CALL TO ORDER AND ROLL CALL: Mr. Sullivan called the Lino Lakes Environmental Board meeting to order at 6:31 p.m. on August 26, 2020. II. PLEDGE OF ALLEGIANCE II. APPROVAL OF AGENDA The Agenda was approved as presented. III. APPROVAL OF MINUTES August 26, 2020 Ms. Andrzejewski made a MOTION to approve the August 26, 2020 Meeting Minutes. Motion was supported by Mr. Schwartz. Motion carried 6 - 0. V. OPEN MIKE Mr. Sullivan declared Open Mike at 6:33 p.m. Open Mike was closed at 6:34 p.m. DRAFT MINUTES Environmental Board August 26, 2020 Page 2 VI. DISCUSSION ITEMS A. Meeting Attendance and Quorum Mr. Sullivan did a brief overview of Chapter 217 in Code of Ordinances which goes over the duties of the Environmental Board as well as the meeting attendance and quorum requirements. B. Land Use Application Process Mr. Sullivan did a quick summary of the land use application process and cost of different fees. He would like to thank Ms. Larson for the work in putting the information together. VII. ACTION ITEMS A. Planned Unit Development General Concept Plan Review for Burque Property Mr. Nelson described the plan unit developmentment of four parcels into 102 single family homes and a 50 unit senior housing building that would be located directly south of the Northpointe subdivision. These parcels have 23.01 acres of developable land, 34.61 acres of wetland and buffers, and 6.29 acres of street ROW(street right of way). This project would involve rezoning parcels from rural to residential. Most of the site has been used for agriculture in the past. There are opportunities for wetland restoration associated with this project. Storm water on the site heads south to Amelia Lake through private ditches. Storm water management plan will have to be submitted. The project will require an NPDES permit and SWPPP. The site falls within the flood management zone. Flood zone should not encroach into lots if feasible. A wetland delineation will be required and Vadnais Lake Area Water Management Organization (VLAWMO) is responsible for administering the Wetland Conservation Act. VLAWMO will provide decisions regarding any wetland impacts that are proposed to occur during the course of development. The wetlands are considered high priority in the Resource Management Plan. This project should include wetland buffers of 50 feet on average with a 25 foot minimum. There maybe opportunities to restore hydrology on the site by minmizing runoff to the private ditch. DRAFT MINUTES Environmental Board August 26, 2020 Page 3 The northeast portion of the site containing the senior housing building falls within the AUAR boundary. There is an area on the site that is part of the City's Greenway System in the 2040 Comprehensive Plan and that should be established. A detailed tree inventory and preservation plan will have to be submitted and as well as a detailed landscape plan. Mr. Eric Luth, civil engineer with Sambatek, Inc. followed up with his concerns - The majority of the trees are low quality trees, but will do a full tree survey - Wetlands in our opinon in our review is low quality wetlands. So wondering what the reason for the 50 foot wide buffer, the development to the north does not seem to have the same setback. Is the buffer to a builing, to a lot line or what. - Also the trail adds another layer of difficulty. Mr. Grochala stated that several years ago the City partnered with Rice Creek Watershed District and for the comprehensive wetland management plan that covered the entire city. Assessments of all the wetlands and was looked at from a number of factors such aswhether they were under single ownership, importance for flood management, their importance as a water quality corridor, storm water retention, wildlife habitat, soil characteristics and so forth. This area was identified as having high priority wetlands. Given that it is in our greenway corridor and a high priority wetland in our comprehensive wetland management plan it would include a requested to follow buffer setback Mr. Luth would like to have further discussion about #3 the wetlands buffer requirements Mr. Grochala since developer is looking for flexibility in their design to allow for smaller lot size in our typical RI. Smaller lot size as an offset to the open space requirement. Put some of these trade offs in the concept level. And let the designers figure out best way to manage it. Mr. Schwartz stated he knows the importance of greenways corridor and also understand the restrain of having the setbacks or buffers. If the city can give a bit on the buffer and builder can restore or improve the wetlands, that would be an equitable trade off. And would like this to be added to the recommendations. Ms. Holmes would like clariffication on the board reviewing a concept plan. She wanted to know if this plan will come back to us. DRAFT MINUTES Environmental Board August 26, 2020 Page 4 Mr. Grochala noted that this is a general concept plan review, since the developer looking for flexibility in our normal standards we recommend that they go through this process of a concept plan first to get comments from the boards and City Council and the developer will see if they want to move forward. If the developer files a formal submittal and decides to move ahead the Enivormental Board will see the plan again. Ms. Andrzejewski stated that maybe taking into consideration of narrowing of streets in order to help with 50ft setback. Mr. Flower it would be helpful from the board's perceptive if we had the current average wetland setback. And then we would have something to look back on. Also Mr. Flower asked if Mr. Luth was concerned about the greenway and trail system. Mr. Luth said the trail is new to him but feels his client will be open to the trail and he belives it is a good ammenity but his question is the size of the wetland has gotten bigger and the labeled high priority. Mr. Flower mentioned it would be helpful to have what the current average is of the setback based this plan and the calulations of what the developer has. So we all have a good sense of what we are talking about regarding wetlands. Also the wetlands and greenways are a great asset to the city. Also a noise study will be done. Ms. Andzeskwi made a Motion that we forward the general concept plan review with the all the Environmental Boards recommendations. Ms. McNelly seconded the motion. Motion carried 6-0. VIII. UPDATES A. Recycling Updates Mr. Kvendru stated that Lino Park now has an organics sign posted. Anoka County sent out a flyer for residents to sign up for the Organics program with the City and at least 40 households have done so. B. Other Updates Solid Waste Abatement Team meeting was held earlier. It is all the cities getting together and go over the 2021 funding. And discuss recycling and education information. DRAFT MINUTES Environmental Board August 26, 2020 Page 5 No Fall Recycling Day but we will continue with Saturday Recycling Days Mrs. Andrzej ewski had asked about the oak wilt and trenching the trees. Mr. Nelson mentioned that he will be doing a tree survey and as far as drenching it is looked at site by site base. VIII. Respectfully submitted, Mary Fogarty 14 FAA DRAFT MINUTES ENVIRONMENTAL BOARD AGENDA ITEM 6A STAFF ORIGINATOR: Andy Nelson, Environmental Coordinator MEETING DATE: October 28, 2020 REQUEST: Bald Eagle Addition, Preliminary Plat 202 Elm Street APPLICANT: Jason Hohn Bald Eagle Builders Inc. 2025 Gateway Circle Suite 1 Centerville, MN 55038 PROPOSED DEVELOPMENT The project consists of a new lot that will be created by splitting a lot with an existing residence located at 202 Elm Street. The area is currently zoned R-1, low density residential, and is also zoned R-1 in the 2040 Comprehensive Plan. The total gross area of the existing parcel is 46,132 sq. ft. (1.06 acres). Lot 1 Total area: 27,713 sq. ft. Lot 2 Total area: 13,040 sq. ft. Elm Street area: 5,379 sq. ft. EXISTING SITE CONDITIONS Soils The soils consist of Zimmerman fine sands, which are in hydrologic group A and are excessively drained. Two soil borings were performed at the northeast and southwest corners of the proposed house pad. These borings found groundwater at 13 and 15 feet, respectively. These borings also indicated 3-5" of topsoil over primarily very fine sand and silty very fine sand. Land Cover Land cover on this site is classified as 11-25% impervious with short grass. Historical (Marschner) land cover was oak openings and barrens. Wetlands There are no wetlands indicated on site. 1 Flood Plain The site does not fall within flood plain. ANALYSIS Tree Preservation A tree inventory/removal list was submitted. Trees removed are in the basic use area and will not require mitigation trees to be planted. Residential lots require one boulevard tree per frontage. In this case, both parcels 1 and 2 have existing trees in the right-of-way that will satisfy this requirement. Any trees to be preserved that are near construction activities should be protected with tree protection fence installed at a radius of one foot per inch DBH (diameter at breast height). In this case, potential trees to protect are the boulevard white cedars, a maple behind the proposed house pad, and a row of conifers on the south perimeter of Lot 2. It should be noted that there are 10 ash trees on the two parcels, with 3 being slated for removal near the Lot 2 house pad. Because emerald ash borer infestations are increasing in the City, removal of any of the remaining ash trees on site that are not planned to be protected with insecticide injections would be recommended prior to new home construction. Storm Water Management and Erosion and Sediment Control An NPDES permit is not needed for this site as it is less than one acre. An erosion control plan has been submitted. The plan shows silt fence for perimeter control and a rock construction entrance. Storm drain inlet protection will be required for the catch basin in front of 7150 2nd Avenue. The maximum amount of impervious surface allowed per lot is 40%. Lot 1 has 4,405 sq. ft. (15.9%) of impervious surface; Lot 2 has an estimated 4,350 sq. ft. (33%) impervious surface. These lots meet the requirement. 2 RECOMMENDATIONS Recommend the approval of the subdivision plan at 202 Elm Street with the following staff comments and any further comments from the Lino Lakes Environmental Board: 1. A storm drain inlet protection BMP must be added to the catch basin in front of 7150 2nd Avenue. 2. Install tree protection fence at 1 foot radius per inch DBH (diameter at breast height) around any trees near the construction zone that are to be preserved. This may impact tree 115, the tree line on the south perimeter of parcel 2, and white cedars in the right-of-way. Silt fence should not be substituted for tree protection fence, which should be installed according to MnDot 2572 specifications. Tree protection zones should be established prior to any other construction activities occurring on site. 3. Recommend removing any ash trees on the site that are not intended to be treated for emerald ash borer in the future. ATTACHMENTS 1. Site Map 2. There are currently 317 boulevard ash trees remaining. Our goal is to treat 100 trees per year until there are less than 200 trees remaining, followed by treating half of the remaining trees each year until we have removed and replaced them all. It will take the City about 10 years to remove and replace these trees, barring acquisition of grant funding. Projected Boulevard Ash Tree Treatments and Removals 350 T— Trees remaining Trees treated It took two workers about a month to treat 101 trees in the summer of 2020 and it cost $3,353.89 for wages, chemicals, and injection equipment. 1 Increasing levels of EAB infestation are becoming more apparent around the City. Rice Creek Chain of Lakes Park has hundreds of ash trees and a growing number of infestations, which will contribute to increased infestation rates in the surrounding area. The recommended treatment interval for ash trees in heavily infested areas is once every two years. Based on injection data from 2017 to today, we could use some supplemental assistance to dependably hit our treatment goals for boulevard trees. Additionally, our current EAB response program does not offer aid to residents beyond information and advice. One option to ensure that we can hit our treatment goals, while also providing a clear pathway for residents to get their trees treated at a discounted rate, is to enter into an agreement with a contractor that provides injections. There are existing programs that are structured to include these and other benefits to the City. Program Details/Benefits: 1. Discounted rate for injections of City and residents' trees. 2. Distributes a postcard to all residents informing them about EAB, the benefits of injections, and providing a clear option for injections with contact information. 3. Establishes a website/landing page where residents can sign up for free appointments/consultations and find more information about EAB. 4. Provides the City with mapping and data for all trees injected (public and private) to assist in our EAB response planning. 5. Frees up our seasonal workers to work on other tasks, such as natural area restoration.
