HomeMy WebLinkAbout05/17/1972 P&Z MinutesMay 17, 1972 The regular meeting of the Lino Lakes Planning and Zoning Board was called to order at 8:05 P.M., May 17, 1972. All members were present with the exception of Mr. Winiecki, who was out of town. Mr. Kelling made note of the fact that the April 19th minutes, Page 2, paragraph 4, quote him as saying we do not have rights in regard to Center- ville Lake, since the Water Dept. has the priority. He said, for the record, we do have some rights. Mr. Kelling moved to accept the minutes of the April 19, 1972, meeting as submitted. Seconded by Mr. Scherer. Carried unanimously. Mr. Scherer moved to change page 2, sentence 7, of the "Plumbing and Sewer Regulations Adopted on April 24, 1972 ", to read: Percolation test required to be submitted to the Village Engineer. (Omit sentence two of the paragraph in its entirity). Seconded by Mr. Karth. Carried unanimously. Clyde Rehbein asked how this sentence got into this regulation. Mr. Marier said this was an information type paper. The viltage plumber wrote it out, they passed on it, and it was overlooked. It is a human error. Mrs. Kohler asked if any certified engineer could take the required perco- lation test. She said she had waited two weeks because she couldn't get hold of the viltage engineer. Mr. McLean told her any certified engineer would be qualified. Our engineer would qualify any test. Jim Husnik and Clyde Rehbein noted that some land won't pass the percolation test under any circumstances, and yet a drainfield will work. There was general discussion along this line. Mr. McLean noted that the purpose of this meeting is not to discuss the state code and perhaps that could be done at the May 24th meeting. They 011 be discussing the minimum square footage at this meeting and the engineer would be present. This might be a good time to have a question and answer period concerning the state code. The Clerk was advised to send notices to all members concerning this meeting. Jim Bratland was present to discuss sign #20 access. This has been carried over many months. He said the shop supervisor in charge of this sign was no longer with them. There is no access to this sign for inspection and maintenance. A helicopter was suggested, which Mr. Bratland said they would make available to our inspector. It was suggested that he try and work out a land easement with the property owner. Mr. Bratland said he would work at this and have an aswer one way or another in a month. Mr. McLean advised that the frontage road on the east side of 35E, between Main Street and County Rd. "J ", is posted for 9 tons. The rest of this road is posted for 5 ton. The part posted 9 ton is obviously not constructed for that much since each spring (and he has obser ved it for two years now) it becomes a real problem. It takes all summer to repair it. Mr. McLean recommended that the Council have correspondence with the County concerning this stretch and find out the reason for the differing ton limits. If it is a higher tonnage for the business along there, then perhaps they should be assessed or something. 2 -May 17, 1972 Ken Rehbein requested a variance for a split on commercial property, Main Street and Old Highway 8. He wants to split Tract A and B for mortgage purposes. There was discussion as to the drainage problems, but past correspondence from the Engineer and Mr. Hutchinson stated that under the present circumstances it is all in order. Variance had been applied for on April 4th and fee paid. Mr. Nadeau moved to recommend that the variance be granted. Seconded by Mr. Karth. Carried unanimously. Bill Leonard request to extend 64th Street east to his property is being held over to the June 2Ist meeting. Fran Burque presented pi.ans for 100 x 150' tots to be located on the west side of 35E in Centerville. He was advised that he would have to meet the code, and that he should submit a plat and survey. Mrs. Kohler advised they are planning to build a home on Mound Trail, bordering Chomonix. She wondered what procedure was necessary before going ahead with plans. it was advised that she have a percolation test and if that is fine then they can proceed with building plans. Since this is a 21 acre piece there should be no problem. Since Surfside, Inc. and Mr. Roetman were not present as yet, there was general discussion concerning Mr. Marier's park proposal. Mr. Kelling advised that he goes along with Mr. Marier. This would tend to preserve what we have rather than putting in blacktopped roads, traits, etc., which eventually would destroy what we want to preserve. Mr. Marier said he would like to be back to the Council with this proposal in about a month, and would like any criticisms, additions or changes that anyone wants to offer. He noted that his proposal was based on securing easements between property owners and the village. Mr. Wilson's land filling on Highway 49, next to Dick Olsen's, was again discussed. Nothing has bran done concerning this and he is now hauling in more brush and sticks. Mr. McLean made note of the fact that we never see any land developed on plans we have looked at, in particular along the expressways. These obviously are speculations. They tie up land and hurry us and yet nothi'g develops. Glenn Rehbein asked if they are taxed commercial, and if they aren't they should be. He also asked if we could tie a time limit in with a building permit. Donald Lundgren requested variance for less than 21 acres and less than the required 150 foot frontage. He said he was told he didn't need a survey, just the legal description. Ordinance 21 -A says 150 foot frontage is required and he is asking for 120 ft. After general discussion the concensus was that if we set precedent, where do we stop. No minimum footage is stated in depth. Mr. Lundgren stated, that since he is giving this property to his son.in -law he will give him the extra 30 feet to comply with the Ordinance. Mr. Karth moved to recommend to the Council that they grant a variance at this location for less than 21 acres, with a 150 foot frontage, with Mr. Lundgren providing a revised legal description. Seconded by Mr. Kelling. Carried unanimously. 3 -May 17, 1972 Alvin Roetman requested variance to divide land to provide for a roadway into the back part of his property. After discussion, Mr. Nadeau moved to deny this request on the basis of the proposal as it stands. It is not on a dedicated roadway and less than 66 feet. Seconded by Mr. Shearers. Carried unanimously. The Board discussed several alternatives with Mr. Roetman. At 10:20 Mr. Shearen moved to adjourn. Seconded by Mr. Nadeau. Carried unanimously.
