HomeMy WebLinkAbout06/16/1971 P&Z MinutesThe regular meeting of the Lino Lakes Planning and Zoning Board held on June 16,
1971, was called to order by Chairman John McLean at 8:10. Other members present
were Messrs. Husnik, Kelling, Jester, Rehbein, and Hill. Also present were
Attorney Locher and Council Liaison Cardinal.
Mr. Jester moved to accept the minutes of the May 19, 1971
Seconded by Mr. Hill:, Motion carried.
Mr. Ray Pfeiffer of the Naegele Outdoor Advertising Company has made application
for three sign permits No. 82, 83, and 84, on 80th Avenue along 35E. The property
owner is Anna Schmidt. All signs will be 12 x 25 with total area being 600 sq. ft.
and will have fluorescent lighting. Each sign will be all steel. Mr. Pfeiffer
reported that fees have all been paid. He also said their lease is for five years,
Mr. Jester moved that we recommend to the Council to grant application to the
Naegele Advertising Company for permit no. 82, 83, and 84. Seconded by Mr,
Kelling. Motion carried.
The Keith Apitz rezoning hearing was continued from the last meeting. Mr. Locher
reported that notices had been mailed. Mr. McLean read the letter from Mr.
Van Housen to the Clerk dated June 14, 1971. Mr. Apitz presented his revised
maps., Mr. Kelling said he felt the objections had been taken care of. Mr. Hill
asked about gas ventilation and Mr. McLean told him that Ordinances 21C and 55
pertained to this.
Mr. Kelling moved to recommend to the Council for the rezoning for limited use
including the following recommendations: that there be blacktop south of the
new proposed station area all the way to the street; that plumbing and sanitation
facilities be provided as in state regulations; that a crushed rock drive to the
rear of the building be provided; that the building as presented is a pole building
with one inch thick styrofoam and one inch thick Nu -Wood and a painted steel
exterior; that there will be color and treated exterior as on the drawings; that
all work will be in accordance with 21C on the plan; that the south garage door
will be moved east to provide as much clearance as possible; that it does not
include any reference to signs; and that the applicant further agrees that
customer's vehicles will be removed from the premises and kept at a minimum,'
Seconded by W. Hill. Motion carried. A copy will be sent to Mr. Van Housen
and Mr. Gotwald with a letter siting recommendations.
Representing Midwest Radio - Television, Inc. were: Mr. Fred'Memmer, Attorney;
Mr. John Sherman, Engineer; Mr. Lawrence Haeg, President. Mr. Locher stated that
notices of the public hearings on the question of the special use permit. Mr.
Locher recommended we continue the hearing and also recommended limited commercial
zoning. Mr. Sherman reported that the tower will be 1,199 feet high and have
three guy wires so that if it should fall, it would wind down within the guy
wires. All who received notices were seen. The tower takes a 2,000 x 2,000 ft.
area and they stated that the land would remain open land.
They stated that they still have to get authorization from the FAA and the FCC,
but that they wanted authorization from this committee before moving up further
to the FAA and FCC.
Mr. Hill asked about the transmission power. He was told that it does not
interfere with reception of any other radio or television.
Mr. Haeg stated that they would like to locate in this area because the signal
strength can easily be received when moved into the center of the population.
He also stated that W000 is a 50 kilowatt clear channel station.
They would construct a building that would house two 50,000 watt transmitters`
valued at about $75,000 to $80,000 a piece. Mr. Rehbein asked about the tax
structure. He was told that it would be taxed as commercial property and that
they get no special exemptions.
They said that the land would be left in its natural state or that they would do
reforestation to beautify it.
Entrance to the tower would be on Holly Drive. Mr. Sherman said that there
should be no extra traffic problems. After construction, the most traff ie should
be two oars going in and out. The base of the tower and the bases of the guy
wires would be security fenced.
Mr. Haeg stated that they would like to become residents of Lino Lakes.
It was reported that it would be illegal for them to do any construction with
the FCC until they are granted a permit. They don't know exactly how long it
will take to get a construction permit.
Mr. Rehbein moved to recommend to the Council to approve the special use permit
they are asking for but not of leaving the zoning as is and that adequate plans
be presented. Mr. Hill asked if something could be worked out for park or
recreation. He was told that there would be a triangular fence surrounding the
guy wires. Motion seconded by Mr. Kelling. Motion carried. Mr. Locher also
mentioned that the legal posting should be satisfied.
The hearing for the Zoning District Code was held. Mr. Locher read the affidavit
of publication from the Forest Lake Times It was mentioned that it would provide
for many more breakdowns than the other zoning classifications. After some
discussion Mr. Jester moved that it be tabled until the next meeting until we
get a chance to read it. Seconded by Mr. Hill. Motion carried. Mr. McLean
moved that the hearing be continued until the next meeting when they should be
prepared to act. Seconded by Mr. Hill. Motion carried.
The Ken Rehbein hearing will be continued until the next meeting.
The meeting of June 2, 1971, was not held due to the inavailability of Mr. Hawkins.
The matter of the wetlands ordinance will be taken up with the Park Board.
Mr. Hill asked about helicopter practice landings that are being made. Mr. Jester
said that we should recommend to the Council that they investigate this and the
FAA regulations on use of helicopters.
Mr. Jester asked whether the Park Board has come up with a proposal with the
land use ordinance. Mr. Hawkins said they now have another model to consider
for the ordinance.
Mr. Rehbein moved to adjourn at 10 :42.
