The following corrections were made to the April 15 minutes: Page 3, second tolastparagraph, cross out 16', insert 60'; Page 4, second to last paragraph, lastline, "crossing" should be "crossings "; Page 5, sixth paragraph, insert "sewer" petween "court" and "line "; Page 5, third paragraph, insert "even" after "Mr. Hillstatedthat ". Mr. Husnik moved to accept the April 15, 1970 minutes as corrected. Seconded by 14.. Hill. Carried.
sign permit was requested by Naegele Advertising to erect a sign at the northeastornerofHwy. 49 and 135W. Mr. Hill moved to recommend to the Council that theyacceptNaegele's application for Sign Permit #26 to be located as described on theapplication. Motion seconded by Mr. Karth. Carried.
dr. Cheer Cardinal requested a special use permit to park his mobile home on his ownotatRoute1, Box 27, Hugo. Mr. Kelling asked if the Board had made any changesnpolicyoverthelastyearsinceMks. Cardinal had a similar permit last summer.
nr. Husnik moved to recommend to the Council they grant Mr. Cheer Cardinal oftoute1, Box 27, Hugo, a three-month special use permit to live in a mobile homenhisownlotfromJune1toSeptember1. Seconded by Mr. Karth. Motion carriedinanimously.
4r. Karth and Mr. Husnik reported on their survey of the Uniform Minnesota Plumbing3ode. Both men thought it was a good code but pointed out that Mr. West, Plumbingnspector, had said he objected to plastic pipe, which is included in the code. 1t also includes a certain type of copper which can rust. The main problems with
plastic pipe are that it can be damaged by a Roto- Rooter and cannot be used underthehouse (stated in the code). The committeemen felt plastic pipe was okay if usedproperlyandexaminedbytheinspectorindepth.
4r. Husnik moved to recommend to the Council that they adopt the new Minnesota StatelumbingCode (June, 1969) by reference. Seconded by Mr. Kelling. Carriedinanimously.
r. Rehbein and Mr. Hill did not have a report ready on the Contractor's Licensingtdinance, but will try to have this by next month.
r. Cardinal had no report from the Council.
r. Lee Smith presented a petition for rezoning, accompanied by a check for $100.00.

r. Rehbein stated that it was not the Board's practice to approve blanket rezoning, ithout definite plans. Much discussion insued on the liquor store entrance beingessthan1,000 feet from the Methodist Church. Mr. Locher stated there is no
emit on the number of off -sale liquor stores in the Village but that there were
a more on -sale permits available. Mr. .with questioned whether he could get the
aw changed so he could build an off -sale store closer to the church. Mr. Locher

stated it would require an amendment to Ordinance 34 and Mr. Smith could make a
written petition to the Council stating his proposal. Both the rezoning and the
petition could be scheduled at the same hearing.
Mr. Cardinal suggested that the check and petition be turned over to the Council
so they can set up the necessary hearings before the Planning & Zoning and Council. Mr. Smith was also inquiring about permits for light industrial and was told byMr. Locher he must state the exact uses for proposed industrial plants and the
property rezoned for commercial could be given special use permits for industrial
operations.
A public hearing was held for Keith Apitz who requested rezoning of 175 ft. alongBirchStreetfromresidentialtocommercialwhichwouldresultinOrdinanceNo. 6T;
lengthy legal description on file in Clerk's office). Mr. Locher showed that allthenecessarylegalaffidavitswereinorder. Mr. Apitz stated that at present
the only commercial establishment was a shop to repair cars and to sell a few
snowmobiles. This is allowed under the present ordinance.
Mr. Husnik moved to recommend to the Council to adopt Ordinance No. 6T which would
result in rezoning to commercial 175 feet at 525 Birch Street belonging to KeithandJaneApitz, which allows only the present operation of a general service
repair shop. He would have to request further permits to add gas pumps at a
future date. Seconded by Mr. Kelling. Carried unanimously.
A public hearing was held to consider the application by Cecil LaMotte to plat asLaMotte's Third Addition land in Lino Lakes on Centerville Lake (lengthy legaldescriptiononfileintheClerk's office). Mr. Locher showed that all the legal
affidavits were in order.
Mr. Jerome Segal, Attorney for the St. Paul Water Department, and Mr. Bill
Meuwissen from the Water Department were present to contest the boundaries ofMr. LaMotte's plat. Attorney Segal stated that according to the legal descriptionMr. LaMotte's lots were overlapping on land owned by the Water Department alongCentervilleLake.
Mr. Locher stated that it is not the Board's duty to measure lot lines, only toseethattheplatfitsintotheoverallplanoftheVillage. It is up to theVillageEngineertoseethatplatsarecorrectasfarasdimensionsareconcerned. Mr. Gotwald had not yet checked this preliminary plat. The plat must also be
approved by the County Surveyor. W. Segal wanted to correct the plat before it
got to the final stages and also contended that the troubles began with LaMotte'sSecondAddition, of which he had not received a notice of the public hearing. Mr. Cardinal suggested Mr. Segal appear before the Council Monday evening to
present the alleged discrepancy of the lot line.
Mr. LaMotte had a lengthy explanation of how the disagreement over lot lines began
and stated that at one time he had offered to deed 24 3/4 feet along CentervilleLaketotheWaterDepartmentiftheywouldtakedowntheirfence. His offer was
rejected by the Water Department.
The Board agreed the lot line discrepancy should be worked out by professional
men.
Ur. Kelling moved to recommend to the Council that they accept the preliminaryplatforLaMotte's Third Addition. Seconded by Mr. Husnik. Carried.

Mr. Segal stated he would be at the Council meeting on Monday night. Copies of
these minutes will be given to Mr. Segal and Mr. LaMotte at the meeting.
Mr. Al Hammer requested permission to construct a modular home on Oak Lane. He
had been to the building inspector and bad been told to get an okay from the
Planning & Zoning and Council. Mr. Hill thought someone should inspect a model
home in Lexington Village since this was the first of its type proposed in Lino
Lakes. Mr. Husnik reed off the specifications of the house and Clyde Rehbein, in
the audience, stated that it sounded like it met all of the Village codes. He
stated that as long as it met the Village codes, it should be allowed without
further study.
Mr. Karth moved to recommend to the Council that if the modular home presented
by Al Hammer meets ALU the Village codes, the matter should be returned to the
building inspector and he be empowered to issue a building permit. Seconded by
Mr. Husnik. Motion carried unanimously.
Mr. Hammer was instructed to present a request for a variance to the Planning &
Zoning since his lot is less than 2 1/2 acres.
Mr. Clyde Rehbein and Mr. Russell Bakken presented a request for a variance to
straighten out the lot line between their adjoining properties. A portion of
Mr. Bakken's front yard was on Mr. Rehbein's property. Mr. Rehbein and Mr.
Bakken are exchanging property to make the lot lines more perpendicular to the
highway.
The Board felt that since no mnney was being exchanged and no new buildings erected,
the parcels exchanged would be considered as one variance.
Mr. Kelling moved to recommend to the Council that they grant a variance to Clyde
Rehbein and Russell Bakken on property exchanged between the two to straighten
out property lines and also to allow the parcel of land to be considered as one
variance, (lengthy legal description on file in the Clerk's office). Seconded
by Mr. Karth. Motion carried unanimously.
A- motion to adjourn was made by Mr. Husnik and seconded by Mr. Kelling at 10:10 p.m.
Motion carried.
