HomeMy WebLinkAbout07/15/1970 P&Z MinutesThe regular meeting of the Lino Lakes Planning &,Zoning Board held on July 15, 1970 was called to order by Chairman *Lean,at,8:05 p.m.. All members. were present except Mr. Jester and Councilmen Cardinal. Attorney Looker arrived about 8 :15 p.m. Mr. Rehbein moved to accept the June 17, 1970 minutes as presented. Seconded by Mr. Hill. Motion carried. Chairman *Lean asked :Mr. Hill and Mr. Husnik to report on their progress of studying a revised - building code. in Lino Lakes. l r:. Hill reported that they had made several contacts with neighboring suburbs and felt the trend was toward a uniform code for the Twin Cities and suburbs. They will continue to make con- toots and report further at the next meeting. Mr. McLean stated that his was a similar report on the zoning classifications for Lino Lakes. Mr. Tom Van Housen was in the process of obtaining Codes and zoning regulations from surrounding areas. Mr. Van Housen will meet with Mr. McLean, Mr. Kelling, and Mr. Karth in the near future to work on new zoning classifi- cations for Lino Lakes. Mr. McLean reported that the Verner Dahl trailer house had been removed. Mr. Nick Antinozzi and his son presented a survey of 25 acres, on Pine Street of which Mr. Antinozzi was deeding 6 acres to his son for the erection of a home. Attorney Locher could find no problem with the plat since it was over 2 -1/2 acres and fronted on a dedicated road. Mr. Antinozzi was directed to contact Mr. Dupre for a building permit. Chairman McLean questioned. the Attorney concerning parking mobile hones for sale on private property. Mr, Locher answered that parking without oecupying.is not restricted by our, ordinance. Mr. McLean asked Mr. Locher to report on the status of the discussion on the Plumbing Code since there has been much confusion as to whether plumbers are to abide by the old code, or the new Minnesota Plumbing Code and the additions to the code. The present Lino Lakes code is presented in Ordinances 47 and 48. It was felt that Lino Lakes should adopt.by reference the new Minnesota Plumbing Code which is a ecmbined code requiring only one ordinance but at the same time there are stronger points in 47 and .48 which should also be considered. It was felt we should have one code that is current and the fee schedule should be continued into the new code. Mr.. Locher will call Mr. vilittlidelest, the Plumbing Inspector, and ask him if he sees any comparison between Ordinances 47 and 48 and the Minnesota Plumbing Code. The State Code does not include cast irdn stubbing from the house to the street which the Board felt should be in the Lino Lakes code, along with a section on fees, licensing, and bonding. At 8 :30 p.m. Chairman McLean called to order the public hearing for Mr. Lee C. Smith who desired to rezone 4 parcels of land on I -3511 and Old Hwy 8. Also present with Mr. Smith were Attorney Virgil Herrick, Mrs. Crystal Ahlman, and Mr. Bill Ecoff, an interested developer. Attorney Locher showed that all the necessary. legal requirements were in order and read the legal descriptions of all 4 parcels. Fifty -six acres of the development would be an Industrial Park. One of the parcels would be aMotel- Restaurant complex and the rest would be a major shopping center, The present ordinance would have to be amended in order to allow a liquor storetobebuiltlessthan1,000 feet from the church door. Mr. Chester Wood, representing Gethsemane Methodist Church, stated that thechurchwanteditonrecordthattheywouldnowandinthefutureobjectto aliquorstorebeingallowedlessthan1,000 feet from the church door. Attorney Herrick questioned whether motels would be allowed under our presentordinanceandAttorneyLocheranswered "yes" as they would be considered thesameashotels, Mr. Sadttrequested that the rezoning to commercial with special use permits forlightindustrialbestatedsothatwhenLinoLakesdoeshavezoningforindustrial, his property could be rezoned to light industrial. He emphasized that at this time all his plans seem to fit into our present ordinance with special use permits. Chairman McLean explained explicitly to all present that we do not allow blanket rezoning and pointed out and read in detail portions of Ord. 21C which explainshoweverydevelopermustpresentdetailedplans, surveys and maps to thePlanningBoardbeforeanyrezoningisallowed. Attorney Herrick objected to parts of this saying it is impossible to know in advance exact desires of futurebuyers. Mrs. Ahbnen stated that it is important to get one building built for advertisingpurposes. Mr. Bill Eeoff was interested in building a Tool and Die shop on3acresofthesouthwest, corner of parcel C as located 012 the attached mad,.* Mr. McLean told Mr. Scoff it Wo ld be'neoeSserY to get a survey and, legaldescription. of these 3 acres before it eould Abe rezoned, Mr. McLean polled the Board members as to their feelings on the total rezoning. Mr. Korth felt we needed light industry in Lino Lakes and a Tool and Die shopfitintoourpresentordinance. Mr. Husnik felt they should start out byrezoningthesmallparcelfortheToolandDieshop. Mr, Scoff did not thinkitwaspossibletogetthisoutofthelargersection. Mr. Kelling stated hewasinfavoroflightindustrybutwecouldnotgiveblanketzoning. Mr. Smith's plans must fit into our ordinance and be contingent on the feelings of the residents near the location. lbs. Ahlman stated she had already taken around a petition which had been signed by 10 residents who were in favor of the pro- posal. Mr. Rehbein felt that verbally the Board was in favor of rezoning andthatwastherightplaceforaToolandDieshopbuttheyshouldhaveabetterplanfortherestoftheproperty. W. Rehbein felt the Village wants commercial property and also stated that speaking. for the church, the church would sticktothe1,000 ft. regarding the liquor store. Mr. Hill questioned the traffic flow off old Hwy 8 which would go into the major shopping center and wonderediftheStatewouldfeelitwastooclosetothe35`+I interchange. Mr. Smith answered that this was one of the problems that would have to be worked out. Mr. McLean felt favorably toward the plans but requested more definite plans. Mr. Scoff stated that perhaps he could detach his piece on 4th Avenue off the large parcel and redefine this parcel and asked what the procedure would be to have it rezoned. Mr. Rehbein moved to recommend to the Council that they rezone to commercial 3 acres on 4th Avenue as outlined on attached map, provided Mr. Scoff submits e survey map and legal description to the Council and that this be limited commercial for a Tool and Die shop. Seconded by-Mr. Haling. Motion carried. Mr. Smith recommended to the Council that in the near future they'should define light industrial zoning ". W. McLean told him that the Planning Board is working on this at present. The remainder of *. Smith's property will be considered at the August meeting, provided advance notice has been given that Ordinance 21C has been adhered to. Mr. McLean moved to recommend to the Council that the public hearing on theremainderofMr. Lee Smith's property be continued until W. Smith complies with Ordinance 21C and notifies the Council that he has done so 10 days in advance of a regular meeting, Mr. Locher will send notices to residents prior to the continued hearing. Seconded by Mr. Karth, Motion carried. Mr. Smith questioned the Board on their feelings toward a multiple high rise dwelling complex, excluding the sewer problem. Mr. Mclean felt that if it was planned properly and offered the proper services, the Board would prob- ably look favorably on such a plan. Mr. Keiling stated that he had no objection to a planned camnunity but would not be in favor of one that interferred with the visual rights of the present residents. Attorney Herrick questioned the procedure after the 3 acres have been rezoned to commercial. No special use permit is necessary; the Council would perhaps recommend that a building permit be issued. The publio hearing for the Smith rezoning was closed. Mr. Rehbein moved to adjourn at 10 p.m. Seconded by*. 'Ceiling. Motion carried. The "attached" map has previously been distributed to the Planning Board members and Council members.
