Adjourn (QC-) Lino Lakes Charter Commission 1 Jun95 RS Charter Chapter 8 Summary (not legally representative) Chapter 8: Public Improvements and Special Assessments 8.01 • Gives city power to make improvements • Limits assessments to: - Cost - Benefits received 8.02 • Charter governs improvements 8.03 • City to create ordinances, etc. to detail specifics 8.04 Subdiv. 1 • Initiated by >25% petition and majority of council; or, 4/5 majority of council • Detailed process for hearings, timing, etc. • Improvement stopped if: - Greater number petition against than proposed (or subsequent pro petition) - >50% petition against if proposed by 4/5 council Subdiv. 2 • Improvement must go to voters if general funds used Subdiv. 3 • Improvement start to commence between 60 days and 1 year (if costs exceed estimate by >10% must rebid) Subdiv. 4 • One year moratorium on improvement if disallowed 8.05 • Services can be assessed (mistaken reference of 8.03 instead of 8.04) 8.06 • If 100% of affected petition for, process can be expedited 8.07 Subdiv. 1 • Three economic districts to follow State Statute 429 Subdiv. 2 • Legal description of three districts Subdiv. 3 • Residential in these districts can petition out • Right lasts as long as property is residential Lino Lakes Charter Commission 1 Jun95 BD/RS d' Option 3: Abandon § 8 with Safeguards • Leave intact: 8.01 - Gives city power to make improvements - Limits assessments to Cost and Benefits received 8.02 - Charter governs improvements 8.03 - City to create ordinances, etc. to detail specifics A, • Eliminate 8.04 - 8.07 • Replace with: k{ 8.04 - Assessment value in excess of the lower of: - 10% property value }�P S-k, - $25K ` be deferred until sale and/or subdivision of property (at which time deferred assessment and charges due in full) 8.05 - Assessment billed allowed to be spread over minimum of 10 years 8.06 - Improvement costs not covered by assessments may be funded through general funds INDIVIDUAL BENEFITS • Cap on assessment billed • 8.01 reiterates benefited maximum (redundant to SS 429) • Provides minimum time assessment spread over (redundant to policy) • General funds allowed to be used for public improvements • General fund (and improvement in general) usage still subject to §5 referendum privileges PUBLIC BENEFITS • Eliminates complicated and tangled language of §8 • Allows general funds to be used to finance improvements • Makes easier for city to plan, coordinate, and manage improvements INDIVIDUAL NEGATIVES • General funds allowed to be used for public improvements • Assessments could be forced to value benefited (cap also limits) • Allows city to plan and execute improvements (public good vs. private good) PUBLIC NEGATIVES • Cap still ties hands on improvement projects • Referendum privileges inject uncertainty L. 1 Lino Lakes Charter Commission 1 Jun95 IRS Election Timetable To place charter amendment on fall ballot: 7Nov95 Election 12Sep95 Ballot Issues - Exact Language Due To amend through Council: Leadtime additions: - 30 days effectivity wait after readings - 2 readings, 2 weeks apart Need council approval in 1OJul95 meeting
