HomeMy WebLinkAbout01/21/1970 P&Z MinutesThe regular meeting of the Village of Lino Lakes Planning and Zoning Board held on January 21, 1970, was celled to order at 8 :00 p.m. by Chairman John McLean with all members present. Mr. Cardinal was also present. Mr, Korth moved to accept the minutes of December 17, 1969 es presented. Seconded by Mr. Jester. Carried unanimously. Mr. McLean stated that Ordinance No. 52 deals with setting a fee schedule for arocessing petitions for special use permits, rezoning, platting and variances. sir. Locher requested that we recommend whether this should be adopted as an Ordinance to the Village of Lino Lakes, Mr. Locher said some previous applicants felt they should not pay for the services they are getting. The cost of processing, rezoning, platting and variances, and special use permits must be borne by the applicant end not the Village. Ordinance No. 52 etates that no application for a special use permit, rezoning, variance er_ platting shall be accepted or considered unless such application shall be accompanied bye deposit of $100, in addition to a fee schedule for the various types of proceedings described in the ordinance. Mr. Kelling made a motion that Ordinance NW. 52 be passed with the exception that the $100.00 deposit must be paid before considering an application. Seconded by Mr. Karth. Mstion carried unanimously. Mi. McLean stated that we will be unable to process certain of the sign appli- cations from Neegele and Meyer Advertising Companies received to date since they:. do not adequately describe the location of the sign applied for. The sign appli ration from Clem Houle's property asks for two permits and there is only room for one due to the one 990' of frontage. These applications will be referred to the applicants for correction before presentation to the Planning and Zoning Commission. Naegele Sign Company presented applications for special use permits Nos. 70, 13, And 14 which are located on the Jesse Helier property situated on the northwest edge of I -35W, The spacing of these signs was checked with Mr. Gotweld and Mr. Locher and the description of the signs was in accord with our Ordinance No. 51. Permit No. 10 refers to a location east 50' of Gov. Lot 2, Sec. 9. Permit No. 13 refers to a location West 50' of Southwest 1/4 of Northwest 1/4, See. 10. Naegele Sign Company also presented applications for special use permits Nos. 11 Ind 12 to be located on Boyd property on the Northwest side of I -35W. Mr. Karth required if permits Nos. 11 and 12 would be spaced in relationship to the three 3igns that Meyer's have been granted a permit on the Schmuck property. Since the Neegele Permit No. 11 is to be located in the North 50' of the Boyd property and Permit No. 12 is to be located 1200' Southwest, there would be no problem. The Boyd property bas 2465' of frontage on I -35W. Mr. Jester moved to recommend to the Council that special use permit Nos. 10, 11, 12, 13, and 14 be granted to Neegele Sign Company. Mr. Karth seconded this motion. Motion carried unanimously. The hearing for U.S. Lakes Development Co., Lakes Addition No. 2 plat was called to order about 8:45 p.m. Mr. Locher showed that the hearing affidavits were in order. Mr. McLean reed a copy of Mr. Van Housen's letter dated January 8, 1970 regarding the plat for Lakes Addition No. 2 and Mr. Gotweldt's letter of Janu- ip ary 12, 1970; also the letter from the Village Clerk dated January 16, 1970, which were also related to U.S. Lakes Addition No. 2. (Copies of these letters are attached), 2- Mr. Karth mentioned there was quite a lot of work to be done on the area and he also asked if the low :lots would be brought up. Mr. Busch said he realized there are approximately 12 lots in marshy ground, and that there will be some removal of unsuitable soil in those instances. This will be done before building permits will be requested. He did not feel that there were any lots indicated that were 5mpracticel to build on. They had indicated on the proposed plat what they anticipated for storm sewer. There is a ditch along the east side that exists There now, the lake on the west side and the St. Paul Waterworks ditch. Mr. Hill asked if the St. Paul Waterworks would be involved in the drainage problem. Mr. Locher stated that St. Paul Waterworks runs over the Wards Lake. There is no problem there as over the years it has become a waterway. Mr. Jensen stated has been discussed with St. Paul Waterworks and they have indicated to them they have no objections to construction in this area. Mr. Husnik made a motion to accept the plat as presented. Mr. Jester seconded it. Motion carried unanimously. The hearing for the special use permit for two of the areas involving two town house parcels and oneapertment house parcel on Lakes Addition No. 2 was called to order. Mr. Locher showed that the hearing affidavits were in order. These outlots are identified as G & K (town houses), and H (multi - family). The hearing involves applying for a special use permit for construction of town rouses and multi- family units on the designated outlots. References to Mr. Van Nousen's letter were made concerning approval of these outlots. He stated we hould not approve because approval at this point is premature. Mr. Busch mentioned that they have in mind to cone before the Village with e final plat of these two outlots showing all the specifications of the town house levelopment. Mr. Locher mentioned that the Village could require a bond be posted or refuse to issue building permits until there is a definite plan and approval for construction Mr. Busch said he would come back with a plat showing a number of town house units wrlich will consist of a platted lot. The balance of the area will be platted also. 1 r. Karth moved that we recommend to the Council for future use Outlots G, H, and 2 of Lakes Addition No. 2 for town houses and multi- family dwellings, providing oandric comes before the Planning Board and Village Council with plats before taey go to work and for these to be approved by Planning & Zoning and the Council. 1'!r. McLean mentioned the presentation includes items 1 and 2 from Mr. Van Housen's Tanning and Zoning Procedures. He also mentioned that final platting of these lots must be approved prior to the granting of any construction permits. The motion was seconded by Mr. Rehbein. Carried unanimously. The notice of public hearing for Ordinance 6R was discussed.. Mr.. Locher showed that the hearing affidavits were in order. Mr. McLean stated this hearing in- olves Outlot J for Limited Commercial and would be used for small retail business and general offices. Mr. Kelling recommended to the Council that the rezoning of Outlot J to Limited Commercial be granted as outlined in Ordinance 6R for retail business and other offices (excluding filling stations) with no issuance of permits for construction until approval by the Council. Mr. Rehbein seconded this motion. Carried unanimously. 3- The continuance of the Acton Construction Company hearing was opened. Mr. Paul Miller from Acton came forward and introduced Mr. Ralph Chiotti, an economic consultant, and Mr, Bob Isacson who had prepared the drawings whieh they presented, Mr. Chiotti mentioned that the characteristics of the land demands a high value kind of development and I -35E certainly is going to give the area great accessi- bility. There are 18 lots in this proposal for development that would range in ize from 3 acre to 22 acre lots. Jr. McLean asked what kind of businesses did they propose for tlis type of area? dr. Isacson said they would have to await the arrival of sewer cni water, but They would like to limit their requests for rezoning for light industrial business. rr. Locher commented that we can consider this for zoning to Limited Commercial. Mr. Isacson then mentioned that the Planning Commission might be doing themselves less favor by limiting them to one particular category in our zoning. 1vlr. Rehbein made a recommendation that the requirements for items 1 and 2 from Mr. Van Housen's Planning and Zoning Procedures be brought before the Planning Pt Zoning Commission and the Council before the issue of any construction permits. A motion was then made by Mr. Rehbein . for the rezoning to Limited Commercial or light industrial on the two-40 acre tracts on the east side of I -35E, but excluding the 60 -acre tract on the west side of I -35E as originally described in the hearing notice. Mr. Husnik seconded this motion. Carried unanimously. Mr•. McLean mentioned that he had attended a meeting with Mr. L'Allier at the sorest Lake School on the discussion of trailer courts. Monthly meetings have been established with our various planning groups and one man is to represent our group each month along with Mr. McLean who is Chairman. 1r. Cardinal thought a letter should be sent to Mr. Roy Stanley thanking him for his efforts put forth for the Planning & Zoning Board. he next Planning & Zoning meeting will be February 18 at 8:00. Mr. Rehbein hought that Mr. Van Housen should come to the next meeting as Jandric should give us a guideline for what he is setting up for multi- family dwellings. Mr. 'Ceiling made a motion to nominate Mr. McLean for Chairman of Planning & oning for 1970. The motion was seconded by Mr. Rehbein and carried unanimously. Rehbein made a motion to nominate Mr. Kelling as Vice- Chairman of Planning & Zoning. Mr. Hill seconded this motion, Carried. Notion was made to adjourn the meeting at 11:05 p.m, by Mr. Jester, Mr. Rehbein Jeconded it. Carried unanimously.
