HomeMy WebLinkAbout2020-159 Council ResolutionCITY OF LINO LAKES RESOLUTION NO. 20-159 RESOLUTION APPROVING THE POEHLING ADDITION FINAL PLAT WHEREAS, the City received a land use application for the Poehling Addition Final Plat hereafter referred to as Development; and WHEREAS, City staff has completed a review of the proposed Development based on the following plans and information: • Certificate of Survey and Resource Inventory Map prepared by EG Rud & Sons, Inc. revision date October 28, 2020 • Preliminary Plat prepared by EG Rud & Sons, Inc. revision date October 28, 2020 • Preliminary Grading, Drainage & Erosion Control Plan prepared by EG Rud & Sons, Inc. and Plowe Engineering revision date October 28, 2020 • Tree Inventory/Removals prepared by EG Rud & Sons, Inc. revision date October 28, 2020 • Utility As -Built Plan prepared by EG Rud & Sons, Inc. and Plowe Engineering revision date October 28, 2020 • CLOMR-F Exhibit prepared by EG Rud & Sons, Inc. revision date October 28, 2020 • Landscape Plan prepared by EG Rud & Sons, Inc. revision date October 28, 2020 • Final Plat prepared by EG Rud & Sons, Inc. dated October 23, 2020; and WHEREAS, the City Council the approved the Preliminary Plat with Resolution No. 19- 146 on November 12, 2019; and WHEREAS, the Planning & Zoning Board reviewed and recommended approval of the Development on July 8, 2020; and WHEREAS, the proposed Development is not considered premature and meets the performance standards of the subdivision and zoning ordinance; and NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes hereby makes the following: FINDINGS OF FACT 1. The final plat substantially conforms to the approved preliminary plat subject to the conditions listed below. 2. The City Attorney has reviewed the status of title/property ownership related to the final plat prior to release of the final plat. 3. A Development Agreement has been drafted and shall be executed. 4. Conditions attached to approval of the preliminary plat have been fulfilled or secured by the Development Agreement. 1 5. All fees, charges and escrow related to the preliminary or final plat have been paid in full. BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby approves the Poehling Addition Final Plat subject to the following conditions: 1. A vegetated buffer zone extending upland from the shoreline averaging at least 20 feet in width but no less than 10 feet in width shall be installed and maintained on both Lot 1 and Lot 2, Block 1, Poehling Addition. a. One access opening to the shoreline no greater than twenty (20) feet wide is allowed on both Lot 1 and Lot 2. b. The vegetated buffer zone shall be maintained in accordance with the recorded Shoreline Buffer Declaration and Maintenance Plan. c. A Shoreline Buffer Declaration shall be recorded against Lot 1 and Lot 2, Block 1, Poehling Addition. 2. Lot 1, Block 1, Poehling Addition shall be connected municipal sewer and water. Lot 2, Block 1, Poehling Addition shall be connected through the building permit approvals. The existing septic system and private well serving Lot 1, Block 1, Poehling Addition shall be properly removed and or abandon, sealed and approved by the City. 3. Lot 1 and Lot 2, Block 1, Poehling Addition will have limited ability to construct accessory structures, decks or additions due to the required OHWL setback and floodplain requirements. 4. Resolution No. 19-144 approving the lot area variance and Resolution No. 19-145 approving the street setback variance shall be recorded against both parcels. 5. A LOMR-F will be required prior to Certificate of Occupancy. BE IT FURTHER RESOLVED by the City Council of the City of Lino Lakes hereby approves the Poehling Addition Final Plat subject to the following items being addressed: 1. Any comments from the City Engineer letter dated October 28, 2020 shall be addressed. 2. The Developer shall submit a completed CLOMR-F application to the City prior to release of plat for recording. 3. Mortgage consent is required for recording the final plat and Development Agreement. 4. The Development Agreement shall be approved by the City Council, executed and recorded against the property. a. Securities and fees shall be paid. 5. A copy of the recorded Shoreline Buffer Declaration shall be provided to the City prior to issuance of a grading and/or building permit. 6. Copies of the recorded variance resolutions shall be provided to the City prior to issuance of a grading and/or building permit.
