HomeMy WebLinkAbout12-01-1986 Park Board Minutes December 11 1986 Page 1 PARK BOARD Chairman Ray Johnson called to order the regular meeting of the Lino Lakes Park Board at 7 : 05 P. M. , Monday, December 1 , 1986. Members present : James , Ken Johnson, Baumann , Nissen. Members absent : Flannery. Mr. Lindy joined the meeting at 7 : 20 P.M. Also present were Don Volk, Public Works Director and Shar Foster, Secretary. CONSIDERATION OF MINUTES - NOVEMBER 3 , 1.986 The following corrections were requested: - Page 3 - "Fitness Courts" should be changed to "Fitness Course" . - Page 1 - The first sentence should be corrected to read " . . . construction of a tot lot ; therefore, considering the assessed value at that time would have been $1 , 1.00 per acre, park dedication would be: $1 , 100 X 4 acres X 10% = $440 . MOTION: Mr. Nissen moved to approve the 11/3/86 minutes as corrected above. Motion seconded by Ken Johnson and carried unanimouslv. BMX TRACK INSURANCE Mr. Volk reported that. the City Administrator wrote to the City' s insurance representative asking how new legislation regarding park liability affects the City' s insurance coverage. No response to this letter has yet been received. Mr . Volk is also still trying to make contact with the gentleman proposing to reorganize the BMX association . This item will appear on the next Park Board agenda. PARK DEDICATION ORDINANCE The park dedication ordinance proposed by the Park Board and prepared by the City Attorney was reviewed by the Board. One statement - "Land site selection to be made by the City" - was erroneously excluded in the proposed ordinance. The Board felt that this statement should be included. (A copy of the ordinance with insertion of this statement is attached. ) MOTION: Mrs . James moved to recommend to Council approval of the park dedication ordinance (attached) which includes the addition of "Land site selection to be made by the City. " Mr . Baumann seconded the motion which carried unanimously. DENNIS ERICKSON PRELIMINARY PLAT PARK DEDICATION December 1 , 1986 Page 2 PARK BOARD No one from Dennis Erickson Builders came forwarded to present this item, therefore it was tabled until necessary information becomes available. GARY UHDE PRELIMINARY PLAT PARK DEDICATION Mr. Uhde and his consultant appeared before the Board to present the preliminary plat and park dedication proposal for an 80-acre development south of Birch Street . The plan calls for 98 building sites in the 80-acres with hopes of a future second phase development of 64 additional building sites on the acreage to the immediate south. Of this 80 acres , approximately ten acres is proposed for use as park land within the development . The layout is such that , should the acreage to the south or west of this plat become platted in the future, park land could be dedicated for these areas to create a combined central park. (Mr. Uhde owns the acreage to the south and plans to negotiate for the purchase of the acreage to the west . ) Mr. Uhde stressed that he feels that a "neighborhood" park within the plat is an amenity to his development and that he, would like to see tennis courts , a natural skating rink and trails within the park rather than a "community" park. Mr . Uhde felt that he could put in the trails and any further actual development of the park would be negotiable. He also stated that should the City need help with a "community" park he would be receptive to negotiation for land outside his development as satisfaction of required park dedication rather than a "community" park within this development . Because of the type of homes to be built (beginning at $1.00, 000) he did not feel a "community" park would be appropriate here . The consensus of the Board was that the area outlined on the preliminary plat would be acceptable as park land. In addition to the natural skating rink and tennis courts , the Board also asked to see a flat area at the northern part and the southern part of the proposed park for use as an "informal field" for residents to congregate and play baseball , football or soccer. No fencing or actual backstops , etc. would be required. They also felt that access from both the north end and the south end of the proposed park would be necessary for drop- off of children and access by maintenance equipment . A 20 ' wide access with a 10 ' wide paved strip through the center was felt to be sufficient to serve those purposes. December 1 , 1986 Page 3 PARK BOARD Mr. Uhde told the Board that this was the kind of direction he needed from the Board and would have his plat revised to include the "informal field areas" and accesses as discussed .+.o in addition to the skating rink and tennis courts . The Board thanked Mr. Uhde for presenting an actual park plan rather than the usual approach of "pick a couple lots from the undesirable leftovers" . Mr. Uhde said he would be prepared for a later meeting of the Park Board with his revised park plan. HARDWICK/BANCROFT MINOR SUBDIVISION The Board reviewed this subdivision calling for splitting off ten acres from an approximate 60 acre parcel . It was felt appropriate to request $160 as park dedication for this subdivision in accordance with the present park dedication ordinance. MOTION: Ken moved to recommend to Council acceptance of $160 as satisfaction of park dedication for this subdivision. Motion seconded by Mr. Lindy and carried unanimously. VANDALISM REPORTS Mr. Volk stated that the damage done to trees and turf at. Sunrise Park as reported on 11/25,/86 totaled approximately $400 . NEW BUSINESS None. OLD BUSINESS Ray Johnson asked that the letter to the City of St . Paul regarding the Baldwin Lake property purchase offer be sent to the Boardmembers with these minutes . Mr. Volk said the Lawcon grant people will inspect Country Lakes Park on December 2 , 1986. Ray Johnson asked that "Capital Improvements Plan" be included on the next agenda as a discussion item. Mr. Nissen reported that 4-wheel drive vehicles are getting into Country Lakes Park by driving around the gate. Mr. Volk said he was aware of this problem and is trying to alleviate this problem. The meeting adjourned at 8: 37 . Aye. CITY OF LINO LAKES COUNTY OF ANOKA STATE OF MINNESOTA Ordinance No. 14 - 86 AN ORDINANCE AMENDING THE LINO LAKES CITY CODE BY AMENDING PROPERTY DEDICATION PROVISIONS OF THE SUBDIVISION OF LAND REGULATIONS CON- TAINED THEREIN. The City Council of the City of Lino Lakes ordains : Section 1. Property Dedication. The developer shall ded- icate to the City a reasonable portion of the proposed sub- division for public streets, roads , utility easements, water facilities, storm water drainage and holding areas or ponds and other similar utilities and improvements. In addition, the developer shall dedicate to the City land for public use as parks , playgrounds. trails or other open space. The criterion to be used by the City in determining the park needs is as follows: 1. Proposed development density and use. 2. Proximity of development to existing parks. 3. Open space within the development. 4. Future park needs per the comprehensive plan. For residential, commercial and industrial development the following land dedication shall apply: 10% of the total land acreage in the development . Land site selection is to be made by the City. The City may choose to accept an equivalent amount in cash from the applicant for part or all of the portion required to be dedicated to such public uses or purposes based on the fair market value of the land at the time of final approval. This cash equivalent for all residential development shall be $160.00 per dwelling unit to be constructed within such proposed development . For commercial/industrial development , the cash equivalent shall be ten (10%) per cent of the fair market land value of the devel- opment. All cash payments so received shall be placed in a special fund by the City to be used only for acquisition, betterment or debt retirement related to parks, playgr6unds, trails and open spaces. This payment is due to the City Clerk-Treasurer before any documents may be filed with the County Recorder' s Office. Section 2. Effective Date. This ordinance shall be effective thirty (30) days after its pub- lication.
