1. Public Water System - Manganese Test Results (UCMR4) – Public Service17
Director DeGardner explained that he is presenting information on recent findings of the 18
level of manganese in City municipal wells. He introduced Greg Johnson of WSB & 19
Associates to present technical information on the subject. 20
Mr. Johnson explained that manganese naturally exists in ground water. It’s never been 21
considered a health issue until recent years. The U.S. Environmental Protection Agency 22
releases new Unregulated Contaminant Monitoring Rules (UCMR) every five years; 23
manganese appeared in the most recent release. Random wells were tested throughout 24
the state and as it turned out a couple were located in Lino Lakes. The testing showed 25
that some City wells have manganese levels above the Minnesota Department of Health’s 26
recommended health guidelines. As soon as the City received notification, the wells with 27
the highest concentration were not used. As far as addressing the situation long term, 28
several options are listed in the written staff report. 29

Director DeGardner noted a letter to all residents of the City that will be mailed the next 31
day, as well as a City website that has been constructed to provide information on the 32
subject. Mr. DeGardner suggested that overall he feels it is a good thing that the City 33
was selected for testing because now we can be proactive in addressing the situation. He 34
noted that an informational meeting will be held in the City in January at which a 35
Minnesota Department of Health Representative will be present to provide information. 36
Staff’s intent also is to provide to the City Council at an upcoming session a feasibility 37
update a municipal water treatment facility. 38
Mayor Rafferty asked staff to speak about the six wells in the City system (as well as a 39
new well that is planned). Why does the City need all the wells? 40

Mr. Johnson explained that every community has a peaking factor equal to the most water 41
it will use during a year divided by average day consumptions. In Minnesota there is a 42
wide range in those factors, meaning there can a lot more water used in the summer than 43
winter. 44
Mayor Rafferty asked about long range plans for providing water to the current and future 45
population. Community Development Director Grochala said full build out is estimated 46
to require 12 to 13 wells. 47
Council Member Lyden asked about other cities that are facing this situation. Also how 48
can the City be assured that a future well wouldn’t have the same issue? Mr. Johnson 49
noted that typically a test well is drilled in order to pretest water before a final well is 50
done. Other cities have acted in different manner; he’s seen some be proactive 51
(Brooklyn Center recently built a water plant). Council Member Lyden asked if there is 52
any way to improve the “bad” wells and Mr. Johnson spoke to the source of water and 53
explained that in the northern metro there are certain limits to what water is accessible in 54
terms of aquafers. 55
Council Member Stoesz suggested that science has a way of reinterpreting guidelines 56
such as these. Are the Health Department’s recommendations subjective? Mr. Johnson 57
suggested that the recommendations may be different state by state but they are generally 58
based on scientific research done by the EPA. Director DeGardner added that 59
manganese is an unregulated contaminant now and cities aren’t required to test for it. 60
Mr. DeGardner added that there are a lot of factors to consider leading to discussion 61
about the long term approach; a large part of staff’s current approach is to make residents 62
aware. 63
Mayor Rafferty stated that it is appropriate that the City is looking closely at the situation 64
and discussing how to address the situation. 65
Council Member Ruhland asked if there is a technique to utilize all wells but turn down 66
the amount for a balancing effect. Mr. Johnson said the City does have the ability to 67
adjust the flow. 68
Council Member Ruhland asked about the new well planned for Birch Street; how did 69
that test? Mr. Johnson said the test for that well came out with lower numbers but he did 70
suggest that amounts can change in the same vicinity. 71
The council and staff discussed the City’s peak period use and how water use can be 72
restricted. Justin Williams, Utilities Supervisor, explained how the City is currently 73
blending water by monitoring the water tower levels. 74
Director DeGardner remarked that the City is doing what it can and is informing the 75
residents. He added that the City’s water hasn’t changed but again this is a newly 76
identified element that is measured. 77

Council Member Stoesz asked about water reuse, such as with developments that plan to 78
take irrigation water from surface water sources. Is that monitored? Mr. Johnson 79
confirmed that the State Department of Health monitors that water as well. Council 80
Member Stoesz asked if animal consumption (on farms) is monitored also and Mr. 81
Johnson wasn’t familiar with that. 82

Mayor Rafferty said that the Council will continue this discussion after the public 84
meeting at the end of the month. 85
2. Irrigation Controller Grant (Regular Agenda Item) – Community 86
Development Director Grochala and City Engineer Hankee noted their written report. 87
Mr. Grochala remarked that the matter was postponed at the last Council meeting. Last 88
year the City received a grant from the Rice Creek Watershed District to replace irrigation 89
monitors/sensors in City parks. The sensors would work to reduce water consumption by 90
50% annually. This project would assist in reducing consumption of water coming from 91
the ground, serve as a good example of the City being proactive, and provide a modern 92
system of monitoring certain elements of use. The grant provides up to 51% of the cost 93
of a system up to the cost of $41,000. Staff has been working toward implementation 94
since last year. Funding for the City share of the cost (one half of $76,500) would come 95
from the City’s water utility. 96
Council Member Stoesz said he has been following this project and he expected the cost 97
would come in much lower. He has done more review and sees the costs are pretty clear; 98
but he still has sticker shock. He asked if funding this cost would impact funds available 99
for a treatment plant if that were a project in the future. Staff explained that this would 100
be funded from an operating account while the other (a treatment facility) would be trunk 101
funds. 102
Council Member Ruhland asked about the cost of the water saved? Mr. Grochala said the 103
savings would be about $16,000 annually assuming the fifty percent reduction. The 104
payoff considering the cost of the system would be about 4.6 years. 105
Council Member Stoesz said he still questions the need considering the cost. He noted 106
that the City does have staff that could manually turn off irrigation when appropriate. 107
Community Development Director Grochala added that the concept is something that 108
could be a model for the future and the community. 109
The council and staff discussed the status of surface water reuse as part of addressing 110
future water needs. 111

Allen Moser, 540 Marshan Lane, noted concerns about YMCA traffic using his street and not safely. 21
He has spoken to the Police and Community Development Department but the problem persists. He 22
is requesting a sign at both ends of the street. He noted two other residents on that street present 23
that will corroborate. He also noted that semi-trucks that use Lake Drive are using their jake brakes 24
and it creates a lot of noise. Some of those trucks were Cemstone trucks and when he approached 25
that company, they responded well. 26
Mayor Rafferty announced that staff will look into the concerns brought forward and the council 27
will discuss them at their next work session. 28
Mr. Robert Nelson, East Shadow Lake Drive, came forward to discuss the proposed roundabout on 29
Birch Street. He attended the last community forum and has attempted to speak with Anoka 30
County staff but to no avail. Mayor Rafferty noted that there is another community meeting on the 31
subject of Birch Street Improvement Project coming up on January 28; he acknowledges that the 32
engineering is going to be a challenge. Mr. Nelson read information suggesting that roundabouts 33
aren’t a good fit for the street. He is asking that the City look into this matter and get some response 34
from the engineers for the residents’ concerns. 35
Larry Adams, 600 Marshan Lane, said he agrees that there is a problem on his street. There are 36
everyday problems with cars turning around and speeding. 37

3A) Consider Approval of Annual Appointments for 2020 – Administrator Karlson noted that 61

work session. Those appointments are before the Council for consideration of approval. 64
The council heard from Carter Johnson of the Quad Community Press. They are happy to have 65
great staff and he noted that the paper is provided to residents for free at request. There are also 66
mailed subscriptions available. He noted enhancements to the newspaper and its digital site during 67
the past year. Council Member Stoesz asked how people can show appreciation to the carriers and 68
Mr. Johnson suggested tips to the carriers are appropriate and can be passed through the newspaper 69

3B) Consider Updated Employee Drug and Alcohol Policies – Human Resources Manager 73
Karissa Bartholomew read her written report. The City does have two separate policies – one for 74
commercial driver’s license holders and one for other employees. The changes update the policies. 75
Council Member Lyden said he reviewed the policies looking for “the weakest link”. He thinks the 76
MnDOT policy puts a lot of responsibility onto the supervisor. He wonders if staff is comfortable 77
putting the supervisors in that position. Ms. Bartholomew said she is comfortable because they are 78
the individuals who see employees day in and day out so best to identify when something may be 79
off. Fellow employees are told to report suspicions also. 80

Historically the City received a grant from the Rice Creek Watershed District that would support the 99
installation of irrigation controllers on City properties. The controllers would work to save substantial 100
water. At this time staff is requesting authorization to accept a quote for the installation and to award a 101
contract for such. 102
Council Member Ruhland remarked that this appears to be a good plan with pay back for the City costs 103
over just 2.3 years. He asked if the City is able to direct City wells to do just irrigation. Ms. Hankee 104
said that is not possible because water from all wells is blended. 105

INTRODUCTION
Staff is requesting council authorization to prepare plans and specifications for the Well No. 1
Rehabilitation Project.
BACKGROUND
On March 25, 2019, the City Council approved the preparation of the plans and specifications for
the Well House No. 1 Rehabilitation project. The project includes remodeling the existing Well
House No. 1, adding 2 chemical rooms, pitched roof, plumbing, electrical, mechanical, fire
protection, seepage pit and associated improvements.
Bids were received for the above-referenced project on Tuesday, June 18, 2019. A total of one
bid was received from Municipal Builders, Inc. in the amount of $622,494.00. On July 22, 2019,
the City Council passed a resolution in support of rejecting the bid with the intent to rebid the
project in December 2019 or January 2020. Re-bidding the project also allowed staff to evaluate
the project budget and scope.
Considering the possibility of a future treatment plant, staff evaluated the cost of adding
temporary and permanent chemical treatment rooms. City staff received a cost estimate of
$15,000 from a vendor to install an exterior chlorine closet with heat and ventilation. This cost
could possibly exceed $20,000 when additional electrical work is factored into the price. City
staff does not recommend installing an exterior room, preferring to keep the treatment rooms as
originally planned.
The budget for the project is $625,000. Funding for the project is provided from Water Operating
fund.
RECOMMENDATION
Staff is recommending approval of Resolution 20-06, Authorize the Preparation of the Plans and
Specifications, Well House No. 1 Rehabilitation Project.

Staff is requesting City Council consideration of Resolution No. 20-03 to approve a variance
for curb cut/driveway width for 42 Robinson Drive.

BACKGROUND
The property owners of 42 Robinson Drive, Brock and Kahla Jensen, submitted a Land Use
Application for a curb cut/driveway width variance. They are requesting a curb cut width of
26.5 feet be allowed. City zoning ordinance allows for a maximum 26.0 foot curb cut/driveway
width.
ANALYSIS
Capstone Homes, Inc. obtained a building permit in October 2017 to construct a new home at
42 Robinson Drive in the Century Farms North subdivision. The Certificate of Survey
(Attachment #2) submitted with the building permit showed a compliant driveway curb cut
width of 19.4 feet. The Grading As-Built Survey (Attachment #3) submitted by the builder in
July 2018 and field verified by the City confirmed the curb cut width was 26.5 feet. This is 6
inches wider than allowed.
Per City Code Section 1007.044(3)(h):
7. Curb Cut/Driveway Width. No curb cut shall exceed twenty-six (26) feet in width
within a residential zoning district, or thirty-six (36) feet in width if the property is in a
commercial, industrial, or public/semi-public zoning district, as measured at the street right-of-
way line unless approved by the City Engineer. The driveway associated with such curb cut
may increase in width at an angle not greater than forty-five (45) degrees.

Attachment #4 is a Driveway Exhibit depicting a 26 foot wide curb cut and 45 degree angle.
The property is zoned PUD, Planned Unit Development and is located in an urban residential
subdivision. The City Engineer does not approve widening of the curb cut. The property
owners would be required to cut out a 6 inch wide section of the driveway. They are requesting
a variance instead of having to cut out a section of the driveway.
Previous Council & Board Discussions
The City Council and Planning & Zoning Board extensively reviewed and discussed the
driveway width ordinance in March 2018, January 2019 and March 2019. Neither the Council
nor the Board recommended changes to the ordinance. Attachment #6 is a copy of the March
5, 2018 Work Session staff report.
Findings of Fact
Resolution No. 20-03 (Attachment #5) details the findings of fact.
RECOMMENDATION
Staff recommended denial of the variance.
The Planning & Zoning Board reviewed the variance application on January 8, 2020 and
recommended approval with a 4-1 vote. In an effort to minimize future driveway width
variance requests, the Board recommends contractor’s be notified and educated on driveway
width requirements then take a firmer stance on future variance applications. Staff proposes to

RESOLUTION APPROVING A VARIANCE FOR
CURB CUT/DRIVEWAY WIDTH FOR 42 ROBINSON DRIVE
WHEREAS, the City received a land use application for a variance for curb
cut/driveway width for 42 Robinson Drive; and
WHEREAS, the legal description of the property is Lot 6, Block 4, Century Farm North
6th Addition, Lino Lakes, Anoka County, Minnesota; and
WHEREAS, the property is zoned PUD, Planned Unit Development for an urban
residential subdivision and allows for driveways in residential zoning districts; and
WHEREAS, Lino Lakes City Code Section 1007.044(3)(h)7 states no curb cut shall
exceed 26 feet in width within a residential zoning district as measured at the street right-
of-way; and
WHEREAS, the sub-contractor constructed the driveway and curb cut to 26.5 feet wide
at the street right-of-way; and
WHEREAS, the Planning & Zoning Board reviewed the variance application on January
8, 2020 and recommended approval of a 26.5 foot curb cut width with a 4-1 vote.
NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino
Lakes hereby makes the following:
FINDINGS OF FACT
No variance shall be granted unless it meets all the criteria in paragraphs 1. through 7.
below. The City shall make findings regarding compliance with these criteria.
1. The variance shall be in harmony with the general purposes and intent of the
ordinance.
The general purpose and intent of the off-street parking ordinance is to alleviate or
prevent congestion of the public right-of-way and to promote the safety and general
welfare of the public, by establishing minimum requirements for off-street parking of
motor vehicles upon various parcels of land or structures.
The variance to allow for a 26.5 foot curb cut/ driveway width is harmonious with the
general purposes and intent of the ordinance. The additional 6 inches will not congest
public right-of-way or impact public safety.
2. The variance shall be consistent with the comprehensive plan.

Per the 2030 Comprehensive Plan, the property is guided for Low Density Residential
land use. The variance request is consistent with the comprehensive plan. The
applicant’s property is intended for single family dwellings with houses, garages and
driveways.
3. There shall be practical difficulties in complying with the ordinance. “Practical
difficulties,” as used in connection with the granting of a variance, means that the
property owner proposes to use the property in a reasonable manner not permitted by the
ordinance. Economic considerations alone do not constitute practical difficulties.
Practical difficulties include, but are not limited to, inadequate access to direct sunlight
for solar energy systems.
The property owner proposes to use the property in a reasonable manner. The property is
intended for single family dwellings with houses, garages and driveways. The
construction of a driveway is a reasonable use.
4. The plight of the landowner shall be due to circumstances unique to the property not
created by the landowner.
The plight of the landowner was not created by the landowner. The home builder’s sub-
contractor improperly installed a 26.5 foot wide driveway.
5. The variance shall not alter the essential character of the locality.
The variance will not alter the essential character of the locality which is a single family
residential neighborhood with houses, garages and driveways.
6. A variance shall not be granted for any use that is not allowed under the ordinance for
property in the zoning district where the subject site is located.
The variance is not being granted for any use that is not allowed under the ordinance for
property in the zoning district. The property is zoned PUD, Planned Unit Development
for a residential subdivision and driveways are allowed with residential uses.
7. In accordance with MN Stat. 462.357, Subp. 6, variances shall be granted for earth
sheltered construction as defined in MN Stat. 216C.06, Subd. 14, when in harmony with
the zoning ordinance.

BE IT FURTHER RESOLVED by The City Council of the City of Lino Lakes hereby
approves a variance to allow for a 26.5 foot wide curb cut/driveway width for 42
Robinson Drive.

Background
Councilmember Stoesz requested discussion of possibly increasing the allowable width
for residential driveways.
The City Zoning Ordinance allows a maximum residential curb cut width of 26 feet. The
driveway may increase in width at a 45 degree angle at the property line. Driveway
width restrictions are fairly common and serve a number of purposes. These include:
• Maintain front yard green space and enhance the streetscape.
• Preserve areas for on-street parking.
• Minimize impact and maintenance costs to public right-of-way and utility
corridors.
• Preserve street snow storage.
• Minimize conflicts with vehicle, pedestrian and bicycles using street.
• Minimize impervious surfaces.
A preliminary study of municipal zoning ordinances shows residential driveway widths
ranging from 24 – 30 feet. 10 of the 12 communities had maximum driveway widths of
24 feet or less. Roseville has a 26’ width and Blaine allows up to 30’.
Over 500 driveways have been permitted during the last 5 years. There has not been any
significant issues raised by the existing ordinance requirements.
Amendment of the Zoning Ordinance requires a public hearing be held by the Planning &
Zoning Board and approval of an ordinance by the City Council.
Requested Council Direction
Determination by the City Council whether to initiate an Ordinance amendment related to
driveway widths.

others, it is approved by the Public Works Director, the property owner agrees to be responsible for maintaining the area
and the property owner enters into a maintenance agreement with the city.

(2) feet from the curb line. The remaining two (2) feet shall be
surfaced with hot mixed bituminous material.
Roseville Driveways must be constructed of a hard surfaced material such as concrete, asphalt or brick pavers. Gravel is not
allowed as a finished surface. On roadways without curb and gutter if a concrete driveway is being installed the concrete
shall be kept two feet from the roadway edge and asphalt placed in this last section. 6

INTRODUCTION
Staff is requesting City Council consideration of a Zoning Ordinance Text Amendment to
Section 1007.053 to allow for small wireless facilities.
BACKGROUND
Section 1007.053 of the City Zoning Ordinance regulates the construction of antennas within
the City. On November 12, 2019, the City Council adopted Ordinance No. 01-19 creating
Chapter 305 in the City Code enacting Small Wireless Facilities Standards within the public
right-of-way. An amendment to Section 1007.053 is proposed to provide consistency between
the ordinances.

The next generation of wireless services (called 5G) will require wireless providers to install a
large amount of lower hanging antennas connected to fiber optic cable that will allow wireless
providers to provide significantly higher internet speeds. The facilities needed to provide 5G
service are called small wireless facilities. The use of the word “small” is used to describe the
area covered by each antenna, not the size of the facilities. Small wireless facilities include
antennas, equipment cabinets, vertical conduit, power supplies, etc. Typically, small wireless
facilities are attached to utilities poles, such as a light pole in the public right-of-way.
Over the past two years, the Minnesota legislature enacted a new small wireless facility law and
the FCC has released a small wireless facility order. These actions have placed new restrictions
on how cities may handle applications to install small cell facilities. These restrictions include
review and approval deadlines and limitations on fees.
Chapter 305 establishes requirements to install Small Wireless Facilities. Section 1007.053
currently does not address Small Wireless Facilities. An amendment to the zoning ordinance is
proposed to reference Chapter 305.
Draft Ordinance Language
The City of Lino Lakes participated in a group of Minnesota cities to engage the municipal
telecommunications law firm of Bradley Law, LLC to draft a model small wireless facility

ordinance to help the City comply with the new laws and to prepare for the anticipated
applications to install small wireless facilities in the City. The following recommendation
amends the City Zoning Ordinance (new text is underlined):
§ 1007.053 ANTENNAS.
(1) Purpose and Intent. The purpose of this section is to establish predictable and
balanced regulations for the siting and screening of wireless communications equipment in
order to accommodate the growth of wireless communication systems within the City of Lino
Lakes while protecting the public against any adverse impacts on the City’s aesthetic resources
and the public welfare. The provisions of the section are intended to maximize the use of
existing towers, structures, and buildings to accommodate new wireless telecommunication
antennas in order to minimize the number of towers needed to serve the community. The
Collocation of a Small Wireless Facility and the installation or replacement of a Wireless
Support Structure in connection with the Collocation of a Small Wireless Facility on the
Wireless Support Structure is subject to Chapter 305 of the Lino Lakes City Code.
RECOMMENDATION
The Planning & Zoning Board held a public hearing on January 8, 2020. There were no public
comments. The Board voted 5-0 to recommend adoption of the proposed amendment.
Staff is recommending approval of the 1st Reading of Ordinance No. 01-20.

ANTENNAS AND SMALL WIRELESS FACILITIES
The City Council of Lino Lakes ordains:
Section 1. Findings. On November 12, 2019, the City Council adopted Ordinance No. 01-19
creating Chapter 305 in the City Code enacting Small Wireless Facilities Standards within the
public right-of-way. An amendment to Section 1007.053 is necessary to provide consistency
between the ordinances.
Section 2. Amendment. Lino Lakes City Code Section 1007.053 is hereby amended as set forth
below (added text is underlined):
§ 1007.053 ANTENNAS.
(1) Purpose and Intent. The purpose of this section is to establish predictable and balanced
regulations for the siting and screening of wireless communications equipment in order to

Staff is requesting Council approval to authorize the ad for bid for the 2020 Street Rehabilitation
Project and the 2020 Apollo Drive Trail Project and to request quotes for the 2020 Chip Seal
Project.
BACKGROUND
On December 9, 2019, the City Council approved the preparation of the plans and specifications for
the 2020 Street Rehabilitation project.
In accordance with the City’s Pavement Management Plan, streets are identified for annual
maintenance. The pavement management plan analyzes the conditions for the bituminous roadways
within the City, and recommends maintenance and repair strategies for the streets depending on
their conditions. Streets were selected for the 2020 Street Rehabilitation Project based on pavement
management criteria, coring reports, input from Public Works, traffic volumes, and feasibility of
locations. The 2020 Apollo Drive Trail Project will be bid with the 2020 Street Rehabilitation
Project.
The proposed 2020 Street Rehabilitation and Apollo Drive Trail Bid Project includes:
Full Depth Mill & Overlay/ Reclamation – Deerwood Lane from Birch Street south to Fox
Road, and Fox Road from Deerwood Lane west to West Shadow Lake Drive.
Bid Alternate* for Beaver Circle, Deerwood Circle, and Fox Circle.
Thin Overlay – Carl Street from 4th Avenue to the west 1,400 feet, Rehbein Street, 77th
Street, and Gordon Avenue.
Trail Installation & Signal Crossing Improvements – north side of Apollo Drive between
Lilac Street and Lake Drive.
*A bid alternate is being included in the event that we receive favorable bids and have the ability to
complete additional work.
The proposed 2020 Chip Seal Quote Project includes:
Chip Seal, Crack Fill, ADA Pedestrian Ramps & Striping – City Hall Parking Lot and Town
Center Parkway from Lake Drive to YMCA.
Curb Repair – Town Center Parkway south curb line from Lake Drive to YMCA and east
entrance to City Hall parking lot.
The 2020 Street Rehabilitation Project includes water system repairs - gate valve bolt replacement
and investigative service replacement, similar to the 2019 Mill and Overlay Project.

WHEREAS, the City Engineer has prepared plans and specifications for the 2020 Street
Rehabilitation Project, the 2020 Apollo Drive Trail Project, and the 2020 Chip Seal Project.
Project plans and specifications have been presented to the City Council for approval;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Lino Lakes,
Minnesota:
Orders the 2020 Street Rehabilitation Project, the 2020 Apollo Drive Trail Project, and the 2020
Chip Seal Project and approves the plans and specifications, a copy of which is on file at City
Hall. The City Engineer is directed to advertise for bids, and provide bidding administration.
The City clerk shall prepare and cause to be inserted in the official paper and in Finance and
Commerce an advertisement for bids for the making of such improvement under such approved
plans and specifications. The advertisement shall be published for two weeks, shall specify the
work to be done, shall state that bids will be received by the Clerk, at which time they will be
publicly opened at the City Hall by the City Clerk and Engineer, will then be tabulated, and will be
considered by the Council at 6:30 p.m. on February 24th, 2020, in the Council chambers of the
City Hall. Any bidder whose responsibility is questioned during consideration of the bid will be
given an opportunity to address the Council on the issue of responsibility. No bids will be
considered unless sealed and filed with the Clerk and accompanied by a cash deposit, cashier’s
check, bid bond or certified check payable to the Clerk for five (5) percent of the amount of such
bid.

INTRODUCTION
Staff is requesting City Council consideration to approve the sale of .7752 acres of wetland
credit from bank 1122 (Otter Lake) and .3062 acres of wetland credit from bank 1601 (Wollan
Park) for a total purchase price of $93,814.74.
BACKGROUND
The Wetland Conservation Act (WCA) requires replacement of any construction related
wetland impacts on a per square foot basis. Minnesota's wetland banking program includes
both private and state-sponsored wetland banks which have "credits" that are used to offset
(mitigate) authorized wetland impacts. The banks are subject to approval of both the Minnesota
Board of Water and Soil Resources (BWSR) and the Army Corps of Engineers (ACOE). The
City currently has two banks in place.
Bank No. 1122 (Otter Lake) is located east of I-35E and south of CSAH 14. 1.482 acres of
credit are available. This bank is not ACOE approved. Credits can only be used for wetland
impacts not under ACOE jurisdiction.
Bank No. 1601(Wollan Park) is located west of Lake Drive and north of Main Street. 5.12
acres of ACOE approved credit is currently available in this bank. The bank also includes an
additional 1.02 acres of non ACOE credit.
Staff has received a request to purchase wetland credits from Fenway Land Co. The
acquisition is intended to mitigate potential wetland impacts related to a pending residential
development in a neighboring city. The purchase agreement provides for the sale of credits
subject to approval of the wetland mitigation plan by the Rice Creek Watershed District and the
Army Corps of Engineers.
The buyer is requesting purchase of .7752 acre credits from this bank at the price of $1.85
square foot ($62,470.26).
The buyer is requesting purchase of .3062 acre credits at $2.35 a square foot ($31,344.47).
ACOE certified credits have a higher value in the market which addresses the $.50 square foot
price difference.
RECOMMENDATION
This would be the first credit sale from the Otter Lake bank and second from Wollan Park.
Sale of the credits will be used to reimburse the Surface Water Management fund for bank
establishment costs. With this sale the city will be close to recouping its initial investment in
the wetland banks. Staff anticipates adjusting the price for future sales upward.
Staff is recommending approval of Resolution No. 20-09.

RESOLUTION NO. 20-09
AUTHORIZING SALE OF WETLAND CREDITS
FENWAY LAND CO.
WHEREAS, The City has established a wetland bank to preserve and restore open space and to
mitigate the local impacts to wetlands associated with public and private development
improvements; and
WHEREAS, The City has received a request for the purchase of .7752 credits from the Otter
Lake Wetland Bank (BWSR Acct. 1122) in the amount of $62,470.26, and
WHEREAS, The City has received a request for the purchase of .3062 credits from the Wollan
Park Wetland Bank (BWSR Acct. 1601) in the amount of $31,344.47, and
WHEREAS, The City Council finds it is in the best interests of the City to make such credit
sale;
NOW, THEREFORE BE IT RESOLVED by The City Council of The City of Lino Lakes that
staff is authorized to enter into a purchase agreement with Fenway Land Co., in the amount of
$93,914.74 for purchase of 1.0814 acres of wetland credit. The price may be adjusted to reflect
the final approved credit amount determined by the RCWD and ACOE.
BE IT FURTHER RESOLVED that Fenway Land Co., shall be responsible for payment of the
withdrawal and stewardship fees associated with said transaction.
