HomeMy WebLinkAbout02/19/1969 P&Z Minutes1- The Lino Lakes Flenning and Zoning Board meeting of February 19, 1969, was called to order by Chairman Rehbein at 8:10 p.m. with all members present except Stanley. The minutes of the January meeting were approved es read. The first order of business ores to elect a oheirsnan and a vice-chairman. Mr. Kelling moved to nominate John McLean, seconded by Mr. I usnik. There being no further nominations the motion carried. Mr. Husnik moved to nominate Arnold Kelling as vice - chairman, seconded by Mr, McLean. There being no further nominations the motion carried, It was agreed that Mr. Rehbein wculd wntinue to chair the present meeting. Mr. John DeVine appeared to ask for a permit to move in a trailer house for a temporary residence while a house on Ash Street is being fixed up for a permanent residence. He was told to get a 906-day permit from Al Dupre. A letter was presented from El Rehbein & Son requesting a variance on three pieces of prop- erty adjoining the land purchased from Ernest Ludwig, The property lines were not surveyed . properly in the past and some of the buildings on the former Ernest Ludwig lend were actually on the lend of Arthur Shipman and Elsie Wenzel Mr. Rehbein had purchased lend from these people to correct the situation end needed variances for three deeds, There would be no addition.l buildings on these three parcels„ Mr. Rehbein requested that there be no service charge for they are correcting a situation and not benefiting financially, Mr. Kelling moved to recommend to the Council the granting of three variances to El Rehbein Son Inc., on the property having the following legal descriptions: and S PARCEL 1. That part of Lot 10, Auditor's Sub, No, 151, Anoka County, Minnesota described as follorre: Beginning at the northeasterly corner of said Lot 10; thence southerly on the easterly line of said Lot 10, a distance of 10 feet thence northwesterly to the northwesterly corner of said Lot 10; thence east- erly to the point of beginning. PARCEL 2„ The northerly 218 feet of the westerly 14 feet of Government Lot No. 3 Section Twenty (20), Township Thirty -one (31), Range Twenty-two (22), Anoka County, Minnesota. PARCEL 3. The northerly 2 feet of that part of Lot 27, Auditor's Sub, No. 151, Anoka County, Minnesota, lying easterly of the tract of land owned by Arthur Rehbein and described in Book 682, Page 353, and filed in the office of the Register of Deeds in and for said county. Seconded by Mr, Brovold. Carried. It was deoided to leave the matter of the service charge up to the Council, Mrs. Vivian Rehbein requested two variances for two lots of one acre each, on her property on Ware Road. Each lot would have one house built on it in the future. Mr. Husnik moved to recommend to the Council the granting of 2 variances to Mrs. Vivian Rehbein on two lots having the following legal descriptions: PARCEL 1, South 150 feet of the North 450 feet of the East 3234+0 feet of the North 661.5 feet of Southeast 1/4 of Northeast 1/4, Section 31, Township 31, Range 22, subject to the rights of the public in Ware Road, PARCEL 2. South 150 feet of the North 300 feet of the Eaat :z 3 .40 feet ofthe North 661.5 feet of Southeast 1/4 of Northeast 1/4 Section 31, Township 31 Range 22, subject to the rights of the public in Were Road. 40 Seconded by Mr. McLean. Carried, 2- A public hearing was held for the purpose of considering the application of U.S. :takes Development Company to plat ea Lakes Addition No 1, 30 acres near Seventh Avenue just off Birch Street on Reshonau Lake. If the plet was accepted they would erect four model homes and one model townhoese which would be a four-family complex. All of the toente,usee would be sold, not rented. Mr. Gotwald stated that ell the Village ordineaces had been met on the map presented, some of these being: lot size„ depth of lot from lake shore, grade level, street width and all corners had been tiea to the section lines. It was stated that set back lines were not shown because of state law prohibiting this W, Gotwald questioned the utility easement and the general manager for Jandrie said that as fa: as he knew all utility lines would be underground, depending on Northern States Power Company. Present plans call for individual cesspools and private wells. They prefer a central system but this problem has not been worked out yet. However, all homes will be built with pipes to the street so that in the future utilities could be hooked up easily to a central ej)::nm. If a permit is granted and everything runs smoothly they tope to have families living in homes within nine months. Mi. Gotwald stated that the only thing they have not worked out fet Id the bond for the streets which would be up to him to determine the amount end present the figure to tee Council. No building permits could be issued until the bond is secured. Also no storm sewers had been designed or shown on the map. Seventh Avenue was discussed as to tee relocation of the private end and maintenance of same. Severe were questioned rurteer and the general manager stated that it war not their intent to "louse up sales" with septic tank problems. Mr. Gotwald stated that he would hove to check fill samp:oe ind the drain field system and all future utilities. 0 Upon Mr. Gotwald'a recommendation that the plat presented fulfills all the Vill'os ordinances with the exception of posting of the bond for streets, Mi. Mr. Harold Lerkin of Nsegele Outdoor Adveetising Company appeared regarding regulatTooe on billboards. Naegele wishes to have Lino Lakes pass a restricting ordinance so thf:y oon go ahead and contract for lend to erect advertising signs in the future. Mi. Lsrkin will give the Board various ordinances from ne4hboring communities to be studied for poueiLle adoption of an ordinance in Lino Lakes regulating billboards. Mr. Gotwald recommended to the Board that they request the Council to salt W. Jandric for a plan of the over-all area within one month so the Board will have time to study the over-all plan before they are asked to rush into accepting another email plat. This plan should also include the over-all thoroughfare as there will be more than three miles of road when the plat is completed. Plumbing inspection was discussed in detail. Jim Husnik will call a plumbing inspector from White Bear Lake to meet with the Planning Board and the Council and ask him to give his ideas on plumbing ordinance's and inapeotion. It was felt that we need a plumbing ordinance soon. Wit ,1,44 The mobile home ordinance was elso discussed end will be studied t'srther. Dave Brovold brought up several questiots the first being the bad intersect'on et 35W and Highway 8. He stated he personally has seen many accidents et 4his 'comer end won- dered what could be done about it He also questioned the icy condttion of Centerville Road and Main Street. He aid he had notified the County and they were to tc‘ke flare of it but nothing had been done. Mr. Brovold asked what was being done about two of the three trailers which hnd been issued permits previorziy but these permits had long since expired. Two of the three trailers ere still in the Village. Also questioned was the empty "moved in" house on Highway 8. It was felt 1.711, building inspector should inspect this one and if not up to code it should be, red-taggee. Mr. Cardinal will present these matters to the Council at their 42:tt ueeting. Mr. Kelling moved to adjourn at 9:55 p.m. Seconded by Mr, McLean® Carried,
