Design Review Board
October 10, 1990
Chairperson Fred Chase called the regular meeting of the Design
Review Board to order at 7:01 p.m. at the Lino Lakes City Hall.
Members present were: Monika Slatten, Robert King, Fred Chase, and
John Bergeson. Absent was: Al Robinson. Also present was
Building Official, Pete Kluegel; City Engineer, Dan Boxrud; and
Planning Secretary, Laura Elken.
CONSIDERATION OF MINUTES
MOTION: Robert King moved to approve the minutes of September 12,
1990 as written. John Bergeson seconded the motion and the motion
was approved.
OPEN MIKE
No one appeared before open mike.
REVIEW OF A CONCEPT PLAN FOR THE WENZEL PROPERTY CONSISTING OF A
MIXTURE OF SINGLE FAMILY HOMES AND MULTI - FAMILY HOUSING LOCATED OFF
LAKE DRIVE.
No one was present to address the concept plan.
Background from memo written by John Miller.
Hokanson Plumbing from Blaine has agreed to purchase the 66 acre
Wenzel property located south of Elm Street and west of Lake Drive.
The Hokanson people wish to subdivide the land for single- family
residential purposes with townhomes adjacent to Lake Drive.
Kirk Corson, Hokanson's planner, has visited with homeowners
adjacent to the Wenzel land. Mr. Miller has advised Corson the
future development of the backyards of the Rice Lake Lane residents
would be an issue, e.g. should road access be provided so
subdivision of the one -acre lots can be completed. Corson is
meeting with the residents another time and after that meeting we
should have a good idea of what these homeowners want.
John Bergeson addressed fire access to some of the proposed
townhomes. The townhomes not to the very south, but the next ones
to the north appeared to be positioned so that emergency vehicles
may have a problem arriving at the site. The other board members
agreed.
MOTION:
Robert King moved to accept the concept plan with the following
contingencies:

1. Approval from the Anoka County Highway Department and
Minnesota Department of Transportation for all points of
access.
2. Approval of wetland preservation and drainage plans by
the DNR, USACOE, and Rice Creek Watershed District.
3. Reduction in density of the townhouses and submittal of
acceptable plans for the townhouses.
4. Resolution of the street issue with Rice Lake Lane
residents, i.e. subdivision of back yards.
5. Approval of a park and trail plan by the Lino Lakes park
board.
6. Completion of a street plan that eliminates the
rectilinear street pattern.
The motion was amended by John Bergeson and seconded by Monika
Slatten to add:
7. The fire access to be reviewed and approved by the Fire
Chief.
John Bergeson seconded the motion and the motion was approved
unanimously.
REQUEST FOR VARIANCE FROM ARV GEARMAN, APPLICATION #90 -54.
No one was present to address this variance application.
Background information from Mr. Millers memorandum to the board.
Ary Gearman aka A &G Enterprises is developing Rice Lake Estates.
Originally planned and partially developed as a manufactured home
project, Rice Lake Estates was rezoned as a PUD about two years
ago. As part of the PUD Agreement Gearman agreed to build the
larger "R -1X houses" including a 600 square foot garage.
When the lots were originally approved they were undersized with
lot widths of 70 feet. Setbacks were also reduced from the
required 30 feet to 25 feet.
The request before the board is for a front yard variance reduction
from 25 to 20 feet for Lots 8, 9, 10, 11, and 12 of Block 7.
Gearman states that because of the requirement for the larger
dwellings and the steep slope in the back yards, he cannot squeeze

a R -1X house onto these small lots. By locating the homes five
feet closer to the street, however, he can make a fit.
Pete Kluegel added that there are many mature oak trees and to
comply with the present setbacks it would destroy many mature
trees.
MOTION:
Monika Slatten moved to recommend to the city council approval of
a variance to allow single - family home construction to within 20
feet of the front lot line for Lots 8, 9, 10, 11, and 12 of Block
7 of Rice Lake Estates. The recommendation is based on the
findings of fact required by law. John Bergeson seconded the
motion and the motion was approved unanimously.
MINOR SUBDIVISION FOR GLENN LARSON FOR PROPERTY LOCATED ON BALDWIN
LAKE ROAD, APPLICATION #90 -53.
Glenn Larson addressed the board. He purchased a 16 acre parcel of
land located on the east side of Baldwin Lake Road in the very
southwest corner of Lino Lakes.
Mr. Larson wishes to build a single- family structure on the land.
No sewer or water is presently available. They also wish to sell
3.56 acres to their neighbors on the north, the Alexjew's. The new
land parcel would be combined with the Alexjew's 1.8 acre parcel
creating a new parcel 5.36 acres in size. In this regard the
action is really a "lot combination" rather than a "minor
subdivision" as no new land parcel is being created.
With this action the Larson's would retain 12.49 acres of land.
John Miller stated in his memorandum dated October 1, 1990 that
there is good reason to do this. About two years ago the city
approved a road and utility plan for Section 31. This plan was in
response to the development of Woodridge Estates. To assure that
the many small parcels in Section 31 would have access to utilities
and that a reasonable street pattern would evolve the city asked
Ron Stahlberg to prepare an overall plan for the area. By
purchasing the land the Alexejews will be able to better subdivide
their land in the future and to ensure use of all of the buildable
land in this area.
MOTION:
John Bergeson moved to recommend to the city council a minor
subdivision for Glenn and Patrice Larson for property described in
Application #90 -53 contingent upon:

1. Provision of wetland easements for the unbuildable
portions of the properties.
2. Combination of the 3.56 acre parcel with the existing
Alexejew parcel.
Mr. King seconded the motion and the motion was approved
unanimously.
REVIEW OF CITY CODE SECTION 1001.08, SUBDIVISION CODE, LOT
PROVISIONS /CITY ENGINEER, DAN BOXRUD.
Last month this item was discussed and the board members requested
that an ordinance be drawn up for review.
Dan Boxrud submitted a proposed ordinance to the board members
that would implement the lot dimension definitions.
The amendments would do two things:
1. Watercourses would be included in lots and not placed
in outlots.
2. Where lots have water they must still be within 10 feet
of required lot dimensions.
Dan Boxrud pointed out that if the watercourses were included in
the lots the city would not be liable for maintaining them as they
do outlots.
Mr. Chase asked about a sentence within subd. 1001.08. The
sentence states: Watercourses shall be protected by easements to
the anticipated high water level (as determined by the city). Mr.
Chase asked if a definition for normal and high water levels should
be incorporated into the definition section of the zoning
ordinance. He also suggested (as determined by the city) be left
out of the ordinance.
Dan Boxrud stated that the only reason he would prefer to leave in
(as determined by the city) is that several agencies may have
different criteria for the high water mark. If water levels are
established by the city we would have better control over that
area.
After further discussion a motion was made.
MOTION: Robert King moved to table this item because the board
wishes to have a clearer definition regarding what is the normal
water level and what is high water level. Monika Slatten seconded

the motion and the motion was approved unanimously.

Robert King moved to adjourn the meeting. John Bergeson seconded
the motion. Meeting adjourn at 7:37 p.m.
