HomeMy WebLinkAbout10/09/1991 P&Z Minutes1 1 1 The design review board was called to order by the chairperson Fred Chase at 7:00 P.M., at the city of Lino Lakes City Hall on October 9, 1991. Robert King, Fred Chase, Monika Slatten and John Bergeson answered to roll call. Mr. Al Robertson was absent. The city planner, John Miller and support staff Joyce Lund also were present. CONSIDERATION OF MINUTES Robert King moved to approve the September 11, 1991 design review board minutes. Monika Slatten seconded the motion and the motion was approved unanimously. OPEN MIKE No one was present who wanted to speak under open mike. CONSIDERATION OF VARIANCE, DRB APPLICATION 91 -29 FOR JOHN P. KENNY John Miller has been in contact with Mr. Kenny and has been informed negotiations are progressing and Midwest Cable and Satellite is willing to sell or lease land that will enable Mr. Kenny to build the accessory building requested in his application. Mr. Miller requested that the DRB Application 91 -29 be tabled until November 13, 1991 when the agreement will be in writing. Robert King moved to table DRB Application 91 -29 until the November 13, 1991 meeting. John Bergeson second the motion and the motion was approved unanimously. CONSIDERATION OF THE PIPELINE ORDINANCE John Miller informed the board that he has not been able to find the answers to the questions brought up by the design review board at the last meeting. Mr. Miller requested this item be tabled until the November 13, 1991 meeting. Robert King made the motion to table the pipeline ordinance until the November 13, 1991 meeting. Monika Slatten seconded the motion and the motion was carried unanimously. CONSIDERATION FOR REZONE, DRB APPLICATION 91 -39 FOR HOKANSON DEVELOPMENT, INC. Hokanson Development, Inc. has purchased property on Birch Street between Black Duck Drive and Ed Vaughan's property. The land purchased by Hokanson Development is zoned R -1. Recommendation No. 25 of the city's 1991 comprehensive plan amendment refers to this property and states it should be zoned R -1X. The city council voted (5 -0) to table the concept plan until Hokanson Development petitioned to have the property rezoned to R1 -X. The petition has been received and the decision to rezone the property is before the design review board. Rezoning of the property from R -1 to R -1X is necessary for the concept plan to be reconsidered by the city council. 1 DESIGN REVIEW BOARD OCTOBER 9, 1991 John Bergeson moved to recommend to the city council a rezone for DRB Application 91 -39 for Hokanson Development, Inc. to rezone the property from R -1 to R -1X. Robert King seconded the motion and the motion carried unanimously. CONSIDERATION OF A MINOR SUBDIVISION, DRB APPLICATION 91 -40 FOR GERALDINE AND ALLAN LETOURNEAU, GLORIA AND JOHN MCLEAN, LOIS AND RICHARD MORONEY AND MARLIN AND RUTH HANSEN The applicants own land known as Outlot B in Otter Lake Estates. They wish to subdivide the parcel into two separate tracts measuring 3.62 and 9.9 acres. The smaller tract is shown on the survey as Tract A and is known as the island, and is surrounded by the Otter Lake Channel. Tract A is not buildable and the applicants wish to retain this land for recreational use. The applicants hope to sell the larger portion known as Tract B. John McLean addressed the board. Mr. McLean states that the intended subdivision of the land meets all of the requirements set by the city. The only concern the city has is that the land may, sometime in the future become tax forfeit and revert to the city or county. If the property remains whole, a lifetime easement would hinder resale. Geraldine Hansen LeTourneau addressed the board and indicated expenses thus far for property they hope to use for a recreational area. The applicants have been responsible for maintenance and the intended subdivision meets all of the requirements regarding road frontage and acreage. Marlin Hansen addressed the board. He told how the farm had been in the family since the turn of the century and the best way to keep Tract A in the family would be to separate it from Tract B. John Miller explained this is a grey area. The city has never before had a request where a parcel meets all of the area and frontage requirements but will remain unbuildable. Is it wise to create an unbuildable parcel? Mr. Miller has met with Bill Hawkins and his recommendation was to seek some other legal way to maintain the memorial, but Mr. Miller has no particular recommendation on how the situation should be handled. Fred Chase asked the applicants if the property is currently in joint ownership and does any of the applicants' land abut the property in question. The applicants said yes. Mr. Chase asked the applicants to pursue the issue of common property. Could a clause be added to the Otter Lake Estates homeowners association that would indicate the association would be responsible for maintenance. 2 1 1 1 1 1 1 DESIGN REVIEW BOARD OCTOBER 9, 1991 John Bergeson said the request to create recreation property was valid, there is no ordinance to prohibit the creation of this area and just because the city might get it back would be no reason for denial. John Bergeson made the motion to approve DRB Application 91 -40. Monika Slatten seconded the motion. Fred Chase said the city must consider a long term outlook, now there are third and fourth generation family close for maintenance but there is be a long term maintenance agreement that is needed. Mr. Miller said there are three issues here: 1) the loss that could be used in calculating lot areas in a resubdivision is very small, 2) the applicants will actually lose land and 3) if the city gets the land back (because of back taxes) the public works department most likely would be responsible for maintenance. The park board is not interested in small parks or in wetlands. If the applicants are willing and able to create this parcel and make it the responsibility of the homeowners association who will take care of it, the board may want to amend the motion and deed the property to the homeowners association of Otter Lakes Estates for future maintenance. Robert King made an amendment to the motion, the motion to recommend to the city council the approval of Application of a subdivision DRB Application 91 -40 and the property is deeded to Otter Lake Homeowners Association or some other Otter Lake land owners group. John McLean asked for time to organize the paperwork. The board indicated that is appropriate and the motion was carried. CONSIDERATION OF SITE AND BUILDING PLAN DRB APPLICATION 91 -42 AND VARIANCE DRB APPLICATION 91 -41 FOR LYNN AND TERESA WEINKAUF Teresa Weinkauf addressed the board. The applicants are currently operating TRW's Tax and Accounting Service in a building leased from Palico Inc. and have purchased a residence at 7395 Lake Drive with the purpose to change this residence into a building for commercial use to house the Tax Service. John Bergeson asked the reason for the fenced area. Mrs. Weinkauf explained that another business - B G Bazaar operates there as well. The fenced area will be where the Bazaar will keep items for display and the area will not be used for storage. John Miller said the applicants will need a site and building plan for the addition to the front of the structure at 7415 Lake Drive, a variance because the building is within 50 feet of Lake Drive. DESIGN REVIEW BOARD OCTOBER 9, 1991 These two issues are contingent of eight provisions and six findings of fact, and recommended the board approve the site and building plan and the variance. John Bergeson asked how much parking would be needed for two businesses to be within the ordinance requirements. Mr. Miller said there will be seven spaces: three on the drive and four on the northeast corner of the building and the total is within the city zoning ordinance. There will be 1512 square feet with the new addition, the ordinance requires 4/5 parking spaces per 1000 square feet, so the number of spaces meets the requirement. Mrs. Weinkauf said the business will be open from 10 A.M. to 8 P.M. As property owners there were two issues that they will question - 1) Mr. Miller suggested curbing and this is quite expensive and could stop drainage, could wheel stops be used instead, and 2) the signage limit, because later on they intend to put awnings with a logo onto the building. John Miller said we require business within the city to put in concrete curb. The awnings with a logo pose no problem. Robert King moved to recommend to the city council a site and building plan DRB Application 91 -42 for Lynn and Teresa Weinkauf with the eight provisions and six findings of fact as listed by city planner, John Miller in the staff report with the excnotion of item 3 changing the business hours from 10 A.M. to 8:00 W.N. John Bergeson commented that concrete curb could be engineered as such to be different heights to allow for proper drainage. Mrs. Weinkauf stated she applied for a permit for the driveway from the state and it did not require concrete curb. Mr. Miller stated the driveway was a state issue and curb was a city issue to control drainage on the site and to show limits of the parking area. Mr. Chase said cost was basically the concern of the applicant, however the board would act on the ordinance and how they effect residents in the future. John Bergeson asked if it was feasible to install curb after the black top was in. Mr. Chase said the applicant would have to get a building permit and staff would follow -up on that issue, but there would be time to install the culvert and road before winter. The motion carried. 4 1 1 1 1 1 1 DESIGN REVIEW BOARD OCTOBER 9, 1991 Robert King moved to recommend to the city council a variance at 7395 Lake Drive for the business of TWR's Tax Service being within 46 feet of T.H. 49, DRB Application 91 -41 for Lynn and Teresa Weinkauf based on the six findings of fact as outlined by city planner, John Miller. Monika Slatten seconded the motion and the motion carried unanimously. CONSIDERATION OF SITE AND BUILDING PLAN DRB APPLICATION 91 -43 FOR TOM MOLIN Jack Molin addressed the board. The applicant wishes to construct an accessory building, 24 x 36 feet, to store concrete and other material used at Molin Concrete Products. Robert King moved to recommend to the city council a site and building plan limited to construction of a 24 x 36 accessory building DRB Application 91 -43 for Tom Molin. The motion was seconded and carried unanimously. CONSIDERATION OF SITE AND BUILDING PLAN, DRB APPLICATION 91 -45 AND A VARIANCE DRB APPLICATION 91 -44 FOR BEATRICE SALBERG John Miller reviewed the issue. The applicants own several parcels of land and wish to split a 50.2 acre parcel to make a 11.3 and a 38.9 parcel so that another rental residence can be constructed. The variance is required because there is less than the required minimum lot depth for any lot facing Rehbein Street which would establish a jog in the road. Robert King moved to recommended to the city council approval of a minor subdivision DRB Application 91 -45 for Beatrice Salberg with a recommendation that lot depth be 135 feet to eliminate the jog in the road. Monika Slatten seconded the motion and the motion carried unanimously. There was a motion to recommend to the city council approval of a variance for lot creation with 80 feet less than the required frontage DRB Application 91 -44 for Beatrice Salberg to include the six findings of fact as stated by John Miller in the staff report. John Bergeson seconded the motion and it carried unanimously. ZONING ORDINANCE John Miller congratulated the design review board on a job well done on completion of the zoning ordinance. The ordinance needs a cover page, a page in the back for the signatures and an index. The board has not had time to go through the entire ordinance and will do so looking for final typos. Robert King recommended to the city council the revised zoning ordinance with the possibility of typos. Monika Slatten seconded the motion and the motion carried unanimously. 5 DESIGN REVIEW BOARD OCTOBER 9, 1991 OLD BUSINESS There was no old business. NEW BUSINESS There was no new business.
