CALL TO ORDER AND ROLL CALL: Mr. Sullivan called the Lino Lakes Environmental Board meeting to order at 6:30 p.m. on July 28, 2021. II. PLEDGE OF ALLEGIANCE III. APPROVAL OF AGENDA 3 Mr. Sullivan approved the Agenda as stated. IV. APPROVAL OF MINUTES: June 30, 2021 Mr. Sullivan added an amendment to the June 30 meeting minutes in regards to the Concept Plan for the Huntson Addition. Mr. Sullivan asked for a motion to approve the amended minutes. Ms. Cavegn MOTIONED to approve the minutes as requested. Ms. McNulty seconded the motion. Motion passed 4-0. V. MS4 Annual Report and Public Comment Opportunity Mr. Nelson conducted a presentation on the MS4 permit and the development of Storm Water Pollution Prevention Plan (SWPPP) for the city. Mr. Sullivan and Ms. Holmes commented that they believed the education opportunities detailed in the report were an important part of the SWPPP. Mr. Nelson showed examples of the new door hangers that inform residents of the watering restrictions and list fines for noncompliance with the ordinance. Ms. Holmes inquired about any updates on the city's situation with the high manganese levels in the water supply. Mr. Nelson responded saying that an update will be posted in the upcoming newsletter. Mr. Sullivan opened and closed the opportunity for public comment on the SWPPP with no comments provided. VII. UPDATES A. Recyclin2 Update Mr. Davis provided an update on the participation at July's Recycling Saturday event and updates to the organics recycling drop-off program. He discussed improving on - site education regarding organics contamination, including a new addition of signs and stickers added to each site. The Public Works department provided new recycling and garbage bins at each organics site to help further reduce any contamination. Mr. Davis provided an update on the SCORE report and the finances involved with the recycling efforts made in the past six months. Mr. Sullivan asked who empties the recycling bins at the parks. Mr. Davis responded that the Parks department is in charge of emptying the recycling bins. Mr. Sullivan commented that he will be meeting with the City Council to consider encouraging businesses in Lino Lakes to ask for grants from Anoka County to improve their recycling programs. B. General Updates Mr. Nelson provided an update on the upcoming newsletter to be sent out in early August. Articles included contain information about illicit discharge, stormwater ponds, Adopt -a -Drain programs, and more. DRAFT MINUTES Environmental Board July 28, 2021 Page 3 Mr. Nelson commented that the city is looking at a property near the Watermark development that has potential for wetland restoration and mitigation work. The city's engineering firm, WSB, is in the process of preparing a draft prospectus for the potential wetland bank site. He provided further detail about the location of the property as requested by Ms. Holmes. VIII. ADJOURNMENT Ms. Holmes made a MOTION to adjourn the meeting at 7:08 p.m. Motion was supported by Ms. McNulty. Attn: Thomas Budzynski 9100 Baltimore Street Blaine, MN 55449 OWNER: John Commers CB Property, LLC. 285 Grande Way Apt. 501 Naples, FL 34110 BACKGROUND The applicant, Thomas Budzynski of TJB Homes, Inc., has submitted a land use application for preliminary plat. The proposed development is a subdivision of a 40.85 acre site at 6149 20th Avenue into four approximately 10 acre (10.07, 10.08, 10.16, and 10.55 acres) single-family lots. This staff report is based upon the following submittals: oo Preliminary Plat prepared by Acre Land Surveying, dated 8/03/21 oo Wetland Delineation Report prepared by Midwest Natural Resources, dated 10/12/16 oo Tree Preservation Plan prepared by Midwest Natural Resources, dated 6/08/20 oo Resource Inventory prepared by Midwest Natural Resources, dated 6/08/20 oo Geotechnical Exploration Report prepared by Independent Testing Technologies, Inc., dated 10/12/16 oo Stormwater Management Plan prepared by Civil Methods Inc., dated 6/18/20 General Site Characteristics The 40.85 acres site is two parcels, located at just east of Amelia Lake at 6149 20th Avenue, and zoned RX, rural executive. The land is primarily deciduous woodland, grasslands, and wetlands. 1 Soils SSURGO (Soil Survey Geographic Database from Natural Resource Conservation Service) soils data indicates the presence of the following soil types: Cut and fill land (31%); Hayden fine sandy loam with 6-12% slopes, eroded (28.9%); marsh (9.5%); Kingsley fine sandy loam with 2-6% slopes (6.7%); Dundas loam (6.4%); Cathro muck (5.8%); Kingsley fine sandy loam with 12-18% slopes (5.5%); Hayden fine sandy loam (3.5%); and water (2.6%). The northeast portion of the site is Hayden fine sandy loam (hydrologic group B), Kingsley fine sandy loam (hydrologic group C), Dundas loam (hydrologic group B/D), Cathro muck (hydrologic group B/D), and marsh (hydrologic group A/D). Group B and C soils have moderate to slow rates of infiltration and water transmission. The southwest portion of the site is primarily cut and fill land and marsh. The soil properties such as infiltration rates and runoff potential are indeterminate for cut and fill areas. Per the Geotechnical Exploration Report, twenty-two soil borings were conducted for this site. 18 of the borings encountered top soil from depths of 3-19 inches. No topsoil was encountered in the borings for the cut and fill area. Groundwater was encountered in I I of the borings at depths of 4-19'. The other I I borings did not encounter groundwater. Land Cover Pre -settlement land cover (Marschner) was oak openings and barrens in the east portion of the site and wet prairie in the west. Current land cover (Minnesota Land Cover Classification System) is (from northeast to southwest): altered/non-native deciduous woodland, aspen forest in saturated soils, short grasses and mixed trees with 26-50% impervious surface, grassland with sparse deciduous trees, medium -tall grassland, oak forest, cattail marsh - semi -permanently flooded, cattail marsh seasonally flooded, lowland hardwood forest, aspen woodland, upland deciduous woodland, mixed hardwood swamp — seasonally flooded, altered/non- native deciduous woodland, floodplain forest, and palustrine open water. Rare, Unique or Significant Resources Water willow (Decodon verticillatus), a MN DNR listed species of Special Concern, has been identified on site, per the wetland delineation report performed by Midwest Natural Resources. It occurs on undisturbed lakeshores. Conservation of this species depends on avoiding physical alterations of shoreline and preserving native plant buffers. Amelia Lake is a 195-acre lake of biological significance (MN DNR). It flows to Wilkinson Lake and then to East Vadnais Lake. 2 Wetland D is classified as a preserve due to high value amphibian habitat and vegetative diversity. Storm Water Management, Erosion and Sediment Control Per the stormwater management plan, this development will involve disturbance of approximately 5 acres, and will add 2.22 acres of impervious area. The City requires no increase in peak flow rates for 2-, 10-, and 100- year rain events. The conditions as proposed indicate runoff rates will be held steady or reduced for the three categories of rain events. Stormwater runoff currently enters Amelia Lake at four locations. The proposed plan includes conveyance of runoff to stormwater treatment basins planted with native vegetation. More specifically, there will be eight biofiltration basins (raingardens) with underdrains. Post -treatment stormwater will enter Amelia Lake in the same four general locations as it does currently. Infiltration was not deemed feasible for this site, based on presence of clay in soil borings, and because the site is within the Drinking Water Supply Management Area (DWSMA). A stormwater pollution prevention plan (SWPPP) will have to be submitted. The project will also require an NPDES permit. Drinking Water Protection The site is within the Drinking Water Supply Management Area (DWSMA), with the northeast of the site classified as highly vulnerable, and the southwest classified as moderately vulnerable. This will impact the feasibility of stormwater infiltration on the site. The stormwater management plan does not propose infiltration. The proposed lots will have septic systems and private wells because city water and sewer do not currently reach this site. Flood Plain Portions of the site near Amelia Lake fall within FEMA flood plain. Shoreland District Site falls within the Shoreland Management Overlay. The section of ordinance pertaining to shoreland district has the general purpose of protecting public waters. Alterations of vegetation and topography in the Shoreland Overlay District will be regulated to prevent erosion into public waters, fix nutrients, preserve shoreland aesthetics, preserve historic values, prevent bank slumping, and protect fish and wildlife habitat (City ordinance Ch. 1102.09). The regulations prohibit clear cutting of vegetation and allow limited clearing 3 of trees and shrubs to provide a view to the water from the principal dwelling provided that the screening of the structure as viewed from the water is not substantially reduced. Impervious surface coverage on each lot must not exceed 30% of the lot area. The impervious surface area for proposed lot 1 is 5.9%, lot 2 is 5.5%, lot 3 is 5.2%, and lot 4 is 5.5%. The lots meet the impervious surface coverage requirements. Structures and on -site sewage must have a 150 ft. setback from the ordinary high water level. Wetlands Per the wetland delineation performed by Midwest Natural Resources, Inc. dated 10/12/16, there are five wetland areas on the site. Wetland A is the wetland fringe to Amelia Lake. Wetland B is 0.19 acre and classified as a Manage 2, which calls for a 30 ft. base buffer width with a 24 ft. minimum width. Wetland C is 0.67 acre and classified as a Manage 2, which calls for a 30 ft. base buffer width with a 24 ft. minimum width. Wetland D is 1.93 acres and classified as a Preserve, which calls for at 75 ft. base buffer width with a 67 ft. minimum width. This classification reflects this wetland's high value as amphibian habitat and higher vegetative diversity. Wetland E is 1.23 acre and classified as a Manage 2, which calls for a 30 ft. base buffer width with a 24 ft. minimum width. Vadnais Lake Area Watershed Management Organization (VLAWMO) facilitates the Wetland Conservation Act in its watershed, but is not a permitting agency. VLAWMO does provide permit information, resources, and planning assistance. Permits may be required from the Board of Water and Soil Resources if wetland impacts are proposed. Alternative Urban Areawide Review (AUAR) Considerations The project area does not fall within the AUAR boundary. Tree Preservation Plan A tree inventory and preservation plan has been submitted. Tree species were inventoried in the vicinity of the basic use areas. Species identified in these areas include quaking aspen (33.8%), cottonwood (21.2%), black cherry (11.5%), northern pin oak (10.7%), green ash (4.9%), white oak (3.9%), and bur oak at (2.9%). Smaller quantities of elm, cedar, paper birch, willow, and apple were also present. M The preservation and mitigation plans call for saving 235 trees, removing 536 in the basic use and non -environmentally sensitive areas, and removing 22 trees in the natural resource protected area. These 22 trees will be mitigated for at a rate of one tree provided for every two trees removed. This plan calls for the planting of 11 mitigation trees. RECOMMENDATIONS Staff recommends the Lake Amelia Woods Preliminary Plat be forwarded on to the Planning and Zoning Board and City Council with the following comments and any additional comments from the Environmental Board: 1. A survey for rare, unique, and significant resources should be performed. This survey should include a data request to the MN DNR for Natural Heritage Information System data for this site. The survey should also include information on presence and/or extent of any MN DNR listed threatened, endangered, or special concern species. If any of the aforementioned species are identified on the site, their locations should be mapped as this may impact future work on the lots (lake access locations, for example). 2. Buffers for the wetlands and shore of Amelia Lake should be established in accordance with Vadnais Lake Area Watershed Management Organization (VLAWMO) recommendations. 3. Tree protection fence appears to encroach on protected root zone areas on trees on all four lots. Trees that have more than 30 percent of their root zones impacted shall be counted as removed and must be mitigated for at applicable rates unless they are in basic use areas. 4. Green ash (Fraxinus pennsylvanica) and Siberian elm (Ulmus pumila) appear on the list of trees intended to be saved. These trees should be removed. Mitigation trees for removals of these species will not be required. 5. Recommend that red maple and sugar maple be removed from the suggested trees to replant with list on the Tree Mitigation Plan.
