HomeMy WebLinkAbout03-09-2020 Council Packet EXPANDED AGENDA CITY COUNCIL AGENDA Monday, March 9, 2020 *********** 6:30 p.m. (Scheduled to be broadcast on Channel 16) City Council: Mayor Rafferty, Councilmembers Cavegn, Lyden, Ruhland and Stoesz City Administrator: Jeff Karlson CITY COUNCIL MEETING, 6:30 P.M.  Oath of Office – Councilmember Cavegn  Roll Call - Councilmembers Stoesz, Lyden, Ruhland, Cavegn and Mayor Rafferty were present;  Pledge of Allegiance  Open Mike / Public Comment - Jamie Jensen, St. Clair Estates developer, asked for assistance in finalizing his accounts with the City; Sierra Rasmussen, 640 Barbara Lane, read a statement requesting that the Council amend the City Code to allow for bees; Terry O’Connell, 1000 Main Street, received questions about parks from residents as she knocked doors for her campaign for City Council. She brought those questions to the Park Board and received some response and she’d like the council’s advice on sharing that information  Setting the Agenda: Addition or Deletion of Agenda Items The agenda was approved as presented SPECIAL PRESENTATION 1. ADMINISTRATION DEPARTMENT REPORT A) Consider Annual Appointments for 2020, Jeff Karlson Action Taken: Motion by Lyden, seconded by Stoesz, to approve the annual appointments as presented, was adopted 4. PUBLIC SERVICES DEPARTMENT REPORT A) Consider Resolution No. 20-15, Accepting bids and Awarding a Construction Contract, Well House No. 1 Rehabilitation Project, Diane Hankee Action Taken: Motion by Stoesz, seconded by Ruhland, to approve Resolution No. 20-15 as presented, was adopted; Councilmember Lyden voted nay 6. Review Regular Agenda – 19 Item 5A, Contract with Northland Recreation, Inc. for Woods Edge Park 20 Playground Equipment – Public Services Director DeGardner reviewed his written 21 request to proceed with a contract to purchase the necessary equipment for this new park 22 facility. He noted that he is comfortable with the contractor as they have provided 23 services to the City in the past. 24 Council Member Lyden asked about how the playground will be surfaced and Mr. 25 DeGardner said it will be surfaced with engineered wood fiber and it will be ADA 26 accessible. 27 Council Member Lyden added that he’d find it advantageous to have a visual of what is 28 planned; he wants to see equipment that engages the children. He also asked if the 29 YMCA is partnering or planning to utilize this park and Mr. DeGardner said that the 30 YMCA has not decided to officially be a part of the park project but he expects there may 31 be some unofficial use. Council Member Lyden asked if there will be benches for 32 parents and how much sunshine the site will provide Mr. DeGardner said some trees are 33 being trimmed but the site will be quite shady; he will review the master plan at the 34 council meeting. 35 Council Member Stoesz asked if signage for this park will clearly indicate that this is a 36 Lino Lakes’ park and not a YMCA park. Mr. DeGardner responded that he will make 37 that a consideration as signage is installed. 38 CITY COUNCIL WORK SESSION DRAFT 2 Item 5B, Sprint Spectrum L.P. Lease Agreement – Public Services Director 39 DeGardner reviewed his written report requesting authorization to enter a lease agreement 40 for the second city tower. The City recently approved an identical agreement (except for 41 location) for the other water tower. 42 NOT ON PRINTED AGENDA 43 Council Member Ruhland asked why the work session is not held in the council 44 chambers. City Clerk Bartell noted that historically the council has chosen to hold its 45 work sessions in the less formal environment of the community room; all meetings are 46 recorded and so are accessible to interested parties. 47 Council Member Stoesz suggested a discussion about not televising the advisory board 48 meetings since there is a cost involved and perhaps a less formal atmosphere would be 49 good for their discussions. BACKGROUND On January 27, 2020, the City Council approved the preparation of the plans and specifications for the Well House No. 1 Rehabilitation project. Well House No. 1 was the City’s first well house constructed in 1970. The project includes remodeling the existing structure, adding 2 chemical rooms, a pitched roof, plumbing, electrical, mechanical, fire protection, seepage pit and associated improvements. The completed project will upgrade the facility to meet current environmental and safety standards. The rehabilitated well house will provide a level of service comparable to a new Well House reducing long term maintenance cost. The project provides equipment upgrades and necessary repairs to the existing Well House No. 1 including: 1. The addition of separate internal fluoride and chlorine rooms (within existing well house) and seepage pit per Minnesota Department of Health requirements. 2. Rehabilitation of existing Well House No. 1 including a new pitched shingled roof, soffit lighting and exterior siding. 3. New exterior door and replacement of existing doors. 4. New bituminous driveway and subgrade, and expanded pavement behind the well house for chemical delivery vehicles and well maintenance rig. 5. Replacement of existing chemical feed equipment and associated appurtenances. 6. Replacement of existing HVAC systems. 7. Building additions will be provided with mechanical systems as required to meet the space heating load and ventilation air change rate. 8. Replacement of main switchgear and motor control center. 9. Replace existing control panel and other electrical equipment inside the well house (i.e. lights, receptacles, switches, cable and conduit, etc.). 10. Replacement of well instrumentation, i.e. pressure transducers, prelube solenoid valve, magnetic flow meter, door entry switches, etc. The project was bid on March 4, 2020 and one bid was received from Municipal Builders, Inc. in the base bid amount of $669,900.00. A bid alternate was included to do some additional exterior concrete or asphalt paving. Staff is recommending award of the base bid only. The project is proposed to be funded through the Water Operating Fund. The completion date for this project is December 31, 2020. RECOMMENDATION Staff recommends adoption of Resolution No. 20-15, Accepting the Bid and Awarding a Construction Contract in the amount of $669,900.00 to Municipal Builders, Inc. for the Well House No. 1 Rehabilitation Project. The parcel remained vacant since it was platted. Based on historic county aerials, the accessory structure was constructed sometime between 2005 and 2008. Sanitary sewer and water services were installed to the right-of-way as part of the West Shadow Lake Drive Street and Utility Improvement Project in 2019. Existing Site Conditions The existing parcel contains a 150 square foot accessory structure and gravel and paved patio areas, three trees and open grass areas. The parcel is serviced by municipal water and sanitary sewer. West Shadow Lake Drive abuts on the north/northwest. The parcel has floodplain and shoreland. The Ordinary High Water Level elevation is 883.77 and extends onto the site. The FEMA Flood Elevation is 887 and extends onto the site. Zoning and Land Use The parcel was rezoned from R, Rural to R-1X, Single Family Executive in 2018 with Ordinance No. 19-18 in conjunction with the West Shadow Lake Drive Street and Utility Improvement Project. This lake is classified as a Recreational Development Lake and has an 883.77 OHWL elevation. The required setback from the OHWL is 75 feet for sewered lots and the maximum allowed impervious surface area is 30% of the site area. The proposed OHWL setback is 75 feet and the proposed impervious surface area is 30% of the site area. Both shoreland requirements are met. Floodplain Management The 2015 DFIRM indicates Zone AE floodplain on the parcel. The FEMA base flood elevation (BFE) is 887. The proposed single family home is positioned on the parcel so that it is in the Zone AE floodplain. The lowest elevation of the proposed single family home is 885, which is described as the assumed grade in the crawl space. Per procedures listed under Section 1103.07(2), it has been determined the parcel is in the Flood Fringe district. The FEMA Flood Map Service Center does not indicate that a regulatory floodway is on the site. Due to the absence of a floodway and the presence of the BFE, the parcel is in the Flood Fringe district. Per Section 1103.06(3)(a) Conditional Uses, any structure that is not elevated on fill or flood proofed in accordance with division (2)(a) Standards for flood fringe permitted uses, of this section, requires a conditional use permit. The proposed single family home does not meet the requirements of (2)(a) Standards for flood fringe permitted uses, which requires that all structures, including accessory structures, must be elevated on fill so that the lowest floor, as defined, is at or above the regulatory flood protection elevation. The finished fill elevation for structures must be no lower than one foot below the regulatory flood protection elevation and the fill must extend at the same elevation at least 15 feet beyond the outside limits of the structure. Per Section 1103.06(4)(f), the Standards for Flood Fringe conditional uses: (f) Alternative elevation methods other than the use of fill may be utilized to elevate a structure's lowest floor above the regulatory flood protection elevation. These alternative methods may include the use of stilts, pilings, parallel walls, etc., or above-grade, enclosed areas such as crawl spaces or tuck under garages. The base or floor of an enclosed area shall be considered above-grade and not a structure's basement or lowest floor if: 1. The enclosed area is above-grade on at least one side of the structure; The enclosed area is above-grade on at least one side of the structure as the low floor elevation of the home is above-grade. 2. It is designed to internally flood and is constructed with flood resistant materials; and The crawl space is designed to internally flood through the use of flood vents and will use materials as outlined in the building code. 4 3. It is used solely for parking of vehicles, building access or storage. The above- noted alternative elevation methods are subject to the following additional standards: No other use has been designated on the floor plans or would be approved other than “crawl space”. a. Design and certification. The structure's design and as-built condition must be certified by a registered professional engineer or architect as being in compliance with the general design standards of the State Building Code and, specifically, that all electrical, heating, ventilation, plumbing and air conditioning equipment and other service facilities must be at or above the regulatory flood protection elevation or be designed to prevent flood water from entering or accumulating within these components during times of flooding. The design of the structure will be reviewed through the building permit process and will be required to meet building code standards and flood proofing requirements. The furnace and hot water heater are shown on the first floor of the home, above the flood protection elevation. The air conditioning equipment was not shown. b. Specific standards for above-grade, enclosed areas. Above-grade, fully enclosed areas such as crawl spaces or tuck under garages must be designed to internally flood and the design plans must stipulate: i. The minimum area of openings in the walls where internal flooding is to be used as a flood proofing technique. There shall be a minimum of two openings on at least two sides of the structure and the bottom of all openings shall be no higher than one foot above grade. The automatic openings shall have a minimum net area of not less than one square inch for every square foot of enclosed area subject to flooding unless a registered professional engineer or architect certifies that a smaller net area would suffice. The automatic openings may be equipped with screens, louvers, valves, or other coverings or devices provided that they permit the automatic entry and exit of flood waters without any form of human intervention; and The house plans show at least two openings on two sides of the structure. The flood vent details and report state that the bottom of the vents shall be no more than one foot above final grade. The ICC-ES Evaluation Report for the flood vents states that the Model 1540-520 can accommodate 200 square foot of the enclosed space. Based on the provided plans, the enclosed crawl space is approximately 1,636 square foot, which will require nine (9) flood vents. The ICC-ES Evaluation Report states that the flood vents are mechanically operated and are activated by rising water. ii. That the enclosed area will be designed of flood resistant materials in accordance with the FP-3 or FP-4 classifications in the State Building Code and shall be used solely for building access, parking of vehicles or storage. 5 No other use has been designated on the floor plans other than “crawl space”. Design will be approved through the building permit process. Comprehensive Plan Resource Management System The Resource Management System Plan goal of preserving surface water quality is supported by regulating the amount of allowed on site impervious surfaces. The proposed 30% impervious meets the allowed 30% Shoreland District impervious surface requirements. Land Use Plan The 2030 and draft 2040 Comprehensive Plan guide the parcel for low density residential development. The proposed single family home construction is consistent with low density residential land use. Housing Plan The goals and policies of the Housing Plan are not negatively impacted by the floodplain alteration required for the construction of a single family home. Transportation Plan Goals of the Transportation Plan are to ensure that street and roads are as safe as possible and to reduce unnecessary traffic. West Shadow Lake Drive is a reconstructed local street and has capacity to accommodate one (1) new single family home. Sanitary Sewer Plan A goal of the sanitary sewer plan is to provide an affordable and safe sanitary sewer system. Municipal sanitary sewer has been installed along West Shadow Lake Drive and has capacity for the construction of one (1) new single family home. Water Supply Plan A goal of the water supply plan is to provide residents affordable potable water that is safe and of high quality for daily consumption and fire demand. Municipal watermain has been installed along West Shadow Lake Drive and has capacity for the construction of one (1) single family home. Planning and Zoning Board The Planning and Zoning Board reviewed the project on February 12, 2020. The Board requested input from the staff on the following items: 1. Is the crawl space intended to flood? Is storage allowed in the crawl space? Do the vents open automatically? How does the water leave the crawl space? 6 Staff clarified that the crawl space is intended to flood and is to only be used for storage. Habitable space is not allowed. Staff also clarified that the vents open automatically. The vents are to be installed 1-foot from the bottom of the crawl space. In order to empty the crawl space of water, pumps may need to be used. A door to the crawl space is also proposed and could be opened when the water levels recede. 2. Is the choice using the crawl space and vent construction over the use of stilts or fill for aesthetic purposes? Staff clarified that the use of the crawl space instead of stilts is an aesthetic decision. The applicant is seeking a conditional use permit in order to avoid using fill. 3. What is the crawl space floor elevation and are plantings allowed near the vents? Staff stated that the proposed crawl space floor elevation is 885. The details for the vents and the City Code both require the area in front of the vents to be clear. Staff did not recommend planting any landscaping in front of the vents. The Planning & Zoning Board held a public hearing on February 12, 2020. The applicant, Leslie Schuhbauer, introduced herself to the Planning & Zoning Board. No other public comments were made at the public hearing. The Board recommended approval with a 3-0 vote with conditions as detailed in Resolution No. 20-21. Findings of Fact Resolution No. 20-21 details the Conditional Use Permit Findings of Fact. The proposed single family home with alternative elevation methods is consistent with the Land Use, Utility, Local Water Management, Capital Improvement, Policy and Natural Environmental Plans and recommendations of the comprehensive plan with the required plan revisions as detailed in February 12, 2020, staff report. 2. The proposed development application is compatible with present and future land uses of the area. The proposed single family home with alternative elevation methods is compatible with present and future land uses. The parcel and adjacent parcels are guided and zoned for residential use. A single family home is consistent the residential land uses. 3. The proposed development application conforms to performance standards herein and other applicable City Codes. A Site Plan Review has been completed and the proposed single family home with alternative elevation methods will meet zoning performance standards if conditions listed in staff report are met. 4. Traffic generated by a proposed development application is within the capabilities of the City when: a. If the existing level of service (LOS) outside of the proposed subdivision is A or B, traffic generated by a proposed subdivision will not degrade the level of service more than one grade. b. If the existing LOS outside of the proposed subdivision is C, traffic generated by a proposed subdivision will not degrade the level of service below C. c. If the existing LOS outside of the proposed subdivision is D, traffic generated by a proposed subdivision will not degrade the level of service below D. d. The existing LOS must be D or better for all streets and intersections providing access to the subdivision. If the existing level of service is E or F, the subdivision developer must provide, as part of the proposed project, improvements needed to ensure a level of service D or better. 3 e. Existing roads and intersections providing access to the subdivision must have the structural capacity to accommodate projected traffic from the proposed subdivision or the developer will pay to correct any structural deficiencies. f. The traffic generated from a proposed subdivision shall not require City street improvements that are inconsistent with the Lino Lakes Capital Improvement Plan. However, the City may, at its discretion, consider developer-financed improvements to correct any street deficiencies. g. The LOS requirements in paragraphs a. to d. above do not apply to the I- 35W/Lake Drive or I-35E/Main St. interchanges. At City discretion, interchange impacts must be evaluated in conjunction with Anoka County and the Minnesota Dept. of Transportation, and a plan must be prepared to determine improvements needed to resolve deficiencies. This plan must determine traffic generated by the subdivision project, how this traffic contributes to the total traffic, and the time frame of the improvements. The plan also must examine financing options, including project contribution and cost sharing among other jurisdictions and other properties, that contribute to traffic at the interchange. h. The City does not relinquish any rights of local determination. The proposed single family home with alternative elevation methods does not change the level of service along West Shadow Lake Drive. It is a local road and is capable of handling the traffic volume proposed by the single family home. 5. The proposed development shall be served with adequate and safe water supply. The proposed single family home with alternative elevation methods will be served by an adequate and safe water supply. The parcel is served by a 12” municipal watermain located along West Shadow Lake Drive. 6. The proposed development shall be served with an adequate and safe sanitary sewer system. The proposed single family home with alternative elevation methods will be served by an adequate and safe sanitary sewer system. The parcel is served by a 3” municipal force main sanitary sewer located along West Shadow Lake Drive. 7. The proposed development shall not result in the premature expenditures of City funds on capital improvements necessary to accommodate the proposed development. No City funds are being expended on this project. 4 8. The proposed development will not involve uses, activities, processes, materials, equipment and conditions of operation that will be detrimental to any persons, property, or the general welfare because of excessive production of traffic, noise, smoke, fumes, glare, or odors. The proposed single family home with alternative elevation methods is an allowed use within the R-1X, Single Family Executive District with an approved conditional use permit. The project will not generate excessive traffic, noise, smoke, fumes, glare or odors. 9. The proposed development will not result in the destruction, loss, or damage of a natural, scenic or historic feature of major importance. There are no natural, scenic or historic features on the existing site. BE IT FURTHER RESOLVED by The City Council of Lino Lakes in addition to the administrative requirements of a conditional use permit, the following standards of Section 1103.06(4)(f), are being met: (f) Alternative elevation methods other than the use of fill may be utilized to elevate a structure's lowest floor above the regulatory flood protection elevation. (c) The proposed water supply and sanitation systems, if any, and the ability of these systems to minimize the potential for disease, contamination and unsanitary conditions; The parcel is currently served by existing municipal watermain and sanitary sewer. The single family home will connect to those services following current editions of the CEAM Standards and the City of Lino Lakes Standard Specifications. (d) The susceptibility of any proposed use and its contents to flood damage and the effect of such damage on the individual owner; The proposed single family home with alternative elevation methods includes an enclosed crawl space equipped with flood vents for temporary flood storage. The garage slab and first floor of the single family home are above the floodplain elevation. (e) The importance of the services to be provided by the proposed use to the community; The proposed single family home with alternative elevation methods provides no services to the community. The parcel is zoned R-1X, Single Family Executive. (f) The requirements of the facility for a waterfront location; The proposed single family home with alternative elevation methods meets the requirements of a facility for a waterfront location. (g) The availability of viable alternative locations for the proposed use that are not subject to flooding; There are no viable alternative locations for the proposed single family home on the parcel. They are all subject to flooding. The applicant shall not modify the municipal watermain and sanitary sewer that provides service to the parcel. No floodwater may be pumped into the sanitary sewer system. 2. Electronic bidding assures complete bids, assures accuracy in total costs, and provides efficient means for creating bid tabulations. Contractors can update their bids at any point before the bid opening and they do not need to be present at the bid opening. The Bidding Policy details how the electronic bidding process would be implemented while also maintaining language about traditional sealed bidding processes for paper submissions. Contracts that involve public improvements under Minnesota Statutes, chapter 429 may have additional requirements. The city of Lino Lakes follows Minnesota law in regard to municipal contracts, including procedures for competitive bidding and all public contract requirements. Procedure: 1. Approval. Projects or procurements must be either in the approved budget or require city council authorization prior to bidding. All competitively bid contracts require city council action awarding a contract. 2. Plans and Specifications. Prior to seeking bids, the city must prepare plans and specifications that meet all laws and requirements. A standard contract template shall also be used and will be modified as necessary for any given project. Minnesota Statutes, section 331A.03 authorizes the city to replace publication in the city’s official newspaper with dissemination on the city’s website; provided, however, that the city follows the procedural requirements contained in said statute. 4. BACKGROUND Last year, the City entered into a Joint Powers Agreement (JPA) with the City of Hugo for cost sharing of the East Cedar Street & 24th Avenue/Elmcrest Avenue North Improvement Project. The project includes paving 24th Avenue/Elmcrest Avenue from Tart Lake Road to the south a distance of 2,300 feet, and East Cedar Street from Otter Lake Road to the east a distance of 2,600 feet. As outlined in the JPA the East Cedar Street improvements are the financial responsibility of the City of Lino Lakes and the 24th Avenue/Elmcrest Avenue improvements are the financial responsibility of the City of Hugo. On June 10, 2019, the City Council ordered the project, approved the plans and specifications and authorized the advertisement for bidding. Bids were received for the project in August of 2019. Both the City of Hugo and Lino Lakes passed Resolutions to reject bids and amended the JPA to rebid the project early in 2020 for construction in 2020. After the first amendment was passed, the City of Hugo received indications that there may be development interest on a parcel adjacent to Elmcrest Avenue. A bid alternate for the extension of sanitary sewer and watermain was included in the plans through a second amendment to the JPA. The second amendment outlines that associated costs would be the responsibility of the City of Hugo. On December 9, 2019, the City Council authorized the rebidding. Bids were received on Tuesday, January 28, 2020. A total of six bids were received. The Lino Lake’s total project cost including soft cost and contingency is equal to $624,000. Funding for the project is proposed through the arterial street reconstruction fund (from special assessments for Cedar Street collected from abutting developments) in the amount of $247,500. State aid will fund the remaining $376,500 of project costs. The completion date for this project is November, 2020. WSB and Associates has submitted a proposal to complete the construction services for the East Cedar Street & 24th Avenue/Elmcrest Avenue North Improvement Project in the amount of $58,502. Note this cost shared with the City of Hugo as outlined in the JPA. VOTE REQUIRED: 3/5 INTRODUCTION Staff is requesting City C ouncil approval of the Amended Stipulation Agreement with the Leibel Property ownership group , regarding the NE Lino Lakes Drainage Area Improvement project. BACKGROUND In March of 2019, the City Council authorized acquisition of property by eminent domain for the NE Drainage Improvement Project. The City continued to negotiate directly with the Leibel ownership group throughout 2019. This process included coordinating efforts with a private developer interested in the balance of the property. On November 20, 2019, the City Council approved a Stipulation Agreement with the Leibel Family regarding purchase of their property. Under the agreement, the property owners concurred with public purpose of the condemnation and agreed to the amount of compensation, but retained the ability to seek additional compensation if the developer acquisition was not completed. The original dates in the agreement established a deadline for the owners and developers to enter into a Purchase Agreement by March 1, 2020 and close on the property by April 1, 2021. All parties have worked diligently to meet these requirements however, additional time is needed. Accordingly, the purchase agreement deadline and the closing date are proposed to be changed to June 1, 2020 and July 1, 2021, respectively. A certain developer (the “Developer”) is also negotiating with Owners to directly purchase the balance of the Property from the Owners, and the Developer and City are coordinating their efforts and allocating matters relating to the acquisitions between themselves. 4. The Owners and the Developer hope to enter into a purchase agreement for the balance of the Property in the near future. 5. In light of and in anticipation of the Owners entering into the Purchase Agreement with the Developer, the City and Owners now wish to enter into this Stipulation as it relates to the City’s pending Petition in Condemnation. Based on the above, the parties agree as follows: 1. The Owners concur with the necessity and public purpose for the City’s taking, as outlined in the City’s Petition in Condemnation. 2. The Owners stipulate to the just compensation amount consistent with the City’s appraised value of the Property, which is the amount outlined in the City’s Petition in Condemnation: $52,000.00 for PID No. 14-31-22-14-0001 and $386,000.00 for PID No. 14-31-22-12-0002. 3. If either (a) Owners and Developer do not enter into a Purchase Agreement on or before June 1, 2020, or (b) the transaction contemplated by that Agreement does not close by July 1, 2021, Owners may elect to declare this Stipulation is null and void, and Owners may pursue an award of just compensation at a Commissioners’ Hearing in accordance with Minnesota law. Owners must notify the City of such election in writing by delivering to City, within two weeks of the triggering event, a notice of cancellation of this Stipulation. 4. The parties agree the electronic signatures of this Stipulation shall constitute valid, binding signatures. 5. This Amended and Restated Stipulation replaces and supersedes that certain Stipulation dated November 21, 2019, entered into by the parties in this matter. BACKGROUND In January of 2020, the City issued a Public Water Advisory regarding manganese levels in the municipal water supply. While the City’s water supply continues to meet all Safe Drink Water Act standards, testing by the Minnesota Department of Health (MDH) showed some of our wells have manganese levels above MDH’s recommended health guidelines. As part of the City’s response plan, staff has been working with engineering consultants and MDH professionals on short, mid, and long term plans to reduce manganese levels in the municipal water supply. One course of action is the possible construction of a Water Treatment Plant. Staff has worked with City Engineer, WSB and Associates, to identify the necessary scope of the study. The study components include: 1) Evaluation of Alternative Water Supply Options to address short to mid-term needs. 2) Analyze Source Water 3) Evaluate Water Treatment Options 4) Review Potential Plant Site 5) Prepare Centralized Water Treatment Plan Preliminary Drawings 6) Evaluate future system needs and phasing 7) Study Neighborhood Impacts 8) Determine Estimated Costs In response to City Council direction at the March 2, 2020 works session, WSB has provided a revised proposal in the amount of $34,538.00. The Study is anticipated to be complete by June 1, 2020. Architectural renderings are not included in this phase of the proposal, but can be provided for an additional fee. No public outreach is included at this time. Staff would anticipate that both architectural renderings and a public information meeting would be part of a future project development phase. The study will be funded through the City’s trunk water fund. The Minnesota Department of Health recently tested the City’s manganese levels in each of the City’s wells as part of the EPA Unregulated Contaminant Monitoring Rule 4 (UCMR4). The water quality testing data from MDH indicates that five of the City’s six wells exceed the maximum recommended manganese level for infants (100 ppb), and three of the wells exceeds the maximum recommend manganese level for adults and children (300 ppb). Therefore, the design and construction of a water treatment plant should be studied to treat the high levels of manganese that exist in the City’s drinking water in addition to treating other contaminants such as iron and ammonia. Alternative water supply options will also be evaluated as part of this study. I. SCOPE OF WORK 1. Alternative Water Supply Options In lieu of constructing a water treatment plant(s) to treat the City’s existing wells, alternative water supply options will also be evaluated. These options include: A. Drilling new wells B. Purchasing treated water from another community or water utility 2. Analyze Source Water All existing water quality data for the City’s existing wells will be reviewed with respect to primary and secondary drinking water standards as well as contaminants and emerging contaminants. We recommend completing additional testing for any key water quality parameters (ex. ammonia, total organic carbon, emerging contaminants, etc.) that possibly have not been tested to date by the City. Our team will then develop a comprehensive treatment plan that addresses all identified contaminants, ensures regulatory compliance, and produces high quality water for the City’s customers. WSB will also look ahead and evaluate the water quality parameters that will likely need to be evaluated for both conventional and biological filtration for the water treatment pilot testing to be completed in the next phase of the project. It is assumed for this study that the City will pay for all water quality testing. Mr. Rick DeGardner March 4, 2020 Page 2 3. Water Treatment Options Upon completion of the source water analysis, we will explore available water treatment options and the recommending preferred processes for treating known and emerging contaminants that will potentially need to be treated over the anticipated life of the water treatment plant(s). The report will examine available treatment process options for identified contaminants potentially needing treatment, recommend a preferred treatment process for each identified contaminant, identify required space needs for preferred treatment processes, provide recommendation as to the required size and preferred location for the facility, and provide cost estimates for constructing and operating the facility. We will study both conventional and biological filtration and present their benefits. The iron, manganese, and ammonia in the City’s water could be treated without chlorine and potassium permanganate with biological filtration. Biological filtration is commonly practiced in the United States and Europe and is endorsed by the Minnesota Department of Health (MDH) as an efficient and effective method for treating these (and other) contaminants. The benefits of biological filtration include higher filtration rates, longer filter runs (reduces backwash supply and wastewater volumes), savings in chemical costs, and reduction in disinfection byproducts. The design of a conventional gravity filtration process with detention and aeration can easily be modified to accommodate biological filtration after the successful completion of a biological filtration study as required by MDH. WSB will coordinate and attend tours of existing water treatment facilities that utilize each of the treatment methods being evaluated so that City staff have a clear understanding of the treatment technologies and options that are available for the water treatment plant. The analysis will include, but not be limited to, initial construction costs, long term operational costs, the ability of each system to effectively and efficiently remove iron, manganese, ammonia, and other contaminants from the water supply, the discharge of the waste product, and the ability of the plant to be expanded or be modified in the future. This will be a comprehensive review and recommendation on the “best” plant to meet the current and future needs of the City. 4. Review Existing Site A potential site for the proposed water treatment plant has been identified at the southwest intersection of Birch Street and 12th Avenue South. The WSB team will visit the proposed water treatment plant site and review the existing wetlands in the area. We will also review the as-built drawings, easements, and existing infrastructure to determine if the site is feasible for further consideration for the water treatment plant. Potential contaminants and other barriers that may restrict or affect the layout of the plant at the site will be evaluated up front during this analysis. Other factors such as ease of chemical deliveries, access for maintenance trucks, security, stormwater retention, proximity to water and sanitary sewer utilities, proximity to three phase-480 volt electrical power, proximity to existing and future wells, and the potential for the City to acquire the property will be evaluated during the preliminary design phase. 5. Centralized Water Treatment Plant Preliminary Drawing We will design and create a footprint for a gravity filtration water treatment plant that will be superimposed onto a conceptual site plan drawing at the southwest intersection of Birch Street and 12th Avenue South. The water treatment plant footprint will show the exterior dimensions of the plant and not show internal rooms or room dimensions. The Mr. Rick DeGardner March 4, 2020 Page 3 conceptual site plan will also show space for a future water treatment plant expansion footprint. 6. Water Distribution System Modeling and Watermain Phasing Plan Preliminary water distribution system modeling has indicated that a centralized water treatment plant could initially treat Wells 1, 3, 5, and 6, and without upsizing the existing 16-inch watermain on Birch Street. The City’s maximum day water demands will eventually exceed the hydraulic capacity of the existing 16-inch watermain on Birch Street. If Wells 2 and 4 are left untreated and used only as peaking wells on maximum day demands, the existing 16-inch watermain should have adequate hydraulic capacity to convey treated water from a centralized water treatment plant for the next 10 to 15 years based on the water demand projections in the City’s Comprehensive Plan. At that time, a parallel 16-inch watermain will need to be constructed along Birch Street and extended westward and eastward in phases as the capacity of the water treatment plant is increased and possibly expanded in the future with new wells pumping to the plant. Constructing a future plant expansion and a parallel 16-inch watermain in phases along Birch Street will be evaluated as part of this study. The raw watermain costs to be constructed from the City’s existing wells to the centralized water treatment plant will also be figured-in to the estimated costs. 7. Study Neighborhood Impacts The preliminary design report will explore potential impacts of the water treatment facility on neighboring properties due to noise, odors, operating hours, traffic, and other identified sources of impact and recommend a process for mitigating any identified impacts during the final design process. Neighborhood meetings are not anticipated for this study phase and not included in this proposal. 8. Determine Estimated Costs The preliminary design report will include estimated construction and operating costs for a groundwater treatment facility. Estimated costs will assume industry standard costs for a gravity filtration water treatment plant. The report will explore and recommend “order of magnitude” water rate revisions needed to offset future budget impacts to fund the water treatment plant. This analysis does not replace a water rate study that should also be completed under a separate project. 9. Report Preparation The findings, estimated costs, and recommendations from the study will be summarized in a report along with report figures and presented to the City Council. 10. Meetings We will coordinate, prepare handouts, and attend up to three (3) meetings with City staff and three (3) City Council meeting to discuss the report. The proposed schedule includes the following milestone dates: Task Completion Date City Council Authorization to Proceed March 9, 2020 Complete Feasibility Study May 15, 2020 Present Feasibility Study to City Council June 1, 2020 B. Estimated Fees Compensation for tasks shall be on an hourly basis, based on the actual hours worked for personnel assigned to the project. We propose to perform these services for an hourly, not-to-exceed fee of $34,538. A spreadsheet showing the estimated hours for each task is attached to this proposal. Architectural renderings are not included in this phase of the project but can be provided for an additional fee of $1,800 per rendering if requested by the City. Geotechnical services are also not included in this phase of the project. We will rely on previous soil borings to study the existing soil conditions at the proposed site. We will invoice the City on the basis of actual hours spent at current billing rates. Additional services requested by the City will be invoiced on the basis of actual hours spent at current billing rates plus the actual cost of reimbursable expenses. All services will be invoiced monthly. Our billing rates will be adjusted on an annual basis. A detailed list of project tasks is defined and shown on the attached task hour budget worksheet. Tasks not shown are considered outside of the scope of services. This letter represents our understanding of the Water Treatment Plant Feasibility Study.
