EXTRACT OF MINUTES OF MEETING OF THE CITY COUNCIL OF
THE CITY OF LINO LAKES, ANOKA COUNTY, MINNESOTA
A regular meeting of the City Council of the City of Lino Lakes,
Anoka County, Minnesota was duly held in the City Hall, City of Lino
Lakes, at 8:00 P.M., on the 28th day of June, 1976 at which meeting the
following members were present: Acting Mayor Richard Zelinka and
Councilmen Harvey Karth and John McLean.
Mr. John McLean introduced the following Resolution•,': and moved its
adoption:
A RESOLUTION SPECIFYING THE INTENT OF THE CITY OF LINO LAKES TO
PREPARE AND ADOPT PLANS AND REGULATORY CONTROLS TO ASSURE THE PRO-
TECTION OF METROPOLITAN AND CITY OF LINO LAKES INVESTMENTS IN THE
LINO LAKES INTERCEPTOR.
WHEREAS, the Metropolitan Council has approved plans and specifications
for the Lino Lakes interceptor and has directed the Metropolitan Waste
Control Commission to provide service to existing platted parcels of
land in the Country Lakes Addition, the Shenandoah Addition and to
existing mobile home sites in the Baldwin Lake Trailer Park: and
WHEREAS, the Metropolitan Council has expressed its expectation that
Lino Lakes,by December 31, 1976, should prepare and adopt plans and
regulatroij controls to assure the protection of lletropolitan and Lino
Lakes investments in the Lino Lakes interceptor; and
WHEREAS, the Metropolitan,Counc`ilrr has indicated these plans and regulatory
controls should include zoning ordinance amendments, private sewage
disposal regulations and interim development controls applicable to
"problem areas" whichawill ensure development densitites and capacities
to forestall the premature expansion and extension of the Lino Lakes
intep.ceptor; and
WHERAS',at the request of the City, the Metropolitan Council staff has
provided :further definition of the expected plans and regulatory
controls;' and
WHEREAS, the City of Lino Lakes is willing to provide the Metropolitan
Council plans and regulatory controls to coincide with the completion
of the Lino Lakes interceptor;
NOW THEREFORE BE IT RESOLVED by the City Council of the City of Lino Lakes:
1. The City will prepare and adopt plans and regulatory controls to
protect metropolitan and City of Lino Lakes investments in the
Lino Lakes Interceptor.

2. The City will accomplish plan and regulatory control adoption
by December 31, 1976.
3. The City will prepare and adopt plans and regulatory controls which
address Metropolitan Council expectations in the following areas:
a. The City will define an urban service area based on the capacity
of the Lino Lakes Interceptor in the area served by the interceptor
and will generally define methods of allocating interceptor
'capacity during the next fifteen years within this urban service
area. The Lexington Park Lakeview area will also be defined
as an urban service area based on allocation of capacity in
the Blaine Interceptor.
b. Outside ofthe urban service area the City will establish
development density standards. These standards will apply
on an interim basis while the City develops and adopts'a long-
term rural area growth management strategy through the municipal
comprehensive planning process.
c. The City will amend its zoning ordinance to include a restrictive
soils provision.
d. The City will define existing and potential septic tank problem
areas and adopt appropriate offical controls to assure that
development in such areas will not create additional or new
pollution problems.
e. If Minnesota Pollution Control Agency on -site sewage disposal
installation and maintenance standards are promulgated by
November 1976, the City will adopt an ordinance consistent with
them. If MPCA regulations are not -enacted by November 1976,
the Cil'y will add on -site disposal system maintenance provisions
to the current City septic tank regulations which will be used
until the MPCA regulations become law. In either case the City
will adopt on -site sewage disposal provision which will provide
for the following:
1) Minimum standards for the installation of new systems.
2) Minimum standards and procedures for monitoring and main-
taining new and existing disposal systems.
3) Methods of improving existing systems which need upgrading
to meet the established minimum standards.
4) Cooperate with Anoka• County Comprehensive Health Board and
the Rice Creek Watershed Board for groundwater quality
monitoring in areas with septic tank systems.
5) Provide public information for on -sit disposal system
operation and maintenance.
6) Positive support for City enforcement personnel to administer
the above regulations.

The motion for the adoption of the foregiong Resolution was duly
seconded by Councilman Zelinka and upon vote being taken thereon,
all Members present voted in favor thereof. Whereupon the said
Resolution was declared duly passed and adopted.
