CITY OF LINO LAKES RESOLUTION NO.22-33 RESOLUTION APPROVING MEMORANDUM OF UNDERSTANDING WITH RICE CREEK WATERSHED DISTRICT SHENANDOAH PARK BMP FEASIBILITY STUDY WHEREAS,the 2009 Rice Lake Stormwater Retrofit Assessment(SRA),prepared by the Rice Creek Watershed District and the Anoka Conservation District provided a blueprint to improve stormwater quality and reduce the volume of runoff entering the stormwater system from neighborhoods that contribute to the degradation of Rice Lake; and WHEREAS, on September 27, 2013 the U.S. Environmental Protection Agency approved the District's Lino Lakes Chain of Lakes Nutrient Total Maximum Daily Load Study,with the purpose of quantifying the total phosphorus loading reductions needed for Rice Lake, and others, to meet state water quality standards; and WHEREAS,the development of content within the SRA included review and input from other partners in the Rice Lake Subwatershed, including the City of Lino Lakes and WHEREAS,the SRA includes a project concept for the City's Shenandoah Park, suggesting it as an ideal location to develop a project to improve water quality by reducing total phosphorus loads and runoff rates, and potentially restoring previously drained wetland areas, collectively resulting in improvements to Rice Lake; and WHEREAS,the SRA establishes that a feasibility study including additional engineering and modeling is required to analyze potential project concepts, and their respective benefits, for Shenandoah Park(Study); and WHEREAS,the Study will provide valuable information should either the City or RCWD pursue external grant funding for a proposed water quality improvement project in Shenandoah Park in the future; and WHEREAS,the City desires to proceed with the aforementioned Study to further develop project concepts for Shenandoah Park; and, WHEREAS,the RCWD desires to cooperate with the City by providing cost-share assistance for the Study; NOW,THEREFORE,BE IT RESOLVED by the City Council of the City of Lino Lakes hereby approves the MOU with the RCWD and authorizes the Mayor and City Clerk to execute the agreement on behalf of the City. BE IT FURTHER RESOLVED,that City staff are hereby authorized and directed to enter into a contract with WSB for the preparation of the Shenandoah Park BMP Feasibility Study in the amount of$21,925. The motion for the adoption of the foregoing resolution was introduced by Councilmember Ruhland and was duly seconded by Councilmember Lyden and upon vote being taken thereon, the following voted in favor thereof: Ruhland, Lyden, Stoesz, Cavegn, Rafferty The following voted against same: None Ro afferty, Mayor ATTEST: li n Bartell, City Jerk-- CITY COUNCIL AGENDA ITEM 6B STAFF ORIGINATOR: Michael Grochala, Community Development Director MEETING DATE: March 14, 2022 TOPIC: Consider Resolution No. 22-33, Approving Agreement with Rice Creek Watershed District, Shenandoah Park BMP Feasibility Study, Michael Grochala VOTE REQUIRED: 3/5 INTRODUCTION Staff is requesting City Council approval of a Memorandum of Understanding (MOU) with the Rice Creek Watershed District (RCWD) and authorize a professional services agreement with WSB and Associates to complete a Best Management Practices(BMP) Feasibility Study for Shenandoah Park. BACKGROUND In 2009-2010 the RCWD, in partnership with the Anoka Conservation District, completed a Subwatershed Assessment focusing on Rice Lake in the Rice Creek Chain of Lakes. The purpose of the study was to identify potential subwatershed water quality projects to reduce runoff volume and sediment/nutrient loading to Rice Lake. The study identified Shenandoah Park as a prime candidate for additional study in advance of developing a large capital improvement project. A private ditch system, maintained by the City runs through the park, under Birch Street, and discharges into Rice Lake. The ditch serves as the primary stormwater outlet for the residential neighborhood extending south to Coyote Trail. A majority of the park area is comprised of partially drained wetland. Staff is of the opinion that opportunity exists for a restoration project that would enhance water quality and provide for an improved greenway element to the park. WSB and Associates completed a wetland delineation on the park property in 2021. They have submitted a proposal to complete the feasibility study and corresponding water quality modeling in the amount of$21,925. The Rice Creek Watershed District is proposing to participate in the project. The RCWD's share is not to exceed $10,962.50 (50%) of the cost. The RCWD is acting on the proposed MOU at their March 9, 2022 board meeting. Funding for the City's share of the project will come from the Surface Water Management Fund. This fund was established in 1992 to cover the costs of surface water planning and trunk facility improvements. RECOMMENDATION Staff is recommending approval of Resolution No. 22-33. ATTACHMENTS 1.
