HomeMy WebLinkAbout03/15/1972 P&Z MinutesThe regular meeting of the Lino Lakes Village Planning and Zoning Board was called to order at 8 P.M. on March 15, 1972, All members and Mr. Marier end Mr. Locher were present. Mr. Kelling approved the minutes of the February 16th meeting as submitted. Seconded by Mr. Karth. Carried unanimously. Mr, McLean read a letter from the Clerk, dated March 7, 1972, to Mr. Oscar Ramberg of the Northwest Saddle Club. It stated that a third 90 -day temporary trailer permit would not be issued, due to lack of construction, It was also noted that the Club is in violation of Village Ordinance No, 6Q and that the trailer house should be removed immediately. Mr. McLean noted that the Saddle Club's Board will appear at the next Council meeting and tell of thirr plans. A letter dated March 9, 1972, from the Clerk to the P&Z, was reed regarding a split of property by Mr. Liehtsoheidl into two small lots, less than 2 1/2 acres each. No variance was secured. It was suggested that there could have been deeds of record in progress before our ordinance. The building permit was issued in August 1971. It was recommended that Mr. Locher look into this matter and advise of his findings to the Councils Skelly Oil is requesting a variance for sign permit #53 to increase the height of their existing sign. There is no application for variance in the records. The gentleman representing Skelly presented the Chairman with a check in the amount of $25.00 for the fee. The total height of the sign they wish to in- stall is 64.9 feet, and our codes states a maximum height of 65 feet. The lighting will be from the ground up - externally lit. The structure and face will be all steel. The SKEW sign will be raised (without the arrow as shown on the drawings) with a FCC® sign underneath. The sign as it is now, is pretty well obscured by the pine trees, Mr. Hill raised the question if it should fall, what is the proximity to the ramp. It was felt that if the wind were such to knock this down, you could have a problem with any size sign. Mr. Kelling moved to recommend that the Council permit this variance upon the receipt of application. Seconded by Mr. Hill. Carried unanimously. 8 :30 P.M. Continued hearing on Forrest Tagg rezoning request. Mr. Locher advised that Notices of Public Hearings, Publication Notice and Affidavit of Mailing are all complied with. Mr. Tagg advised that he proposed to start his construction by doing the 20 unit center building first. He has the right of way secured from the church. The State gave permission for access onto Hwy. 8, Permit 72-9A-D6. The percolator and core tests have beeamade. The well was not complete on his plans, so he has to work some more with the Anoka Health Dept, on that. He said he would not like to have to delay now, other- wise they probably couldn't get started until fall. That wouldn't be finaneiall advantageous as you would miss the peak season. He plans 68 motel units but would just complete the main building this year, and the other two buildings next year. He feels he could have the one done in 90 days. He had new plans which the architect had just completed showing the landscaping. Mr, McLean questioned why he hadn't planned for a frontage road to run along the expressway and then push his plans back in a little further. Mr, Tagg felt it would push everything too far in, Also, he said the State indicated they were thinking about putting a rest area in on the south side of 35W in that low marshy land. It was suggested he may run into problems in the future as he is only 40 plus feet set back from the fence. Should a frontage road be put in there, he might have trouble. Mr. Gotwald's letter of March 15th 2 3/15/72 was read. He indicated 5 recommendations: 1. Direction of the surface water flow off the site should be shown. 2. Direction of Street surface grade. 3. North 24 unit building should be set back at least 60 ft. from the Highway property line as to allow for a possible future frontage road and the passage of utility improvements or fire fighting equipment. 4. Site investigation report and sewage system design are complete, but approval of the system by the Anoka County Health Dept. is necessary, 5. The final plan must have the approval of the Highway Dept. Mr. Van Housen's letter, received March 14, 1972, had 4 recommendations: 1. A letter from the Highway Dept. with access permit was needed. 2. Approval from the Village Engineer and Anoka Co. Health Dept's. must be bad. 3. Section 5.03 -A4 - Landscaping has not been complied with, 4. Section 5.03-81 - Certification has not been complied with by to the development is poor, unworkable and a traffic hazard as a congestion problem will surely develop. He also felt it is not the highest and best use for this land. He recommended Denial. There was discussion as to how much of this acreage should be included in the rezoning. Mr. Tagg wanted it all rezoned so he could put up a sign in the far northeast corner. It was figured this sign would be about 475 feet off the freeway. The State code doeai't allow for spot zoning and we are trying to get away from it, Mr. Tagg stated he plans to use the south 40 acres for recreational purposes, such as snow mobile trails, etc. He would like to erect two sign. One would be in the vicinity of the motel situated to attract attention of cars going north. He would like to have it 85 feet, but our code stipulates 65 feet. The one in the northeast corner would face the north to attract southbound traffic, Mr, Shearen moved to recommend approval of Mr. Tagg's application for rezoning with adherence to the recommendations stipulated by both the engineer and planner, and that it be restricted to limited commercial use for the motel and restaurant only. Seconded by Mr. Karth. Carried unanimously, Ken Rehbein's office building plans were reviewed. W. Hutchinson of the Anoka County Health Dept. submitted a letter dated March 13, 1972, with several suggestions for additional information or changes. Mr. Van Housents letter of Feb. 22, 1972, outlined a number of recommendations: 1. Section 5.0344 - Landscape Plan is not provided. 2. Section 6.14A - Limited Business District requires special screening. 3. Sewage Disposal System should be verified. 4. Two points of ingress - egress at Highway requires a permit from the State Highway Dept, 5. Section 7.03D) - As drawn lot is not blacktopped. His recommendation was to resubmit with revised plans and required approvals. Mr, Kurth, who was resenting W. Rehbein, indicated they will meet with the neighbors and put up whatever type screening they agree to. The long point of land on the south end will not be planted because it is drainfield, this will be sodded. A homeowner, Mr, Torp, had questions concerning the 20 foot utility easement and set back. He indicated he and another neighbor felt they would prefer tree screening as it would be of better value to the homeowner. At any rate, they would want a guaranteed maintained screening. Mr, Karth moved to recommend acceptance of the plans as laid out with the compliance of stipulations set forth by the engineer, planner and Health Dept., and with a screening agreement to be carried out within 90 days with the ad- 3 3/15/72 joining neighbors, and said screening to be installed within one year from the time of agreement. Seconded by Mr. Nadeau. Carried unanimously. A.A. Johnson Tool Building Addition plans were reviewed. Mr. Van Housen, in a letter dated February 22, 1972, recommended denial until revised plans would be submitted, and then upon their satisfactory review, approval. Mr. Gotwald stated in his letter of March 15, 1972, that the revised plat plan covers most of the required information as outlined in his letter dated Feb. 15, 1972. The site elevation will not be altered, therefore, the drainage plan for this addition is not necessary. He also advised that before a permit is issued for the installation of the septic tank system as shown that Mr. Johnson should submit a letter of approval from the Anoka County Health Dept. Mr, Van Housen' letter of March 13, 1972, approved the plans subject to the following: 1. Is the Sewage Disposal. System satisfactory to the Village Engineer since it is so close to the property line? 2. That the 2' blacktop mat is added throughout the parking lot in accordance with Section 7,02, 3. Add Eleven 11) 1 -1/2" - 2" caliper green ash or soft maple along street and highway as indicated in Spring 1972. Mr, Johnson asked if it is in the code that he must blacktop. Be said he would plan to but wondered if it had to be done righteway. Mr. Locher read 70.2, which states blacktop is necessary for commercial. Mr. Kelling questioned planting trees along Aqua Lane there. He said fences now trap the snow in the winter and cause it to pile up - trees would cause even more trouble, Mr. Karth advised eliminating ash or maple on Aqua Lane per Mr. Kelling's recommendation. The plans show blacktop extending from the east end of the building, Mr. Johnson asked if he couldn't sod that and move the blacktop out further, the reason being, he would like to expand in a couple years and it would be less expensive than to have to rip out blacktop. Mr. McLean advised that he have his architect or planner draw this in with red before the Council meeting to make it clearer what he plans. Mr. McLean also stated he should get the en- gineer or architect to bring the elevations up to date. They are not on these revised plans, but were on the first. Mrs. Swanson asked if the parking area is blacktopped, where is all the water in that area going to go? She stated there are no ditches along Aqua Lane, Mr. Kelling said there is a ditch that goes along Highway 8, with culverts all along under private drives. Mr. Hill noted that there might be a potential back up problem. Mr. Johnson said they were putting in a retaining wall with this in mind. Mr. Karth moved to recommend approval of the plans as submitted in accordance with the planner, engineer and Health Dept., omitting the trees on the north side of the building. Seconded by Mr. Shearen. Carried unanimously. Mr. McLean noted that a Mr, Burke had been mining or doing soil removal on village land without a permit. W. Locher indicated that the village engineer should be advised. Mr. Marier said he would look into this. W. Locher had received a letter from Mr. Hutchison's office regarding the filling being done at the Blue Heron. They indicated they were about done except for the final coverage. They are filling to make additional parking, with the first fill being a lot of refrigerators, etc., they then received 4 3/15/72 PCA approval. They are not encroaching on the lake and the later fill is primarily lumber. The County plans to investigate again. They noted the lumber is on top and should have been on the bottom, but substantial coverage will make it ok. It was noted that there should be fencing around the parking area so no one drives into the lake, Mrs. Swanson wondered why there was no cable connecting the posts in this area. Mr. Locher said they have been having an awful time getting the State to cooperate there and it is their job. Mr. Marier is going to bring this to the attention of the Council and advise that a letter be directed to Mr, Kowalsky in this regard. Mr. Locher advised that the people representing the Riding Stable on Birch St. did not show up at the last Council meeting and they have been issued a ticket for renting snowmobiles. A copy of a letter was received by Mr. Locher, with original going to Mrs. Lillian Wilson, from Mr. Hutchinaon's office, dated Feb. 23, 1972, advising her that the building still has not be ascertained. A special P810 meeting was set for Wednesday, March 29th, to discuss minimum building sizes, such as single family, townhouses, etc. Mr. Hill advised of Mr. Marier, Mr, Dupre and himself going to check on a two car garage, Gerald Hopkins wanted to bring into the Village. They de- cided upon inspection it was not up to our specifications and would be too costly for the owner to bring them up. They denied it. Mr. Locher advised that the Richard Roberts hog farm was inspected March 2, 1972. There were about 25 cattle and about 100 hogs present. The hogs were confined to three separate locations. Mr. Robert's son advised that they were feeding grain, etc.and "a little garbage ". He indicated they were going to market soon. NEC. r Roberts is to report to the Council next month. Roger Barnes and Mr. Myrum want to convert the use of their property from that of a furnace repair to a used car sales. They were going to be here to- night but didn't show up. Mr. Locher said he had talked to Mr, Tagg just before he left this evening and he said Victor A. Peterson would like to buy 20 acres on the north end of his farm. He would want to store metal building components, etc., there. He was to be on the agenda tonight but didn't come. Mr. Shearen moved to adjourn at 10 :30 P.M. Seconded by Mr. Hill, Carried unanimously.
