ALL FELT THIS SHOULD BE COMPLETED AS SOON AS POSSIBLE, AS THEY BELIEVED IT WAS A SAFETY ISSUE. THEY FELT THIS IMPROVEMENT PROJECT SHOULD TAKE PRIORITY OVER OTHER IMPROVEMENT PROJECTS. RESIDENT SUE WALSETH PRESENTED A PETITION WITH APPROXIMATELY 120 SIGNATURES FROM RESIDENTS OF THE AREA TO BE ENTERED INTO THE PUBLIC RECORD. Staff has proposed that approximately $20,000.00 be approved for this purchase, with the funding source identified as Contingency Account 10 1 -499-4905-000. Staff recommends the purchase of a multi -function scanner / printer / copier unit from Coordinated Business Systems based upon their quotation. This purchase includes the hardware, acessories, software, technical support, installation, and ongoing training. It also includes a 90-day standard electro/mechanical parts and labor warranty, as well as a 5-year manufacturer's guarantee which provides limited additional coverage. A full service maintenance agreement is available which is inclusive and covers repair and replacement and all items except for paper and staples. The maintenance agreement is volume -based and is one-third of a cent (.0003) for scanned images and not more than .0125 (approx. one cent) for printed or copied images. Currently, our existing copy -only machine generates a volume of approximately 31,500 images per month at a cost per image of .0132. It is not known exactly how many images per month the new scanning unit will reduce the volume on the current machine, but it will extend the life of the existing copying and printing machines and therefore forestall the need for future replacement. Maintenance is typically performed on a quarterly basis. Because it is difficult to estimate volume at this point, the vendor, Coordinated Business Systems, is willing to provide the City with a full service maintenance agreement for the first quarter (through December, 2002) for a fee of $300, which is based upon a volume of 30,000 prints and unlimited scanned images. After that time, usage would be evaluated and estimated based upon the quoted per -image rates. Staff recommends this be a cash purchase rather than a lease agreement or financed arrangement. Although the vendor does provide lease agreements, and on occasion provides financing, the rate of interest does not appear to make this an attractive alternative at this time. Resolution No. 02-94 approves the purchase and designates the funding source for this purchase. The final dollar amount will be based upon the quotation provided to Council at the August 8, 2002 Work Session, plus tax, and a single quarterly maintenance agreement (through December, 2002), less any discounts which may be negotiated. The Commission's operating budget for 2003 is proposed at $358,410. This is a decrease of $107,767 under the 2002 budget. The 2002 budget was significantly higher than the 2003 budget due to the costs associated with the formal franchise renewal process. The Media Center proposed budget is $900,546.00. This budget is composed of operating expenditures totaling $549,346 and capital expenditures of $351,200. In addition to the • budget, the Operating Committee (city administrators of the seven member cities) has also proposed an increase in the subscriber's monthly PEG fee from $2.38/mo. to $2.45/mo. The Memorandum of Understanding between the member cities and AT&T Broadband allows for an annual cost of living increase in the PEG (Public, Education and Government) fee. The seven - cent increase represents a 2.8% CPI average. The increased funding is necessary for the Media Center to meet facility and equipment goals over the next five years. This budget is composed of operating expenditures totaling $549,346 and capital expenditures of $351,200. In addition to the budget, • the Operations Committee has also proposed an increase in the subscriber's monthly PEG fee from $2.38/month to $2.45/month. The Memorandum of Understanding between the Member Cities and AT&T Broadband allows for an annual cost of living increase in the PEG fee. The seven cent increase represents a 2.8% CPI average. The increased funding is necessary for the Media Center to meet facility and equipment goals over the next five years. The Telecommunications Commission is recommending this increase in the PEG fee. Recommendation: That Member Cities approve the 2003 Media Center budget and increase in the PEG fee to $2.45/month as presented by the Telecommunications Commission and Operations Committee. The Joint Powers Agreement states, "submitted budgets shall be deemed approved by a Member City unless, prior to October 15 preceding the effective date of the proposed budget, the Member City gives notice in writing to the Commission that it is withdrawing from the Commission." AGENDA ITEM NO. 6A STAFF ORIGINATOR: Rick DeGardner, Public Services Director ® COUNCIL MEETING DATE: August 12, 2002 TOPIC: Consideration of Receiving Bids and Awarding Birch Park Trail Project VOTE REQUIRED: Simple Majority BACKGROUND: This trail project is located at the end of Trapper's Crossing Court in the Trapper's Crossing development and will provide direct access to Birch Park. The project includes the installation of approximately 315 feet of timber boardwalk, and a timber staircase including planters and concrete pavers. Park maintenance staff will be taking care of all landscaping and plantings. Project manuals were sent to eight contractors. Sealed bids were opened on July 2, 2002. Two bids were received with Global Specialty Contractors, Inc. being the lowest responsible bidder at a base bid of $106,632. The low bid was higher than anticipated. Mr. Richard Gray, Landscape Architect of TKDA, and I have reviewed this issue and have looked at several options including whether to modify the bid proposal, re -bid the project, or to accept the low bid. We considered modifying several line items such as omitting the load testing of piers and omitting the grouting of pier shafts. Several substitutes such as using poured concrete rather than pavers on the stairs and open areas were considered. However, the identified cost savings are marginal and will detract from the aesthetics of the project and it's longevity. After considering several options, I am recommending that we proceed with the project and award the bid to Global Specialty Contractors, Inc. with a base bid amount of $106,632. The funding for this project is the Dedicated Parks Fund. This project was approved by the City Council as a component of the Park Board's 1996, 2001, and 2002 Goals totaling $75,000. Proceeding with the project will require designating an additional $60,000 of undesignated park dedication funds for the Birch Park trail project. At the August 5, 2002 Park Board meeting, The Park Board recommended designating the necessary park dedication funds and proceeding with this project. The scheduled final completion date for the project is October 31, 2002. OPTIONS 1. Highland Meadows Park is a four acre park located at 624 Arlo Lane and will primarily serve the residents of the Highland Meadows Additions, Bluebill Ponds, Mar Don Acres and the Twilight Acres developments. This park was master planned earlier this year with input from neighboring residents at two master planning meetings. A copy of the master plan is attached. The Phase One Project consists of the removal of plant material, general earthwork, installation of trails, asphalt paving for the '/z court basketball court, concrete walks and play area curbing. Thirteen project manuals were sent out. Only one bid was submitted The bids were publicly opened on August 8, 2002 at City Hall as follows: Base Bid Alternate Bid Glenn Rehbein Excavating, Inc. $89,385.00 $20,000.00 Since the engineer's estimate was $88,350. and that Glenn Rehbein Excavating, Inc is a local, reputable company, staff is recommending receiving the bid and awarding the Highland Meadows Park Development Phase 1 Project to Glenn Rehbein Excavating, Inc. with a base bid in the amount of $89,385.00 The funding for this project is the Dedicated Parks Fund. The development of Highland Meadows Park was a component of the Park Board's 2002 Goals totaling $199,200. The final plat and the easement vacation are both subject to City Council review and approval. The application was previously submitted by Glenn Rehbein Companies as Village Hills. Spirit Hills. Page 3 of 9 • Building: The applicant is proposing to construct three buildings and a canopy for gas islands totaling 30,266 square feet. This breaks down to building A at 13,720 square feet, building B at 6,440 square feet, building C at 7,606 square feet plus the canopy is 2,500 square feet in size. The buildings are generally designed with peaked roofs with focus features at selected ends of the buildings. The highest points of the buildings measure approximately 28' feet in height and conform with the maximum 45-foot height requirement imposed in the GB District. The buildings are proposed to be finished with rock face block and stucco (EIFS) sign banding and accents. Standing seam metal roof at varying heights will be the roofing materials. The proposed mix of materials conform to the standards in Section 3, Subdivision 4.B of the City Code. Trash Enclosure: The site plan does illustrate exterior trash handling areas. According to Section 3, Subd. 4.G of the Ordinance, all refuse and recyclable materials must be stored within the principal building or within an accessory structure (within a side or rear yard) that is totally screened from eye level view from neighboring uses and public rights of way. The applicant is aware of the provision and has placed the enclosures upon the site plan. There are now two 10, x 10' foot enclosures with brick walls and gates. The first enclosure is located behind Building A along the western lot line. The second enclosure belonging to Building B (the bank) is located in rthe southwest corner of the lot along Birch St., this is not permitted. The enclosure for Building B may be better suited if placed behind the building along the western lot line away from Birch St. Both enclosures will be surrounded by landscaping to soften the look of the enclosure. The plan states that waste for Building C will be stored within the building. Signage: Signage on the site is proposed to be individual letters mounted over the storefronts. Signage is governed by the City's sign ordinance and requires a separate permit. All signs will be reviewed with the sign permit applications and must satisfy applicable requirements of the Ordinance in regard to sign type size and location. Landscaping: As shown on the landscape plan, a variety of trees shrubs and ornamental plantings are proposed on site. A heavier landscaping treatment is included along Ware Road which separates the proposed development from existing single-family residential uses. A fence six feet in height was provided by the developer on the east side of Ware Rd. at the time of development of the single-family residential area. The proposed Amur Maples have been replaced with less invasive species. Landscaping, in the form of deciduous or coniferous trees, should be extended along the west property line. Parking: The standards for calculating the off-street parking requirements for Retail Store and Service Establishment are outlined in Section 3, Subdivision 5 of the City Code. For the purposes of calculating parking spaces, the ordinance requirement is to use 90% of the gross building area. • • Spirit Hills. As shown in the table above, a total of 136 off-street parking stalls are required for the proposed use. Because this will be a multi -tenant building, a general parking ratio has been applied. The applicant's plan calls for 138 stalls including the gas island areas. Thirty-six (36) spaces are proposed to be constructed with a pervious Netlawn turf. The use of the Netlawn allows the applicant to satisfy parking requirements while reducing the site's impervious surface area and maximizing on -site infiltration of storm water run-off. Five handicap parking stalls are required one of which must be van accessible. These have been provided. Two access points into the site are proposed. The northern access utilizes the existing Ware Road/Ware Circle intersection. The southern access is located approximately 220 feet north of the Ware Road/Birch Street intersection. The proposed southern access location maximizes the separation from both the Ware Road/Ware Circle and Ware Road/Birch Street intersections. The City Engineer has indicated that the proposed development will necessitate the need for a right turn lane from Ware Road onto Birch Street. Staff is evaluating this requirement in conjunction with the proposed extension of Ware Road to Hodgson Road (CR 49). A five (5) foot concrete sidewalk is proposed along Ware Road, extending from Birch Street to Sioux Lane, to facilitate pedestrian access to the site. Maintenance of the sidewalk shall be the responsibility of the commercial development. A connection to a future trail along Birch Street is also proposed on the plan. Spirit Hills. Page 5 of 9 Lighting: A plan has been submitted for review. The ordinance provides for maximum lighting P g g levels of one -foot candle at the street and 0.4 when casting light onto a residential property. Glare can be an issue from fixtures even if foot-candle measurements are met. Because of proximity to residential uses the type of fixture will be critical. The ordinance requires that light sources be hooded or controlled. The fixture proposed is a decorative, round cutoff luminaries that has the option of a solid dome or a glow dome. Staff believes all of the lights should include a solid dome. The submitted plan does show a combination of domes. No specific lighting type has been provided for under the canopy. Lighting under the canopy shall be designed with completely recessed lighting and no lighting on the canopy sides. Grading and Drainage: The submitted erosion and grading plan is subject to review and approval by the City Engineer. The City Engineer's comments, dated July 3, 2002, are attached. Utilities: The submitted utility plan is subject to review and approval by the City Engineer. The City Engineer's comments, dated July 3, 2002, are attached. Easements: All standard easements are to be dedicated with the final plat. There is an existing drainage and utility easement to be vacated that was previously platted with the Spirit Hills subdivision; this shall be completed prior to issuance of a building permit. Park Dedication: Park dedication has not previously been satisfied on this parcel. As a result, the proposed final plat will be subject to park dedication requirements. For commercial development, a park dedication requirement of $2,175.00 per acre is required. The plat includes 3.75 acres, which requires a park dedication of $8,156.25 to be paid prior to recording the final plat. Proposed Use: The development is intended to be used for Retail and Service uses consistent with the GB, General Business District. Three uses proposed on the plan include a Day Care Facility, Motor Fuel Station (Convenience Store) and Bank with Drive-Thru, which require a Conditional Use Permit. Approval of these uses are included as part of the PDO approval but are identified here for clarity in what will be permitted. The Planning and Zoning Board shall recommend a conditional use permit and the Council shall order the issuance of such permit only if it finds that such use at the proposed location: 1. Will not be detrimental to or endanger the public health, safety, comfort, convenience or general welfare of the neighborhood or the City. Comment: Bank drive-thru, child day care and service station uses currently exist within the City of Lino Lakes. None of the uses should be detrimental or endanger the public. 2. Will be harmonious with the general and applicable specific plans and policies of the comprehensive plan of the City and this ordinance. 9 Spirit Hills. Page 6 of 9 Comment: The comprehensive plan guides for commercial use of this site. Once rezoned from R-I to General Business the site would match the comprehensive plan. 3. Will be designed, constructed, operated, and maintained so as to be harmonious and appropriate in appearance with the existing and/or intended character of the general vicinity and will not change the essential character of that area. Comment: The building designs include many windows and rock face block. The design will be carried through on all four sides of the buildings. This should help make the buildings more attractive. Landscaping and fencing should soften the development and help screen the use from residents. The added sidewalk should be beneficial for pedestrians. 4. Will be served adequately by essential public facilities and services, including street, police and fire protection, drainage structures, refuse disposal, water and sewer systems, and schools; or will be served adequately by such facilities and services provided by the persons or agencies responsible for the establishment of the proposed use. Comment: The proposal should be served adequately by such facilities and services. 5. Will not create excessive additional requirements at public cost for public facilities and services and will not be detrimental to the economic welfare of the community. Comment: This development should not increase public costs, nor be detrimental to the economic welfare of the community. 6. Will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. Comment: The proposed commercial uses upon this site should not create any excessive externalities that would be abnormal to the character of commercial sites. 7. Will have vehicular approaches to the property which are so designed as not to create traffic congestion or an interference with traffic on surrounding public thoroughfares. Comment: The site layout meets standards held within the City's zoning ordinance including turn lanes, access width, and access spacing/location. 8. Will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. Comment: The applicant is currently working with the RCWD to satisfy the remaining • mitigation requirements through a comprehensive drainage plan for the site, future Ware Road extension and surrounding properties. Spirit Hills. Page 7 of 9 9. Will conform to specific standards of this ordinance applicable to the particular use. Comment: Each use should conform to the specific standards listed within the General Business section of the zoning ordinance. Specifically, the day care should meet the requirements listed under Section 7 H (11)(a). Environmental Board: The Environmental Board reviewed the proposed development on April 24, 2002 and recommended approval. Their comments are attached and, where applicable, have been incorporated into this report. Rice Creek Watershed District Review: The Rice Creek Watershed District (RCWD) granted a TWAFAA (Table With Authorization For Administration Action) on February 27, 2002, pending resolution of Wetland Conservation Act (WCA) issues. The applicant is proposing to fill 8,000 square feet of existing wetland on the site. 3,041 square feet is proposed to be mitigated on -site. The applicant is currently working with the RCWD to satisfy the remaining mitigation requirements through a comprehensive drainage plan for the site, future Ware Road extension and surrounding properties. The wetland delineations have been approved and RCWD has agreed to work with the applicant to create the best solution for is wetland impacts and protection. No permit for the work at Spirit Hills will be issued until the overall impacts are addressed during the Ware Road permitting process. Anoka County Highway Department: A copy of the application has been submitted to Anoka County for review. Their comments will need to be incorporated into the site design. Dedication of access control, along Birch Street, to Anoka County should be shown on the final plat. It is anticipated that improvements to the Ware Road/Birch Street intersection, including turn lanes will be required. Site Improvement Performance Agreement: Prior to the commencement of any site work, the applicant will be required to enter into a performance agreement with the City and post all the necessary securities required by it. RECOMMENDATION The Planning and Zoning Board reviewed the application at their July meeting and they recommend approval with the following conditions: A. Approval of rezoning the site to GB, General Business and approval of the PDO overlay subject to the following conditions: 1. All refuse and recyclable materials shall be stored within the principal building or within an accessory structure (within a side or rear yard) that is totally screened from eye level view from neighboring uses and public rights of way. 2. TKDA memorandum from Stephen Hartley dated May 1, 2002 After reviewing the above documents, I have the following comments: General Comments: In order to provide for better understanding and clarification of the Plan, the following information should be provided: 1. Grading notes should be numbered and referenced to and from the Plan accordingly. 2. It is not noted on the Plan whether the spot elevations provided are existing or proposed. They are presumed to be proposed, but must be distinguished and stated clearly on the Plan. There are some spots (particularly between buildings at the south end of the site) that do not show clearly that they will drain. In addition, drainage flow direction should be more clearly defined at the site entrances (i.e., drainage to Ware Road vs. on site, etc.) 3. Denotations on the Plan such as FL, FCL, LP, D etc., should be noted in a glossary or 0 index as to what they identify or stand for. There are some differences between the full size and half size copies provided. For example, hatched areas do not show up on the full size Plan, and the location of curb and gutter differs between copies. Other Comments 1. The Plan must note or reference that all curbing shall be B611 concrete curb and gutter as required by the City. Curb cuts must be noted on the Plan where it is intended to drain to infiltration areas. The location of curb and gutter must be clearly shown and referenced to the City standard accordingly. 2. The Plan must show specifically where silt fence is to be installed (essentially all locations where any runoff can leave the site). 3. All disturbed areas shall be seeded and mulched immediately, or within a maximum of two weeks from final disturbance. ® 4. The "future" mitigation at the SE corner of the site is labeled "if necessary". It would appear that the detention area is necessary, regardless, since permanent drainage from the site is being routed to this location. The expected HW should be noted on the Plan, and the overflow route (to Birch Street) must be better defined to indicate what the effects on Birch Street may be. 5. A shaded area is shown on the NW side of the property, between the driveway and pond, along with a note stating "Tuff Turf' swale. The shading must be referenced in a glossary or index with the other cross hatching, and a specific reference or detail to "Tuff Turf' must be provided. It is presumed that "Tuff Turf' is an industry trademarked product, and it must be referenced and/or specified and described accordingly. 6. The entire wetland mitigation work for this site is very confusing. Notes on the Plan referring to mitigation should reference to the note describing the requirements of the Rice Creek Watershed. Re -delineations in the spring of 2002, future mitigations if necessary, etc. are stated on the Plan. If such re -delineations have been performed, they should be incorporated into the Plan accordingly. Mitigation areas should also be clearly defined and outlined. This Plan shall not be considered approved until the Watershed has reviewed and approved the Plan accordingly. Again, the mitigation work shown for this site is not clear and must be clarified and detailed on the Plan in accordance with the requirements of the Rice Creek Watershed District. 7. A reference or detail for "Netlon Advanced Turf' and "Netavator" must be provided. It is presumed that this is an industry trademarked product, and it must be referenced and/or specified accordingly. A note is provided stating that grading on Larry Grubbs' property is permitted. It is not shown on the Plan where this property is located, or exactly what may or may not be permitted. The note should be revised to state that no grading shall be allowed beyond the site property, unless the Contractor attains authorization from adjoining property owners accordingly. The Contractor shall be responsible for any disturbances or encroachment upon adjoining private properties. 10. A note is provided stating adding peat and topsoil to root zone mixing. This must be more clearly explained as to where, what, etc. Reference to an appropriate specification or detail is needed. 11. Previous correspondence indicated that a right turn lane from southbound Ware Road to Birch Street will be needed. This should be reflected on the Plan to adjust the site grading accordingly. 0 Storm Notes 1 • A note should be included that all storm sewer pipe, manholes, and appurtenances shall adhere to the requirements and standards of the City of Lino Lakes. 2. For the PS -NW Outlet Structure, the normal elevation of the pond must be provided on the Plan. The outlet and ditch to Rice Lake must be reviewed and approved by the Watershed District to assure that the outlet is adequate. Drainage Calculations 1. HydroCAD Drainage Calculations have been provided. However, a site plan (existing and proposed) with specific drainage areas highlighted must be provided to allow for adequate review of the calculations. 2. The retention pond at the north side of the property must provide a permanent pool size that meets NURP standards in accordance with the requirements of the Rice Creek Watershed District and the City of Lino Lakes. A preliminary observation suggests that the pond is undersized. The Developer's Engineer shall submit calculations demonstrating that the project's storm water detention system does meet the treatment requirements of the Watershed and the City. Traffic is going to be the most obvious problem. It appears that Ware Rd should be fine North of Birch St. On the other hand, Birch St will cause some trouble to motorists. Vehicles leaving the shopping center will have to merge on to Birch St. During the busy times, motorists attempting to travel EB Birch St from Ware Rd will have a difficult time • entering the traffic flow. Every day, Birch Street becomes congested during the morning and afternoon rush hour. Motorists heading EB Birch Street from Hodgson Rd are just getting up to speed when they approach Ware Rd. Additionally; residents that live in the developments North/South of Birch are using Ware Rd to gain Access to Birch St. This makes the intersection of Ware Rd and Birch Street extremely busy and potentially dangerous. Ware Rd is controlled by stop signs on either side of Birch St. I have observed many motorists get frustrated waiting for a natural break in traffic so that they can enter the traffic flow on Birch St from Ware Rd. Now add the additional traffic that will be generated by the Spirit Hills Commercial Center. Motorists no doubt will be taking chances that they normally would not, to gain access to Birch Street. The City Council approved the preliminary plat with Resolution 01-120 in August 2001. At that time, the project was owned by Land Holding Group. The project has since been purchased by K-G Development. The change in ownership resulted in postponement of final plat approval for several months. The City's requirements now have been fulfilled and the project is ready for approval. The City has several requirements for final plat approval: 1. Final plat must substantially conform to approved preliminary plat. 2. Development agreement, including financial securities. 3. Title information approved by City Attorney. 4. Conditions of approval (preliminary plat approval) must be met. The submitted final plat conforms to the preliminary plat. The development agreement was completed and site work is underway. VOTE REQUIRED: BACKGROUND: AGENDA ITEM 7E Michael Grochala August 12, 2002 Resolution No. 02 — 91, Rejecting Bids for the Black Duck Lift Station Simple Majority The City Council approved the plans and specification and authorized staff to advertise for bids to reconstruct the Black Duck Lift Station at the June 24, 2002 City Council meeting. Bids were opened on August 1, 2002 for the project. The Engineers estimated construction cost was $321,500.00. Two bids were received for the project as follows: Bidder Barbarossa & Sons Lametti & Sons Amount $368,473.00 $387,745.00 The low bid of $368,473.00 was received from Barbarossa & Sons. The bid amount is approximately 13% over the engineer's estimate. This is a significant increase over what was expected. It is likely that the number of bids received and the high bid amounts were a result of the poor weather conditions experienced during this year's construction season. It is staff's opinion that it would be in the best interests of the city to reject all bids at this time. We would recommend that the project be rebid early next spring under more favorable bidding conditions. The results of the quotes are presented below. City Council action is required to award a contract to the lowest responsible bidder. Contractor Amount of Bid Ro-So Contracting, Inc. $27,300.00 Penn Contracting, Inc. $32,320.00 W. B. Miller, Inc. $39,895.00 This project was part of the 2001 Surface Water Management Projects and was separated out due to easement issues. The funding for this work is provided by the Surface Water Management Fund. This fund was established in 1992 as a revenue source in order to meet the "administrative, planning, ponding, mitigation, and water quality needs" of the City. It is reimbursed through assessments to new subdivisions and is also collected as property owners connect to City utilities. OPTIONS: 1. Return to staff for further review. 2. Adopt Resolution Number 02-92, accepting quotes and awarding a contract to Ro- So Contracting, Inc. for the Holte Pond project. 3. Not adopt Resolution No. 02-92.
