DESIGN REVIEW BOARD MEETING
August 8, 1990
Chairperson Fred Chase called the regular meeting of the
Design Review Board to order at 7:00 p.m. at the Lino Lakes
City Hall. Members present were: Al Robinson, John
Bergeson, Fred Chase, Robert King, and Monika Slatten. Also
present were: Mayor, Harold Bisel; Council Member, Andy Neal;
City Planner, John Miller; and Planning Secretary, Laura
Elken.
CONSIDERATION OF MINUTES
Al Robinson said that he was not present at the July meeting,
but was listed as present.
John Bergeson said that he was given credit to suggesting
moving the handicapped parking stalls closer to the front
doors of Dean Quimby's site & building plan. Fred Chase made
the suggestion.
MOTION: Mr. King moved to recommend approval of the July 11,
1990 design review board minutes as corrected. Monika
Slatten seconded the motion and the motion was approved
unanimously.
VARIANCE, PHIL TAVINSKY, APPLICATION #90 -43
The applicant has purchased a 10.6 acre parcel of land at the
end of Holly Court in south - central Lino Lakes. He wishes to
build a single - family residence on the site.
Approximately three years ago Ken Lundgren subdivided four
parcels of land east of Holly Drive on a new road presently
named Holly Court. One of the parcels was subsequently
subdivided from one 20 acre tract to two 10 acre building
sites. On the attached sketch the area shown as "Parcel B"
was purchased by Tavinsky.
If it weren't for the wetlands on the property, the site
would be able to provide all of the required setbacks.
Because of wetlands however, the setbacks that are required
include setbacks from shorelines.
A letter from Tom Hovie from the DNR stated that he has no
problem with the issuing of a variance, because the site is
surrounded by wetlands.
Tavinsky has to obtain a variance before he can get a
building permit.
MOTION: Mr. King moved to recommend to the city council
approval of Application #90 -43, approving a variance from the
city's Shoreland Management Ordinance allowing Phil Tavinsky
to build to within 150 feet of the ordinary high water mark

and within 40 feet of the bluffline of Cedar Lake. Monika
Slatten seconded the motion and the motion was approved
unanimously.
MINOR SUBDIVISION FOR SECURE PROPERTIES, APPLICATION #90 -44.
Secure Properties, Inc. owns land adjacent to three quadrants
of the diamond interchange at C.R. 14 and I -35E. At this
time the applicant wishes to sell a portion of its land. It
has been discovered that the highway survey markers do not
correlate exactly with the legal descriptions. The attorneys
involved with this feel that the boundaries must be corrected
before the sale can be completed. Most of the changes are
less than a foot.
The land is planned for commercial uses.
For a clean title the attorneys want a correction. That is
the reason for the minor subdivision.
John Bergeson asked if this area is within the freeway
interchange study. It is within this area, and the applicant
is aware of the study.
MOTION: John Bergeson moved to recommend to the city council
approval of a minor subdivision for property located at C.R.
14 and I -35E as described in Application #90 -44. Al Robinson
seconded the motion and the motion was approved unanimously.
CONSIDERATION OF A SITE PLAN FOR ANOKA COUNTY CORRECTIONS,
APPLICATION #90 -45, AND CONDITIONAL USE PERMIT, APPLICATION
#90 -47.
Dick Fritsky and Scot Storm were present from Anoka County.
Dick Fritsky gave a brief description of the proposed
facility. He stated that the new facility will hold 50
juveniles. Because of changing laws you can no longer place
juveniles with status, or more serious juvenile offenders.
That is why there is a need for more juvenile housing. This
structure will also hold program and class room space.
The land is zoned Public - Semi - Public. The architect prepared
a plan that met all of the required setbacks, etc.
The building's area including the main and lower level is
31,896 square feet. The exterior will be brick with an
asphalt shingle roof. A total of 53 parking stalls will be
provided.
John Miller assured the board members that the plans will be
scrutinized by the State Department of Health and other
review agencies. The structures will be functional and no
health hazard etc. will be permitted.

John Bergeson asked about sewer to the facility. Mr. Miller
stated that city utilities are constructed just to the
facility, and should be extended yet this year.
MOTION: John Bergeson moved to recommend to the city council
approval of a site and building plan for Anoka County as
shown in Application #90 -45. Robert King seconded the motion
and the motion was approved unanimously.
CONDITIONAL USE PERMIT
MOTION: Robert King moved to recommend to the city council
approval of a conditional use permit for Anoka County for the
expansion of residential facilities at the correctional
facilities site in Lino Lakes, as outlined in Application
#90 -47. Al Robinson seconded the motion and the motion was
approved unanimously.
REZONING OF PINERIDGE ESTATES FROM R -1X TO R -5, APPLICATION
#90 -46.
This is the third request reviewed by the DRB with regard to
rezoning or variances for Rick Carlson's PineRidge Estates.
At the DRB's July meeting the board considered and
recommended against several variances for lot sizes in
PineRidge. In addition the board members recommended the
city council rezone the property from R -1X to R -1.
At the July 23rd council meeting the council members
discussed this item at length. They finally took two
actions: 1) denied the variance, and 2) suggested Carlson
ask for a rezoning from R -1X to R -5, Planned Unit
Development. The council was still concerned about the
housing issue, i.e. R -1X houses versus R -1 houses. The
council members agreed informally that rezoning to a PUD zone
would permit Carlson to build on the smaller lots but through
the PUD agreement be required to build to R -1X housing
standards.
The council set the public hearing for the rezoning for
August 27th.
The 1987 comprehensive plan amendment shows the land planned
for "Urban Residential" uses. This includes single - family
development on sewered lots.
The R -5 zoning district is the city's planned unit
development district. Lino Lakes has had one residential
PUD, the Rice Lake Estates subdivision.
A review of the R -5 regulations will show a lot of
requirements for colors of buildings, landscaping, and
parking lot information. Obviously this applies to
commercial and industrial projects. Most of this is not

addressed in the Rice Lake Estates PUD agreement and
shouldn't be included in an agreement for PineRidge.
Section 5, Subd. 9 (3) (C) requires that a "Preliminary
Development Plan" be approved by the design review board.
This would include the preliminary plat and the landscaping
plan. It should also include the requirement that Carlson
build to the R -1X housing standards.
Fred Chase wanted to make it clear that a PUD is an overlay
district. Therefore, it is still considered a R -1X.
Mr. Chase stated another concern. He felt that a PUD should
be in the control of only one land owner or one group of land
owners. John Miller informed the board that Rick Carlson is
the only owner of the land, and when he does sell the parcels
to builders, a copy of the PUD agreement will be attached and
be adhered to.
Monika Slatten asked about improvements to Ware Road. John
Miller stated that in the short term no improvements will be
seen.
MOTION: Robert King moved to recommend to the city council
approval of rezoning of land known as PineRidge Estates from
R -1X to R -5 Planned Unit Development, Application #90 -46.
John Bergeson seconded the motion and the motion was approved
unanimously.
MOTION: John Bergeson moved to recommend to the city council
approval of a Preliminary Development Plan for PineRidge
Estates including 1) a preliminary plat for single- family
homes, 2) a landscape plan, 3) a requirement that all single -
family homes meet R -1X standards, and 4) provisions for a
temporary park with a 3.7 acre park land dedication. Mr.
King seconded the motion and the motion was approved
unanimously.
REVIEW OF THE PROPOSED COMPREHENSIVE PLAN
John Miller asked the board members for their comments to the
proposed Comprehensive Plan.
John Bergeson made reference to the fact that there is a need
to link the north part of Lino Lakes to the south part of
Lino Lakes. Trails would be a good way to link the two areas
together.
Mr. Chase addressed the issue of new developments. He stated
that there is a lot of attention to the new developments, but
the older developments sometimes get forgotten. Parks are
planned for the new areas, but maybe there is a need for a
park in an area that is older and consideration should be
given.

John Bergeson felt that reference should be given to the city
purchasing run down properties. The EDA (Economic
Development Authority) would have the power to purchase this
type of properties, and reference to that should be made in
the comprehensive plan.
John Bergeson also suggested that wherever the EDC is
mentioned, the EDA should also be mentioned.
The board asked about the time frame in going through this
draft. John Miller stated that the Metropolitan Council gave
the city two years to complete the plan. And that there is
no real hurry in completing it.
The text will be amended to show the above recommendations
and a new copy will be given to the board members.
The board members are asked to review this in detail and give
a lot of thought into what they would like to see in Lino
Lakes, and what they feel should be changed.
Mr. King moved to adjourned the meeting. meeting adjourned
at 7:47 p.m.
