Adjournment PARK BOARD January 5 , 1987 Chairman Ray Johnson called to order the regular meeting of the Lino Lakes Park Board at 7 : 02 P .M . , Monday , January 5 , 1987 . Members present : Ken Johnson , Baumann , Nissen . Members absent : James , Lindy. Member Flannery has given notice of resignation from the Board. Others present : Don Volk , Public Works Director and Shar Foster, Secretary. CONSIDERATION OF MINUTES - December 1 , 1986 Ken Johnson moved to approve the 12/1/86 minutes as presented. Mr . Baumann seconded the motion which carried unanimously . BMX TRACK UPDATE Mr. Neil Schult appeared before the Board with an update on the status of attempts to reorganize the BMX track and the insurance issue . He reported that there has been a reorganization of leaders for the BMX track . Those leaders are presently working on a fund- raiser to help pay for insurance for the BMX track and they feel that the association will be self-sufficient after the insurance is taken care of. He also reported that the association has made ar- rangements for insurance coverage that will be 24-hour/day liability coverage ($1 ,000 ,000) , with the City named as the second insured party. A certificate of insurance will soon be forwarded to the City. Chairman Johnson thanked Mr . Schult for this update and asked to be kept abreast of BMX activities . DENNIS ERICKSON BUILDERS PRELIMINARY PLAT - PARK DEDICATION Mr. Arnie Ficocello , (representative for Dennis Erickson Bldrs . ) , and their engineering consultant presented to the Park Board their plans with regard to park dedication within the proposed plat for development south of Birch Street . The plans called for 3 . 8 acres of land to be dedicated for park purpose as satisfaction of park dedication . This 3 . 8 acres (approx- imately 100 of the land to be developed) will be in the southeastern corner of the plat and provide adequate space for a hockey rink and ballfield. The developer and the Park Board felt that this park would be a "neighborhood" park rather than a "community" or "regional" park. Mr. Ficocello stated that Dennis Erickson is considering a "phase two" development to the immediate south of this plat , in which case it is possible that park dedication land could be acquired just adjacent , creating a connected , central park for the two develop- ments . The developer (per Mr. Ficocello) plans to bring the 3 . 8 acres to an appropriate grade for park purposes . Any further develop- ment of the actual park , or any equipment to be added would be the responsibility of the City , as would be the maintenance of the park . PARK BOARD January 5 , 1987 Page Two Chairman Johnson thanked the two gentlemen for their presentation and the Board stated that these plans as outlined this evening were acceptable to the Park Board. At this time Mr. Nissen was excused from the meeting due to another commitment . The Board was then left with no quorum , therefore all further items were handled as discussion only . CITY OF ST. PAUL - BALDWIN LAKE PROPERTY Chairman Johnson noted that the City of St . Paul responded negatively to the Park Board ' s offer of $1 to purchase the Baldwin Lake property. (This item was last discussed at the 11/86 meeting - see 11/86 minutes . ) PARK DEDICATION ORDINANCE Chairman Johnson also noted that the Park Dedication Ordinance was amended and approved by the City Council as prepared by the Park Board at their recent meeting, and the City Attorney. CAPITAL IMPROVEMENTS PLAN The Board discussed the capital improvements plan for the next five years . Some additions and corrections were made to update the plan. Mr . Volk said he would review the plan further. The updated plan will be presented as a review/discussion item at the next Park Board meeting . Mr. Volk was specifically asked to return with cost estimates to complete the parking area for the east field at City Hall Park and to light the fields at Sunrise Park . Three items which the Board felt should receive attention possibly during the next few years on the CIP were 1 ) lights on the tennis courts at Arena Acres , 2 ) a well at Shenandoah to flood the skating rink or the purchase of a tank truck , 3 ) the addition of the parks for the proposed Erickson plat and the proposed Uhde/Regency plat . VANDALISM REPORTS None . OLD BUSINESS None . NEW BUSINESS Mr . Volk reported that at the recent "Strategic Planning Workshop" , the City Council and other attendees suggested that rather than have a Council member attend the Park Board and Planning Board meetings , that a Park Board member and Planning Board member attend a Council meeting each month to improve communications between the Boards and Council . Wuornos & Associates DATE: December 2, 1986 RE: Erickson Plat and Zone Change Applications #86-1 and 86-43 I. BACKGROUND This application requests the approval of a 78 lot subdivision for single family detached homes on urban sized parcels. Approval will involve a Comprehensive Plan amendment, a rezoning from "ER" to "R1", a preliminary plat, and reviews by the Metropolitan Council and Waste Control Commission and the Rice Creek Watershed District and Corps of Engineers. A feasibility study for utilities have been ordered by the City Council. II. LAND USE The City's Comprehensive Plan illustrates the north third of this parcel as Urban Residential while the remaining portion is planned for Expansion Eesidential . Several areas on the site are classified as conservation/restrictive soils, which were created as areas of the community which cannot practically sustain urban development. The Task Force has recommended one acre lots to be resubdivided when sanitary sewer is available. III. SEWER POLICY PLAN This plat falls within an area planned for sewer service within the near future. The City Engineer should advise the city as to the feasibility and process for providing sanitary sewer and water services to this plat prior to a final review of this plat. IV. ZONING The entire parcel is currently zoned "ER" and would require a rezoning to "R1" to allow urban size lots to be platted. The property to the north of this site is currently zoned "R1" and thus it would not be considered a spot zoning. The minimum lot size allowed i1n an "R1" zone is 11,250 square feet. V. SUBDIVISION REGULATIONS The street and lot layout is generally acceptable. Lot 2 of Block 1 has an awkward configuration. AGRICULTURAL LANDS This specific site is not currently being actively farmed and it is not designated as Prime Farmland in the Comprehensive Plan. VII . HISTORICAL AND ARCHEOLOGICAL SITES This specific site does not contain nor is it close to any historical or archeological sites noted in the Comprehensive Plan. Due to its proximity to Reshanau Lake the developer should check with the Historical Society for any requirements for archeological digs. VIII. NATURAL RESOURCES This specific site does contain woodlands and soil extraction sites, but no unique wildlife habitats. These features should be given special design considerations in the final plat layout. IX. SOILS AND TOPOGRAPHY The city's Restrictive Soils Ordinance should be reviewed as to its impact on this plat. Proper grading and erosion control plans should be reviewed by the City Engineer. n The soil conditions on the south portion of the site will have some moderate to severe limitations to development. Special engineering considerations should be given to any site and building plans. Runoff provisions should be reviewed by the City Engineer and Building Official prior to issuance of a building permit. X. FLOOD PLAIN A small portion of the property may fall within a Zone A flood plain area. This should be indicated by the surveyor. XI. PUBLIC SERVICES Increased demands on police and fire protection services should be reviewed by the appropriate staff. Specific park facilities and required dedications have been reviewed by the Park Board. The developer may consider alternative park designs but the general location seems appropriate. Sanitary sewer and water supply plans should be reviewedrby the City Engineer. XI. ROADWAYS n The property has approximately 1,300 feet of frontage on Birch Street which is designated as a collector. This connection should be 'adequate to support the number of lots proposed. Adequate connections to adjacent land have been provided. The layout should be reviewed by the Public Works Director in terms of maintenance considerations. PROFESSIONAL OPINION It is our professional opinion that this proposal is consistant with the proposed Comprehensive Plan updates and should be approved at the appropriate time. The City Engineer and Building Official should review the soils report prior to the construction of any improvements. The feasibility studies for sanitary sewer and water services should be approved prior to, and as a condition to, the approval of this plat. A parkland dedication of 3-5 acres for a neighborhood park should be required. This proposal seems to make good planning sense conceptually, but we are concerned about their timing as it relates to the required process for amending the Comprehensive Plan. We have reviewed the situation and timing with the developer and he has agreed to wait for the March-April public hearing date. He can proceed, at his own risk, to discuss his plans and refine his designs based on the City's comments. Our overriding concern is the various potentials for liability exposure the City might have if approvals or guarantees, implied or official , were given and for some reason the plans were not adopted by the City. The City has certain timing, quality, and procedural requirements which should not be compromised. We hope the Comprehensive Plan amendments, re-zoning, and preliminary plats can be completed in order and with minimal delay to any development proposal , but do strongly encourage the City to not shortcut the process. We recommend this application be tabled until the above mentioned process can be completed. If the City feels it is necessary to immediately act on the application, and a denial is passed due simply to a timing or procedural matter, we should point out that Section 5, Subd. 3(9) of your Zoning Ordinance states: "No application for rezoning which has been denied shall be resubmitted for a period of twelve (12) months from the date of said order of denial unless all reasons for denial , as ,.� outlined by the City Council , have been satisfied."
