HomeMy WebLinkAbout10/18/1972 P&Z MinutesThe regular meeting of the Lino Lakes Planning; and Zoning Board was called to order at 8 :12 P.M. on October 16, 1972. Present were Misters, **Lean, Kelling, Karth, Hill, Nadeau and Shearen. Mr. Farrand was absent. Mr. 'Metier was present as lieson to the Council. hile the Board members studied the minutes of the past meetings, Mr. Marier commended the Deputy- Clerk, Joan Heath, on the job of taking minutes. He noted he appreciated the thorough and clear way in which they were done. Mr. Karth moved to accept the minutes of the September 20th meeting as corrected: Page 3, line 1: first number should be 12Q Seconded by Mr. Shearen. Motion carried. Mr. Hill moved to accept the minutes of the Special October 11th meeting as corrected: Page 2: acreage chart on the bottom should read; Block 1 & 4 (on lake) Block 3 Outlot 1 Outlot G Block 5 Outlot L 2.3 acres 4 acres 5.8 acres 1.8 acres 7 acres 2.8 scree 13.8 acres Page 3, Paragraph 3, line 4: about $7.00 per foot, Delete $4.00 to $5.00 per foot. lconded by Mr, Shearen. Motion carried. There is only one major item on the agenda, that of U. S. Lakes replotting. roe have been presented with additional information. The Village Planner and ngineer also received these mops, but too late to get comments back on them. Mr. Busch explained the maps to the Board. The 'oest side can't be developed until sewer is in - they gust justify putting a park on that side for that reason. McLean mentioned that he felt the opinion of the people present at the last L,pecial .meetings was that they don't want a park in Addition 42. He noted ybe their planning theory isn't velif if people don't want it. Busch said they have no objection to putting a park on the Vest side really, but he felt a small number of people objecting wasn't really a sufficient ndication that it wasn't wanted. He noted there will be 180 residences. Page Two Parking was mentioned as a problem at this proposed park. gib'. Musch didn't feel it would be a problem. It would be a park for mothers to take their children ibr a walk end to maybe swim. He felt it would be premature to have a park on the lest side of the Lake as it doen't fit in with anything. W. McLean indicated the feeling of the Village was that the rest of the Village must be considered too. He suggested running the park inland from the lake so as to include more than lake activities. The area in candy stripe on the Projeoted map is only land the company owns by fee and contract ownership. Mh'. Karth asked what the objection would be to give the extra land in the buffer zone to the land owners. Yr. Busch felt it would be self defeating in terms of open space area and space. Also some would be so large and the taxes very great. Mt. Hill brought up the problem of mini bikes and snowmobiles on the buffer zone, also the construction of fences around. property. Mr. Busch felt the material used for the walkway wouldn't be suitable for mini bikes. People aren't going to come from all over the country to bicycle. He projected that if it worked it woad be continued throughout other areas. MoLean asked if other uses were considered for this buffer zone when making plans. Mr. Busch said more lots could have been put in. He also said it is not the same exact layout 88 was planned with townhouses. There was discussion as to public access tothe lake. The club house and marina Mould be private. The feeling of the members was that there should be one public access with boat launch, although usage of the Lire should be restricted es it is cr..ly about 350 acres. W. Musoh didn't think a power boat access was necessary. La lake is ideally set up for sail boating and small power boats. Mr. Hill asked what is the primary use of the lake, fishing, recreation, etc? W. Busch said the company's idea is that the lake be reasonably versatile to the people in the area. He said the club house will be built first and then the marina. The marina will be confined to small power crafts and sail boats. It was questioned how the Village would control the lake. Mr. Busch felt it was oremature for the Village to lay down any controls until they see what's bappenning. There was discussion as to the fishing in the lake. Mr. Kelling sold there were crappies in the lake years ago, and if it were sufficiently deepened there could be again. Jack IIielentheis said they have achieved a depth of 15-20 feet ix1 some areas. here was discussion concerning the walkways and the motorized vehicle problem also maintenance of such a zone. It was noted that there is no way to keep people off a public area. The problem of people throwing rubbish over the fence such a zone was discussed. There was discussion about changing the zoning from R5 to all Ri. Mr. Hill elt if they don't, it's possible to later change to a different system. Mr rich said the company has no objection to rezoning it all Rl. lLn. Beyer presented a proposed tissue overlay of the vehicular curve mentioned 77.ty Mr. VanHousen at the last meeting. He had felt the side distance was limited. Page Three lug; Merier went over the lots which W. Gottwald suggested as needing rill. W. Hill asked if the Park Board has any feelings on what they went in a perk. Mr. McLean felt they had not set down any criteria. W. Merier thought the Council would be in favor of a park system in one area rather then spread throughout an area. W. IGelling felt the P & Z Board should go on record as saying that they want powered vehicles kept at zero. There was discussion concerning the 7,000 feet of sanitary service extensions needed, also the assessment proposal. Mr. Busch said W. Carley hes all of that in his notes. He could see no need for another bond issue. Mt. Marier paid it would require a tax, or a levey or a bond issue. Mr. McLean read a letter from W. Gottwald regarding the sewer question. There was general discussion, also as it regarded fiscal relationship. Lakes was asked about sales in the vedelopment. They said the sewer problem has restricted sales. Only 23 out of 160 lots have been sold. Sales have been slow since February since the sewer problem appeared in the papers. M. Nadeau asked if expanding the sewer now will improve the system now. W. yer said yes, it would improve the flow. Mr. Nadeau noted it wouldn't make it ziy easier to handle and haul away. Mr. McLean asked if there was a covenant in the contracts with the individuals oatline a golf course as related to their lots. W. Musoh said no. gnether they had a legal case, he didn't know. Kelling coved that the Pllenning and Zoning Commission recommend to the Council that the two (2) applications for variance to our Zoning Code presented by U. S. Lakes be accepted provided that U. S. Lakes revises their applications as follayst 1. Both applications be revised to provide for R 1 zoning on all lands covered in the two applications. 2. Delete all open space or park proposal from the two applications 3. The platting be revised to utilize those areas that were designated as open space. 4. Revise East Shadow Lake Drive to suggested layout provided by U. S. Lakes. 5. The development and sale of lots be restricted to 75.80% of the presently serviced areas before proceeding to platted areas requiring extension of services. rylonded by Mir. Shearen. Carried with Mr. Nadeau voting no, as he didn't understand every aspect. W. Kelling moved secondly that the Planning and Zoning Commission recommend o the Council that they develop an open space or park proposal that will also provide public access to Reshnau Lake and that this proposal be presented to U. S. Lakes. U. S. Lakes after negotiation, will provide lands in their development to support this proposal in a quenitity related to their 10% requirement under our ordinances. Seconded by Mr. Karth. Motion carried Four unanimously, 1, McLean read a letter from Mr, Earl Kammerer, dated October 14, 1772, dealing with a variance granted to them September 25th. His question now deals with an easement into this property, and just what would be required should they want to build on their lots, br, Herter noted the minutes of the October 20th meeting spelled out his problem with dedicated roads, etc. Mr. McLean recommended forwarding the letter to Attorney Locher and ask that he give his coments to the Council. Mere was discussion of signs around the Village for which permits have not been obtained. Mr. McLean moved to recommend that the development !mown as Forjay on Hwy. 49, be required to provide development plans subject to the zoning ordinance prior to issuance of any further building permits. Seconded by Mr, Hill, Carried. Mr. Hill mentioned that Skyline Auto Body is now advertising that they sell gain dryers. He wondered if this is within their permit, since it is different than what they came in with. The feeling was that since it is zoned commercial we would have no control over what they sell. re was discussion on restrictions on target shooting. r. Kelling moved to adjourn at 10:20 P.
