City of Lino Lakes Planning & Zoning Board MEETING GUIDELINES Open Mike — The purpose of a Board Meeting is to accomplish the business of the city. When presenting at a meeting please remember to be respectful, and follow these guidelines: oo Please address the meeting chair. oo State your name and address for the record. oo Please observe a 4-minute limit. oo The topic must relate to city business. oo Open Mike is for items not on the agenda. oo A spokesperson must represent a group of five or more—groups will have 8 minutes. oo The Presiding Officer may limit duplicative presentations. oo Remember,the meeting is to discuss city business only. Public Hearing - Held as a separate item of business on the agenda. The public hearing segment is your opportunity to tell the Board how you feel about issues scheduled to be heard. Typically, a hearing follows these steps: oo The Presiding Officer (Chair or Vice-Chair) will announce the proposal to be reviewed and ask for the staff report. The presiding Officer shall maintain strict order and etiquette at all meetings. oo Staff will present their report on the proposal. oo Board members will then ask City Staff questions about the proposal. oo The Presiding Officer will then open up the public hearing for anyone present who wishes to comment on the proposal. This is the time for the public to make comments or ask questions about the proposal. Comments should be limited to four (4) minutes unless further time is granted by the Presiding Officer. All comments should be directed to the Board as a body and not to any individual Board Member or City Staff Member unless permission is granted by the Presiding Officer. No person shall be permitted to enter into any discussion, either directly or through a member of the Board without the permission of the Presiding Officer. oo After everyone in the audience wishing to speak has given his/her comments, the Presiding Officer shall close the public hearing. oo The Board will then discuss the proposal. APPROVAL OF AGENDA The agenda was approved as presented. IV. APPROVAL OF MINUTES: Mr. Evenson made a MOTION to approve the July 14, 2021 meeting minutes. Motion was supported by Mr. Wipperfurth. Motion carried 4—0. Mr. Reinert, Mr. Laden, and Chair Tralle abstained. V. OPEN MIKE Chair Tralle declared Open Mike at 6:31 p.m. There was no one present for Open Mike. Mr. Laden made a MOTION to close Open Mike at 6:31 p.m. Motion was supported by Mr. Evenson. Motion carried 6—0. Chair Tralle abstained. VI. DISCUSSION ITEMS A. Zoning Ordinance Update Discussion—PUD, Planned Unit Development, Kendra Lindahl, Landform DRAFT MINUTES Planning&Zoning Board August 11,2021 Page 2 Ms. Kendra Lindahl, Landform,presented a summary of changes to the Planned Unit Development section of the Zoning Ordinance. Ms. Lindahl requested the Planning &Zoning Board review changes as recommended by staff and provide feedback. Upon receiving feedback, the draft will be revised and reviewed again in December with the other ordinance updates. Board Comments In reference to section 1007.04(4), Mr. Root said the term `guidelines' is not appropriate as the verbiage implies recommendation or suggestion. He interpreted the ordinance to be more restrictive. He suggested utilizing a phrase akin to `recognized standards'. In reference to section 1007.04(4)(a), Mr. Root stated the phrase `presumptively appropriate' is not accurate. He said we need to be clear the items listed are recognized standards defined by the City. In reference to section 1007.04(6)(c)(3), Mr. Root explained since the phrase `open space' can be used to reference natural areas or developed park areas, he recommended utilizing the term `useable' exclusively when referring to park areas. He requested a definition of the term `useable'. Furthermore, he wanted clarification as to what parts of the open space can be used. In reference to section 1007.04(9)(b), Mr. Root commented there should be notification requirements regarding the neighborhood meeting, specifically who gets notified and by what means. He asked for clarification as to what a presented concept plan should look like at a neighborhood meeting. He recommended recording the meeting in order to ensure neighborhood concerns are addressed. He said at the neighborhood meetings, residents should be reminded they can attend and comment at any publicly held meeting during open mike or during the project's public hearing. In reference to section 1007.04(9)(d)(5)(h), Mr. Root asked, in regards to the market feasibility study, who would deem it necessary. He recommended this section should be moved to section 1007.04(2)(h)with other public benefits as recognized by the City. In reference to section, 1007.04(9)(b), Chair Tralle stated he would like the Planning & Zoning Board members invited to the neighborhood meetings. In reference to section, 1007.04(1), Mr. Wipperfurth commented he prefers the wording of the original text because it accurately addresses each point for the purpose of the PUD. He also appreciated that the original text mentions the comprehensive plan as it is important to emphasize the comprehensive plan could be different from the existing zoning guidelines. In reference to section, 1007.04(9)(b), Mr. Wipperfurth liked the idea of conducting a neighborhood meeting,but he questioned if it would be too early in the process to have the meeting prior to the concept plan. He said it would be more beneficial to have the meeting after the concept plan review and before the preliminary plan review in order to give the developer more time to assemble his/her plan. In order to hasten the construction of a park, Mr. Wipperfurth recommended, as a requirement of the PUD, applicants submit a timeline of the park's construction. He commented it is unacceptable for a park's construction to take 1-2 years. In reference to section, 1007.04(9)(e)(5)(a), Mr. Wipperfurth asked DRAFT MINUTES Planning&Zoning Board August 11,2021 Page 3 given the requirement that construction should begin within one year upon approval of a PUD Final Plan, what is the definition of construction. Mr. Laden expressed concern with moving the rural residential PUD to the ordinance section. He said by doing so, the City is giving up the opportunity to negotiate with developers regarding the implementation of open space, trails,parks, etc. In reference to section, 1007.04(9)(b), Mr. Vojtech suggested including a statement which specifies what we will do with the information gathered from the neighborhood meeting. In reference to section, 1007.04(2)(g), Mr. Vojtech asked for clarification as to what would be deemed desirable to the City and who would make that decision. In reference to section, 1007.04(2)(g), Mr. Reinert concurred with Mr. Vojtech's comment asking what does desirable mean and who gets to define that. In reference to section, 1007.04(1), Mr. Reinert expressed his appreciation for the wording of the original text since it had more definition than the edited version. Mr. Reinert asked City staff to comment on how densities will function in relation to PUDs. Staff Comments Mr. Grochala said densities were established within the 2040 Comprehensive Plan. He explained when City staff review a PUD, they first determine how the parcel is guided according to the comprehensive plan. If the parcel is guided low density, 1.6 to 3 units per acre is allowed. Sometimes, a PUD may be submitted for multiple, adjacent parcels with various densities. In this instance, the City Planner would determine the number of units allowed per density multiplied by the number of acres and then divide that number by the total acreage which would result in the uniform density requirement. This would then give the developer flexibility to adjust buildings on the site. Mr. Grochala continued if a parcel guided low density is developed using conventional zoning, the developer has the following zoning district options R-1, R- 1X, or R-2. City staff would then guide that parcel based on its land characteristics. If it is heavily wooded or by a lake, characteristics such as these may dictate a change in one of the zoning districts and the developer would need to rezone the parcel and build accordingly. The lot size for an R-1 district is 10,800 sq. ft., but with a PUD, the City may be flexible regarding width or depth. This is why the term `guidelines' was used within the PUD section of the zoning ordinance because the developer is using the zoning ordinance requirements as a guideline to shape the PUD. Ms. Lindahl commented there may be an alternative word for `guidelines', however, `standards' and `requirements' would not work because as part of the PUD, developers are typically asking for flexibility from the district standards and requirements. DRAFT MINUTES Planning&Zoning Board August 11,2021 Page 4 Mr. Root suggested inserting language which states the City is open to negotiation. Mr. Reinert surmised, when a PUD is allowed, the R-1 district requirement of 10,800 sq. ft. remains, but the requirement of 80 ft. by 135 ft. is eliminated. He questioned if this is because the topography in the City is such that flexibility is necessary to be able to work with developers. Mr. Grochala stated the 10,800 sq. ft. requirement could be eliminated as well at the City's discretion. A PUD is a negotiated zoning district. The developer is looking for tradeoffs and if the City likes what the developer proposes, the City can approve it. If a conditional use permit is submitted and it meets the requirements, it is typically approved. Therefore, removing the PUD by conditional use permit gives the City more control. The alternative option for a developer is to follow conventional zoning district requirements. Mr. Reinert clarified and gave an example of a development with 25 homes guided low density. The district requirement would be 10,800 sq. ft.,but under a PUD, the City could allow one lot to be 9,000 sq. ft. and another lot 12,000 sq. ft. if it was in the City's interest to save a tree. Mr. Grochala confirmed the City may allow the developer to condense the lot footprint in order to preserve something currently in existence. Ms. Larsen said typically lots abutting the wetlands are smaller and lots off of the road are enlarged. Ms. Lindahl informed the Board the ordinance will be reviewed, a draft will be made, and the definitions will be revised last. She asked Mike to lead the discussion concerning the concept plan and the neighborhood meeting. Mr. Grochala explained the purpose of the concept plan is to have the developer create a simple sketch of the development, present it to the Board and City staff, and receive feedback before any significant amount of funds are spent on surveying, engineering, etc. At the PUD concept stage,possible public provisions are identified and it is the developer's responsibility to incorporate those items into the plan. Mr. Grochala then explained the neighborhood meeting should occur prior to the concept plan in order to give neighbors an opportunity to also inform the design. He agreed with the Board it is important to know what feedback is given to the developer at each meeting. Ms. Lindahl stressed the importance of ensuring the neighborhood meetings do not include City staff. Although, she said the City should be aware of the meetings and what is discussed. Ms. Lindahl suggested assembling a policy guideline for developers on how to conduct neighborhood meetings. She stated the meetings would not be required, but it would be strongly encouraged. DRAFT MINUTES Planning&Zoning Board August 11,2021 Page 5 Mr. Laden agreed with Chair Tralle's comment to have the Planning &Zoning Board invited to the neighborhood meetings since they represent the citizens of Lino Lakes. Chair Tralle commented it is important for the Board to attend the meetings simply to observe the conversation between the developer and the neighborhood. Mr. Grochala said we can make sure the Board members are invited to the meetings. However, he cautioned the Board not to get drawn into the conversation. Mr. Wipperfurth appreciated Mr. Grochala's explanation as to why the neighborhood meeting should occur at the concept stage and he agreed. He reiterated it would be more difficult for a developer to make changes to the development after plans are drawn and money is invested. Mr. Grochala then changed the conversation to address rural cluster developments. He said there are a few permanent rural areas in the City that will never receive City sewer and water specifically between Rondeau Lake Rd and 35W and a corner section in the southeast quad of the City. In these areas, the City is considering letting owners subdivide at a higher density to allow for cluster developments; however, 50% of the land would need to be preserved as permanent open or agricultural space. The lot sizes would be a minimum of two acres with a community drain field. Mr. Laden stated it would be helpful to see a map of the permanent rural areas throughout the City. IV Ms. Larsen commented there are few permanent rural areas that will never receive City sewer and water. Mr. Evenson asked if the zoning ordinance specifies permanent rural. Mr. Laden agreed and questioned if it is clear the ordinance is referencing permanent rural areas and not areas current zoned rural. Ms. Lindahl said it should have been more clear in the staff report, but the language in the draft is specific. She commented a map of the permanent rural areas will be included. Mr. Grochala explained City staff also discussed allowing cluster developments in the post 2040,urban reserve areas; however, the 50% open space requirement would be temporary. He said this idea is not currently proposed as it could create unintended consequences. Ms. Lindahl reiterated in the permanent rural areas, the cluster developments would maintain a 50%permanent open space. If proposed, in the urban reserve areas, open space would be protected until municipal sewer and water arrives. DRAFT MINUTES Planning&Zoning Board August 11,2021 Page 6 Chair Tralle questioned if there is a cluster development in an urban reserve area and municipal sewer arrives, would those in the development have to hook up to City sewer. Mr. Grochala said the cluster development would be required to connect to City sewer. Chair Tralle asked who would be responsible for the sewer connection cost. Mr. Grochala explained the homeowners in the cluster development would be responsible for the connection cost,but the cost would be mitigated since they would also sell their open space for urban development. He reminded the Board this concept is not currently proposed,but it is an idea the City is considering. Mr. Grochala then addressed Mr. Laden's concern with moving the rural residential PUD to the subdivision ordinance section. He explained the City would not be giving up the opportunity to negotiate with developers because 50% of the land is required to be preserved as permanent open space per the rural residential PUD. Chair Tralle expressed his support of the cluster developments. Ms. Lindahl informed the Board district standards will be discussed in the months ahead. Is Chair Tralle asked if conditional use permits will be addressed. Mr. Grochala said conditional use permits will be covered in each individual district. Mr. Reinert inquired if the surface water management plan in relation to residential impervious surface percentages will be discussed. Mr. Grochala replied the surface water management plan in relation to the individual residential districts will be addressed. Chair Tralle questioned if outdoor storage issues would be a topic of discussion. Ms. Larsen said outdoor storage could be addressed under the general provisions section. Chair Tralle explained he would like to talk about storage given the recent situation concerning Glamos Wire. It was his understanding Glamos Wire was renting out parking lot space to someone for the purpose of parking semis and the lot was built to do so. Ms. Larsen said the lot was not built for storage purposes. DRAFT MINUTES Planning&Zoning Board August 11,2021 Page 7 Mr. Grochala stated the lot was originally built for employee parking. Chair Tralle went onto say he did not understand why people in residential areas are allowed to park unhooked, utility trailers on City streets for months at a time, but Glamos Wire is prohibited from renting out lot space to park semi-trailers. Mr. Grochala explained the City allows outside storage per conditional use permit if it is screened and there is a primary business on the site. The ordinance does not allow outside storage without a principal building because it will generate the lowest tax value on that property and it has the potential to lower the property values of surrounding properties. Regarding residential areas, Mr. Grochala said recreational vehicles can be parked in driveways if they are parked in accordance with the street's minimum setback. Also, recreational vehicles do not need to be screened. Mr. Grochala stated if a homeowner is unable to meet any of those requirements, the homeowner is still allowed,per an exemption in the City Code, to park recreational vehicles on the street. However, you cannot park in the street between the hours of 2 a.m. and 6 a.m. beginning November 1"through April I". B. Project Updates Staff provided verbal updates to the Board on current City projects. VIII. The applicant proposes to subdivide 2 existing parcels into four, 10 acre rural lots for the purpose of constructing four(4) new single family homes. The subject site is located east of Amelia Lake and is 40.85 gross acres as measured above the OHWL. The Land Use Application is: 1 oo Preliminary Plat o 4 rural lots This staff report is based on the following information: oo Preliminary Plat Plan Set prepared by Acre Land Surveying dated 8/03/21 & 9/2/21 oo Preliminary Plans for Grading prepared by Civil Methods, Inc. dated 2/22/2020 oo Wetland Delineation Report prepared by Midwest Natural Resources dated 10/12/16 oo Tree Preservation Plan prepared by Midwest Natural Resources dated 6/08/20 oo Resource Inventory prepared by Midwest Natural Resources dated 6/08/20 oo Geotechnical Exploration Report prepared by Independent Testing Technologies, Inc. dated 10/12/16 oo Stormwater Management Plan prepared by Civil Methods Inc. dated 6/18/20 ANALYSIS Previous Land Use Application Submittal In 2017, the applicant and property owners submitted a PUD Concept Plan to the City proposing a master planned residential community consisting of 8 market rate apartment buildings, 20 twin homes and 2 senior assisted-living buildings. The total number of housing units was 452. The proposal did not move past concept plan. The current preliminary plat proposal is for 4 housing units. Existing Site Conditions The 40 acre site is currently vacant, natural open space. Per the MLCCS, land cover includes cattail marsh, deciduous woodlands, oak forest and tall grasslands. It is in the shoreland district of Amelia Lake. Topography contour elevations range from 908.1 OHWL to 930 along CSAH 54 and from 900 on the south end to 950 on the north end. A previously submitted Existing Slopes and Hydrology plan sheet indicating some slopes exceeding 20% on site. No development is proposed in these areas. The property width tapers from approximately 1,000 feet(north)to 200 feet (south). The property length along CSAH 54 is approximately 3,000 feet. A 66 foot wide utility transmission easement with overhead power lines bisects the parcel north to south. Groundwater was encountered at 4— 19 ft. Wetlands exist on site. Zoning The subject site is zoned R-X, Rural Executive. Land use prior to 2040 is limited to agricultural related uses and single family residential limited to 1 unit per 10 acres. The proposed development of 1 unit per 10 acres is consistent with the comprehensive plan. Zoning Requirements The subject site is zoned R-X, Rural Executive. It is 40.85 gross acres as measured above the OHWL 908.1 EL. Four lots are being created for the purpose of constructing one (1) single family home per lot. The site is also subject to requirements of the Shoreland Management Overlay District. Amelia Lake is classified as a Natural Environment Lake. This shall be noted on the preliminary plat and certificate of survey submitted with the building permit. In an R-X zoning district, a detached accessory structure is allowed at least 100 ft from the CSAH 54/201h Avenue road right-of-way. Building Requirements At the time of building permit, the single family homes will be reviewed for compliance regarding floor area, garage, design and construction standards and septic system design. Subdivision Ordinance Per City Code Section 1001.076(1), a subdivision which results in three or fewer unsewered residential parcels, tracts or lots from one or two existing parcels, tracts or lots, within unsewered residential areas of the city is a minor subdivision. A subdivision that results in more than three lots from one or two existing lots shall be platted. Four(4)unsewered residential parcels are proposed; therefore, a preliminary and final plat are required. Conformity with the Comprehensive Plan and Zoning Code The preliminary plat is consistent with the comprehensive plan for urban reserve development and zoning code requirements for R-X, Rural Executive as discussed above. Blocks and Lots 4 The preliminary plat contains Lots 1-4, Block 1, Lake Amelia Woods. Ghost Plat Per City Code Section 1007.042(2)(d), all subdivisions in areas without public sanitary sewer shall be designed such that the larger non-sewered lots can be resubdivided to provide smaller sewered lots when sewer becomes available in the future. Homes and accessory buildings shall be located on these lots so as to allow for future resubdivisions. This is also supported by City Code Section 1007.081(2)(d). The applicant submitted Sheet S4, Ghost Plat showing future resubdivisions of the 4 lots. Further subdivision of these lots will require public sanitary sewer and water. The ghost plat shall be revised to reflect the correct wetland buffers, connection to the north, cul de sac lengths, utility easements, the ravine and topography and limited number of driveways onto CSAH 54/201h Avenue. Streets and Alleys All 4 lots are served by CSAH 54/201h Avenue which is an A-Minor Reliever. Road right-of-way 60 ft wide from centerline is required and provided on the preliminary plat. The A-Minor Reliever road has capacity for 4 additional lots. The private driveway for 6351 201h Avenue encroaches south onto the subject site approximately 24 ft. A 24 ft wide Private Ingress/Egress Easement is proposed over the driveway. The applicant shall prepare a separate easement and exhibit clearly showing the location of the easement. This easement shall be recorded. Easements The following drainage &utility easements are required on the Preliminary Plat and Final Plat: oo CSAH 54/20th Avenue= 20 ft oo Side Lot Lines = 10 ft oo Amelia Lake=Delineated Wetland+ 10 ft or oo Amelia Lake=Floodplain 100 yr. Elevation+ 10 ft(whichever is greater) oo Wetlands =Delineated boundary+ 10 ft oo Stormwater Facilities =HWL+ 10 ft Storm Water Management and Erosion and Sediment Control Per City Code Section 1011.011, a stormwater management plan is required for all proposed land development activity if the site is within the 100-year floodplain or within 1,000 feet of a public water. Lake Amelia Woods is within the floodplain and shoreland district. 5 Per the Storm Water Management Plan prepared by Civil Methods, Inc. dated June 18, 2020, the project is expected to disturb approximately 5 acres and add 2.22 acres of new impervious area to the site. Runoff from the site enters Lake Amelia at 4 general locations. Drainage patterns will be maintained from existing to proposed conditions. No other properties will be impacted by runoff from the project. Drainage from the proposed impervious area will be conveyed to stormwater treatment basins and ultimately to Lake Amelia as it does under existing conditions. oo Water Quality Treatment Volume The City requires treatment of runoff based on 1.1" over the new impervious surface. Eight(8) biofiltration basins with native vegetation are proposed for water quality treatment. Infiltration is not feasible due to presence of clay and the site is within the Drinking Water Supply Management Area(DWSMA). oo Runoff Rate Control The City requires no increase in peak flow rates for the 2, 10 and 100 yr. frequency events. With the proposed basins, runoff rates are held or reduced for the overall project. oo Water Quality Control Water quality control is being provided through a series of biofiltration basins (raingardens). A minimum 75 foot wide vegetated wetland buffer along Wetland A(lake) equivalent to the shore impact zone area shall be required as a stormwater management best management practice (BMP) to minimize runoff pollutants from entering the lake. This is supported by City Code Section 1102.07(1)(c)3c. The City Engineer comments that more information is needed to determine low floor separation, basins shall be on the same lot as they are treating, and filtration basins are not allowed in the Drinking Water Supply Management Area. Per City Code Section I IO2.07(2)(a), structures and facilities must be located to meet all setbacks. Stormwater facilities are not allowed within the 150ft OHWL setback, 40 ft CSAH 54 setback or 10 ft side yard building setbacks. The plans shall be revised. Utilities Sanitary Sewer Public sanitary sewer is not available to the site. Private septic systems will be required for each parcel. The plans show a primary and alternate site location per lot and corresponding soil boring data was provided. Standard mound systems are proposed for Lot 1 and Lot 2. Type 3 septic systems are proposed for Lot and Lot 4. Per City Code 6 Section 1102.12(2) of the Shoreland Management Overlay district, lots that would require use of holding tanks shall not be approved. Private septic systems cannot be located with the 150ft shoreland setback. These requirements are met. Watermain Public watermain is not available to the site. Private wells will be required for each parcel. Well locations shall be shown on the preliminary plat and placed in relationship to the individual sewage disposal facilities on the same and adjoining lots. The applicant shall demonstrate that each lot can accommodate a private well. Public Land Dedication Per the City's 2040 Comprehensive Plan and Anoka County Chain of Lakes-Otter Lake Regional Trail Master Plan, a regional trail is proposed on the east side of Amelia Lake. The proposed trail extends from CSAH 14 (Main Street) through the City's future recreational facility on Birch Street then south along 201h Avenue. A separate trail easement 20 ft wide along CSAH 54 and 44 ft wide along the south lot line of 6351 20th Avenue shall be recorded. The 44 ft wide easement covers both the 24 ft private driveway easement and 20 ft trail easement. The applicant shall prepare a separate trail easement document and exhibit clearly showing the trail easement location. This easement shall be recorded. The City will require cash in lieu of land dedication for each new lot. Park Dedication Fees Total# of Lots = 4 x 2021 Park Dedication Fee $3,160 =Total Due $12,640 Tree Preservation The goal of tree preservation is to minimize unnecessary loss of habitat, biodiversity and forest resource and to replace removed trees in areas where tree cover is most critical. Tree preservation is especially important within the Shoreland Management Overlay District to prevent erosion, preserve shoreland aesthetics and protect wildlife habitat. Per the Tree List Inventory, there are 793 trees on the subject site. Per Sheet TRI-Tree Preservation Plan and Sheet TR2- Tree Mitigation Plan, 235 trees will be saved, 536 will be removed in the basic use and non-environmentally sensitive areas, and 22 will be removed in the natural resource protected area. These 22 trees will be mitigated for at a rate of one tree provided for every two trees removed. The stormwater basins were 7 included in the basic use area and they should not. The Tree Preservation and Mitigation Plan shall be revised accordingly. Landscaping Canopy cover, foundation landscaping, open space landscaping and buffer and screens are not required for the 4 lot subdivision. Boulevard Trees Boulevard trees are required at the rate of 1 tree per lot frontage for singly family lots. Lots 1-4 contain existing trees along CSAH 54/20t'Avenue that serve as boulevard trees. No additional boulevard trees are required. Sod and Ground Cover All disturbed areas shall have appropriate ground cover in accordance with Section 1007.043(17)(h). Environmental Assessment Worksheet (EAW) An Environmental Assessment Worksheet is not mandated. The four(4)unattached residential units are under the 250 unattached unit threshold required for a mandatory EAW. Great River Energy& UPA Easements The preliminary plat plan set shows a 70 ft wide Great River Energy Easement over an existing overhead transmission line that runs north-south through the development. The plan set notes "Proposed Great River Energy Easement"; however, the easement exists and is recorded. All plan sheets shall be revised to remove the word"proposed" and include the recording document number. The preliminary plat plan set also shows a 66 ft wide UPA Easement along CSAH 54. It does not appear this easement is over an existing utility line. If the easement is not required, it should be vacated. Wetlands A Wetland Delineation Report was completed by Midwest Natural Resources, Inc. on October 12, 2016. A WCA Notice of Decision(NOD) approving the wetland delineation was issued by VLAWMO on November 14, 2016. Although the NOD states the delineation is good for 3 years, staff received confirmation from VLAWMO that the NOD is actually good for 5 years. A 75 foot wide vegetated wetland buffer equivalent to the shore impact zone area shall be required along Wetland A(lake) as a stormwater management best management practice (BMP) to minimize runoff pollutants from entering the lake. The buffer shall extend 75 ft from the delineated wetland boundary. A wetland buffer declaration shall be recorded. The wetland buffer shall be indicated by permanent, free- standing markers. Lot 2 may require a variance to allow for the construction of the driveway in the wetland buffer. This will be better evaluated after the proper wetland buffers are located on the site. The applicant shall clearly indicate any areas on the entire site that may potentially need a variance. A drainage and utility easement 10 feet above the delineated wetland is required. All plan sheets shall be revised to show the correct wetland buffer and drainage &utility easements. Rare,Unique or Significant Resources Water willow(Decodon verticillatus), a MN DNR listed species of Special Concern, has been identified on site per the wetland delineation report. It occurs on undisturbed lakeshores. Conservation of this species depends on avoiding physical alterations of shoreline and preserving native plant buffers. Access points to lake shall not impact these species. Wetland D is classified as a preserve due to high value amphibian habitat and vegetative diversity. These areas will be protected by a wetland buffer adjacent to the wetlands and shoreline. 9 Floodplain The 2015 DFIRM indicates Zone AE floodplain along the lake. The FEMA base flood elevation(BFE) is 910.2 EL. No floodplain impacts are proposed with this development. Shoreland Management Overlay The general purpose and intent of the Shoreland Management Overlay ordinance is to protect public waters. Per the ordinance Policy statement, the uncontrolled use of shorelands of the city affects the public health, safety and general welfare not only by contributing to pollution of public waters, but also by impairing the local tax base. Therefore, it is in the best interests of the public health, safety and welfare to provide for the wise subdivision, use and development of shorelands of public waters. As discussed, the site is located in a Shoreland Management Overlay district of Amelia Lake. This lake is a classified as a Natural Environment Lake and has a 908.1 OHWL elevation. The required OHWL setback is 150 ft for unsewered lots. The proposed houses and private septic system setbacks are compliant. Per City Code Section I IO2.07(2)(a), structures and facilities must be located to meet all setbacks. Stormwater facilities are not allowed within the 150 ft OHWL setback, 40 ft CSAH 54 setback or 10 ft side yard building setbacks. The plans shall be revised. Except for allowed water-orientated accessory structures, accessory structures and facilities shall meet the required principal structure setback and shall be centralized(City Code Section 1102.07(1)(c)6). Per City Code Section I IO2.87(1)(c)4 of the Shoreland Management Overlay ordinance, impervious surface coverage on each lot must not exceed 30%. Per the Preliminary Plat, each lot is under 5.9% impervious and meet the allowed impervious surface coverage requirements. A native vegetated wetland buffer will be required as a stormwater management best management practice (BMP) to minimize runoff pollutants from entering the lake. Wetland/Shoreline Buffer Zone Amelia Lake is one of the few unimpaired lakes in the city and efforts to protect and improve the natural resource should be implemented with any development. A 75 ft wide vegetated wetland/shoreline buffer along Wetland A (lake)will be required as a stormwater management best management practice (BMP) to minimize runoff pollutants from entering the lake. The buffer will also help stabilize the shoreline, reduce erosion and support aquatic plants and wildlife. One (1) access opening through the wetland buffer to the lake no greater than twenty(20) ft wide is allowed per lot. 10 Shore Impact Zone By definition, the shore impact zone is the land between the OHWL and a line parallel to it at a setback of 50% of the structure. Since the required structure setback is 150 ft, the shore impact zone is 75 ft from the OHWL. Comprehensive Plan Lake Amelia Woods is consistent with the goals and policies of the comprehensive plan in regards to resource management, land use, housing, transportation and sanitary waste disposal. More information is needed regarding private wells. Resource Management System Plan Goals of the Resource Management System Plan include: oo Natural Resources and Amenities o Goal #1: Identify,protect and preserve the desirable natural areas and ecological and aquatic resources of the community. oo Land Use Policies o Goal#1: Ensure that well-planned, quality residential, commercial, industrial and institutional development to accommodate the city's projected growth needs occurs in a manner that also conserves and enhances the city's natural resources and amenities. The Lake Amelia Woods protects the natural resource by providing storm water management, wetland and shoreline buffers. Land Use Plan Goal 2: Ensure that zoning and subdivision ordinances and official maps are consistent with the intent and specific direction provided within the Comprehensive Plan. Policies: 1. Ensure developers meet the standards specified within the land-use plan and official controls, including zoning and subdivision ordinances and official maps. 2. Ensure compatibility of adjacent land uses. Lake Amelia Woods is consistent with the 2040 Comprehensive Plan and compliant with the zoning and subdivision ordinances assuming revisions and staff comments can be met. It is also compatible with adjacent residential land uses. 11 Housing Plan Goal 1: Ensure housing development is compatible with existing and adjacent land uses and provides accessibility to key community features and natural resources. Lake Amelia Woods meets the goals of the housing plan. The development is compatible with the existing and adjacent residential homes and the natural resource. Transportation Plan Goal 1: Plan for and achieve required street improvements and connectivity throughout the City of Lino Lakes. CSAH 54/20t'Avenue is an A-Minor Reliever and has capacity for 4 additional lots. Sanitary Sewer Plan Goals of the sanitary sewer plan are to ensure well-planned, quality residential development that conserves and enhances the city's natural resources and to provide an affordable and safe sanitary sewer system. Private septic systems with primary and alternative locations are provided for each lot. Water Supply Plan A goal of the water supply plan is to provide residents affordable potable water that is safe and of high quality for daily consumption and fire demand. Private wells are being installed for each lot. The applicant shall demonstrate that each lot can accommodate a private well. Planning Districts The site is located in Planning District 4. As noted, a regional trail is proposed on the east side of Amelia Lake. The site is located within Amelia and Wilkinson Resource Management Unit(RMU). Environmental Board Comments The Environmental Board reviewed the proposed preliminary plat on August 25, 2021. Their recommendations are noted in the attached August 31, 2021 memo from the Environmental Coordinator. One specific comment was to prohibit motorized boats on Amelia Lake. This requires adopting water surface restrictions with property owner input, a public hearing, City ordinance and MNDNR approval. Staff is requesting Planning& Zoning Board input. 12 MNDNR Comments The preliminary plat was emailed to the MNDNR on August 20, 2021, but comments have not been received. VLAWMO Comments VLAWMO provided advisory comments on August 31, 2021. Overall, the development's stormwater plan meets rate control, runoff volume and water quality requirements. Wetland boundaries and management classifications have also been reviewed. Final Plat A land use application for final plat and Development Agreement shall be required. FINDINGS OF FACT Preliminary Plat Per Section 1001.013, Premature Subdivision: (1) General. Any concept plan, preliminary plat or final plat deemed premature pursuant to the following criteria shall be denied by the City Council. (2) Conditions for establishing a premature subdivision. A subdivision maybe deemed premature should any of the following conditions not be met. (a) Consistency with the Comprehensive Plan. Including any of the following: 1. Land use plan; 2. Transportation plan; 3. Utility(sewer and water)plans; 4. Local water management plan; 5. Capital improvement plan; and 6. Growth management policies, including MUSA allocation criteria. Lake Amelia Woods is consistent with the goals and policies of the comprehensive plan in regards to resource management, land use, housing, transportation and sanitary waste disposal as detailed in this staff report. The development is also consistent with the local water management plan, capital improvement plans and growth management policies. The applicant shall demonstrate that each lot can accommodate a private well. (b) Consistency with infill policies. A proposed urban subdivision shall meet the city's infill policies: 13 1. The urban subdivision must be located within the Metropolitan Urban Service Area(MUSA) or the staged growth area as established by the city's Comprehensive Plan; 2. The cost of utilities and street extensions must be covered by one or more of the following: a. An immediate assessment to the proposed subdivision; b. One hundred percent of the street and utility costs are privately financed by the developer; c. The cost of regional and/or oversized trunk utility lines can be financed with available city trunk funds; and d. The cost and timing of the expenditure of city funds are consistent with the city's capital improvement plan. 3. The cost, operation and maintenance of the utility system are consistent with the normal costs as projected by the water and sewer rate study; and 4. The developer payments will offset additional costs of utility installation or future operation and maintenance. Lake Amelia Woods is a 4 lot rural subdivision with private wells and septic systems. Per the 2040 Comprehensive Plan, the subject site is guided urban reserve and the land is preserved for post-2040 development. Land use prior to 2040 is limited to agricultural related uses and single family residential limited to I unit per 10 acres. The proposed development of I unit per 10 acres is consistent with the comprehensive plan's infill policies. (c) Roads or highways to serve the subdivision. A proposed subdivision shall meet the following requirements for level of service (LOS), as defined by the Highway Capacity Manual: 1. If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade; 2. If the existing LOS outside of the proposed subdivision is C,traffic generated by a proposed subdivision will not degrade the level of service below C; 3. If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D; 4. The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better; 5. Existing roads and intersections providing access to the subdivision must have the structural capacity to accommodate projected traffic from the proposed subdivision or the developer will pay to correct any structural deficiencies; 6. The traffic generated from a proposed subdivision shall not require city street improvements that are inconsistent with the Lino Lakes capital improvement plan. However, the city may, at its discretion, consider developer-financed improvements to correct any street deficiencies; 14 7. The LOS requirements in divisions (2)(c)l. to 4. above do not apply to the I- 35W/Lake Drive or I-35E/Main St. interchanges. At city discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Department of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the subdivision project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties that contribute to traffic at the interchange; and 8. The city does not relinquish any rights of local determination. Lake Amelia Woods meets the requirements for level of service (LOS). All 4 lots are served by CSAH 54120`h Avenue which is an A-Minor Reliever. Road right-of-way 60 ft wide is required and provided on the preliminary plat. The A-Minor Reliever road has capacity for 4 additional lots. The city does not relinquish any rights of local determination. (d) Water supply. A proposed subdivision shall be deemed to have an adequate water supply when: 1. The city water system has adequate wells, storage or pipe capacity to serve the subdivision; 2. The water utility extension is consistent with the Lino Lakes water plan and offers the opportunity for water main looping to serve the urban subdivision; 3. The extension of water mains will provide adequate water pressure for personal use and fire protection; and 4. The rural subdivision can demonstrate that each of the proposed lots can be provided with a potable water supply. Lake Amelia Woods shall be served by an adequate water supply. Each lot will be served by a private well. The applicant shall demonstrate that each lot can accommodate a well and potable water supply. (e) Waste disposal systems. A proposed subdivision shall be served with adequate waste disposal systems when: 1. The urban sewered subdivision is located inside the city's MUSA or is consistent with the MUSA allocation criteria; 2. The city has sufficient MUSA and pipe capacity to serve the subdivision if developed to its maximum density; 3. The subdivision will result in a sewer extension consistent with Lino Lakes sewer plan and capital improvement plan; 4. A rural subdivision can demonstrate that each lot can be served by an adequate sanitary sewer disposal system; and 15 5. A rural subdivision with a proposed communal sanitary sewer or water system has an effective long range management and maintenance program with proper financing. Lake Amelia Woods is served with an adequate waste disposal system. Each lot will be served by a private septic system. RECOMMENDATION Staff recommends continuation of the public hearing for preliminary plat for Lake Amelia Woods. The following items shall be addressed in conjunction with the submission of a revised preliminary plat plan set: 1. Comments from City Engineer Letter dated September 1, 2021 shall be addressed. 2. Comments from the Environmental Coordinator letter dated August 31, 2021 shall be addressed. 3. Comments from Anoka County Highway Department letter dated August 26, 2021 shall be addressed. 4. Any future comments from MNDNR shall be addressed. 5. The applicant shall prepare a draft Private Ingress/Egress Easement document and exhibit clearly showing the location of the driveway easement related to 6351 201h Avenue for City review and approval. 6. Trail Easement: a. The City shall draft a trail easement document. b. The applicant shall draft a trail easement exhibit clearly showing a 44 ft wide easement along the south lot line of 6351 20th Avenue and 20 ft wide easement along CSAH 54/20th Avenue for City review and approval. 7. Wetland Buffer Declaration: a. The City shall draft a wetland buffer declaration. b. The applicant shall draft a wetland buffer declaration exhibit. i. Wetland buffer widths shall be consistent with VLAWMO requirements and the 75 ft wide buffer along Wetland A. ii. The exhibit shall show the location of the free-standing markers. 8. The applicant shall clearly indicate any areas on the subject site that may potentially need a wetland buffer variance. 9. Individual well locations shall be shown on each lot and properly placed in relationship to the individual sewage disposal facilities on the same and adjoining lots. Well plan shall comply with the Minnesota State Well Code, as may be amended, and be submitted for city approval. 10. All plan sheets shall be revised to remove the word"Proposed" in"Proposed Great River Easement" and include the recording document number. 11. If the UPA Easement is not required, it should be vacated. 12. Sheet S 1, Preliminary Plat: a. All "Proposed House"pads shall include a deck. b. It shall be noted on the preliminary plat and future certificate of surveys, "This lot has limited ability to construct accessory structures, decks or 16 additions due to the required OHWL setback and floodplain requirements." c. The plans shall be revised. g. Structures and septic systems shall not be located in the wetland buffers. h. Driveway turn arounds or circles shall not be located in the wetland buffers. 13. Sheet S4, Ghost Plat: a. The ghost plat shall be revised to reflect the correct wetland buffers, road connection to the north parcel, cul de sac lengths < 500 ft,utility easements, the ravine and topography and limited number of driveways onto CSAH 54. 14. Sheet TR1-TR2, Tree Preservation and Tree Mitigation Plan: a. The stormwater/raingarden basins are not part of the basic use area. The minimum elevations for the house pads are dependent on the groundwater elevation, the ordinary high water level (OWHL) of the Amelia Lake, and the design of the stormwater facilities. The existing parcels are within the Amelia Resource Management Unit. The applicant is proposing approximately 2.22 acres of new impervious surface for the proposed driveways and proposed house pads at this time. The proposed project is within the Vadnais Lake Area Water Management Organization (VLAWMO). Stormwater BMPs are needed to meet City stormwater and shoreland requirements. The applicant is proposing to meet City stormwater requirements by constructing several stormwater basins and infiltration basins. The design of the ponds shall meet the requirements of Table 6 of the City's Stormwater Management ordinance. Comments: 1. The building pad Low Floor Elevations (LFE's) must be 4 feet above the highest known groundwater level. 2. The LIFE elevation of future homes shall not be lower than the HWL elevations of the adjacent storm basins. 3. For future maintenance purposes, the basins shall be located on the property for which they are treating impervious surface. 4. Filtration basins shall be located outside of the high vulnerability area shown in the Drinking Water Supply Management Area, see attached map. 5. Applicant to show the location of turf maintenance access to basins. 6. Plans shall show rip rap or alternative stabilization for drain tile underdrain outlets. • Water Supply The existing properties are identified as part of the Stage 3 Planned Service Area in the 2040 Comprehensive Plan. There is not currently any existing water main along 20th Avenue (CSAH 54) in this area. The 2040 Comprehensive Plan does identify a future 8" watermain loop in this area. Applicant to provide dimensions from proposed well locations to proposed building pads and to proposed septic systems (primary and secondary). • Sanitary Sewer The existing properties are identified as part of the Stage 3 post 2040 Planned Service Area in the 2040 Comprehensive Plan and are located in the 4C sub-district. There is not currently any existing sanitary sewer along 20th Avenue (CSAH 54) in this area. The proposed homes will be served by private septic systems. • Transportation The site is located between Amelia Lake and 201h Avenue (CSAH 54). All proposed properties will have access off of 20th Avenue (CSAH 54), an Anoka County state aid highway and an A-Minor Arterial Reliever. A right-of-way width 120-ft is required for minor arterial streets. The existing right-of-way along 20th Avenue (CSAH 54)varies from 55 feet to 70 feet west of centerline. For a portion of the plat, 20th Avenue (CSAH 54) is within the larger Interstate 35E right-of-way. 20th Avenue (CSAH 54) has capacity to handle the additional traffic from the new lots. Anoka County Parks Regional Trail and the City of Lino Lakes Comprehensive plan identify a future reginal trail along the west side of 20th Avenue (CSAH 54). Comments: 1. An additional 5 feet of right-of-way adjacent to 20th Avenue (CSAH 54)where there is less than 60 feet will be required for future reconstruction purposes (60 feet total right-of-way width west of CSAH 54 centerline) • Wetlands and Mitigation Plan There are multiple existing wetlands within the Lake Amelia Woods project area. The plans note that the wetland information was provided by Midwest Natural Resources, Inc. and that field work was done between June and October of 2016. The applicant is not proposing any permanent impacts to wetlands with this project. Comments: 1. A survey for rare, unique, and significant resources should be performed. This survey should include a data request to the MN DNR for Natural Heritage Information System data; preparation of a master list of species found on site; and information on presence and/or extent of any MN DNR listed threatened, endangered, or special concern species. If any of the aforementioned species are identified on the site, their locations should be mapped as this may impact future work on the lots (lake access locations, for example). 2. Buffers for the wetlands and shore of Amelia Lake should be established in accordance with Vadnais Lake Area Watershed Management Organization (VLAWMO) recommendations. Staff comment: This may impact the placement of the house on lot 2. The driveway placement on lot 2 may require a variance to be obtained from the Planning and Zoning Board. 3. Tree protection fence appears to encroach on protected root zone areas on trees on all four lots. Trees that have more than 30 percent of their root zones impacted shall be counted as removed and must be mitigated for at applicable rates. 4. Green ash (Fraxinus pennsylvanica) and Siberian elm (Ulmus pumila) appear on the list of trees intended to be saved. These trees should be • Page 1 removed if they are in the vicinity of other planned removals. Mitigation trees for removals of these species will not be required. 5. Red maple and sugar maple should be removed from the suggested trees to replant with list on the Tree Mitigation Plan. 6. Stormwater basins are not part of Basic Use Areas. Trees that are planned to be removed in these areas must be mitigated for at applicable rates. 7. Prohibit motorized boats on Amelia Lake. Staff comment: Pursuing this would require interaction with the MN DNR as the agency responsible for Water Surface Use Restrictions. The process would involve adopting surface use restrictions for the lake into ordinance, which would require a hearing and approval from the DNR. It would also require working with homeowners who currently have docks and boats on Amelia Lake. 8. No other access points onto CSAH 54 will be permitted for this plat and the right of access along CSAH 54 should be dedicated to Anoka County with the exception for the proposed accesses stated above. Please note that no plantings or private signs will be permitted within the county right of way and care must be exercised when locating private signs, building, structures, plantings, berms, etc. outside of the county right of way, so as not to create any new sight obstructions for this section of CSAH 54. ACHD would like to work with local governments in promoting compatibility between land use and the county highway system. It should be recognized that residential land uses located adjacent to County highways often results in complaints about traffic noise. Existing and/or future traffic noise from CSAH 54 could exceed noise standards established by the Minnesota Pollution Control Agency (MPCA), the U.S. Department of Housing and Urban Development, and the U.S. Department of Transportation. Minnesota Rule 7030.0030 states that municipalities are responsible for taking all reasonable measures to prevent land use activities listed in the MPCA's Noise Area Classification (NAC) where establishment of the land use would result in violations of established noise standards. It is advised that the City and the Developer assess the noise situation for this development as it is proposed to be located directly adjacent to CSAH 54 and take the level of action deemed necessary to minimize the impact of any highway noise by incorporating the appropriate noise mitigation elements into the design and phasing of this plat as applicable. Staff has recently received inquiries from developers wanting to construct more mini self- storage facilities. Since the City is currently updating its zoning ordinance, staff recommends a one (1) year moratorium on mini self-storage facilities to allow time to review and possibly amend the ordinance. ANALYSIS Mini self-storage facilities are only allowed in the City's industrial zoning districts with a conditional use permit. The following conditions apply: 1. No single building shall be greater than one hundred fifty(150) feet in length. 2. If an"on-premises" caretaker dwelling unit is provided on site, construction of said dwelling unit shall conform to all design standard regulations for multiple family dwelling units of the Minnesota State Building Code 8-5. 3. No retailing, wholesaling, manufacturing, repair, or other such activity other than storage is to occur within the mini self-storage facility. There are currently no regulations regarding the number or types of buildings allowed on site or building design standards. In October 2019, the Board and staff discussed the interest in indoor, climate controlled self-storage facilities that are housed in one building as shown below. 1 J a As we work through the zoning ordinance updates, staff will present additional information for consideration regarding individual mini self-storage facilities, indoor climate controlled single buildings, design standards, location, etc. REQUESTED BOARD DIRECTION Staff recommends approval of the interim ordinance creating a moratorium for mini self- storage facilities. Ordinance No. 09-21 2 I"Reading: Publication: 2"d Reading: Effective: CITY OF LINO LAKES ORDINANCE NO. 09-21 INTERIM ORDINANCE CREATING A MORATORIUM FOR MINI SELF-STORAGE FACILITIES WITHIN THE CITY OF LINO LAKES The City Council of Lino Lakes ordains: Section 1. Purpose and Intent. The purpose and intent of this Ordinance is to exercise the City's authority under Minnesota Statutes 462.355, Subd. 4 by the creation of an interim ordinance which has the effect of creating a moratorium on all mini self- storage facilities in Lino Lakes. Section 2. Preliminary Findings: The City Council hereby makes the following preliminary findings to serve as the basis for the necessary study to be made during the moratorium, which serve as the reasons why it is in the public interest for the City to declare a moratorium by virtue of this Ordinance: 1) City staff has determined that current regulations do not adequately address and regulate mini and self-storage uses, particularly given the increase in the prevalence of this type of use in metro area suburban communities. 2) A moratorium will provide sufficient time for the City to review the City's Zoning Ordinance, and study alternative regulations that might be adopted to adequately address the uses within the moratorium enacted by this ordinance. 3) A moratorium will also ensure that ordinance changes will not need to be expedited and that all issues related to mini and self-storage uses can be completely examined. Section 3. Moratorium: Until the Planning &Zoning Board and City Council complete studies related to the aforementioned findings, the City shall not accept or continue to process any land use applications for mini self-storage facilities. The study period will last no longer than one (1) year from the effective date of this Ordinance, unless further extended by the City in accordance with Minnesota Statutes 462.355, Subd. 4. Section 4. Effective Date: This Ordinance is effective upon publication of the Ordinance in accordance with the City Charter. 1 Adopted by the Lino Lakes City Council this 27th day of September, 2021.
