ORDINANCE RELATING TO TRAFFIC AND PROVIDING FOR LOAD RESTRICTIONS TED VILLAGE COUNCIL OF THE VILLAGE OF LINO LATE, MINNESOTA, DOES ORDAIN: SECTION 1 - By reason of deterioration, rein, snow or other climatic con- ditions, Village streets ere, or may be seriously damaged or destroyed unless the use of vehicles thereon ie prohibited or the permissible weights thereof reduced, it is necessary that authority for such prohibition or reduction of permissible weights be enacted by. the Village of Lino Lakes. SECTION 2 - The Police Department or the Chairman of the Road and Bridge Commission of the Village of Lino Lakes shall have, and is hereby granted, the authority es to any street within the jurisdiction of the Village of Lino Lakes to prohibit the use thereof by vehicles or impose restrictions es to the weight of vehicles to be operated thereon whenever such street by reeson of deterioration, rein, snow or other climatic conditions is being or may be seriously damaged or destroyed, unless the use of vehicles thereon is prohibited or the permissible weights thereof reduced. SECTION 3 - Such prohibition or restriction period shall be prohibited or restricted upon the recommendation of the Village Engineer when in his juent any street will be unduly damaged by use, provided that the Police Department or the said Chairman of the Road and Bridge Commission may initially post such street and give the notice hereinafter provided, which notice so given shell be effective for all purposes of this Ordinance for and during such period of time as may be reasonable and necessary for the Village Engineer to examine such street nnd make his recommendations. (2) SECTION 4 - Notice of such prohibition or restriction shall be made by erecting and maintaining signs plainly indicating the prohibition or restriction at each end of that portion of any street affected thereby and any entrance to such street from other public streets or alleys and at such other places as the Police Depart- ment or Chairman of the Road and Bridge Commission may deem advisable. SECTION 5 - If any person, firm or corporation shall desire to use such street, the Police Department or Chairman of the Road and Bridge Commission may at 'ais discretion grant such permission, provided that such person, firm or cor- poratiou shall furnish to the Village a bond with good and sufficient surety thereon guaranteeing to secure the payment of all costs of putting such street in as good condition as it was before restrictions, such bond and the amount thereof to be approved by the Village of Lino Lakes upon recommendation of the Village Engineer, and a permit shall be then issued for which the Village Clerk shall charge a. fee eaual to the total costs involved to the Village in the investigation, engineering fee or other expenses involved therein. SECTION 6 - In the interpretation of any of the provisions of this Ordinance, the terms, provisions and definitions of the statutes of the State of Minnesota applicable to highways and motor vehicles shall govern. SECTION 7 - Any person violating any of the provisions of this Ordinance shall on conviction thereof be punished by a fine of not less than Twenty Five ($25.00) Dollars or not exceeding One Hundred ($100.00) Dollars or by imprison- ment for not more than Ninety (90) days. Each separate day of violation shall be deemed e separate violation, as shall each violation by separate vehicles, though owned by the same owner, be deemed a separate violation.
