CALL TO ORDER AND ROLL CALL: Chair Tralle called the Lino Lakes Planning and Zoning Board meeting to order at 6:30 p.m. on May 14, 2014. 2. APROVAL OF AGENDA The Agenda was approved as presented. 3. APPROVAL OF MINUTES: April 9, 2014 Mr. Masonick made a MOTION to approve the April 9, 2014 Meeting Minutes. Motion was supported by Mr. Root. Motion carried 5 - 0. (Mr. Tralle and Mr. Evenson abstained.) 4. OPEN MIKE Chair Tralle declared Open Mike at 6:32 p.m. There was no one present for open mike. Mr. Hyden made a MOTION to close Open Mike at 6:33 p.m. Motion was supported by Mr. Evans. Motion carried 6 - 0. (Tralle abstained.) DATE : May 14, 2014 TIME STARTED : 6:30 P.M. ACTION ITEMS A. CONTINUED PUBLIC HEARING for Century Farm North: i. Rezone property at 7880 Sunset Ave (PID 07-31-22-23-0004) from R- Rural to PUD-Planned Unit Development ii. Amendment to the Development Stage Plan/Preliminary Plat of Century Farm North Katie Larsen, City Planner, presented the staff report. Staff recommended approval of the rezoning and amendment to the Development Stage Plan/Preliminary Plat. Board discussion included traffic calming measures, park dedication fees and trail improvements. Chair Tralle declared the Public Hearing open at 6:57 p.m. Applicant Gary Uhde, Century Farm Development, 3157 Berwick Knoll, Brooklyn Park. Mr. Uhde commented that every city has a battle with park dedication dollars. Mr. Uhde likes to get resident input for park development. Shane Chatleain, 119 Robinson Drive, stated that he is the closest home to the new development. He expressed concern over traffic and encouraged traffic calming measures. Chair Tralle noted that the board and city staff will do their best to achieve the best result for the community. Mr. Hyden made a MOTION to close the Public Hearing at 7:01 p.m. Motion was supported by Mr. Evenson. Motion carried 6 - 0. (Tralle abstained.) Following discussion, the board agreed to add Condition #25 stating that traffic calming methods or controls will be installed on Robinson Drive. Mr. Laden made a MOTION to recommend approval of rezoning the property at 7880 Sunset Ave from Rural to PUD and amending the Development Stage Plan/Preliminary Plat of Century Farm N, based on the following conditions: 1. All comments from City Engineer letters dated May 7, 2014 and May 9, 2014 shall be addressed. 2. All comments from Environmental Coordinator letter dated April 1, 2014 shall be addressed. 3. All comments from Anoka County Highway Department letter April 21, 2014 shall be addressed except for the relocation of the driveway. 4. Approval from Rice Creek Watershed District shall be required at the time of recording the final plat. 5. A summary table created in Microsoft Excel by lot and block and outlots of lot sizes Planning & Zoning Board May 14, 2014 Page 3 APPROVED MINUTES (gross, unbuildable and net area) and setbacks (front, rear and side) shall be required. 6. The original approved PUD Preliminary Plat for Century Farm North shall be incorporated into the plan set. 7. Drainage and utility easements shall be dedicated over stormwater drainage areas including Outlot B. 8. Conservation easements shall be dedicated over wetland buffer areas as required by Rice Creek Watershed District. 9. Conservation easement language shall include allowance for construction of trails, parks, storm water management facilities, retaining walls, etc. 10. Outlots A and B shall be deeded to the City at the time of recording the final plat. 11. The developer shall draft the deeds for Outlot A and B. 12. A Petition and Waiver Agreement regarding public improvement construction and assessments shall be drafted by the City and signed by the owners. 13. A condition of the final plat for Century Farm North 6th Addition will be if the house located at 7880 Sunset Avenue were ever to be demolished or lose its legal non- conforming status, the driveway will be required to be relocated off of Robinson Drive. 14. The final plat for Century Farm North 6th Addition will require right of access dedicated to Anoka County. 15. The applicant shall provide documentation from RCWD approving the variance from the 25-foot buffer requirements. 16. A separate plan sheet indicating the wetland boundary, wetland buffer and conservation easement and location of wetland buffer signs shall be included in the plan set. 17. The house located at 7880 Sunset Avenue shall immediately hook up to municipal water and sanitary services when available. 18. The existing well located at 7880 Sunset Avenue shall be properly abandoned per state and local regulations. 19. The existing septic drain field located at 7880 Sunset Avenue shall be properly removed per state and local regulations. 20. Sheet C0, Title Sheet: a. The original PUD Preliminary Plat for Century Farm North shall be incorporated into the plan set. 21. Sheet C1-1, Grading, Drainage and Erosion Control Plan: a. Remove comment “Existing driveway to be removed-install new driveway to Robinson Drive.” 22. Sheet L1, Landscape Plan: a. The trail shall be shown on the plan sheet. b. A landscape buffer shall be shown between the trail and the lot line on Outlot A and the Park area. c. The developer shall be responsible for installing the landscape buffers along the trail segments, Lot 1, Block 3 and Lot 1, Block 4. d. A clear vision triangle shall be maintained at the intersection of Robinson Drive and Sunset Avenue. i. Remove 1 large boulevard tree and 2 black hills spruce on Lot 1, Block 3. ii. Remove 2 large boulevard trees and 1 black hills spruce on Lot 1, Block 4 Planning & Zoning Board May 14, 2014 Page 4 APPROVED MINUTES 23. Sheet PP, Preliminary Plat: a. The developer shall complete the density chart on page 5 of this report and include it on Sheet PP-Preliminary Plat. b. The stormwater pond dimensions on Outlot B do not appear to match the pond area shown on the grading plans. Please revise. c. The trail shall be shown on the plan sheet. d. The wetland buffer and conservation easement line shall be modified. e. Dimensions of Outlot A, Lot 10, Block 3 and Lot 1, Block 2 shall be modified. 24. Sheet 2 of 8-Certificate of Survey a. The Certificate of Survey shall in be included in the plan set. 25. Traffic calming methods or controls will be installed on Robinson Drive. Motion was supported by Mr. Hyden. Motion carried 6 - 0. (Tralle abstained.) B. PUD Final Plan/Final Plat for NorthPointe Develpoment Katie Larsen, City Planner, presented the staff report. Staff recommended approval of the PUD Final Plan/Final Plat for NorthPointe Development. Board discussion included noise mitigation, landscaping, and sidewalks. Larry Olson, representative for the developer, Tony Emmerich Construction, 1875 Station Parkway NW, Andover, MN. Mr. Olson commented on the noise standards. He stated that they will work with staff to address headlight glare from cars accessing the development. Mr. Olson noted that they are looking into maintenance-free berms for this development. Following discussion, the board agreed to amend condition 14B to include “landscaping.” Mr. Root made a MOTION to recommend approval of the PUD Final Plan/Final Plat for NorthPointe Development based on the following conditions of approval: 1. All comments from City Engineer letter dated May 8, 2014 shall be addressed. 2. All comments from Environmental Coordinator letter dated May 7, 2014 shall be addressed. 3. Approval from Rice Creek Watershed District shall be required prior to recording the final plat. 4. A Conditional Letter of Map Revision (CLOMR) shall be obtained from the Federal Emergency Management Agency (FEMA) prior to issuance of any grading permits for land located within the floodplain. 5. A Letter of Map Revision (LOMR) shall be obtained from the Federal Emergency Management Agency (FEMA) prior to issuance of any building permits for parcels located within the floodplain. 6. Conservation easements documents shall be drafted by the developer, approved by RCWD and the City and recorded by the developer. Planning & Zoning Board May 14, 2014 Page 5 APPROVED MINUTES 7. Conservation easement language shall include allowance for construction of trails, parks, storm water management facilities, retaining walls, etc. 8. Outlot A of the NorthPointe final plat shall be deeded to the City. 9. The developer shall prepare the deed for Outlot A. 10. The developer shall grade the park in accordance with the approved grading plan and provide top soil and seed per City specifications. 11. A Development Contract shall be drafted by the City, executed by the City and the developer and recorded by the developer. 12. A Declaration for Maintenance of Storm Water Facilities shall be drafted by the City and executed and recorded by the developer. 13. The developer shall submit HOA documentation to the City for review and approval. 14. Traffic Noise Assessment prepared by David Braslau Associates, Inc. a. Field monitoring data shall be collected to support the traffic modeling data in the study. b. The developer/consultant shall provide a cost benefit analysis and documentation for avoidance and mitigation efforts. Factors to be considered include increased setbacks, higher berms, landscaping and noise wall construction. 15. Preliminary Plat-Plan Set, Sheet 3-Preliminary Plat Index: a. The sheet shall be revised to reflect the correct Site Data related to Exemption Area and Wetland Area. 16. Preliminary Plat-Plan Set, Sheet L1-L2-Planting Plan: a. Landscape plantings on the berms along I-35E shall be provided. b. A cross section of the berms with landscape plantings shall be provided. 17. One full size set of the revised Preliminary Plat-Plan Set shall be submitted to the City. 18. One electronic copy of the revised Preliminary Plat-Plan Set shall be submitted to the City. Motion was supported by Mr. Evenson. Motion carried 5 - 0. (Mr. Tralle & Mr. Root abstained.) The board took a ten-minute break at 7:41 p.m. The board reconvened at 7:51 p.m. C. PUBLIC HEARING to consider amending sections of Chapter 1010 of the City Code relating to the regulation of signs Michael Grochala, Community Development Director, presented the staff report. Staff discussed the proposed changes to Chapter 1010 regarding sign regulations. Board discussion included: • Staff should look into illumination of permanent signs in residential districts. • Requirements for permanent wall signage should allow for business to choose which wall they prefer to have the largest sign. • Temporary signage should be enforceable by city staff. Planning & Zoning Board May 14, 2014 Page 6 APPROVED MINUTES • Sandwich boards are directed at pedestrians, usually located on a sidewalk. • Permits for sandwich boards are to ensure that requirements are met for size, material and location. • The permit for temporary signs will allow for off-premise signage, as permits will be parcel based and content will not be monitored. Staff agreed to address some concerns of the board and will draft changes for the next meeting. Staff recommended continuing the item in order for staff to draft the proposed changes. Chair Tralle opened the Public Hearing at 8:31 p.m. Connie Haukom and Candice Clark, American Legion, 7731 Lake Drive. Ms. Haukom stated that this is the time of year that the Legion displays flags. She said they received a letter from the LLPD regarding removal of signage and flags on the Legion property. She requested that numerous flags be allowed in the garden area in and around flower pots. She asked if they are located in a residential area. She had questions about lighting of signs. Staff responded that the Legion is located in a Commercial zoning district, therefore signs can be illuminated. There is a provision in the current ordinance that flags are allowed to a certain extent. The city must treat all business the same and cannot regulate content. Ms. Clark stated that she purchased a sign permit from the city, then found out that the sign she ordered is larger than provisions allow. She suggested that the city attach the sign regulations to the permit application to avoid this problem. Board members agreed that a signage requirement handout should be distributed with the sign permit application. Meyer Nickerson, trustee for Gethsemane United Methodist Church, 7330 Lake Drive, said that he appreciates the work of the city to increase the allowance of temporary signage to 90 days per year. He said that they will know when they will want to advertise their events for the year. He stated that nobody would ever see a sandwich board within the limitation of 10 feet from their building due to their location. He would like to put a sandwich board next to their temporary sign. Board members pointed out that sandwich boards are directed at pedestrians. The city cannot discriminate for one individual business. Mike Russo, Twin City Powder Coating, 548 Apollo Drive, commented that the business owner should be able to choose which side of the building to use the 10% of wall signage, rather than the city regulate a particular side. He eventually hopes to install a new permanent illuminated sign on the building. He added that they would like to expand their equipment to include sandblasting and would like to stay in the city. DISCUSSION ITEMS A. Project Updates Katie Larsen, City Planner, provided an update of current city projects. 7. ADJOURNMENT Mr. Laden made a MOTION to adjourn the meeting at 9:10 p.m. Motion was supported by Mr. Evans. Motion carried 6 - 0. (Tralle abstained.)
