HomeMy WebLinkAbout2020-003 Council Ordinances• • 1st Reading: March 23, 2020 Publication: April 21, 2020 2'' Reading: April 13, 2020 Effective: May 21, 2020 CITY OF LINO LAKES ORDINANCE NO. 03-20 ORDINANCE AMENDING MARKETPLACE PLANNED DEVELOPMENT OVERLAY (PDO) DESIGN GUIDELINES ORDINANCE NO. 03-05 RELATED TO 617 APOLLO DRIVE (RETAIL B BUILDING) The City Council of Lino Lakes ordains: Section 1: Findings of Fact 1. The City received a Land Use Application to amend the Marketplace Planned Development (PDO) Design Guidelines Ordinance No. 03-05. 2. Ordinance No. 03-05 is an amendment to the original PDO Ordinance No. 16-01. 3. Ordinance No. 03-05 regulates site plan and design guidelines for the Marketplace development. The design guidelines detail requirements for site plan, building composition, materials, lighting, signage, landscaping and building elevations. 4. The applicant is proposing to construct a restaurant with rooftop dining that will require modifications to the site plan and building elevations. 5. Per the 2001 Marketplace Site Plan, the subject site is the Retail B building. 6. Ordinance No. 03-05 states under Special Provisions #4 that substantial departures from the approved plans will require an amendment to the Planned Development Overlay (PDO). 7. The Planning and Zoning Board held a public hearing on March 11, 2020. 8. Per City Zoning Ordinance Section 1007.015(5), the Planning and Zoning Board shall consider possible adverse effects of the proposed ordinance amendment. Its judgement shall be based upon, but not limited to, the following factors: (a) The proposed action has been considered in relation to the specific policies and provisions of and has been found to be consistent with the official City Comprehensive Plan. The existing retail business and proposed restaurant are consistent with the City's Comprehensive Plan in regards to resource management, land use, housing, economic development, transportation, sanitary sewer and water supply plan and community 1 • • facilities. (b) The proposed use is or will be compatible with present and future land uses of the area. The existing retail business and proposed restaurant are compatible with present and future land uses. (c) The proposed use conforms with all performance standards contained herein. The existing retail business and proposed restaurant conforms with all performance standards with minor revisions required as noted in Resolution No. 20-26. (d) The proposed use can be accommodated with existing public services and will not overburden the City's service capacity. (e) Traffic generation by the proposed use is within capabilities of streets serving the property. Section 2: Amendment Ordinance No. 03-05 of the City of Lino Lakes is hereby amended to include the Architectural Plan Set prepared by Jamb Architects dated December 12, 2020 related to the Retail B building subject to the revisions detailed in Resolution No. 20-26. Section 3: Legal Description The subject site is legally described as Lot 3, Block 1, Lino Lakes Market Place. Section 4: Development Regulations Development of the subject site shall be in substantial conformance with the following attached exhibits from the Architectural Plan Set prepared by Jamb Architects dated December 12, 2020 subject to the revisions detailed in Resolution No. 20-26: Exhibit A: Sheet T1.1, Title Sheet Exhibit B: Sheet A1.1, Site Plan Exhibit C: Sheet A2.1, Tenant Basement Plan Exhibit D: Sheet A3.1, Tenant Floor Plan Exhibit E: Sheet A4.1, Tenant Floor Plan -Roof • • • Exhibit F: Sheet A6.0, Existing Exterior Elevations Exhibit G: Sheet A6.1, Exterior Elevations Exhibit H: Sheet A6.2, Roof Top Exterior Elevations Exhibit I: Color Rendering Section 5: Effect This ordinance shall be in force and effect from and after its passage and publication according to the Lino Lakes City Charter. The other provisions of Ordinance No. 03-05 are still in effect. Adopted by the Lino Lakes City Council this 13th day of April, 2020. The design guidelines detail requirements for site plan, building composition, materials, lighting, signage, landscaping and building elevations; and WHEREAS, the applicant is proposing construct a restaurant with rooftop dining that will require modifications to the site plan and building elevations; and WHEREAS, per the 2001 Marketplace Site Plan, the subject site is the Retail B building; and WHEREAS, the subject site is legally described as Lot 3, Block 1, Lino Lakes Market Place; and WHEREAS, Ordinance No. 03-05 states under Special Provisions #4 that substantial departures from the approved plans will require an amendment to the Planned Development Overlay (PDO); and WHEREAS, a public hearing was held before the Planning & Zoning Board on March 11, 2020, and the Board recommended approval of the site and building plans modifications with revisions. NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes hereby makes the following findings: FINDINGS OF FACT (a) The proposed development application must be consistent with the policies and recommendations of the Lino Lakes Comprehensive Plan including: 1. Land Use Plan. 2. Transportation Plan. • • • 3. Utility (Sewer and Water) Plans. 4. Local Water Management Plan. 5. Capital Improvement Plan. 6. Policy Plan 7. Natural Environment Plan. The existing retail business and proposed restaurant are consistent with the City's Comprehensive Plan in regards to the land use plan, transportation plan, utility plans, local water management plan, capital improvement plan, policy plan and natural environment plan. (b) The proposed development application is compatible with present and future land uses of the area. The existing retail business and proposed restaurant are compatible with present and future land uses. (c) The proposed development application conforms to performance standards herein and other applicable City Codes. The existing retail business and proposed restaurant conforms with all performance standards with minor revisions required as detailed in this resolution. (d) Traffic generated by a proposed development application is within the capabilities of the City when: 1. If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade. 2. If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C. 3. If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D. 4. The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better. 5. Existing roads and intersections providing access to the subdivision must have the structural capacity to accommodate projected traffic from the proposed subdivision or the developer will pay to correct any structural deficiencies. 6. The traffic generated from a proposed subdivision shall not require City street improvements that are inconsistent with the Lino Lakes Capital Improvement Plan. However, the City may, at its discretion, consider developer -financed improvements to correct any street deficiencies. 7. The LOS requirements in paragraphs 1. to 4. above do not apply to the I- 35W/Lake Drive or I-35E/Main St. interchanges. At City discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Dept. of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the subdivision project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties that contribute to traffic at the interchange. 8. The City does not relinquish any rights of local determination. The traffic generated by the existing retail business and proposed restaurant are within the capabilities of the streets serving the property and meet LOS requirements. The City will not relinquish any rights of local determination. (e) The proposed development shall be served with adequate and safe water supply. The existing retail business and proposed restaurant will be served with adequate and safe water supply. (f) The proposed development shall be served with an adequate or safe sanitary sewer system. The existing retail business and proposed restaurant will be served with adequate and safe sanitary sewer. (g) The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. No City funds are being expended for this development. (h) Development shall be permitted only in such a manner that the maximum number of trees shall be preserved. It shall be the duty of the person seeking approval to demonstrate that there are no feasible or prudent alternatives to the cutting of trees on the site. 3 • • • The existing retail business and proposed restaurant does not propose any tree removal. If tree removal is necessary, additional trees and/or landscaping may be required. BE IT FURTHER RESOLVED by The City Council of the City of Lino Lakes hereby approves the site and building plan modifications to 617 Apollo Drive subject to the following conditions and/or items being addressed: 1. A Site Improvement Performance Agreement shall be approved by the City Council and executed and securities submitted to the City prior to site improvement construction. 2. Screen fencing may not block egress paths. 3. Construction details, material boards and color palettes are required for the following: a. Ground mounted block wall. b. Rooftop fence screening. c. Rooftop metal safety guardrails. 4. Details for stairway lights are required. 5. Sheet T1.1, Title Page: a. Revise title from Eagle Liquors to 617 Apollo Drive. b. Revise parking calculations to be consistent with page 5-6 of the March 23, 2020 Council Staff Report. 6. Sheet A1.1, Site Plan: a. The ground mounted 6 foot high cedar fence shall be replaced with a 6 foot high block wall for the north 2 sections and a 9 foot high continuous block wall for the south 2 sections. i. The block wall should match existing building materials and colors. b. The sidewalk and striped pedestrian crossing across Marketplace Drive as required with construction of the original building shall be completed. c. The landing pad for middle door shall be inarked. d. The middle door may need to be wider for emergency exit requirements. e. A concrete sidewalk shall be extended from the landing of the exterior staircase to the existing sidewalk. 7. Sheet A6.0, Existing Exterior Elevations: a. The plan sheet does not accurately show the existing metal overhead door that replaced the glass windows. i. Are the overhead doors being replaced with glass windows? 8. Sheet A6.1, Exterior Elevations: a. The ground mounted 6 foot high cedar fence shall be replaced with a 6 foot high block wall for the north two (2) sections and a 9 foot high continuous block wall for the south two (2) sections. i. The block wall should matchexisting building materials and colors. b. The rooftop 6 foot high stained cedar fence shall be a neutral color. c. Under Exterior Elevation Keynote the last #23 shall be revised to #25. d. The block wall shall be high enough to screen the exhaust unit. a. Restroom exhaust location and details shall be shown. b. Dishwasher exhaust location shall be clearly shown. i. Is it above or into the trash enclosure? Adopted by the Council of the City of Lino Lakes this 23rd day of March, 2020.
