and 114 PM peak hour trips. Ms. Katie Larsen 09/02/2020 Page 2 Sidewalks and trails will need to be extended through the site. 1. Staff informed the applicant that there will be no additional traffic allowed on Red Oak. The Northpointe Traffic Study completed in 2013 included anticipated traffic from a proposed senior apartment complex on outlot C. Based on ITE rates at the time, the senior apartments would generate 292 daily trips, 17 AM peak hour trips and 21 PM peak hour trips, compared to the proposed site that would generate 185 daily trips, 10 AM peak hour trips and 13 PM peak hour trips. The Traffic Study should address this change. The traffic study shall include the intersections of Red Oak and 20th Avenue, 215t Avenue and Cedar Street, Birch Street and 201h Avenue and 201h Avenue at the proposed site intersection. The analysis should address the intersection geometrics (i.e. turn lanes) and traffic control needed to accommodate the proposed site development. 2. The Northpointe Traffic Study should be reviewed to determine if all improvements recommended have been completed or still required. 3. The applicant will need to receive approval from Anoka County for the site access to 20th Avenue. The proposed access is approximately 1,300 feet south of Birch Street. It is anticipated that they will require left and right turn lanes on 20th Avenue. 4. The City will review the access location for conformance with our Comprehensive Plan and future development / access to the west of 20th Avenue. 5. Right of way shall be provided at the impacted intersections to accommodate any required or future improvements. In addition, right of way shall be provided east of the Birch Street for the future connection to the existing Northpointe development. 6. A noise study will be required, and noise attenuation should be accounted for in plat layout. Currently there is no space provided for noise attenuation and we anticipate this will impact to the proposed plat layout/ density. • Wetlands The site includes 35 acres of wetland and buffer. An approved wetland delineation will be required. The applicant will need to work with both RCWD and VLAMWO for Wetland Conservation Act regulations. • Landscaping The landscaping will be reviewed with a future submittal. • Floodplain The site includes 60-70% Zone A Floodplain. A Base Flood Elevation will need to be determined and approved by FEMA. A LOMR will be required and floodplain mitigation will be required as applicable. • Drainage and Utility Easements Drainage and Utility easements, through 6620 20th Avenue, will be required to extend municipal utilities from Cypress Street to the proposed development. The proposed public road serving the portion of the site near Birch Street will require Right of Way from the parcel located at 6620 20th Avenue. Right of way along 20th Ave will need to be dedicated along with the proposed internal local roadways. Conservation easements will be required over wetlands. She is requesting a metal roof with exposed fasteners be allowed. City ordinance allows for metal roofs with standing seam (i.e. hidden fasteners). ANALYSIS In the summer of 2020, the property owner prepared to submit a building permit application to replace the roof on the house. The application included a Menards specification sheet detailing the roofing materials as Emerald Green Premium Pro -Rib Steel Panel with an exposed fastener panel system. City ordinance does allow for metal roofs; however, they must be standing seam (i.e. hidden fasteners). Per Section 1007.043(2)(a): 3. Single family dwellings shall have at least a four/twelve (4112) roof pitch and shall be covered with shingles or tiles or a standing seam metal roof. Per Section 1007.043(4)(i)4.g., this criteria applies to both single family dwellings and accessory buildings. g. Roof and exterior color and material compatible with home (except manufactured tool shed). The property owner ordered the materials before applying for the building permit. These are custom cut metal sheets and per the property owner, cannot be returned to the store or manufacturer. The total cost is approximately $2,000. The issue is the aesthetic value of the exposed fasteners. The intent of requiring standing seam metal roofs is so the fasteners (i.e. screws) are not visible. The property owner is also requesting the same roofing materials be allowed on the two (2) detached accessory structures (garages). Staff is asking for Planning & Zoning Board input on this request. CRITERIA AND FINDINGS OF FACT No variance shall be granted unless it meets all the criteria in paragraphs 1. through 7. below. The City shall make findings regarding compliance with these criteria. 1. The variance shall be in harmony with the general purposes and intent of the ordinance. The general purpose and intent of the General Provisions section of the Zoning Ordinance is to establish general development performance standards. These standards are intended and designed to assure compatibility of uses; to prevent urban blight, deterioration and decay; and to enhance the health, safety and general welfare of the residents of the community. The variance to allow a metal roof with exposed fasteners is not harmonious with the general purposes and intent of the ordinance regarding the enhancement of the general welfare of the community. 2. The variance shall be consistent with the comprehensive plan. The variance request is consistent with the comprehensive plan. Per the Comprehensive Plan, the property is guided for Low Density Residential land use. The existing land use is single family residential with a single family dwelling unit and detached garage. 3. There shall be practical difficulties in complying with the ordinance. "Practical difficulties," as used in connection with the granting of a variance, means that the property owner proposes to use the property in a reasonable manner not permitted by the ordinance. Economic 2 considerations alone do not constitute practical difficulties. Practical difficulties include, but are not limited to, inadequate access to direct sunlight for solar energy systems. The property owner proposes to use the property in a reasonable manner; however, there is no practical difficulty in complying with the required standing seam metal roof. 4. The plight of the landowner shall be due to circumstances unique to the property not created by the landowner. The plight of the landowner was created by the owner purchasing a metal roof with exposed fasteners prior to obtaining a building permit. There are no unique circumstances to the property causing them to not be able to comply with the ordinance. 5. The variance shall not alter the essential character of the locality. The variance will not alter the essential character of the locality which is a single family residential neighborhood with houses and garages. 6. A variance shall not be granted for any use that is not allowed under the ordinance for property in the zoning district where the subject site is located. The property is zoned R-1, Single Family Residential and single family detached homes and garages are permitted and accessory uses. 7. Moonen & City Council For the Property at 7831 Lake Dr. Lino Lakes, MN, 55014 Right after we moved in we were told we couldn't have 2 sheds a house & a garage. So we had the house & existing garage reroofed because the house was leaking & built another garage in the back of the property bacause we have to be 45 ft away from the power lines that goes though the middle of our property. Meanwhile I had been helping my boyfriend with his house inside & out (see pictures), we put this roofing material on his house & we used smart siding (see picture). Since then we got hail damage which damaged the 3 roofs & the vinyl siding on the back garage. So my boyfriend said we should use the insurance money & put metal roofs on & put smart siding on the back garage as it's a more durable material. So I asked him if he would help us he said yes. Knowing I would have to order the materials that would take a few week I did. Menards lists this material as residential roofing (see pictures). After getting the materials (see pictures), we had to wait for a weekend with nice weather & for my son to not have National Guards duty before we could get started as we both also work during the week. Then I called Parick to see if we need to have a permit to reroof our 3 bldgs. He said that we did but we could get 1 permit that would cover all 3 roofs for $104.00 So I called city hall to get their hours & after work on 7/30/20 1 stopped to get the permit. They said I couldn't use this type of roofing materials. I have already bought the material & can't take them back because they are special order & special cut parts. I ask that you allow us to use this roofing materials to roof our house. I also ask that you allow us to use this same materials to roof the 2 garages.
