HomeMy WebLinkAbout01/15/1969 P&Z MinutesThe Lino Lakes Planning and Zoning Board meeting of January 13, 1969 was called to
order by Chairman Aehbein at 8:30 p.m. with Brovold, Stanley, Rehbein and Jester
present. Those absent were VoLean, Belling and Husnik.
A publto hearing was held for the purpose of rezoning 1.7 scree et the corner of 35K
and Main Street fran residential to commercial. Two representatives from the DX Ser-
vice Stations were present to request the rezoning and a variance. Mr. Locher stated
that the proper notices had been mailed and published and all prerequisite requirements
had been met for the hearing.
Mr. Stanley moved to recommend to the Couaoil the rezoning of the land having the
following legal description:
That pert of the Southwest 1/4 of the Northeast 1/4 of Section 24, Township
31, Range 22 described as follows: Beginning at the point of intersection
of the South line of County State Aid Highway No. 14 and the Easterly right -
of-way line of Interstate Highway No. 35E; thence Bast along said South line
of County State Aid Highway No. 14 a distance of 200 feet; thence at a right
angle South 250 feet; thence at a right angle Neat 298.22 feet to said East-
erly right- of-+way line of Interstate highway No 35E; thence Northerly along
said Easterly right -of -way line 275.62 feet to the point of beginning.
and also to grant a variance on said property. Seconded by Mr. Jester. Carried.
The Chairman ruled that the election of a new chairman and vice - chairman would be
held at the February meeting because three membera were absent.
A letter was reed Pram Mr. Kenneth Rehbein requesting a variance to build a house on a
lot less than 2 1/2 acres at the corner of Fourth and Pine which is also commeroial
property. He stated that there would be no basement; the house would have frost footings.
Mr. Jester moved to recommend to the Council that they grant a variance to Mr. Kenneth
Rehbein for a lot at Fourth and Pine having the following legal description:
That part of the NW 1/4 of Section 5, Township 31, Range 22, Anoka County,
Minnesota, described as follows: Commencing at the NW corner of said NW
1/4 of Section 5; thence southerly, along the westerly line of said NW 1/4,
a distance of 800° to the point of beginning; thence continuing southerly,
along said westerly line of NW 1/4, a distance of 200' thence easterly, at
right angles, a distance of 208'; thence northerly at right angles, a
distance of 208'; thence westerly, at right angles, a distance of 208' to
point of beginning. Subject to Fourth Avenue.
Seconded by Mr. Stanley. Carried.
recommend to the Council
Mr. Keith Apits appeared to request a variance for 25.*eet of land to be added to his
present property on Biroh Street. Mr. Jester moved grant a variance to Mr. Apits
on 25 feet of land having the following legal description:
That part of the Northeast Quarter of the Southeast Quarter, Section 30,
Township 31, Range 22, Anoka County, Minnesota, described as follows:
Beginning at the intersection of the South line of said tract and the
centerline of State Highway No. 49 as now established; thence East along
said South line and the centerline of a public road for 433 feet to the
point of beginningof the treat of land to be hereby described; thence con-
tinuing East along said line for a distance of 25 feet; thence North at
right angles for a distance of 170 feet; thence West parallel with the
first course for 25 feet; thenoe South 170 feet to the point of beginning.
Seconded by Mr. Brovold. Carried.

A long discussion of plumbing inspection for the Village ensued. The Minnesota
State Plumbing Code Book was discussed as a possible basis for a new ordinance.
It wee decided that Mr. Jester would talk with several qualified plumbers and
inspectors in neighboring villages and get their professional opinions on plumbing
codes and inspectors. It was pointed out that if a plumbing inspector ever is hired
he should be one that has no profit interest in this community, nor one who's com-
petition does.
Mr. Rehbein stated that the Mobile Home Ordinance would be discussed next month due
to lack of attendance.
Mr. Cardinal presented the new zoning map of the Village, which is already out - dated.
Mr. Cardinal asked Mr. Locher to state the latest developments of the Rolland Johnson
case. Judge Gillespie had denied the petition which had tried to force the Council
to issue a building permit on a lot on a non- existing road. Mr. Johnson had appealed
to the Supreme Court and had requested them to waive the appeal bond which states
that he must pay the court costs if he loses. The Council had voted to defend the
appeal and denied the waiver of the bond. No date was set for the hearing.
Mr. Jester moved to adjourn at 9:45, seconded by Mr. Brovold. Carried.
