HomeMy WebLinkAbout04/10/1991 P&Z Minutes1 1 1 DESIGN REVIEW BOARD April 10, 1991 Vice Chairperson Al Robinson called the meeting of the design review board to order at 7:00 p.m. at the Lino Lakes City Hall. Members present were: Monika Slatten, Robert King, Al Robinson and John Bergeson. Members Absent: Fred Chase. Also present was: Mayor, Harold Bisel; and City Planner, John Miller. CONSIDERATION OF MINUTES Robert King moved to recommend approval of the March DRB minutes. Monika Slatten seconded the motion and the motion was carried. OPEN MIKE: Linda Elliott, 2001 Otter Lake Drive approached the board. She had some comments regarding Oak Brook Peninsula. The board asked that she make her comments when the item is before the board. CONSIDERATION OF A MINOR SUBDIVISION FOR KEN & GAIL JUDD, APPLICATION #91 -09. Several years ago Jack Morehouse wanted to subdivide a small parcel from his 40 acre farm. The land was to be used by his daughter (Gail Judd) , as the site of a residence. At that time the city required a five acre division of land. Morehouse and his daughter agreed that if and when the land was sold for development she would deed back to him most of the five acres, keeping only the building site. Recently the design review board and city council approved a concept plan submitted by Jack Menkveld who has a purchase agreement for Morehouse's land. As agreed between Morehouse and his daughter most of the Judd land will be sold to the developer. Actually the Judd's will be retaining a parcel only 135 x 235 feet or just under 3/4 of an acre. The request before the board is the subdivision of the Judd property to allow the combination of about 4 1/4 acres with the adjacent 35 acre parcel. John Bergeson asked if park dedication would be due. Mr. Miller explained that it would not be required because the applicant is not creating any additional parcels. MOTION: John Bergeson moved to recommend to the city council approval of Application #91 -09 granting a minor subdivision for Ken and Gail Judd. No park fee is required. Robert King seconded the motion and the motion was approved unanimously. REVIEW OF A MINOR SUBDIVISION FOR OTTO & LYNETTE PATZOLDT, AND VARIANCE, APPLICATIONS #91 -10 AND #91 -11. 1 DESIGN REVIEW BOARD April 10, 1991 William Pierce, 6542 Central Ave., a builder that will be purchasing the two created parcels approached the board. The Patzoldt's live at 7157 Rice Lake Drive and wish to subdivide their one -acre lot for single- family residential development. The "back- half" of the Patzoldt's lot is adjacent to Second Avenue and has sewer available. A variance would be required for lot width. Mr. Pierce stated that a certificate of survey with the house location on it will be submitted to the city. MOTION: Robert King moved to recommend approval to the city council a minor subdivision as submitted by Otto & Lynette Patzoldt and described in DRB Application #91 -10. Approval is contingent upon payment of an $800.00 park fee. Monika Slatten seconded the motion and the motion was approved unanimously. MOTION: Robert King moved to recommend to the city council approval of a variance permitting the creation of two lots each having 75 feet of road frontage (a positive finding of fact was completed) as described in DRB Application #91 -11. Monika Slatten seconded the motion and the motion was approved unanimously. CONSIDERATION OF A MINOR SUBDIVISION FOR JOHN & SUZAN FITZPATRICK, APPLICATIONS #91 -13 AND VARIANCE #91 -14. John & Suzan FitzPatrick reside at 7109 Rice Lake Drive and wish to subdivide their one -acre lot for single - family development. The "back- half" of the FitzPatricks' lot is adjacent to Second Avenue and has sewer available. A variance would be required due to a 75 foot lot width. MOTION: Robert King moved to recommend to the city council approval of a minor subdivision as submitted by John and Suzan FitzPatrick and described in DRB Application #91 -13. Approval is contingent upon payment of an $800.00 park fee. John Bergeson seconded the motion and the motion was approved unanimously. SITE AND BUILDING PLAN FOR THE CENTENNIAL FIRE STATION, APPLICATION #91 -12, AND VARIANCE #91 -15. 2 1 1 1 1 1 1 DESIGN REVIEW BOARD April 10, 1991 This item was tabled because the architect was not present. CONSIDERATION OF A VARIANCE TO PERMIT PRIVATE STREETS IN OAK BROOK PENINSULA. APPLICATION #90 -66. John Miller stated that the city council has approved the preliminary plat for Bob Adamson to develop Oak Brook Peninsula. He stated that the city council also approved a minor subdivision for Marlin Hansen giving Bob Adamson access to his subdivision. The city has amended his variance application to include a request to construct a private bridge and road. The bridge and road would be an extension of Otter Lake Drive and give access to the five lot subdivision. Laurie Kinneberg addressed the board. She had several issues she brought up to the board. 1. Permits from DNR and RCWD have not been approved. 2. If the road were built it would fall within 50 feet of the shoreline, going against city code. 3. The road is in good condition now. If heavy equipment were brought in the area during construction it would ruin the road. Who would have to pay for the damages. 4. She is requesting that this item be tabled. Letters were distributed to the board members outlining these concerns. Bob Adamson addressed the board. He stated that he has applied and received permits from the DNR and RCWD for the plat. The only exception is that permits have not been given as of yet for the bridge. The agencies are waiting to see the designs of the bridge before permits are granted. He stated that the private road would both benefit the city and the private land owners. The home owners association would be responsible for the maintenance of the road. Laurie Kinneberg asked various road questions and received answers from the board and Mr. Adamson. MOTION: Robert King moved to recommend to the city council approval of the amended application #90 -66 permitting construction of a private bridge and road for Oak Brook Peninsula. 3 DESIGN REVIEW BOARD April 10, 1991 Monika Slatten seconded the motion. Mr. Bergeson had a comment. He is concerned about a homeowners association consisting of only five property owners. He felt that private streets are more appropriate in high density areas such as townhouse areas. He would favor public roads. Ms. Slatten asked if the homeowners association would be handed down to the new residents once people sold their homes. Bob Adamson stated that the homeowners association would be perpetual. He stated that the association would have well maintained streets and costs are slight. A private road is a benefit in selling upper -end homes. The motion was carried with Mr. Bergeson voting no. SITE AND BUILDING PLAN FOR THE CENTENNIAL FIRE STATION, APPLICATION #91 -12 AND VARIANCE #91 -15. Ellen Luken, Architect, reviewed the site plan. Some of the highlights of the new station are as follows: 1. Drive through station 2. Open parking area with separate reserved fire fighter parking area. 3. Considerable amount of landscaping. 4. A pine tree will be planted in the front for a Christmas Tree. 5. Three flag poles. Ms. Luken reviewed the floor plan to the board members. Mr. Bergeson asked which way the trucks exit the station. Milo stated that most of the time the trucks will exit onto Lake Drive from the front of the building. Occasionally, if it is a non - emergency situation trucks will exit from the rear of the building. The building will be all brick with perhaps some tile for accent. There is ample amount of accent lighting. Spotlights on trucks and walls will be lighted. Glass block sections will also be lighted. Al Robinson asked about the cost of this project. Milo Bennett 4 1 1 1 1 1 1 DESIGN REVIEW BOARD April 10, 1991 stated that the overall cost is within the city's budget. John Miller stated that a variance is required for the driveway width. The fire department, like the school district uses long vehicles. One driveway is proposed to be 30 feet wide and the other 32 feet wide. The city maximum is 26 feet. MOTION: Monika Slatten moved to recommend to the city council approval of the site and building plan for the Lake Drive Fire Station as outlined in Application #91 -12. John Bergeson seconded the motion and the motion was approved unanimously. MOTION: Monika Slatten moved to recommend to the city council approval of a variance request to permit construction of driveways measuring 30 and 32 to the Centennial Fire District Station. No. 2, as outlined in Application #91 -15. John Bergeson seconded the motion and the motion was approved unanimously. NEW BUSINESS John Bergeson asked that the board review driveway widths within the city code book. Al Robinson suggested the board review the park dedication ordinance, particularly regarding public structures. Mr. King moved to adjourn the meeting. Monika Slatten seconded. Meeting adjourned at 8:00 p.m. 5
