City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: oo Please address the meeting chair. oo State your name and address for the record. oo Please observe a 4-minute limit. oo The topic must relate to city business. oo Open Mike is for items not on the agenda. oo A spokesperson must represent a group of five or more—groups will have 8 minutes. oo The Presiding Officer may limit duplicative presentations. oo Remember,the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: oo The Presiding Officer (Chair or Vice-Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. oo Staff will present their report on the proposal. oo Board members will then ask City Staff questions about the proposal. oo The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. oo After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. oo The Board will then discuss the proposal. APPROVAL OF AGENDA The agenda was approved as presented. IV. APPROVAL OF MINUTES: Mr. Reinert made a MOTION to approve the May 12, 2021 meeting minutes. Motion was supported by Mr. Laden. Motion carried 3 —0. Mr. Evenson abstained. Chair Tralle abstained. V. OPEN MIKE Chair Tralle declared Open Mike at 6:32 p.m. There was no one present for Open Mike. Mr. Laden made a MOTION to close Open Mike at 6:32 p.m. Motion was supported by Mr. Evenson. Motion carried 4—0. Chair Tralle abstained. VI. ACTION ITEMS A. PUBLIC HEARING: Conditional Use Permit for Commercial Stables and Variance for Number of Animal Units for 426 Pine Street DRAFT MINUTES Planning&Zoning Board June 9,2021 Page 2 Ms. Larsen, City Planner, presented the staff report. The applicant and property owner, Christopher Stowe, submitted a Land Use Application for a conditional use permit amendment and variance for the commercial stable operations at 426 Pine Street. The conditional use permit amendment is to amend the previously approved Resolution No. 20-129,No. 20-130 and No. 20-144 and the variance request is to allow for fifty(50) animal units. Board Comments Mr. Root commented that there were very little comments provided by staff regarding the findings of fact. He asked Ms. Larsen if this means staff agreed with the applicant's findings. Ms. Larsen stated that staff is presenting the applicant's findings of fact for tonight's conversation and narrative. Mr. Root asked what the number of animal units is based on. Ms. Larsen stated that the number of animal units is based on the gross acreage of the site. Chair Tralle asked why all three parcels have not been combined. 4 Ms. Larsen stated that staff considered this with the original CUP in 2020. However, the Commercial Stables Ordinance does state that as long as the parcels remain under common ownership, they are allowed to take credit for them. Chair Tralle asked what the Rice Creek Watershed District is requiring of the applicant that is going to take six months to complete. Ms. Larsen stated that Rice Creek is working with the applicant on some wetland and floodplain fill violations. They are trying to work together to come up with a plan to mitigate those issues. Applicant's Comments Christopher Stowe, 426 Pine Street, Lino Lakes with attorney Jacob Steen, Larkin Hoffman Attorneys, 8300 Norman Center Dr. Bloomington, commented that this property was originally built in 1968 for boarding and showing. Mr. Stowe acquired the property in April of 2018 and began using the property as originally intended. Shortly after this point the City adopted the Commercial Stables Ordinance which Mr. Stowe was not aware of at the time. The 1 horse for every 2 acres recommendation is accurate in the circumstance that the horses are using the pastureland for their feeding purposes. The difference with this property is that all the feeding hay is brought in, and all the excess manure is brought out. The manure DRAFT MINUTES Planning&Zoning Board June 9,2021 Page 3 is stored on site and removed regularly. Many of these horses are rescues or ill in some way. Most horses are cared for by community and volunteers. There are some groups that utilize this facility for boarding as well. Mr. Stowe is asking for an amended CUP with the variance. He is asking to be allowed to board 50 animals out of a facility with a designed capacity of 120. Mr. Steen raised concerns with 3 of the conditions laid out in the staff report. His first concern is with condition number 2, which refers to the term of the 1968 conditional use permit which he objects to in principle. Mr. Steen's second concern is with condition number 13 an issue with the Rice Creek Watershed District on the grounds of needing a longer period of time to come into compliance. This condition defers authority to a 3rd party, the Watershed District on a CUP issue. His last concern surrounds the need for a manure management plan. He shares the cities concern on this issue but is not receiving clear direction from the MPCA currently. Board Comments Mr. Laden asked what the nature of the portable shelters are. Mr. Stowe stated that horses need sun protection in the summer and wind protection in the winter. The structures are three sided with an opening near the ground around the perimeter. Mr. Evenson asked how big the stalls are in the arena. IL 10 Mr. Stowe stated that the stalls vary in size but are larger than the common stall today. Mr. Reinert stated that the main issue he sees is the management of the manure. He asked Mr. Stowe how he is disposing of the manure currently. Mr. Stowe stated that he is using dump trailers. He stated that he purchased this property three years ago. In 1997 the City approved a bike track and a 144-unit parking structure which according to the map would be placed on wetland. Mr. Stowe feels like he was grandfathered in due to purchasing the property before the ordinance change. The 1968 Special Use Permit had no expiration date and he has not been provided any literature on this permit. He stated that the map of his property is misleading on the history of his property as well as the current state. He stated that he would like to have 50 animal units on site, continue with the manure management, and agree to the shelter requirements. Mr. Root stated that he is empathetic to the situation,but the board is constrained by procedures. He stated that he wants to confirm that the property was purchased prior to the Commercial Stables Ordinance being changed. Mr. Root asked Mr. Stowe how many animals there were prior to the ordinance change. DRAFT MINUTES Planning&Zoning Board June 9,2021 Page 4 Mr. Stowe stated that he moved his animals as soon as he could but could not provide an exact count. Mr. Root reiterated the requirements of granting a variance to Mr. Stowe. Chair Tralle declared the Public Hearing open at 7:27 p.m. Bernie Bogenreif, 455 Andall Street, Lino Lakes, commented that he has concerns that the City is already addressing. He is not in favor of extending the deadline on the Rice Creek Watershed District violations. He is concerned with potential water quality issues. He is not in favor of increased animal units on the property for a variety of reasons. He is concerned with animal health issues surrounding crowding and cleanliness. Mr. Bogenreif also raised the question of where excess animals would go if Mr. Stowe were shut down. Chair Tralle stated his opinion that if Mr. Stowe is shut down then the removal of animals would be the issue of Mr. Stowe or the state. Not an issue of the City. Kerry Bogenreif, 455 Andall Street, Lino Lakes, had an issue with loud machinery operation into the nighttime hours last summer. The manure disposal also adds to the noise of the area. She raised an issue with the accompanying noise impacting her quality of life. Regarding the Watershed District violations, she shared the opinion that it should be taken care of quickly and settling this issue should be a requirement of this variance being granted. Mr. Stowe addressed his neighbors from 455 Andall Street and apologized for previous noise issues. Chair Tralle stated he is opposed to requiring resolution of the Watershed District violations prior to reaching a decision on this variance. Mr. Laden made a MOTION to close the Public Hearing at 7:38 p.m. Motion was supported by Mr. Evenson. Motion carried 4—0. Chair Tralle abstained. Board Comments Mr. Reinert asked Ms. Larsen to speak to how many animals were on the site when originally built. Ms. Larsen stated that she was unsure of how many animals were on the site in the 1960's. Mr. Reinert stated that whomever makes a motion should consider the noise complaints and limit the source of the noise starting at 7 p.m. DRAFT MINUTES Planning&Zoning Board June 9,2021 Page 5 Mr. Evenson asked Ms. Larsen to reiterate the timeline of the property being purchased and the Commercial Stables Ordinance change. Ms. Larsen stated that Mr. Stowe moved in around April or May 2018 and in July 2018 the City amended and adopted the Commercial Stables Ordinance which allowed for the doubling of the number of animal units. Mr. Laden stated he was struggling with doubling the number of animal units. He asked Ms. Larsen if this variance would be applied to the property. Ms. Larsen stated that the variance would go with the property. Mr. Laden stated that he was concerned about this because although Mr. Stowe is a responsible owner what happens when he sells his property. He also stated that he has concerns regarding approving a variance where the findings of fact were written by the applicant. Mr. Root commented that putting a deadline on resolution with the RCWD or the MPCA is problematic because there is no control over these outside entities but suggested it be brought back for review until these issues are resolved. Mr. Laden wanted to know if the applicant needed to be in compliance with the RCWD within 6 months or if the issue needs to be fully closed with the RCWD within 6 months. V Ms. Larsen stated that currently the applicant needs to be in compliance within 6 months. She stated that this language can be changed. Mr. Laden suggested that there be a deadline after there is resolution with these entities. Ms. Larsen suggested that City speak with their attorney and Mr. Stowe's attorney to come up with some language that both can agree on concerning a timeline. Mr. Reinert made a MOTION to recommend approval of the conditional use permit for commercial stable operations at 426 Pine Street. Motion was supported by Mr. Root. Motion carried 4—0. Chair Tralle abstained. Mr. Reinert made a MOTION to recommend approval of the variance for commercial stable operations at 426 Pine Street. Motion failed due to the lack of a second. Mr. Root made a MOTION to recommend denial of the variance for commercial stable operations at 426 Pine Street. Motion was supported by Mr. Evenson. Motion carried 3 — 1. Chair Tralle abstained. DRAFT MINUTES Planning&Zoning Board June 9,2021 Page 6 B. PUBLIC HEARING: Conditional Use Permit for Open and Outdoor Storage at 2300 Main Street(Glamos Wire,Inc.) Ms. Larsen, City Planner, presented the staff report. The applicant, Steve Tomas of Glamos Wire, Inc., submitted a Land Use Application for a Conditional Use Permit (CUP) for Open and Outdoor Storage at their facility located at 2300 Main Street. Board Comments Mr. Laden asked why the board would waive the 50% shrub requirement if it is in our ordinance. He asked if the existing greenery counts toward that 50%requirement. Ms. Larsen stated that the existing greenery does count toward that requirement and that is why it would be reasonable to waive it. Mr. Laden asked what would happen if the board waived this requirement and the existing trees were then removed. Ms. Larsen stated that there would be a requirement that the existing trees be maintained or replaced if removed. Mr. Root commented that allowing existing greenery to serve as a screen is acceptable. Chair Tralle concurred with Mr. Root that the existing greenery was adequate as long as the fence is installed. Chair Tralle declared the Public Hearing open at 8:13 p.m. There was no one present for the public hearing. Mr. Laden made a MOTION to close the Public Hearing at 8:14 p.m. Motion was supported by Mr. Evenson. Motion carried 4—0. Chair Tralle abstained. Mr. Evenson made a MOTION to recommend approval of the conditional use permit for open and outdoor storage at 2300 Main Street with the removal of the 50% shrub requirement. Motion was supported by Mr. Root. Motion carried 4—0. Chair Tralle abstained. VII. DISCUSSION ITEMS A. Zoning Ordinance Update Discussion — General Provisions, Kendra Lindahl, Landform DRAFT MINUTES Planning&Zoning Board June 9,2021 Page 7 Ms. Kendra Lindahl, Landform,presented a summary of Zoning Ordinance changes to the General Provisions section needed to comply with State Law, eliminate inconsistencies in the document,better reflect City goals and make the ordinance easier to read and understand. This is an initial draft of key concepts. The Planning &Zoning Board should review the draft changes recommended by staff and provide direction on any other desired changes. The direction will be incorporated into the full draft that will be presented later this year. Board Comments Chair Tralle asked if the wind and solar energy sections could be combined. Ms. Lindahl said City likes the idea of an alternate energy zoning section with subsections for solar and wind if the board agrees. Currently the City has been allowing solar projects. Mr. Laden asks how solar and wind could be combined in the zones. He feels solar can go just about anywhere but wind needs to have more restrictive requirements. Ms. Lindahl agrees with Mr. Laden and clarifies wind and solar would be under the same section, subsections would clarify the differences with both. Chair Tralle comments on solar gardens taking land out of taxable property and asks if the same would be true of wind. V Ms. Lindahl clarifies that this does not refer to a wind farm but rather refers to a wind accessory to a structure. A single facility not exceeding 5,000 kilowatts. Staff is referring to a home or business. r. Root asks what the current standard zoning on solar power arrays are. Ms. Lindahl said that if asked to prepare a solar ordinance for review there are three different solar patterns that would be considered which are building integrated, building mounted, and ground mounted solar arrays. A review would also consider more technical aspects such as reflection proof covers and the panels ability to move. Mr. Root points out that a 5-megawatt wind structure would need a mounting pole of 120ft high and would have a blade diameter of 140ft. Because of this he would like any wind ordinance proposal to have differing standards for different zones. He would also like any zoning proposal to anticipate common issues with wind power such as shadow flickering and noise. Ms. Lindahl stated that they did draft a free standing WECS which cannot exceed 50 ft in height as measured from the grade at the base of the tower to the highest possible extension of the blades. She commented that setbacks were also addressed by saying the tower must be able to fall over and not hit the lot line. DRAFT MINUTES Planning&Zoning Board June 9,2021 Page 8 Mr. Laden stated that he would like to see something in the ordinance that addresses shadow flickering. Mr. Reinert stated that wind is more of a nuisance than solar. Mr. Laden commented that he would like to see wind allowable only in rural areas. Mr. Root concurred stating that wind is going to be too restrictive to be allowed in most residential areas. Chair Tralle stated that wind generation should only be allowed in rural areas. Ms. Lindahl asked the board for their thoughts on the current solar zoning process. Mr. Grochala stated that solar projects are treated as an accessory structure so a resident can install solar if they meet all the accessory structure requirements. Mr. Root stated that he would like to see examples of a formal code. Ms. Larsen commented that the City has received inquiries about ground mounted solar arrays for private property that they currently have no guidelines for. For ground mounted arrays they have no basis of code and would like direction from the board. Chair Tralle commented that the issue of reflection becomes much more serious with a ground mounted solar array. Mr. Laden commented that he would like to see ground mounted solar arrays treated differently than other accessory structures. Mr. Evenson asked whether a ground mounted solar array took the place of an accessory structure under the current guidelines. Ms. Larsen stated that under the current code the City has no clear answer to that question. Ms. Lindahl asked Mr. Evenson how he feels about adding flexibility to the metal roofing standards. Mr. Evenson stated that he is in favor of more flexibility regarding metal roofing standards. Mr. Root pointed out some changes in the text to increase understanding. DRAFT MINUTES Planning&Zoning Board June 9,2021 Page 9 Mr. Laden commented that the section regarding sports courts needs to clarify that it is referring to outdoor sports courts. He also questioned why an accessory structure that does not need a building permit needs a zoning permit. Mr. Grochala stated that building code does not apply to anything under 200 sq. ft but anything under that still needs a zoning permit to ensure that they are meeting all setback requirements. Mr. Laden commented that he thought it is unrealistic to expect residents to come in for a zoning permit. Ms. Larsen stated that the building department gets numerous zoning permit applications for accessory structures. Mr. Laden commented on the section regarding car ports. He stated that limiting the size of car ports to 300 sq. ft is restrictive. B. Project Updates Staff provided verbal updates to the Board on current City projects. VIII. Building Requirements At the time of building permit, the single family house proposed on Lot 2 will be reviewed for compliance regarding floor area, garage and design and construction standards. Subdivision Ordinance The legal description of the parcel is Lot 14, Block 3, Mar Don Acres and was platted in 1978. Similar residential subdivisions of Mar Don Acres lots have been approved in previous years (Cavegn Estates-2006, Hailey Manor-2007, Isabell Estates-2014 and Golden Acre-2017). Conformity with the Comprehensive Plan and Zoning Code The preliminary plat and final plat are consistent with the comprehensive plan for low density residential development and zoning code requirements for R-1, Single Family Residential as discussed above. 4 Blocks and Lots The final plat contains Lot 1 and Lot 2, Block 1, Butler Addition. As noted above, Lot 1 contains the existing house and Lot 2 proposes a new single family home. Streets and Alleys Lot 1 is served by Meadow View Trail which is a local road. The existing road right-of- way is 60 ft. No additional road right-of-way is required. Lot 2 is served by Lois Lane which is a minor collector road. The existing road right-of- way width is 60 ft. which is consistent with previously approved plats in the area. No additional road right-of-way is needed. Easements Drainage and utility easements at least ten (10) feet wide are required and shown along all lot lines. An oversized drainage and utility easement exists on Lot 2 in the rear yard over the stormwater management facility. Storm Water Management and Erosion and Sediment Control Per the March 25, 2021 RCWD CAPROC, a stormwater infiltration basin is not required per RCWD rules. However, a stormwater BMP is still needed to meet City stormwater requirements because the site is over one (1) acre. The applicant is proposing to meet City stormwater requirements by constructing an infiltration basin in the south corner of Lot 2. The bottom of the infiltration basin is 906.5 and the HWL of the basin is 907.51, which both meet freeboard requirements per City Code Chapter 1011. Utilities Sanitary Sewer An 8" sanitary sewer main exists along Lois Lane. The existing house is connected to municipal sanitary sewer. The new house will also be connected to municipal sanitary sewer. Watermain An 8"watermain exists along Lois Lane. The existing house is currently on a private well. A 1"water lateral is stubbed to Lois Lane, but is not connected to the house. The existing house shall connect to municipal watermain. Lot 1 with the existing house will not be charged a park dedication fee. They recommended approval of the project with conditions listed in the July 7, 2021 Memo from the Environmental Coordinator. Conditions include tree protection fence and biologs shown at the correct distances on the tree inventory sheet and landscaping plan. Public Safety Department The Police Division and Fire Division reviewed the plans and have no additional comments or concerns. Development Agreement A Development Agreement will be drafted by the City and shall be executed. Title Commitment The City Attorney reviewed the title commitment and final plat and commented mortgage consent is required. 7 Stormwater Maintenance Agreement The infiltration basin will be privately maintained and a Stormwater Maintenance Declaration is required with the final plat. FINDINGS OF FACT-FINAL PLAT The Planning and Zoning Board shall consider the final plat and the Community Development Department shall forward the Planning and Zoning Board recommendations to the City Council. The following requirements shall be met before consideration of the final plat by the Planning and Zoning Board: 1. The final plat shall substantially conform to the approved preliminary plat and phasing plan. The final plat substantially conforms with the preliminary plat. 2. Conditions attached to approval of the preliminary plat shall be substantially fulfilled or secured by the development agreement, as appropriate. The applicant is proposing 9 housing units (8 new housing units plus 1 existing house). This equates to 2.99 units per net acre (9 units/3.01 acres =2.99 upa). This is consistent with the density range. Staff Comment: 1. Additional wetland buffers and arterial road right-of-way dedication will affect the net acres and net density. Rezoning The property is currently zoned R, Rural and is guided for both medium and low density residential land use. Per the City's zoning ordinance, land that is guided medium density can be zoned R-2 or R-3. Building Design Standards The applicant provided color renderings of example townhome products. More information is required regarding the proposed building design standards for both the two-family dwelling and townhomes. Color renderings of proposed townhomes were provided. Building design standards as detailed in City Code Section 1007.043 (2)(b) and 1007.094(4) shall be met. 5 Staff Comments: 1. The proposed buildings are shown at 24 feet wide. Garages must be 20 ft in width. Attention should be made to the building design standards especially regarding garages and floor areas. 2. A homeowner's association is required for exterior building and common space maintenance. Streets and Alleys Oak Hollow Lane would extend south the serve the housing units. Street right-of-way is proposed at 60 ft with a 32ft wide paved street. These meet City requirements. Ware Road is a Minor Collector Road which requires 80 ft of street right-of-way width. 66ft is currently provided. A temporary cul de sac is proposed at the south end of Oak Hollow Lane. The bulb encroaches into Lots 4-6, Block 2. 6 Staff Comments: 1. Seven feet(7) of additional road right of way along Ware Road shall be required. 2. The temporary cul de sac should be shifted to the east to minimize impacts to the lots and front yards. Easements Standard drainage and utility easements have been provided along all lot lines. Staff Comments: 1. Standard drainage and utility easements at least 10 feet wide shall be provided along all lot lines. 2. Drainage and utility easements shall also be dedicated over stormwater management facilities. 3. Conservation easements shall be required over wetlands and greenway corridors. Stormwater Management and Erosion and Sediment Control The concept plan shows a potential stormwater pond on Outlot A. The City Engineer has concerns regarding the size of the pond. Staff Comment: 1. A stormwater management plan and erosion and sediment control plan in accordance with Chapter 1011 shall be required. Utilities Municipal watermain and sanitary sewer will be extended from Oak Hollow Lane south to serve the development. Each individual lot shall hook up to public water and sanitary sewer. The site is located in Sanitary Sewer District 1 (Sub-district I and 1C). Flow is collected along Oak Hollow Lane and conveyed north. Staff Comment: 1. Per the City Engineer, sanitary sewer to serve Huntson Addition will come from Oak Hollow Lane; however, this sewer line in does not have enough depth to serve future development to the south. 7 Parks, Greenways and Trail Plan Per the 2040 Comprehensive Parks, Greenways and Trails Plan, this development is adjacent to the Shenendoah and Birchwood Acres Park service area. A future neighborhood park is designated to the east of Ware Road. A greenway corridor and future trail are located south of the development. The City will require cash in lieu of land dedication. Tree Preservation and Landscaping A Tree Preservation Plan and Landscape Plan in compliance with Section 1007.043 (17), Required Screening, Landscaping and Buffer Yards shall be submitted. Staff Comment: 1. A 20 foot wide landscaping buffer is required between the medium and low density land uses. Environmental Review Record An Environmental Assessment Worksheet(EAW) is not warranted. The threshold computation of unattached units (0) and attached units (8) is less than one. Wetlands The concept plan indicates 0.99 acres of wetlands on site. The wetlands were delineated by Jacobson Environmental in August 2017. The buffers are shown as 25 ft wide. RCWD is the local governing units (LGU) for administering the Wetland Conservation Act(WCA). Staff Comments: 1. A wetland delineation report and RCWD WCA Notice of Decision shall be required with the Preliminary Plat submittal. 2. Wetland buffers consistent with RCWD regulations (50 ft wide average, monument signs etc.) may be required. 3. Wetland mitigation and restoration may be required. Floodplain The FEMA Floodplain Map indicates no flood plain on the subject property. Shoreland District The subject property is not located within the Shoreland Management Overlay District. 8 Public Safety Comments As required by City ordinance, Public Safety requires a turnaround(i.e. the temporary cul de sac) for emergency services be installed. House addressed shall also extend north- south along Oak Hollow Lane. Environmental Board Comments The Environmental Board reviewed the concept plan on June 30, 2021. General comments included the need for a landscape buffer between the Huntson Addition and the existing single family lot to the east. Concept Plan Review Disclaimer The City's review and comments on the concept plan's relation to the Comprehensive Plan and development regulations does not grant any rights to the applicant to develop the property as depicted by the concept plan. However, staff recommends that the 40-ft wide portion of the property adjacent to a Ware Rd be dedicated as road right-of-way, making the actual area of the lot approximately z 114,796 square feet. Ware Rd is a minor collector road, which requires 80-ft wide right-of- way. The minimum elevation for the W house pads will be dependent on the groundwater elevation, the design of the stormwater co pond, and the depth of the sanitary sewer. The applicant is proposing approximately 23,614 square feet of new impervious surface for the proposed roadway, driveways, and building pads. If only considering the Block 1, Lots 1 &2 of Block 2, and Outlot A, this amount of impervious is above the 40% maximum impervious surface cover as stated in the City of Lino Lakes Zoning. The applicant will be required to work with the Rice Creek Watershed District and obtain a CAPROC if they move forward with development. A stormwater BMP is needed to meet City stormwater requirements because the site is over one (1) acre. The applicant is proposing to meet City stormwater requirements by constructing a stormwater pond on Outlot A. The design of the pond shall meet the requirements of Table 6 of the City's Stormwater Management ordinance. • Water Supply The existing property is identified as a Stage 1A Planned Service Area in the 2040 Comprehensive Plan. There is existing 8-inch diameter ductile iron pipe (DIP)water main along Oak Hollow Lane north of the site and 8-inch diameter DIP water main east of the site along Ware Road. A stub extends to the property line of 6149 Ware Road. The existing single family home is connected to the City's water system along Ware Road. It is feasible to extend the 8-inch diameter water main to service the proposed lots. The proposed townhomes will be required to connect to the City's water system. • Sanitary Sewer The existing property is identified as a Stage 1A Planned Service Area in the 2040 Comprehensive Plan and straddles the 1A and 1C sanitary sub-districts. There is existing 8-inch diameter polyvinyl chloride (PVC) sanitary sewer, 4-inch diameter PVC force main, and an 18-inch diameter MCES interceptor along Ware Road. There is existing 8-inch diameter polyvinyl chloride (PVC) sanitary sewer along Oak Hollow Lane north of the site that flows north to 8-inch diameter sewer along Ravens Court. A sewer stub extends to the north property line of 6149 Ware Road with an invert of 894.33 according to the record plans for Raven's Hollow development. The existing house is connected to the sanitary sewer on Ware Road. Assuming the sanitary sewer is extended for the entire length of the development at minimum grade, the sanitary depth would range from 894.33 to approximately 895.00. It is possible to extend the 8-inch diameter sanitary sewer to serve the townhomes in Huntson Addition. However, staff recommends that this be the last extension of the sanitary sewer in this area due to concerns with grades and shallow pipe depth. The proposed townhomes will be required to connect to the City's sanitary sewer system. • Transportation The site is located at 6149 Ware Road and abuts the southern portion of Oak Hollow Lane. Oak Hollow Lane was extended to the south with the intent of future development access during the construction of Raven's Hollow. Ware Road has a 66-ft wide right-of-way in this area, but requires 80-ft wide right-of-way as a minor collector road. Oak Hollow Lane has a 60-ft wide right-of-way. Oak Hollow Lane is a local city street and has capacity to handle the Huntson Addition Concept Plan Engineering Review Ms.Katie Larsen 7/72021 Page 3 additional traffic from the new lots. Townhome residents will use Ravens Court, a local road, to access Ware Road, a minor collector. Ravens Court and Ware Road also have capacity to handle the additional traffic from the proposed development. The applicant is proposing to access Blocks 1 and 2 from Oak Hollow Lane and extending Oak Hollow Lane through the site. The proposed roadway is 32-ft wide from back-of-curb to back-of-curb and is approximately 165-ft in length. The applicant currently shows a proposed temporary cul-de-sac with a 46-ft radius. The proposed cul-de-sac and temporary easements greatly impact the adjacent properties and the area available for stormwater ponding. After review, staff believes that a 40-ft radius temporary cul-de-sac would be sufficient for the site or that a 25-ft by 32-ft turnaround could be added to the eastern side of the roadway. The 40-ft radius temporary cul-de-sac can be offset so that the majority of the cul-de-sac would be within Outlot A. City Ordinance states that cul-de-sac radii need to be 46-ft, but also states that minor variations of that requirement can be allowed with the consensus of the Public Works Director, City Engineer, and City Administrator. Multiple temporary cul-de-sacs have been installed in Lino Lakes with radii of 40-ft. • Wetlands and Mitigation Plan There are multiple existing wetlands on the Huntson Addition property. The plans note that the wetland delineation was performed by Jacobson Environmental, Pllc, in August of 2017. If not already approved, the wetland delineation shall be approved by the Technical Evaluation Panel (TEP). • Landscaping Staff does not have any comments on this time. Floodplain There are no existing floodplains on Huntson Addition. • Drainage and Utility Easements The applicant is proposing 10-ft wide drainage and utility easements along adjoining right-of- way, rear lot lines, and the plat boundary lines. The applicant is proposing a 5-ft wide drainage and utility easement for the side lot line adjacent to Outline A. Per City Code, the City requires 10-ft wide drainage and utility easements along lot lines and allows these easements to be centered on common rear and side lot lines.
