HomeMy WebLinkAbout12/15/1971 P&Z MinutesThe regular meeting of the Lino Lakes Village Planning and Zoning Board was called to order at 8 :00 P.M., December 15, 1971, by Mr. McLean. All members were present. Mr. Cardinal was absent due to illness. Mr. Karth moved to accept the minutes of the November 17th meeting as pre- sented. Seconded by Mr. Kelling. Carried unanimously. The applicants requested removal of the sign applications from the Agenda. They asked thlt,they be postponed until February. Mr. Locher advieed he had not had the opportunity to review the new state code for placement of signs. He had talked to the Mayor about it and it.waa felt the revision Wea that they can only be located on commercial or industrial zone areas. It would be expensive to zone a small area, but that might be just the idea. He will check further into this and have a report for the Jantiry meet- ing. Mr, Keith advised that Naegele was to have a meeting with the state on Monday. Mr McLean said he would call Naegele then and see if anything had developed and let Mr. Locher know. There was general discussion as to the square footage allowed in the code book for different dwelling unite. Mr. Kelling felt the 800 ft. code for a single family dwelling was a carry over from en old code. It was to help older and younger couples. Mr. Rehbein thought this was upgraded to about 960 eq. foot at zone time. He felt the minutes would show it although it was never carried over to the code book. Mr. Kelling end Mr. Jester thought they remembered something to this effect too. Mrs. Thiltgen was Clerk at the time. Mr. Kellirl thought some kind of a compromise was needed. A two bedroom dwelling was not necessary for older couples, and the present code makes no provision for any- thing less except in a single family dwelling. It was recommended that the Clerk - Treasurer ask the building inspector if the garage on the Rogalle property had a building permit, and if it is situated right according to the code. There was discussion as to what the sheet metal building is that is on Highway 49, on the property next to Dick Olson's house. Did the owner have a permit to put this up, and what is being done back in that swampy area. 8:30 Hearing on the request for a Special Use Permit for Eugene M. Jerdee and DeLores L. Jerdee, to allow them to operate a small engine repair shop, et 899 West County Rd. J. The Affidavit of Mailing is dated December 3, 1971. M. Jerdee indicated he will sell and service Jacobsen lawn and snowblower equip- ment, but will neither sell nor service snowmobiles. It is not a full time job as he works for the Village of Blaine. He took out a building permit (# 245) in September for a pole -type building, but did not put up that sort of structure. He says the sign he has up is 4x2. He has done eadensive grading for lawn and road improvement end plans to fi11 it in in the spring. There had been some question from neighbors as to why he was grading. They had wondered if he planned to expand, and they were wary that this might entail e; great deal of noise. He said it was solely for landscaping purposes. He isn't requesting rezoning, just a special use permit. Mr. Husnick moved to recommend the Special Use Permit be granted to allow them to operate a small engine repair shop, not to include snowmobile engines, and to sell.'lawnmowers, garden tractors and snowblowers, new and used, within the existing buildings, subject to annual inspection as to compliance. Seconded by Mr. Hill. Carried. 2 12/15/71 There was discussion with Mr Van Housen as to the advisability of changing the code es to square footage for R1 and R3 dwellings. He suggested Ri is too low with 800 sq. foot. As to Chomonix problem with their townhouses falling short of the footage, under R3 they are qualifying by adding 100 sq. foot. It was suggested we will have to define exactly what is living area, Mr. Van Housen stated the lower level of a split entry or -split level is considered living area if it is intended to be used. Mr. McLean moved to lay over future discussion and study of Ri until the first of July, 1972, at which time the state code is supposed to be issued. Seconded by Mr, Kelling. Carried unenim. Hearing on application by F. L. Tagg and Lorraine M. Tagg, for rezoning from residential to commercial- general and limited business property situated at the southeast intersection of Highways 49 and 35W. Mr. Tagg advised this is a 67 acre land locked parcel, and he is presently negotiating with the Methodist Church for a 5 acre tract exchange in order to give him an outlet. He plans the building of a motel and restaurant, with the further projection of a shopping complex. He said he has checked and he has been advised he can get a highway access permit. Mr. Van Housen suggested he talk to Mr. Gotwald about any sewer and water problems that there might be. Mr. Van Housen advised him that he had a completely inadequate submittal. He wouldn't be able to get zoning on this whole parcel without knowing exactly what is planned. Mr. Tagg said that he would like a sign up on the extreme east end of the property, ad- vertising the motel, and he can't put one up until it is zoned commercial according to the state code. It was advised he could spot zone for the sign if there is a surveyor's description. Mr, McLean moved to recommend that his hearing be laid over for one month, for the January meeting of P&Z, if Mr. Tagg can come up with all required information for the planner and village engineer, and that their recommendations and the time requirement be met. Seconded by Mr. Hill. Carried unanimously. Hearing on Chamonix South, latest revision, December 1971, Outlot K, Townhouses Mr,.Gotwald submitted a letter, dated December 15, 1971, indicating he had re viewed the revised preliminary plat as to streets, drainage, sanitary sewer' and water system. Based on his findings he recommended approval of the pre - liminary utility and drainage layout. Mr. Van Housen indicated that 100 sq. feet have been added to the units to meet and exceed our requirements under the code, ,Private roads off of Birch St. and Lantern Lane are and will remain private, streets and will be privately maintained. Mr. Bill Meyer, Engineer, U„ S L$kes Development Co„ gave a short presentation indicating the areas of change. The ptOposed width of streets is 24 feet. A through street was eliminated to decrease traffic from Lantern Lane to Birch Street, Mr. Van Housen commented that he generally concurs with the plan except for minor variations. He advised that Birch Street will be busier in the future. He recommended that greater set back be made on building blocks 10 & 11. Visually this would be bettat from Birch Street. It would then require more screening. Mr. Van Housen advised moving back about 20 feet to make it a 50 foot set back, Mr. Van Housen also felt that the architecture on the exterior of the units wasn't as rustic as they indicated it was going to be. He was advised by Mr.. Brand that the units will be rough sawn and handshakes,, although this isn't shown on the drawing. There was general discussion. Mr. Hill asked if there was sufficient room for two car parking. They advised there was with one in the garage & one in the driveway. Mr. Kelling recommended to Council the acceptance of revised preliminary plat, dated December 1971, Outlot K, Lakes Addition #2, subject to various restric- tions, namely; setting back building blocks 10 and 11 another 20 feet, or 50 feet total, from Birch Street; screening more adequately on the south side of Block 11; and that roads be privately maintained and controlled by owners. Also that the whole layout be subject to approval by the engineer. Seconded by Mr. Karth. Carried unanimously. U. S. Lakes was also requesting a variance to put up a model:home, specifically building block 8, a 2 and 3 bedroom unit. After- discussion they were advised by Mr. Locher and Mr, Van Housen that a variance would not be necessary. Mr. Van Housen stated the home could not be used for occupancy however before sewer and water were in. It would only be built for model usuage at this time. Mr. Van Housen requested they revise their plat showing building blocks 10 and 11 set back for the December 27th Council meeting.. Mr. Van Housen gave an end of the year review of the Comprehensive Plan. He stated he has no authorization to proceed. A public hearing is necessary even though there is no rezoning involved, W. Van Housen recommended a closer look be taken at the oomprehenaive plan that's been submitted before we come to any conclusions that would come to a public hearing. Mr. Mclean stated that getting this straightened out should be our number one goal after the first of the year. Mr. Karth moved to recommend to the Council that they retain Ton Van Housen for at least another year to assure adequate continuity of his services in the above regard. Seconded by Mr, McLean. Carried unanimously. Mr. Jester moved to adjourn at 10 :25 P.M. Seconded by Mr. Hill. Carried unanimously.
